    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El 28 de mayo de 2021 el alcalde del Ayuntamiento de Selva dictó el Decreto de Alcalde 116/2021, que contiene el siguiente tenor literal: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;«&lt;strong&gt;Resolución de Alcaldía por la que se constituye la bolsa de policía local del Ayuntamiento de Selva &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1.-&lt;/strong&gt; El 25 de septiembre de 2020 la junta de Gobierno Local de este Ayuntamiento aprobó las bases que tienen que regir la convocatoria del concurso por la constitución de una bolsa de policía local del Ayuntamiento de Selva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2.-&lt;/strong&gt; El Boletín Oficial de las Islas Baleares (*BOIB) n.º 167 de 29 de septiembre de 2020 publicó dicho acuerdo, y se otorgó un plazo de 10 días hábiles, contadores desde el día siguiente de su publicación, para presentar solicitudes junto con los méritos alegados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.- &lt;/strong&gt;El 14 de octubre de 2020 finalizó el plazo otorgado porque los aspirantes pudieran presentar sus solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;4.- &lt;/strong&gt;El 26 de octubre de 2020 se publicó la lista provisional de admitidos y excluidos otorgando un plazo de 3 días hábiles para presentar las alegaciones que lo consideren. Habiendo pasado el plazo no se han presentado alegaciones. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5.- &lt;/strong&gt;El 18 de mayo de 2021 se constituyó el tribunal y se valoraron el méritos que los aspirantes presentaron, de acuerdo con las bases. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;6.- &lt;/strong&gt;El 18 de mayo 2021 se publicó el acta del tribunal con la baremación provisional otorgando un plazo de 3 días hábiles para que los aspirantes que lo consideren puedan presentar cuántas alegaciones consideren oportunas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;7.- &lt;/strong&gt;Transcurrido el plazo otorgado, no se han presentado alegaciones a la baremación del Tribunal &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos jurídicos &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;I.-&lt;/strong&gt; Las bases de la convocatoria del concurso por la constitución de una bolsa de policía local del Ayuntamiento de Selva (BOIB n.º 167 de 29 septiembre de 2020). &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;II.- &lt;/strong&gt;Por otro lado, resulta de aplicación el artículo 10 del Real decreto legislativo 5/2015, de 30 de octubre, por el cual se aprueba el texto refundido de la Ley del Estatuto Básico del Empleado público, en cuanto a la definición y funciones de los funcionarios interinos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;III.-&lt;/strong&gt; Respecto a la competencia resultan de aplicación los artículos 21.1.h y 124.4.y) de la Ley 7/1985, reguladora de las bases de régimen local, así como el artículo 21 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares, en cuanto a las atribuciones de la alcaldía como jefe de personal, dirección de gobierno y administración municipal y de organización de los servicios. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo el expuesto anteriormente, dicto la siguiente, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Primero.-&lt;/strong&gt; Constituir la bolsa de policía local del Ayuntamiento de Selva como funcionario interino del Ayuntamiento de Selva, por orden de prelación y para cubrir necesidades urgentes que puedan subvenir según el establecido en el artículo 10 Real decreto legislativo 5/2015, de 30 de octubre, por el cual se aprueba el texto refundido de la Ley del Estatuto Básico del Empleado público, y resto como sigue a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Segundo.-&lt;/strong&gt; Publicar la presente resolución, en el Boletín Oficial de las Islas Baleares (BOIB), a la sede electrónica del Ayuntamiento de Selva, al objeto de dar conocimiento público. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tercero.- &lt;/strong&gt;Notificar el presente decreto a los representantes sindicales de los funcionarios del Ayuntamiento de Selva. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Quart.- &lt;/strong&gt;Dar cuenta a la próxima sesión ordinaria de Pleno que se celebre.»&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra la mencionada resolución, que agota la vía administrativa, las personas interesadas pueden interponer de forma alternativa, los siguientes recursos: o bien recurso potestativo de reposición, a interponer ante la alcaldía, en el plazo de un mes, contador desde el día siguiente de la notificación de la presente resolución, o bien directamente recurso contencioso-administrativo, a interponer ante el Juzgado de lo contencioso-administrativo de Palma, en el plazo de dos meses, contadores desde el día siguiente de la notificación de esta resolución; todo esto sin perjuicio que los interesados puedan interponer aquellos otros recursos que consideren procedentes. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
