font-size:12px"><span style="line-height:100%"><span style="color:#000000">Por acuerdo de Pleno de fecha 9 de marzo de 2021 se aprobó inicialmente la modificación de la Ordenanza fiscal reguladora de la tasa por ocupación de terrenos de uso público con mercancías, materiales de construcción, escombros, barreras, puntales, caballetes, andamios y otras instalaciones análogas. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Finalizado el plazo de exposición pública, no se han presentado alegaciones contra el acuerdo y en consecuencia queda aprobado definitivamente el texto de la mencionada Ordenanza.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Seguidos todos los trámites reglamentarios, se publica el texto íntegro de la Ordenanza que queda redactado de la siguiente manera:</span></span></span></p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Ordenanza reguladora de la tasa por ocupación de terrenos de uso público con mercancías, materiales de construcción, escombros, barreras, puntales, caballetes, andamios y otras instalaciones análogas. </span></span></span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Artículo 1. </span></span></span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Fundamento y naturaleza </span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Este Ayuntamiento conforme a lo que autoriza el artículo 106 de la Ley 7/85 de 2 de abril, Reguladora de las Bases de Régimen Local y de acuerdo con el que prevé el artículo 20,3,g) del R.D.L. 2/2004, de 5 de marzo, que aprueba el texto refundido de la Ley Reguladora de las Haciendas Locales, establece la Tasa por utilizaciones privativas o aprovechamientos especiales por la ocupación de terrenos de uso público con mercancías, materiales de construcción, escombros, barreras, puntales, caballetes, andamios y otras instalaciones análogas, que se regulará por la presente Ordenanza, redactada conforme al artículo 16 del R.D.L. 2/2004 mencionada .</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Artículo 2. </span></span></span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Obligados al pago </span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Están obligados al pago de la tasa regulada en esta Ordenanza, las personas o entidades a las que se otorguen las licencias, o las que se beneficien del aprovechamiento , si se procedió sin la oportuna autorización.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Artículo 3.</span></span></span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Categorías de las calles o polígonos </span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1.- A los efectos previstos para la aplicación de los epígrafes de la Tarifa segunda a la cuarta del artículo 4 siguiente, las vías públicas de este Municipio se clasifican en 4 categorías. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2.- Anexo a esta Ordenanza figura un índice alfabético de las vías públicas de este Municipio con expresión de la categoría que corresponde a cada una de ellas.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3.- Las vías públicas que no estén señaladas al índice alfabético serán consideradas de la categoría de la calle más cercana, y si confluyen dos o más calles con distintas categorías, sería la de la calle de categoría superior. Permanecerán calificadas así hasta el 1 de enero del año siguiente a aquel en que se apruebe por el Pleno de esta Corporación la categoría correspondiente y su inclusión en el índice alfabético de vías pública.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4.- Cuando el espacio afectado por el aprovechamiento esté situado en la confluencia de dos o más vías públicas clasificadas de distinta categoría, se aplicará la tarifa que corresponda a la vía de categoría superior. </span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Artículo 4. </span></span></span></strong></p> <p style="margin-bottom:0px; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2.- Normas de aplicación de las Tarifas: </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">a) Cuando las obras se interrumpen durante un tiempo superior a dos meses, sin causa justificada, las cuantías resultantes por aplicación de la Tarifa segunda sufrirán un recargo del cien por cien a partir del tercer mes, y, en caso , que una vez finalizadas las obras, continúen los aprovechamientos, a las cuantías se los aplicarán un recargo del 200 por 100. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">b) Las cuantías resultantes por aplicación de la Tarifa tercera sufrirán los siguientes recargos a partir del tercer mes desde la instalación o concesión. Durante el segundo trimestre un 25 por ciento, durante el tercer trimestre un 50 por 100 y en cada trimestre, a partir del tercero, un 100 por 100. </span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Artículo 5. </span></span></span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Normas de gestión </span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1.- En conformidad con lo previsto el artículo 22 y siguientes del RDL 2/2004 de cinco de marzo cuando con ocasión de los aprovechamientos regulados en esta Ordenanza se produzcan desperfectos en el suelo o instalaciones de la vía pública, los titulares de la licencia o los obligados al pago venderán sujetos al reintegro total de los gastos de reconstrucción y reparación de los mencionados desperfectos o reparar los daños causados, que serán, en todo caso, independientes de los derechos liquidados por los aprovechamientos realizados.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2.- Las cantidades exigibles de acuerdo con la Tarifa se liquidarán por cada aprovechamiento solicitado o realizado y serán reducibles por los periodos naturales de tiempos señalados en los respectivos epígrafes. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3.- Las personas interesadas en la concesión de aprovechamientos regulados en esta Ordenanza tendrán que solicitar previamente la correspondiente licencia. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4.- En caso de solicitud de prórroga de la ocupación, se volverá a presentar la documentación oportuna y liquidar una nueva tasa. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Artículo 6. Obligación de pago </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1.- La obligación de pago de la tasa regulada en esta Ordenanza nace: </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">a) Tratándose de concesiones de nuevos aprovechamientos en la vía pública, en el momento de solicitar la correspondiente licencia. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">b) Tratándose de prórrogas de aprovechamientos ya autorizados , en el momento de solicitar la correspondiente prórroga. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2.- El pago de la tasa se realizará: </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">a) La tasa se exigirá en régimen de auto liquidación en el momento de pedir la licencia º</span></span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">correspondiente al aprovechamiento solicitado. Por parte de los servicios técnicos municipales competentes se tiene que comprobar las declaraciones formuladas. Cualquier cuestión a aclarar se tiene que comunicar a los solicitantes a efectos de su corrección.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">b) Cuando se presenta la solicitud de autorización para disfrutar de los aprovechamientos especiales se presentará debidamente cumplimentado el impreso de auto liquidación de la tasa.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Alternativamente, pueden presentarse en el Servicio Municipal correspondiente, los elementos de la declaración al objeto que los funcionarios municipales presten la asistencia necesaria para determinar la deuda.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Disposición Transitoria</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">La presente Ordenanza fiscal permanecerá en suspenso en relación al artículo cuarto tarifa primera y por tanto no será de aplicación hasta el 1 de enero de 2022.
