2021-06-03 CAIB CAIB ![CDATA[Resolución del Conseller de Transición Energética, Sectores Productivos y Memoria Democrática por la cual se revocan las subvenciones concedidas en el marco de la convocatoria pública para establecer nuevos puntos de recarga rápida y semirapida para vehículos eléctricos en el marco del Impuesto sobre estancias turísticas ne las Illes Balears y de medidas de impulso de turismo sostenible]] 2021-06-01 650108 22574 215621 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Hechos</strong></span></p> <ol> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El 25 de diciembre de 2018 se publicó en el BOIB la resolución del Conseller de Territorio, Energia i Mobilidad de 10 de diciembre de 2018, por la que se aprueba mediante el procedimiento de gasto anticipado, la convocatoria pública para establecer nuevos puntos de recarga rápida y semirapida para vehículos eléctricos en el marco del Impuesto sobre estancias turísticas de las Illes Balears y de medidas de impulso de turismo sostenible.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">La Dirección General de Energía y Cambio Climático concedió una subvención a las personas o entidades que figuran en el anexo de esta resolución en el marco de la convocatoria pública para establecer nuevos puntos de recarga rápida y semirapida para vehículos eléctricos en el marco del Impuesto sobre estancias turísticas de las Illes Balears y de medidas de impulso de turismo sostenible.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">La personas o entidades que figuran en el anexo no han aportado la documentación requerida para la justificación de la realización de las actuaciones subvencionadas.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">La Dirección General de Energía y Cambio Climático ha realizado un requerimiento a las personas y entidades que figuran en el anexo mediante el que se les solicita la presentación de la documentación justificativa que acredite la realización de las actuaciones subvencionadas en el plazo de 15 días de acuerdo con el Real Decreto 887/2006.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Habiéndose agotado el plazo para aportar la documentación requerida, las personas y entidades que figuran en el anexo no han presentado la documentación pendiente.</span></span></p> </li> </ol> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Fundamentos de Derecho</span></strong></span></p> <ol> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">El <em>Conseller de Transició Energètica, Sectors Productius i Memòria Democràtica </em>es el órgano competente para resolver este procedimiento de acuerdo con la estructura orgánica del Govern de les Illes Balears y la Odren de la Consellera de Comercio, Industria y Energia de 15 de mayo de 2008 mediante la que se establecen las bases reguladoras de la concesión de subvenciones en materia de energía.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">El Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">El artículo 70.3 del Real Decreto 887/2006, de 21 de julio, mediante el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, establece que, agotado el plazo para la justificación de las actuaciones se concederá un plazo adicional improrrogable de 15 días. Agotado este nuevo plazo implicará el reintegro o revocación de la subvención concedida.</span></span></p> </li> </ol> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Por todo lo anterior, dicto la siguiente</span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Resolución</span></strong></span></p> <ol> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Revocar la subvención concedida y desvincular el remanente del documento contable a los beneficiarios que figuran en el anexo de acuerdo con el concepto, importe y número de CONCE que figuran en el citado anexo.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Dar por finalizado el procedimiento y, por lo tanto, archivar los expedientes indicados en el anexo.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Publicar esta resolución en el Boletín Oficial de les Illes Balears.</span></p> </li> </ol> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:black"><strong><span style="line-height:115%">Interposición de recursos</span></strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Contra esta resolución, que agota la vía administrativa, se puede interponer recurso de reposición ante el <em>Conseller de Transició Energètica, Sectors Productius i Memòria Democràtica</em> en el plazo de un mes a contar desde el día siguiente de la publicación en el Boletín Oficial de les Illes Balears, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas y el artículo 57 de la Ley 3/2003, de 26 de marzo, del Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
