    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El director general de Movilidad y Transporte Terrestre ha formulado la siguiente propuesta de resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Hechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. El día 7 de septiembre de 2020 se publicó en el BOIB núm. 157 la Orden del Consejero de Movilidad y Vivienda, por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de transporte por carretera de viajeros y mercancías, en el ámbito territorial de las Islas Baleares. Estas bases prevén que las convocatorias que se dicten a su amparo se aprobarán con una resolución del consejero de Movilidad y Vivienda y se publicarán en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. El 23 de noviembre de 2020 el consejero de Movilidad y Vivienda dictó una resolución por la que se aprueba mediante el procedimiento anticipado de gasto, la convocatoria de ayudas para el sector del transporte público por carretera de viajeros y mercancías con el objeto de paliar los efectos económicos y sociales de carácter negativo que se han producido por la alerta sanitaria derivada de la Covidi-19, en el ámbito territorial de las Islas Baleares. Esta resolución de convocatoria se publicó en el BOIB núm. 201 de 28 de noviembre de 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En concreto, se trata de conceder ayudas económicas para los trabajadores autónomos y las pequeñas y medianas empresas que sean titulares de autorización de transporte público de viajeros o de mercancías residenciadas en el ámbito territorial de las Islas Baleares, por las inversiones y actividades realizadas consecuencia de la alerta sanitaria derivada de la Covid-19, y contribuir de este modo a paliar el impacto económico ocasionado en el sector.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. En el punto cuarto de la convocatoria se establece que la selección de los beneficiarios de las ayudas se hará mediante el sistema de concurrencia no competitiva, y que se han de seleccionar a todas las personas físicas y jurídicas titulares de autorizaciones de transporte público de viajeros y mercancías residenciadas en el ámbito territorial de las Islas Baleares que cumplan los requisitos establecidos en la convocatoria y que adjunten la documentación adecuada a la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. En el punto quinto de la convocatoria indican las siguientes actividades e inversiones subvencionables:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a)&lt;/em&gt; La adquisición de material y productos sanitarios consumibles, con el objeto de reducir los riesgos higiénico-sanitarios ante la Covid-19 adecuados a la actividad; entre estos se subvencionan los que van dirigidos a la protección individual del personal de la empresa y la protección de los viajeros en los vehículos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;— Mascarillas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;— Gel hidroalcohólico&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;— Guantes de protección&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;— Gafas de protección&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;— Pantallas faciales&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;— Termómetros sanitarios digitales&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;— Realización de tests o pruebas PCR&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b) &lt;/em&gt;La adquisición de material o equipos para la protección de los locales y de los vehículos considerados como una inversión necesaria para poder llevar a cabo la actividad; entre estos se subvencionan:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;— Mamparas, paravientos o similares&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;— Viricidas y geles desinfectantes de superficie&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;— Equipos purificadores o de ozono&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;— Vinilos y adhesivos de señalización de los vehículos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;— Equipos de limpieza y desinfección&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;— La asistencia externa para tareas de desinfección de los equipos, instalaciones y vehículos, exclusivamente en respuesta a la situación de contingencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En el apartado 2 del punto quinto se indica que en las inversiones inferiores o iguales a 500 euros no será necesaria la presentación de las facturas justificativas de los gastos, que se sustituirán por la declaración responsable del anexo 4 que adjunta con la convocatoria, donde se explicarán las inversiones realizadas y las actuaciones llevadas a cabo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5. En el punto sexto de la convocatoria se indica que ésta tiene asignado un importe máximo de 1.500.000 para el año 2021, con cargo a la partida presupuestaria 25201/413G01/47000/00. El crédito mencionado se distribuye territorialmente, en virtud del artículo 7.4 de la Ley 3/2014, de 17 de junio del sistema de financiación definitivo de los consejos insulares y según las cuantías actualizadas para el bienio 2020 a 2021 de la siguiente manera:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;-Mallorca: 1.107.000 euros&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;-Menorca: 161.500 euros&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;-Ibiza: 202.500 euros&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;-Formentera: 29.000 euros&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;6. Tal como se indica en el punto séptimo, las solicitudes se presentarán de forma telemática en el plazo comprendido entre el 29 de noviembre de 2020 -al día siguiente de la publicación de la convocatoria en el BOIB- y el 15 de enero de 2021, rellenando el anexo 2 y adjuntando la documentación que se indica en el punto octavo de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;7. De acuerdo con el punto noveno de la convocatoria, la cuantía máxima subvencionada será de 50.000 euros por solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las ayudas se materializan mediante una subvención directa a fondo perdido sobre el gasto realizado en el material que se relaciona a continuación y por los importes máximos indicados:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a) &lt;/em&gt;Material y productos consumibles&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;— Desinfección y limpieza de vehículos&amp;nbsp;y/o locales hecha por empresas especializadas: según factura.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;8. Conforme al punto decimocuarto de la convocatoria, con la presentación de la solicitud y la documentación establecida en el apartado octavo, se entiende justificada la aplicación de la ayuda a la finalidad de la convocatoria, teniendo en cuenta que para las ayudas solicitadas inferiores o iguales a 500 euros entiende cumplida esta justificación con la declaración responsable del anexo 4 y, en cambio, para las ayudas solicitadas de más de 500 euros será necesario la presentación de la memoria justificativa del anexo 5, junto con los justificantes de los gastos así como los de su pago.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;9. Dentro del plazo indicado en el punto séptimo de la convocatoria se han presentado de forma telemática un total de 77 solicitudes de ayudas con el anexo 2. De entre estas, las solicitudes que constan en el anexo de la presente resolución se han presentado de forma correcta, si bien alguno de los gastos no son subvencionables de conformidad con el apartado quinto de la convocatoria, o bien se superan determinados importes establecidos en el apartado noveno de la convocatoria, por lo cual la jefa del Servicio de Ordenación del Transporte emitió los correspondientes informes en los cuales proponía el pago de una parte de los importes solicitados, una vez comprobados los siguientes extremos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- El cumplimiento por parte de los solicitantes de los requisitos establecidos en el apartado tercero de la convocatoria y en el artículo 5 de la Orden de bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Que las actividades e inversiones son subvencionables de acuerdo con el apartado quinto de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- En las solicitudes de ayudas por un importe igual o inferior a 500 euros, que se ha presentado correctamente la declaración responsable del anexo 4.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- En las solicitudes de ayudas por un importe superior a 500 euros, que los interesados han presentado correctamente la memoria justificativa del anexo 5, así como la documentación acreditativa de los gastos y la de su pago. En estos casos, el alcance de la comprobación se ha extendido a la comprobación de las facturas o documentos acreditativos de los gastos, así como su pago y también que el importe de las unidades se ajustase a los máximos indicados en el punto noveno de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;10. Notificadas las propuestas de resolución provisional a los solicitantes relacionados en el anexo, ha transcurrido el plazo de diez días sin que ninguno de estos haya presentado alegaciones, por lo cual procede la emisión de propuesta de resolución definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;11. Hay crédito adecuado y suficiente en la partida presupuestaria 25201/413G01/47000/00 del presupuesto de la Comunidad Autónoma de les Islas Baleares para el año 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. La Resolución del consejero de Movilidad y Vivienda de 23 de noviembre de 2020 por la que se aprueba mediante el procedimiento anticipado de gasto la convocatoria de ayudas para el sector del transporte público por carretera de viajeros y mercancías con el objeto de paliar los efectos económicos y sociales de carácter negativo que se han producido por la alerta sanitaria derivada de la Covid-19, en el ámbito territorial de las Islas Baleares (BOIB núm. 20, de 28 de noviembre de 2020).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. La Orden del Consejero de Movilidad y Vivienda de 7 de septiembre de 2020, por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de transporte por carretera de viajeros y mercancías, en el ámbito territorial de las Islas Baleares (BOIB núm. 157, de 10 de septiembre de 2020).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La Ley 38/2003, de 17 de noviembre, general de subvenciones (BOE núm. 276, de 18 de noviembre de 2003).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. La Ley 2/2020, de 15 de octubre, de medidas urgentes y extraordinarias para el impulso de la actividad económica y la simplificación administrativa en el ámbito de las administraciones públicas de las Islas Baleares para paliar los efectos de la crisis ocasionada por la Covid-19 (BOIB núm. 180, de 20 de octubre de 2020).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;7. La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas (BOE núm. 236, de 2 de octubre de 2015).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;8. La Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 44, de 3 de abril de 2003).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. Ley 14/2014, de 29 de diciembre, de finanzas de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 8, de 15 de enero de 2015).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;11. El Decreto 75/2004, de 27 de agosto, de desarrollo de determinados aspectos de la Ley de finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 122, de 2 de septiembre de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;12. La Ley 1/2019, de 31 de enero, del Gobierno de las Islas Baleares (BOIB núm. 15, de 2 de febrero de 2019).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;13. El Decreto 11/2021, de 15 de febrero, de la presidenta de las Islas Baleares por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 21, de 15 de febrero). &lt;span style="display:block; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Propuesta de resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Conceder las ayudas para el sector del transporte público por carretera de viajeros y mercancías con el objeto de paliar los efectos económicos y sociales de carácter negativo que se han producido por la alerta sanitaria derivada de la Covid-19, en el ámbito territorial de las Islas Baleares, por un gasto de 29.416,25 euros, a favor de los solicitantes que figuran en el anexo de la presente resolución, por los importes indicados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Autorizar y disponer un gasto de 29.416,25 euros a favor de los solicitantes que figuran en el anexo de la presente resolución, con cargo a la partida presupuestaria 25201/413G01/47000/00 de los presupuestos de la Comunidad Autónoma de las Islas Baleares para el año 2021, por los importes indicados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Reconocer la obligación y proponer el pago por un gasto de 29.416,25 euros a favor de los solicitantes que figuran en el anexo de la presente resolución, con cargo a la partida presupuestaria 25201/413G01/47000/00 de los presupuestos de la Comunidad Autónoma de las Islas Baleares para el año 2021, por los importes indicados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. Comunicar a los beneficiarios que las ayudas a que se refiere la presente resolución se encuentran sometidas al Régimen del Marco Nacional Temporal relativo a las medidas de ayuda a empresas y autónomos consistentes en ayudas directas, de acuerdo con el punto decimosexto de la Resolución del consejero de Movilidad y Vivienda de 23 de noviembre de 2020 por la que se aprueba mediante el procedimiento anticipado de gasto la convocatoria de ayudas para el sector del transporte público por carretera de viajeros y mercancías con el objeto de paliar los efectos económicos y sociales de carácter negativo que se han producido por la alerta sanitaria derivada de la Covid-19, en el ámbito territorial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Los beneficiarios quedan obligados al cumplimiento de las obligaciones establecidas en el punto decimotercero de la Resolución del Consejero de Movilidad y Vivienda de 23 de noviembre de 2020 por la que se aprueba mediante el procedimiento anticipado de gasto la convocatoria de ayudas para el sector del transporte público por carretera de viajeros y mercancías con el objeto de paliar los efectos económicos y sociales de carácter negativo que se han producido por la alerta sanitaria derivada de la Covid-19, en el ámbito territorial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Publicar esta resolución en la página web de la Dirección General de Movilidad y Transporte Terrestre y en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Movilidad y Vivienda en el plazo de un mes a contar desde el día siguiente de la publicación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala Contenciosa Administrativa del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses contados desde el día siguiente de la publicación, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
