    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Se hace público que mediante Decreto de Alcaldía núm. 267 de fecha 02/06/2021, se ha adoptado el siguiente acuerdo: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;PRIMERO.- Aprobar las bases y la convocatoria que rigen la concesión de ayudas económicas para fomentar la reactivación del desarrollo económico local y la promoción turística del municipio de Es Migjorn Gran para minimizar el impacto de la crisis económica provocada por Covidien-19 , que se transcriben a continuación. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;SEGUNDO.- Las ayudas serán concedidas con cargo a las partidas Presupuestaria 433-48002 y 433-48003 con un importe máximo de 46.759,99 € sin perjuicio de que se puedan ampliar de acuerdo con las disponibilidades de la tesorería municipal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;TERCERO.- El plazo de presentación de las solicitudes será de 30 días hábiles a contar desde el día siguiente a la publicación de la convocatoria de las presentes bases en la Base de Datos Nacional de Subvenciones a través del diario oficial de la provincia (BOIB) y la página web del Ayuntamiento de Es Migjorn Gran. El plazo de presentación de solicitudes será improrrogable. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;1. OBJETO Y FINALIDAD&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;El objeto de estas bases es la regulación de la convocatoria para la concesión de ayudas económicas a personas titulares de un negocio afectados económicamente por la situación de crisis ocasionada por el COVID-19.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Las medidas adoptadas por las diferentes administraciones competentes en materia sanitaria y las restricciones obligatorias para diferentes sectores económicos de la isla de Menorca han producido un agravio económico muy negativo, del que todavía se derivan sus efectos, con una disminución drástica de los ingresos de estos negocios, lo que ha implicado una caída del empleo en Menorca sin precedentes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;El Ayuntamiento de S Migjorn Gran pretende fomentar el desarrollo económico local y la promoción turística del municipio des Migjorn Gran, de acuerdo con las competencias atribuidas al art. 29.1.t) de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares, con el fin de aumentar la productividad y competitividad de los comercios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;La finalidad de estas ayudas es aportar recursos económicos a las personas titulares de negocios, otorgando liquidez a las empresas del pueblo para contribuir a facilitar el cumplimiento de sus obligaciones empresariales, mantenimiento de la actividad y empleo y amortiguar la reducción drástica de ingresos, y así poder contribuir a la reactivación de las empresas, el mantenimiento del tejido comercial y empresarial de Es Migjorn Gran, al impulso de la promoción y dinamización del sector y destinada a favorecer la consolidación empresarial en el término fomentando, impulsando y apoyando la actividad económica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Se pretende proteger el interés general de la ciudadanía de Es Migjorn Gran, dando apoyo a las personas autónomas, microempresa y pequeña empresa, para minimizar el impacto de la crisis económica provocada por el COVID-19 y conseguir que, una vez finalizada la alarma sanitaria, se produzca lo antes posible una reactivación de la economía de nuestra ciudad, actuando directamente sobre las personas físicas y jurídicas más afectadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;2. BENEFICIARIOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Podrán solicitar la ayuda económica las personas físicas o jurídicas, comunidades de bienes y entidades sin ánimo de lucro titulares de un negocio con alguna de las actividades incluidas en los epígrafes del IAE enumerados en la base tercera en cualquiera de las formas reconocidas, y que a consecuencia en cumplimiento de lo establecido en el Real decreto 926/2020, de 25 de octubre, por el que se declara el estado de alarma para contener la propagación de infecciones causadas por SARSCoV-2 y la normativa de desarrollo efectuada por la Administración de la Comunidad Autónoma de las Islas Baleares, han visto reducida significativamente su facturación a partir del 1 de enero de 2021 y que en la fecha de presentación de la solicitud de esta convocatoria de ayudas continúan ejerciendo su actividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;3. REQUISITOS PARA SOLICITAR LA AYUDA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Podrán solicitar la ayuda las personas físicas y jurídicas que reúnan los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;1) Tener domicilio social y fiscal en Es Migjorn Gran o domicilio social y fiscal en Menorca y establecimiento en Es Migjorn Gran.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2) Figurar de alta en el IAE, anual o temporal, en alguno de los epígrafes (ejercicios 2020 y 2021):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:98%"&gt;&lt;span style="color:#00000a"&gt;f) Sectores incorporados si están en situación de ERTO (además de todos los relacionados antes):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:98%"&gt;&lt;span style="color:#00000a"&gt;- E969.1 Salas de bailes y discotecas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;3) Para negocios con establecimiento, disponer de título habilitante municipal para ejercer la actividad, expedido por el Ayuntamiento de Es Migjorn Gran (licencia de apertura y funcionamiento, declaración responsable de inicio y ejercicio de actividad, o similar).&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:98%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="color:#00000a"&gt;4) Tener una facturación inferior a la del 2019 en más del 15%&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:98%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="color:#00000a"&gt;5) Tener una plantilla media, incluida la persona titular de la actividad, de un máximo de 25 trabajadores/as. El cómputo de trabajadores se realiza con independencia de la jornada a tiempo completo o parcial, el régimen de contratación fija o temporal, o que se encuentre en cualquier situación de expediente de regulación temporal de empleo (ERTO), excedencia, permisos, bajas por incapacidad temporal o situaciones similares de suspensión de la relación laboral de la empresa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;6) Hallarse al corriente de las obligaciones tributarias, con la Seguridad Social y con el Ayuntamiento, así como estar al corriente en el pago de obligaciones por reintegro de subvenciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;7) No estar en ninguna de las circunstancias que le impidan adquirir la condición de persona beneficiaria de la ayuda económica, que establece el art. 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones (BOE núm. 276 de 18.11.2003)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;8) No tener ninguna propuesta de sanción por infracción grave o muy grave por razones sanitarias relacionadas al COVID-19. En el supuesto de que el expediente sancionador por razones sanitarias ligadas a la COVID-19 se archive con posterioridad a la solicitud de la ayuda, el interesado tendrá derecho a la percepción de la ayuda solicitada. En el caso de que la propuesta de sanción se archive, y que por tanto puedan ser beneficiarios de la ayuda, los interesados deberán notificarlo al Ayuntamiento. Para poder ser beneficiario de la ayudas, la propuesta de sanción debe haberse archivado en el lapso de tiempo comprendido entre la presentación de la solicitud y la propuesta de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Aquellas actividades dadas de alta en el Censo de actividades económicas de la AEAT a partir de la publicación en el BOIB de estas bases quedarán excluidos de la presente convocatoria de ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;4. CUANTÍA DE LA AYUDA Y DISTRIBUCIÓN DEL CRÉDITO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;El importe fijo de la ayuda es de 1.500 € por negocio. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;En cada establecimiento le corresponderá una sola ayuda (1200 €) aunque figuren de alta en más de uno de los epígrafes del IAE contemplados en la convocatoria &lt;/span&gt;&lt;span style="color:#0000ff"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;5. COMPATIBILIDAD DE LA AYUDA ECONÓMICA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Con el objetivo de llegar a todos los sectores, la concesión de la ayuda económica es incompatible específicamente con las ayudas convocadas mediante &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1) Decreto de Presidencia núm. 45/2021 de 5 de febrero, por el que se aprobaron las bases relativas a las ayudas del CIME del mes de enero para paliar los efectos económicos en diferentes sectores económicos de Menorca como consecuencia de la adopción del nivel 4 de alerta sanitaria (BOIB núm. 16 de 6 de febrero de 2021) y&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2) Decreto de Presidencia núm. 89/2021 de 23 de marzo, por el que se aprobaron las bases de las ayudas del CIME de los meses de febrero y marzo para paliar los efectos económicos derivados de la adopción del nivel 4 de alerta sanitaria en diferentes sectores económicos de Menorca (BOIB núm. 41 de 25 de marzo de 2021).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;La concesión de la ayuda económica es compatible con otras ayudas, subvenciones, ingresos o recursos que por el mismo concepto se puedan recibir de otras administraciones o entidades, sin perjuicio de la obligación de los beneficiarios de comunicarlo de la forma establecida en estas bases, y siempre que su cómputo no supere las limitaciones establecidas en la normativa comunitaria aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;6. PRESUPUESTO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Esta convocatoria cuenta con el presupuesto inicial de &lt;strong&gt;46.759,99€, &lt;/strong&gt;como consecuenca de la aportación del Gobierno de las Islas Baleares en el marco del Convenio de colaboración entre la Administración de la Comunidad Autònoma de las Islas y el Ajuntamiento des Migjorn Gran para conceder ayudas dirigidas a paliar las consecuencias de las restricciones motivadas por la crisi sanitaria de la COVID-19, en los sectores económicos, la aportación del Consell Insular de Menorca en el marco del Convenio de colaboración entre el Consell Insular de Menorca para la dinamitzación comercial y con motivo de la crisis de la covid-19 para el año 2021 y con la aportación de fondos propios del Ayuntamiento des Migjorn Gran, y de acuerdo con el articulo 58.2 a 4) del Reglamento de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Partidas: 433-48002 i 433-48003&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;7. PLAZO Y PRESENTACIÓN DE SOLICITUDES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;El plazo de presentación de las solicitudes será de &lt;strong&gt;30 días hábiles &lt;/strong&gt;, a contar a partir del día siguiente de la publicación de la convocatoria de las presentes bases en la Base de Datos Nacional de Subvenciones, a través del diario oficial de la provincia (BOIB) y de la página web del Ayuntamiento de Es Migjorn Gran. El plazo de presentación de solicitudes será improrrogable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;El extracto de la convocatoria que regirá este procedimiento se publicará, a través de la Base de Datos Nacional de subvenciones (BDNS), en el Boletín Oficial de Islas Baleares (BOIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Las solicitudes se presentarán únicamente de forma telemática &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;El modelo de solicitud normalizado estará disponible en la web municipal (www.ajmigjorngran.org).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;En este formulario constará la declaración responsable de la persona solicitante sobre el cumplimiento de todos los requisitos para solicitar la ayuda económica y de las condiciones y compromisos para su concesión y en concreto serán:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-alpha" start="1"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Que el domicilio social y fiscal es en Es Migjorn Gran o que el domicilio social y fiscal en Menorca y establecimiento en Migjorn Gran.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:98%"&gt;&lt;span style="color:#00000a"&gt;Tener una facturación inferior a la del 2019 en más del 15% &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Que tiene destinados menos de 25 trabajadores de media anual por cada negocio por el que piden la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Que la entidad está válidamente constituida en escritura pública y registrada (empresa) e inscrita en el registro de cooperativas (cooperativas) &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Que el negocio por el que se pide la ayuda continúa sufriendo agravios económicos derivados de las restricciones sanitarias adoptadas a raíz de la aplicación de lo establecido en el Real Decreto 926/2020, de 25 de octubre, por el que se declara el estado de alarma para contener la propagación de infecciones causadas por SARSCoV-2 y la normativa de desarrollo efectuada por la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Que el negocio para el que se solicita la ayuda ejerce su actividad en la fecha de presentación de la solicitud de esta convocatoria de ayudas, continúa ejerciendo su actividad y mantendrá el ejercicio de la actividad por la que solicita la ayuda, como mínimo, hasta 31 de diciembre de 2021 o en el ejercicio 2021 para los negocios temporales&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Que no está sometido a ninguna de las circunstancias recogidas en el art. 13.2 de la Ley 38/2003, de 17 de noviembre, general de subvenciones y del artículo 10 del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones y el artículo 4 apartados 5, 6 y 30.4 de la Ley orgánica 1/2002, de 22 de marzo, que regula el derecho de asociación,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Que no ha sido sancionado mediante resolución administrativa o sentencia judicial de carácter firme por discriminación salarial, acoso moral o cualquier tipo de trato desigual, por razón de sexo, en el ámbito de las relaciones laborales de conformidad con lo dispuesto en el artículo 27 de la Ley 12/2006, de 20 de septiembre, para la mujer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Que la totalidad de las ayudas públicas o privadas financiadas con fondos públicos recibidas en concepto de ayudas estatales destinadas a apoyar la economía en el contexto del actual brote del COVID-19 no supera el importe de 1, 8 millones de euros por empresa previsto en el Marco temporal comunitario vigente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Con la declaración responsable, el interesado manifiesta, bajo su responsabilidad, que cumple los requisitos establecidos en estas bases y en la normativa vigente para obtener las ayudas, que dispone de la documentación que así lo acredita, que la pondrá a disposición del Administración cuando le sea requerida y que se compromete a mantener el cumplimiento de las anteriores obligaciones durante el periodo de tiempo inherente al reconocimiento o ejercicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Si la solicitud no reúne los requisitos establecidos en la convocatoria, se requerirá al interesado para que la subsane en el plazo máximo e improrrogable de cinco días, indicándole que, si no lo hace, se considerará que desiste de su solicitud, previa resolución que se dictará en los términos previstos en el artículo 68 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Las personas interesadas se pueden acoger a lo recogido en el art. 28.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, en relación al hecho de no presentar documentos que ya estén en poder del Ayuntamiento o de cualquier Administración pública. Con esta finalidad, el interesado deberá indicar en qué momento y ante qué órgano administrativo presentó dichos documentos, y el Ayuntamiento deberá recabarlos electrónicamente a través de sus redes corporativas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;span style="color:#00000a"&gt;En los supuestos de imposibilidad material de obtener el documento/s por parte de este Ayuntamiento, y con anterioridad a la formulación de la propuesta de resolución, se podrá requerir a la entidad para que lo presente o, si no, para que acredite, por otros medios, los requisitos a que se refiere el documento/s.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;8. PROCEDIMIENTO PARA LA CONCESIÓN DE LA AYUDA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;El orden de inicio del expediente corresponde al Alcalde ..&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Las solicitudes se resolverán por orden cronológico de presentación, cuando se hayan efectuado las verificaciones oportunas y hasta que se agote el presupuesto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:98%"&gt;&lt;span style="color:#00000a"&gt;La aprobación se hará por resolución del alcalde que es definitiva en vía administrativa, será motivada debiendo quedar acreditados en el procedimiento los fundamentos; también deberá constar el solicitante a la que se concede o desestima la ayuda económica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;La resolución de concesión, que pondrá fin a la vía administrativa, será notificada a los solicitantes de conformidad con lo prescrito en los artículos 40 y siguientes de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas mediante publicación en el BOIB, a través de la BDNS, con expresión de la convocatoria, el programa y el crédito presupuestario al que se impute, la persona beneficiaria, la cantidad concedida y finalidad de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Aquellas solicitudes que cumplan las condiciones y requisitos para adquirir la condición de beneficiario, pero no se les haya concedido la ayuda económica porque se ha agotado el crédito de la convocatoria, quedarán en lista de espera para una segunda convocatoria, siguiendo el orden del registro de entrada de la solicitud, en su caso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Si alguna de las personas beneficiarias renuncia a la subvención concedida, el órgano concedente podrá acordar, sin necesidad de una nueva convocatoria, la concesión de la subvención a la persona o personas solicitantes siguientes en el orden del registro de entrada .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;El órgano que concede la subvención comunicará esta opción a los interesados, a fin de que accedan a la propuesta de subvención en el plazo improrrogable de diez días. Una vez aceptada la propuesta por parte de la persona o personas solicitantes, el órgano administrativo dictará el acto de concesión y procederá a notificarlo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;9. EFECTOS DE LA CONCESIÓN Y PAGO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Si la resolución es favorable, se realizará el pago a través de transferencia bancaria a la persona beneficiaria de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Dado el carácter excepcional de la situación del abono se realizará mediante el pago anticipado del 100% del importe concedido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;No podrá realizarse el pago de la subvención hasta que la persona beneficiaria no esté al corriente en el cumplimiento de las obligaciones tributarias o mientras sea deudor por resolución de procedencia de reintegro. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;10. PLAZO PARA RESOLVER Y EFECTOS DEL SILENCIO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;span style="color:#00000a"&gt;El plazo máximo para resolver y notificar la resolución de procedimiento no podrá exceder de tres meses, contados a partir de la fecha de presentación de la solicitud en el Registro de entrada del Ayuntamiento de Es Migjorn Gran.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;span style="color:#00000a"&gt;En los casos en que se haya solicitado alguna de las ayudas del CIME convocadas por los Decretos de Presidencia núm. 45/2021 de 5 de febrero y núm. 89/2021 de 23 de marzo, por los que se aprobaron las bases relativas a las ayudas del CIM para paliar los efectos económicos de los meses de enero, febrero y marzo en diferentes sectores económicos de Menorca como consecuencia de la adopción del nivel 4 de alerta sanitaria (BOIB núm. 16 de 6 de febrero de 2021 y BOIB núm. 41 de 25 de marzo de 2021) y, a la fecha de la concesión de la ayuda por parte del Ayuntamiento de Es Migjorn Gran aún no se hubiese resuelto si es beneficiario o no, quedará suspendida la obligación de resolver por parte del Ayuntamiento hasta su comprobación definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;En el resto de supuestos, el transcurso del plazo máximo de tres meses sin que se haya notificado la resolución del procedimiento a los interesados, legitima a estos para entender desestimada por silencio administrativa la solicitud de concesión de la ayuda económica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;11. PLAZO Y JUSTIFICACIÓN DE LA AYUDA ECONÓMICA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;El plazo para justificar la ayuda económica finalizará el 31 de marzo de 2022 mediante trámite telemático. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;De acuerdo con el artículo 30.7 de la Ley 38/2003, General de Subvenciones, y dado que se trata de subvenciones que se conceden en atención a la concurrencia de una determinada situación en el perceptor, no se requerirá otra justificación que la acreditación de que concurren dichas circunstancias, sin perjuicio de las actuaciones de comprobación y de control financiero que puedan realizarse para verificar su exactitud. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;A tal efecto, los beneficiarios deberán presentar una declaración formal en la que constará:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;- el importe de la facturación del establecimiento durante los años 2019, 2020 y 2021, así como el porcentaje de disminución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;- El número medio de trabajadores del establecimiento durante los años 2019, 2020 y 2021&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Dicha declaración se presentará de acuerdo con el modelo del anexo dentro del primer trimestre del año 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;El Ayuntamiento de Es Migjorn Gran podrá solicitar los justificantes de los gastos que se consideren oportunos y que permitan la comprobación de la adecuada aplicación de la subvención. En los supuestos en los que no se hayan realizado los compromisos o no se justifique debidamente el gasto del importe económico subvencionado, podrá revisar la subvención concedida y acordar el reintegro que proceda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;12. REINTEGRO DE LAS SUBVENCIONES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:0.46cm"&gt;&lt;span style="color:#00000a"&gt;En el caso de incumplimiento total o parcial de las obligaciones y de las declaraciones manifestadas por los beneficiarios de estas ayudas se iniciará el expediente de revocación y consiguiente devolución de las ayudas según corresponda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Cualquier alteración de las condiciones tenidas en cuenta para la concesión de la subvención y, en todo caso, la obtención concurrente de subvenciones o ayudas otorgadas por otras administraciones, personas o entes públicos o privados, no notificadas con anterioridad y no compatibles, podrá dar lugar a la modificación de la resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;La resolución del reintegro de la subvención será adoptada por el Ayuntamiento, previa instrucción de expediente de acuerdo con la legislación general aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Las cantidades a reintegrar tendrán la consideración de ingresos de derecho público; es aplicable para su cobro lo dispuesto en la normativa vigente de recaudación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:108%"&gt;&lt;span style="color:#00000a"&gt;La falta de reintegro al Ayuntamiento de Es Migjorn Gran de las cantidades reclamadas, en período voluntario, dará lugar al cobro por vía de apremio, de acuerdo con la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;13. RÉGIMEN DE RECURSOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Contra la presente convocatoria, las bases y las resoluciones administrativas que se adopten en ejecución de estas se pueden interponer los siguientes recursos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) Recurso de reposición, ante el mismo órgano municipal autor del acto administrativo, en el plazo de un mes, a partir del día siguiente de la notificación o, en su caso, publicación del acto que se recurra .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) Recurso contencioso administrativo, ante el Juzgado Contencioso Administrativo de las Islas Baleares, en el plazo de dos meses, a partir del día siguiente de la notificación o, en su caso, publicación del acto que se recurra."&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
