&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. En fecha 02/18/2021 se publicó en el Boletín Oficial de les Illes de Baleares número 24 la resolución del Consejero de Transición Energética y Sectores Productivos por la que se efectúa la convocatoria pública para la designación de un laboratorio oficial para el ensayo y el contraste de garantía de objetos fabricados con metales preciosos en las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. En fecha 04/28/2021 el Servicio de Registro Industrial emitió el informe favorable a la designación del INSTITUTO TECNOLOGICO DE LA BISUTERIA, (ITEB), NIF G07070246, como laboratorio oficial para el ensayo y el contraste de garantía de objetos fabricados con metales preciosos en les Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. El artículo 32.6 del Estatuto de autonomía de les Ills Balears, reconoce la competencia ejecutiva en "Pesos y medidas. Contraste de metales "en la Comunidad Autónoma, en los términos que establezcan las leyes y normas reglamentarias cuando sean necesarias para ejecutar la normativa del Estado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. La Ley 17/1985 y el Real Decreto 197/1988 establecen la competencia de las comunidades autónomas para designar el laboratorio oficial para el ensayo y el contraste de garantía de objetos fabricados con metales preciosos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. El Decreto 86/2009, de 27 de noviembre, de desarrollo de la Ley 17/1985, sobre objetos fabricados con metales preciosos, establece la necesidad de designar un laboratorio oficial para el ensayo y el contraste de garantía de objetos fabricados con metales preciosos en les Illes Balears mediante un procedimiento con convocatoria pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. Decreto 11/2021, de 15 de febrero, de la Presidenta de les Illes Balears, por el que se establecen las competencias y la estructura orgánica básica las consejerías de la Administración de la Comunidad Autónoma de les Illes Balears el que determina que actualmente es la Consejería de Transición Energética y Sectores Productivos la que ejerce las competencias en metales preciosos, mediante la Dirección General de Política Industrial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. El apartado 2.f) de la Resolución del Consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 2 de marzo de 2021 de delegación de competencias y de suplencia de los órganos directivos de la Consejería.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. Designar a la entidad INSTITUTO TECNOLOGICO DE LA BISUTERIA, en adelante ITEB, NIF G07070246, como laboratorio oficial de &lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;s I&lt;/span&gt;&lt;span style="color:#000000"&gt;lle&lt;/span&gt;&lt;span style="color:#000000"&gt;s Balears&lt;/span&gt; por diez años, durante los que debe cumplir, y poder acreditar en todo momento, los requisitos establecidos en la convocatoria ya la normativa aplicable&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. Notificar esta Resolución al titular.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3. Publicar esta Resolución en el Boletín Oficial de &lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;s I&lt;/span&gt;&lt;span style="color:#000000"&gt;lle&lt;/span&gt;&lt;span style="color:#000000"&gt;s Balears&lt;/span&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Interposición de recursos &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra esta resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el Consejero de Transición Energética, Sectores Productivos y Memoria Democrática en el plazo de un mes a contar desde el día siguiente de la notificación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;También se puede interponer directamente un recurso contencioso administrativo ante el Juzgado Contencioso Administrativo en el plazo de dos meses contados desde el día siguiente de la notificación, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
