El día 11 de enero de 2021, el Consejo de Gobierno de las Islas Baleares adoptó un Acuerdo por<span style="display:none">&lt;A[por|para]&gt;</span> el cual se establecen los niveles de alerta sanitaria por islas que tienen que regir la comunidad autónoma de las Islas Baleares, de conformidad con el Acuerdo del Consejo de Gobierno de las Islas Baleares de 27 de noviembre de 2020, y se disponen medidas excepcionales aplicables a la isla de Mallorca (BOIB nº. 5, de 12 de enero 2021). </span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El día 25 de febrero de 2021 el Patronato de la Fundación Mallorca Turismo aprobó una modificación del Plan<span style="display:none">&lt;A[Plan|Plano]&gt;</span> de Actuación para<span style="display:none">&lt;A[por|para]&gt;</span> el ejercicio 2021 para llevar a cabo la tramitación y posterior concesión de una convocatoria extraordinaria de ayudas para otros sectores económicos para paliar los efectos de la Covid-19 por un importe de 1.310.000,00 €.</span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El Plan estratégico de subvenciones del Consejo Insular de Mallorca para el año 2021 prevé que la Fundación Mallorca Turismo lleve a cabo la convocatoria extraordinaria de ayudas para paliar los efectos de la Covid-19 a distintos sectores económicos de Mallorca y menciona, en concreto, en el sector de la distribución mayorista de mercancías y salas de baile y discotecas de Mallorca.</span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El día 4 de marzo de 2021 el director de la Fundación Mallorca Turismo dictó Resolución por<span style="display:none">&lt;A[por|para]&gt;</span> la cual aprobó la II convocatoria extraordinaria de ayudas para paliar los efectos de la Covid-19 en el sector de la distribución mayorista de mercancías y a las salas de baile y discotecas de Mallorca, con un presupuesto de 1.310.000,00 €, (extracto publicado en el BOIB nº. 32, de 6 de marzo de 2021).</span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Día 6 de mayo de 2021, la técnica jurídica de la Fundación Mallorca Turismo, como instructora del presente expediente, emitió informe sobre el resultado de la valoración de las solicitudes presentadas que cumplen todos los requisitos y de las solicitudes que se tienen que desestimar, de acuerdo con los criterios establecidos en la convocatoria.</span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. El día 6 de mayo de 2021, el director de la Fundación Mallorca Turismo informa de que los beneficiarios propuestos cumplen los requisitos establecidos en la convocatoria para poder acceder a las subvenciones y que se desestiman varias solicitudes de subvención.</span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. El día 6 de mayo de 2021 se emite informe jurídico sobre la propuesta de resolución de concesión de las ayudas al beneficiario con CIF E57699985 y de desestimación de varias solicitudes.</span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. En el presupuesto de gastos de la Fundación Mallorca Turismo hay crédito adecuado y suficiente para atender el gasto que se deriva de la presente convocatoria, por un importe de 1.310.000,00 €, de los cuales ya se han concedido 411.000,00 €.</span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos<span style="display:none">&lt;A[Fundamentos|Cimientos]&gt;</span> de derecho </strong></span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. De acuerdo con el artículo 6 de los Estatutos de la Fundación Mallorca Turismo son finalidades de la Fundación, entre otros, impulsar la reactivación de la economía de Mallorca mediante el otorgamiento de las ayudas o subvenciones en distintos sectores con el fin de conseguir la recuperación económica de la isla.</span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. &nbsp;De acuerdo con el artículo 16 de los Estatutos de la Fundación Mallorca Turismo son atribuciones de la dirección gestionar y ejecutar los planes<span style="display:none">&lt;A[planes|planos]&gt;</span> y los programas que aprueba el Patronato y formalizar y aprobar toda clase de actos y contratos (BOIB nº. 24, de 23 de febrero de 2019).</span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. La Ley 38/2003, de 17 de noviembre, general de subvenciones y Real decreto 887/2006, de 21 de julio, por<span style="display:none">&lt;A[por|para]&gt;</span> el cual se aprueba el reglamento de la Ley general de subvenciones. </span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. La Ordenanza general de subvenciones del Consejo insular de Mallorca (BOIB nº. 21, de 18 de febrero de 2017), modificada por el Pleno del Consejo de Mallorca en sesión de día 14 de junio de 2018 (BOIB nº. 96, de 4 de agosto de 2018). </span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. La Ley 2/2020, de 15 de octubre, de medidas urgentes y extraordinarias para el impulso de la actividad económica y la simplificación administrativa en el ámbito de las administraciones públicas de las Islas Baleares para paliar los efectos de la crisis ocasionada por la Covid-19 (BOIB nº. 180, de 20 de octubre de 2020). </span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. El Convenio de colaboración entre la Administración de la Comunidad Autónoma de las Islas Baleares y el Consejo Insular de Mallorca para conceder ayudas dirigidas a paliar las consecuencias de las restricciones motivadas por la crisis sanitaria de la COVID-19 en los sectores económicos de la restauración y otros firmado en fecha 29 de enero de 2021, aprobado por el Consejo Ejecutivo del Consejo de Mallorca en sesión celebrada en la misma fecha.</span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. El artículo 10 del Decreto de la presidencia del Consejo Insular de Mallorca de 9 de julio de 2019, por<span style="display:none">&lt;A[por|para]&gt;</span> el cual se determina la organización del Consejo Insular de Mallorca y las modificaciones posteriores, establece que la Fundación Mallorca Turismo&nbsp; queda adscrita en el Departamento de Turismo y Deportes (BOIB nº. 99, de 18 de julio de 2019). </span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo eso,</span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Dicto la siguiente <strong>Resolución</strong>:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1. INFORMAR a los interesados de que contra esta Resolución, que no agota la vía administrativa, se puede interponer un recurso de alzada ante<span style="display:none">&lt;A[ante|delante de]&gt;</span> el presidente del Patronato de la Fundación Mallorca Turismo, en el plazo de un mes, a partir del día siguiente de la publicación de la resolución de concesión en el Boletín Oficial de las Islas Baleares. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Contra la desestimación presunta, por silencio, del recurso de alzada se puede interponer un recurso contencioso administrativo ante el juzgado contencioso administrativo que corresponda en el plazo de seis meses, a partir del día siguiente de la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución). </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">No obstante lo anterior, se puede interponer, si considera, cualquier otro recurso que se estime pertinente.
