    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 6&amp;nbsp;de julio&amp;nbsp;de 2017&amp;nbsp;por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para la Creación de empresas para actividades no agrarias en las zonas rurales, correspondientes al año 2017, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;&lt;em&gt;&lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Islas Baleares&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 28&amp;nbsp;de mayo&amp;nbsp;de 2021, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.El 17 de octubre de 2021 el vicepresidente del FOGAIBA dictó Resolución de concesión de ayudas para la creación de empresas para actividades no agrarias en las zonas rurales, publicada en el Boletín Oficial de las Islas Baleares núm. 133, de 25 de octubre de 2018, en relación con la ayuda concedida al amparo de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 6 de julio de 2017, por la que se convocan, para el año 2017, subvenciones para la creación de empresas para actividades no agrarias en las zonas rurales, a la beneficiaria ISABEL LLODRA RIERA, con NIF ***2391** y núm. de expediente CENA2017_1/025, con un plazo de ejecución de 9 meses para el inicio del plan empresarial y 5 años para la ejecución desde la fecha de notificación de la resolución.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.El 10 de mayo de 2021, por registro electrónico, con registro entrada núm. 7170970, la beneficiaria presentó una solicitud de ampliación de los plazos establecidos para la justificación del proyecto, hasta el 15 de abril de 2026, debido a la demora en la concesión de las licencias de obra y actividades del Ayuntamiento y, por tanto, retraso en las obras y no poder comercializar hasta obtener la certificación final de obra y justificar los 3 años de ingresos que debe acreditar.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.El apartado undécimo, justificación y pago de las ayudas, de la Resolución del Presidente del FOGAIBA de 6 de julio de 2017, establece que el plazo máximo para notificar y justificar el cumplimiento del plan empresarial es de cinco años, a contar de al día siguiente de la fecha de notificación de la resolución de concesión de la ayuda. Sin embargo, este plazo no podrá superar el 1 de diciembre de 2023.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.La concesión de la ayuda se notificó el 25 de octubre de 2018, por tanto el plazo máximo para la justificación de la inversión propuesta acababa el 26 de octubre de 2023 (5 años). El interesado presentó la solicitud de prórroga el día 10 de mayo de 2021, y por tanto dentro de plazo.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.De acuerdo con el apartado 2 del artículo 20 de la Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020, regula que, con carácter excepcional y por razones debidamente justificadas, los beneficiarios de las ayudas podrán solicitar la ampliación o reapertura de los plazos establecidos en la respectiva convocatoria, con excepción del plazo de presentación de solicitudes. Esta solicitud debe presentarse antes del vencimiento del plazo de que se trate.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;El FOGAIBA podrá acordar la ampliación solicitada siempre que con ello no se perjudiquen derechos de terceras personas. El acuerdo de ampliación se notificará individualmente al interesado y no es susceptible de recurso.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Dado el Decreto 64/2005, de 10 de junio, de creación del FOGAIBA; en virtud de la Orden de la Consellera de Agricultura y Pesca de 23 de diciembre de 2005 se dispone que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero a partir del 1 de enero de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. Dado que la solicitud de la prórroga se ha presentado antes del vencimiento del plazo de justificación de la realización de la inversión y está debidamente motivada, se concederá la prórroga solicitada, según el apartado undécimo de la convocatoria, hasta el 1 de diciembre de 2023, de acuerdo con el apartado 2 del artículo 20 de la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;2. Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares desde 2.014 hasta 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Propuesta de resolución de concesión&amp;nbsp;de prórroga&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y propongo al vicepresidente en Materia Agraria del&amp;nbsp;FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Conceder la prórroga hasta el 1 de diciembre de 2023 a ISABEL LLODRA RIERA, con NIF***2391**, expediente número CENA 2017_1/025. Por tanto, el plazo máximo para la justificación de la inversión aprobada será de 5 años, 1 mes y cinco días, desde el 26 de octubre de 2018 hasta el 1 de diciembre de 2023.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Notificar esta resolución al interesado mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
