    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 21 de diciembre de 2018, por la cual se convocan, para el año 2018, subvenciones para inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;/span&gt;&lt;em&gt;&lt;span style="color:#212121"&gt;&lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#212121"&gt;&amp;nbsp;de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 30/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 23&amp;nbsp;de abril&lt;/span&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;de 2021&lt;/span&gt;&lt;span style="color:#212121"&gt;, firmó la siguiente resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;em&gt;“RESOLUCIÓN DE REVOCACIÓN TOTAL&amp;nbsp;Y DENEGACIÓN AMPLIACIÓN DE PLAZOS&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 21 de diciembre de 2018 por la que se convocan, para el año 2018, subvenciones para inversiones en la prevención de los daños causados a los bosques por incendios forestales, desastres naturales y catástrofes.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2. Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de los interesados que figuran en el anexo de la Resolución con los datos y los importes correspondientes.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3. Considerando la Resolución de concesión de la ayuda mencionada, y de acuerdo con lo establecido en el punto 6 del apartado undécimo de la convocatoria antes mencionada, el hecho de no presentar la documentación justificativa o de no ejecutar la actuación objeto de la ayuda en el plazo y en los términos establecidos, supone un incumplimiento al que es aplicable lo dispuesto en el punto 4 de las exclusiones y reducciones previstas en el anexo III de la mencionada resolución, en casos de incumplimiento grave, falsedad, intencionalidad y negligencia el beneficiario quedará excluido de la misma medida durante el año natural en que se ha detectado el incumplimiento y el año natural siguiente.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;4. Dentro del plazo legalmente establecido para la justificación de las actuaciones aprobadas, la persona interesada con fecha 30 de septiembre de 2020 con número de registro de entrada 21794 presenta la solicitud de pago así como la factura y justificante del orden de transferencia bancaria, pero, una vez examinada esta solicitud de pago y la documentación exigida, y de acuerdo con el Informe de inspección final de realización de las inversiones/actuaciones de 29 de octubre de 2020, se comprueba que las actuaciones no se han ejecutado.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;5. Con fecha 30 de octubre de 2020 el beneficiario presenta solicitud de una prórroga de la realización de las tareas previstas en la memoria del expediente.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;6. Como no se ha ejecutado la actuación objeto de la ayuda en el plazo y en los términos establecidos supone un incumplimiento al que es aplicable la exclusión prevista en el anexo III de incumplimiento grave, falsedad, intencionalidad y negligencia de la misma medida durante el año natural en que se ha detectado el incumplimiento y el año natural siguiente, asimismo, se deniega la solicitud de prórroga para la realización de las tareas previstas, cuando ya se ha presentado una factura y el justificante de pago, aunque no se ha realizado ninguna actuación.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;7. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, dispone que "Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ".&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;8. Co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha 8 de febrero de 2021 se notifica&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;a&amp;nbsp;la entidad interesada, mediante la publicación en la web, el Informe/Propuesta provisional de resolución de revocación total de 4 de febrero de 2021 de incumplimiento grave, falsedad, intencionalidad y negligencia de la misma medida durante el año natural en que se ha detectado el incumplimiento y el año natural siguiente y denegar la prórroga. Una vez transcurridos los 10 días hábiles, el interesado no ha presentado ninguna alegación.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;9. Por todo ello, se propone hacer la revocación total a causa del incumplimiento al que es aplicable la exclusión prevista en el anexo III de incumplimiento grave, falsedad, intencionalidad y negligencia y denegar la prórroga.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;10. Se ha considerado el Informe/Propuesta provisional de resolución de 4 de febrero de 2021, de revocación total de la ayuda concedida a E&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;S CABA&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;S,SL con NIF B07963812.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2. Orden del Consell&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;er&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&amp;nbsp;de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014 a 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/2015 de 1 de octubre&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Propuesta de Resolución&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y propongo al vicepresidente en materia agraria del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.Excluir la entidad beneficiaria &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;E&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;S CABA&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;S, SL, con NIF B07963812 (exp.PIFO2018_1/007) durante el año 2018 de la Submedida 8.3. Inversiones prevención de los daños a los bosques por incendios forestales, desastres naturales y catástrofes.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2. Revocar totalmente la Resolución de ayuda concedida al beneficiario por el importe y con los datos detallados en el anexo de esta resolución, que es un total de 1 expediente y que comienza con E&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;S CABA&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;S&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, SL y termina con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;E&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;S C&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ABAS, SL, que suma un importe total de 9.562,50€ euros, relativa a la línea de ayuda "Inversiones prevención de los daños a los bosques por incendios forestales, desastres naturales y catástrofes", dada la exclusión de la submedida antes mencionada.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3. Finalizar el procedimiento y archivar el expediente &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;PIFO2018_1/007.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;4. Notificar esta resolución a la beneficiaria mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
