es 219210 CAIB text/html es 2021-06-02 CAIB 2021-06-05 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Hechos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1. El 16 de abril de 2019 (BOIB n.º&nbsp;49) se publicó la Resolución de la consejera de Innovación, Investigación y Turismo de 8 de abril de 2019 por la que se aprueba la convocatoria para conceder ayudas destinadas a promover la implantación de herramientas TIC y procesos basados en TIC para la mejora de la gestión empresarial de las pymes (pequeña y mediana empresa) y asociaciones sin ánimo de lucro de las Illes Balears mediante el instrumento de bonos tecnológicos.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2. La base 7 de la convocatoria establece que el plazo para presentar la solicitud empieza diez días hábiles después de la publicación de la convocatoria en el <em>Boletín Oficial de las Illes Balears</em> hasta agotar los créditos disponibles y en ningún caso más allá del 30 de marzo de 2020.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">3. Debido a la crisis sanitaria provocada por la COVID 19, el día 14 de marzo de 2020 se publicó en el <em>Boletín Oficial del Estado</em> el Real Decreto&nbsp;463/2020, de 14 de marzo, por el que se declara el estado de alarma para la gestión de la situación de crisis sanitaria ocasionada por la COVID-19, que disponía, entre otras medidas, la suspensión de los plazos administrativos para la tramitación de los procedimientos de las entidades del sector público.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">4. Esta suspensión de los plazos administrativos fue levantada con efectos desde el 1 de junio de 2020 por el Real Decreto&nbsp;537/2020, de 22 de mayo, por el que se prorroga el estado de alarma declarado por el Real Decreto&nbsp;463/2020, de 14 de marzo, por el que se declara el estado de alarma para la gestión de la situación de crisis sanitaria ocasionada por la COVID-19.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">5. Dado que el plazo para presentar las solicitudes previsto en la convocatoria finalizaba día 30 de marzo de 2020, es decir, faltaban once días para su finalización en la fecha que fue suspendido (día 14 de marzo de 2020), el plazo para presentar solicitudes se retomó día 1 de junio de 2020 y finalizó día 15 de junio de 2020 (once días hábiles después).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Las solicitudes de ayuda que tuvieron entrada con posterioridad al día 15 de junio de 2020 son inadmisibles por haber sido presentadas fuera del plazo.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Fundamentos de derecho</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Resolución del consejero de Transición Energética y Sectores Productivos por la que se modifica la Resolución de la consejera de Innovación, Investigación y Turismo de 8 de abril de 2019 por la que se aprueba la convocatoria para conceder ayudas destinadas a promover la implantación de herramientas TIC y procesos basados en TIC para la mejora de la gestión empresarial de las pymes y asals de las Illes Balears mediante el instrumento de bonos tecnológicos (BOIB n.º&nbsp;158, de 12 de septiembre de 2020).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Por todo ello, dicto la siguiente</span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Declarar la inadmisión de las solicitudes de subvención por implantación de herramientas TIC y procesos basados en TIC para la mejora de la gestión empresarial de las pymes y asociaciones sin ánimo de lucro de las Illes Balears mediante el instrumento de bonos tecnológicos, de la convocatoria aprobada por Resolución de la consejera de Innovación, Investigación y Turismo de 8 de abril de 2019 (BOIB n.º&nbsp;49, de 16 de abril de 2019), dado que fueron presentadas fuera del plazo establecido en las bases de la convocatoria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Ordenar el archivo de los expedientes que se detallan en el anexo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Publicar esta Resolución en el <em>Boletín Oficial de las Illes Balears</em>.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Interposición de recursos</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Contra esta resolución, que agota la vía administrativa, puede interponer recurso potestativo de reposición ante el consejero de Transición Energética, Sectores Productivos y Memoria Democrática en el plazo de un mes contador desde el día siguiente de haber recibido la notificación de esta Resolución, de acuerdo con el artículo&nbsp;123 de la Ley&nbsp;39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo&nbsp;57 de la Ley&nbsp;3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
