    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span&gt;&lt;span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la cual se convocan subvenciones para Inversiones a las explotaciones agrícolas, para los años 2015-2019, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;Boletín Oficial de las Islas Baleares&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&amp;nbsp;de acuerdo con los términos que prevee el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;Los expedientes han sido tramitados por el Fondo de Garantia Agraria y Pesquera de las Islas Baleares (FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;El vicepresidente &lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;en Materia Agraria &lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;del FOGAIBA, con fecha de &lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;4&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&amp;nbsp;de &lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;mayo&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&amp;nbsp;de 20&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;2&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;1&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;, dicta lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;2.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;El 10 de septiembre de 2020, el secretario general de la Consejería de Agricultura, Pesca y Alimentación dictó una Resolución de concesión de ayudas para inversiones en las explotaciones agrarias, que se publicó en el Boletín Oficial de las Islas Baleares número 161, del 17 de septiembre de 2020, en la que figuraba una concesión a favor &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;de PAUL-LUCIAN FALTICSKA, con un importe de ayuda de &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#000000"&gt;&lt;span&gt;&lt;em&gt;29.595,08€ y un plazo de 6 meses, con número de expediente INEA2018_1/357.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;3.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;El 8 de febrero de 2021, con registro de entrada núm. L95E2002, la persona indicada en el apartado anterior ha presentado una solicitud de desistimiento de la ayuda, aunque como es posterior a la concesión se trata de una renuncia, lo que supone llevar a cabo la revocación total de la ayuda concedida.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;4.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;El artículo 21.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, establece la obligación de la Administración a dictar resolución expresa y a notificarla. En su párrafo segundo especifica que «En los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como la desaparición sobrevenida del objeto del procedimiento, la resolución consistirá en la declaración de la circunstancia que concurra en cada caso, con la indicación de los hechos producidos y las normas aplicables ».&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;5.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;El 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que «Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho,&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ».&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;6.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;Por&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;&amp;nbsp;todo ello, se propone hacer la revocación total debido a la renuncia de la ayuda concedida por los beneficiarios que se indican en el anexo I de esta resolución.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span&gt;&lt;span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
