&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;DECRETO DE ALCALDÍA&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ANTONI SOLIVELLAS ESTRANY, ALCALDE-PRESIDENTE DEL AYUNTAMIENTO DE ESCORCA, ILLES BALEARS; &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con las atribuciones que me confiere la vigente Ley de Régimen Local, &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por la presente, &lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;DECRETO:&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto el Real Decreto Legislativo 6/2015, de 30 de octubre, por el que se aprueba el texto refundido de la Ley sobre Tránsito, Circulación de Vehículos a motor y Seguridad Vial, donde se atribuye a los municipios la competencia de regulación, ordenación, gestión, vigilancia y disciplina del tránsito en las vías urbanas de titularidad municipal.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vista la Ordenanza Municipal reguladora de las tasas para el aparcamiento de vehículos de tracción mecánica en las vías municipales (ORA) y de regulación de las zonas de circulación restringida (ACIRE), publicada en el BOIB núm. 70, de 8 de junio de 2017.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto que, la regulación afecta a la modalidad de ORA (utilización privativa o aprovechamiento especial de los terrenos de uso público y local para el estacionamiento de vehículos de tracción mecánica) y ACIRE (acceso a determinadas zonas que requieran de un uso restrictivo).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto que el estacionamiento en la zona regulada, por ORA o por ACIRE, no implica el desconocimiento de las normas de circulación, ni el abono del precio público permite no cumplir con la demás normativa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vista la modificación del personal de la Brigada Municipal.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto que todo el personal destinado al servicio de la Brigada Municipal ha recibido información específica en el uso de las PDA, propiedad de la ATIB, que han de servir para confeccionar los boletines de denuncia.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto que todo el personal destinado a la Brigada Municipal ha recibido la formación necesaria en cuanto a la ordenanza municipal reguladora de las tasas para el aparcamiento de vehículos de tracción mecánica en las vías municipales (ORA) y de regulación de las zonas de circulación restringida (ACIRE), para el control de vehículos estacionados en las zonas reguladas y para las infracciones que en dichas zonas puedan observarse.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vista la potestad reguladora de la administración municipal, de acuerdo con la Ley 7/1985, de 2 de abril, Reguladora de les Bases de Régimen Local.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En consecuencia, RESUELVO:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;PRIMERO: El control del estacionamiento a las zonas afectadas por ORA o ACIRE, será llevado a cabo de manera directa por personal integrado en este servicio, en concreto, el personal de la Brigada Municipal. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;SEGUNDO: Que en las zonas habilitadas como ORA o ACIRE, puedan denunciar las infracciones a las normas de circulación, por ir en contra de la regulación de los estacionamientos de:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Estacionamiento en las zonas para peatones.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Estacionamiento en zonas de carga y descarga.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Estacionamiento en lugares prohibidos por la señal correspondiente.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Estacionamiento en las zonas habilitadas sin la correspondiente reserva establecida en el art. 6 de la Ordenanza.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Estacionamiento sin haber respectado el orden establecido en el art. 7.4 de la Ordenanza.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;TERCERO: El personal de la Brigada Municipal vestirá uniforme del Ayuntamiento con identificación, así como indumentaria de alta visibilidad. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;CUARTO: Cada controlador llevará una PDA de la ATIB asignada a él, de forma que esté siempre vinculada a una única persona la denuncia efectuada des de un aparato telemático, además, dispondrá de contraseña para asegurar que no la utiliza otro controlador.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;QUINTO: Los controladores de la ORA o ACIRE, solo podrán denunciar con sistemas telemáticos que permitan, en todo momento, identificar fehacientemente quien ha confeccionado la denuncia.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;SEXTO: Los controladores de ORA o ACIRE tendrán asignado un distintivo identificativo que será el que figurará en el boletín de denuncias. Este distintivo se corresponderá con la siguiente grafía: E000X; donde E es invariable, 000 se corresponde con los tres últimos números de su DNI y X con la letra de su DNI. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;SEPTIMO: La relación actualizada, con el detalle de la identificación del servicio de vigilancia de la ORA o ACIRE, que no sean agentes de la autoridad, con expresión del nombre, apellidos, las tres últimas cifras de su NIF y la dirección, así como el número de identificación que figura en el punto OCTAVO. En las notificaciones que se tramiten constará el número de controlador y la referencia del presente BOIB.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;OCTAVO: De acuerdo con lo dispuesto en el art. 87.2 del Real Decreto 6/2015, de 30 de octubre, por el que se aprueba el texto consolidado de la Ley de Tránsito, Circulación, Vehículos a Motor y Seguridad Vial, mediante la presente publicación se facilitan los datos de identificación de los denunciantes:&lt;/span&gt;&lt;/p&gt;
