    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En fecha 13 de mayo de 2021, el director general de Vivienda y Arquitectura ha formulado la siguiente propuesta de resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Hechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. El 2 de septiembre de 2019 el consejero de Movilidad y Vivienda dictó la resolución por la que se convocaron las ayudas para el alquiler de viviendas del año 2019, en el marco del Real Decreto 106/2018, de 9 de marzo, por el que se regula el Plan Estatal de Vivienda 2018-2021 (BOIB n.º 121, de 3 de septiembre de 2019). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. El 5 de junio de 2020 el consejero de Movilidad y Vivienda dictó la resolución por la que se aprueba la sexta concesión parcial de las ayudas para el alquiler de viviendas durante el año 2019 y se reconoce la obligación a favor de 153 beneficiarios de la ayuda destinada a subvencionar el alquiler, de conformidad con la Resolución del consejero de Movilidad y Vivienda de 2 de septiembre de 2019 por la que se convocaron las ayudas para el alquiler de viviendas del año 2019, en el marco del Real Decreto 106/2018, de 9 de marzo, por el que se regula el Plan Estatal de Vivienda 2018-2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En el anexo 1 de la resolución mencionada se relacionaba a los beneficiarios de las ayudas y la cuantía de la correspondiente ayuda. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. La persona interesada en el expediente individual PAV 3408/2019, de ayudas para el alquiler de viviendas del año 2019, ha formulado su respectiva reclamación mediante la que alega que no se les reconoció el total de la cuantía de la ayuda que le corresponde de acuerdo con el cumplimiento de los requisitos establecidos en la convocatoria, y solicita la rectificación de la Resolución de concesión y el pago de la cantidad pendiente de cobro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. Los servicios competentes de la Dirección General de Vivienda y Arquitectura han comprobado que se han producido errores materiales en los cálculos que comportan diferencias entre la cuantía de la ayuda para el alquiler concedida y reconocida al beneficiario y la cuantía que legalmente le corresponde según las bases de la mencionada convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5. En consecuencia, realmente queda pendiente de concesión y de percibir la cantidad que se expresa en el listado en que se señala el expediente individual afectado, la persona interesada, el importe concedido, el importe percibido y el importe pendiente de percibir. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;6. De acuerdo con la Instrucción 1/2008, de 10 de junio, de la Intervención General y la Dirección General del Tesoro y Política Financiera que regula los pagos de subvenciones de escasa cuantía a un número significativo de perceptores, el interventor general, mediante la autorización del día 26 de noviembre de 2018, ha autorizado para este expediente la utilización del procedimiento de pago de subvenciones de escasa cuantía a una pluralidad de perceptores en la tramitación de ayudas para el alquiler.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. El artículo 109.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, establece que las administraciones públicas podrán rectificar, en cualquier momento, de oficio o a instancia de los interesados, los errores materiales, de hecho o aritméticos de sus actos (BOE n.º 236, de 2 de octubre de 2015).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. La Resolución del consejero de Movilidad y Vivienda de 2 de septiembre de 2019 por la que se convocaron las ayudas para el alquiler de viviendas del año 2019, en el marco del Real Decreto 106/2018, de 9 de marzo, por el que se regula el Plan Estatal de Vivienda 2018-2021 (BOIB n.º 121, de 3 de septiembre de 2019).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. La Resolución del consejero de Movilidad y Vivienda de 11 de septiembre de 2020 por la que se aprueba la sexta concesión parcial de las ayudas para el alquiler de viviendas durante el año 2019 y se reconoce la obligación a favor de 153 beneficiarios de la ayuda destinada a subvencionar el alquiler de conformidad con la Resolución del consejero de Movilidad y Vivienda de 2 de septiembre de 2019 por la que se convocaron las ayudas para el alquiler de viviendas del año 2019, en el marco del Real Decreto 106/2018, de 9 de marzo, por el que se regula el Plan Estatal de Vivienda 2018-2021 (BOIB n.º 35, de 13 de marzo 2021).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. El artículo 9 de la Ley 14/2014, de 29 de diciembre, de finanzas de la Comunidad Autónoma de las Illes Balears (BOIB n.º 8, de 15 de enero de 2015).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5. La Ley 3/2020, de 29 de diciembre, de presupuestos generales de la Comunidad Autónoma de las Illes Balears para el año 2021 (BOIB n.º 216, de 31 de diciembre de 2020).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;6. La Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas (BOE n.º 236, de 2 de octubre de 2015).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

La Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB n.º44, de 3 de abril de 2003).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;8. El Decreto 8/2021, de 13 de febrero, de la presidenta de las Illes Balears, por el que se determina la composición del Gobierno y se establece la estructura de la Administración de la Comunidad Autónoma de las Illes Balears, que incluye la Consejería de Movilidad y Vivienda (BOIB n.º 20, de 14 de febrero de 2021).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;9. El artículo 2.11.&lt;em&gt;b)&lt;/em&gt; del Decreto 11/2021, de 15 de febrero, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, que establece que la Dirección General de Vivienda y Arquitectura, dependiente de la Consejería de Movilidad y Vivienda, ejerce sus competencias, entre otros, en el ámbito material de fomento, coordinación y gestión de las ayudas públicas en materia de vivienda (BOIB n.º 21 ext., de 15 de febrero de 2021).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Propuesta de resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Propongo al consejero de Movilidad y Vivienda que dicte una resolución en los siguientes términos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Rectificar los errores materiales existentes en la Resolución del consejero de Movilidad y Vivienda de 21 de septiembre de 2020, por la que se aprueba la sexta concesión parcial de las ayudas para el alquiler de viviendas durante el año 2019 y se reconoce la obligación a favor de 153 beneficiarios de la ayuda destinada a subvencionar el alquiler, y se propuso el pago de los importes concedidos y justificados, en cuanto a las cantidades concedidas y justificadas que están pendientes de percibir, según se expresa en el siguiente cuadro:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Autorizar un gasto por un importe de 156,00&amp;nbsp;€ (ciento cincuenta y seis euros), con cargo a la partida presupuestaria 25501 431B01 48000 00 (FF 18030), en concepto de ayudas pendientes de percibir para el alquiler de viviendas del año 2019, de acuerdo con lo dispuesto en la &lt;span style="color:#000000"&gt;Resoluci&lt;/span&gt;&lt;span style="color:#000000"&gt;ón del consejero de Movilidad y Vivienda de 2 de septiembre de 2019 por la que se convocaron las ayudas para el alquiler de viviendas del año 2019, en el marco del Real decreto 106/2018, de 9 de marzo, por el cual se regula el Plan Estatal de Vivienda 2018-2021 (BOIB núm. 121, de 3 de septiembre de 2019)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Disponer un gasto por un importe de 156,00&amp;nbsp;€ (ciento cincuenta y seis euros), a favor de los beneficiarios y por el importe que figura en el anterior cuadro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. Reconocer la obligación de las características señaladas en el punto tercero.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5. Proponer a la directora general del Tesoro y Política Financiera el pago de las diferencias aritméticas de las ayudas pendientes de pago a los beneficiarios señalados por un importe de 156,00&amp;nbsp;€ (ciento cincuenta y seis euros),, con cargo a la partida presupuestaria 25501 431B01 48000 00 (FF 18030), que se realizará utilizando el sistema de transferencia masiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;6. Publicar esta Resolución en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Manifestar la conformidad con la propuesta de resolución y dictar resolución en los mismos términos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra esta Resolución, que agota la vía administrativa, se podrá interponer un recurso potestativo de reposición ante el consejero de Movilidad y Vivienda, en el plazo de un mes desde el día siguiente al de la publicación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;También se podrá interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses desde el día siguiente al de la publicación, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
