Mediante una&amp;nbsp;resolución del consejero de Educación y Universidad de 18 de julio de 2018 (BOIB núm. 73, de 14 de junio), se autorizó el cambio de titularidad del centro privado concertado Aula Balear, de Palma, con las enseñanzas siguientes autorizadas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Educación infantil: 6 unidades y 150 plazas escolares&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="line-height:normal"&gt;2.&amp;nbsp;&lt;span style="color:black"&gt;El 12 de enero de&amp;nbsp;202&amp;nbsp;1,&amp;nbsp;la&amp;nbsp;representante del centro&amp;nbsp;presentó una solicitud de modificación de la configuración&amp;nbsp;del&amp;nbsp;centro privado concertado Aula Balear, de Palma, con la ampliación de una unidad del CFGS de Administración y Finanzas (ADG32)&amp;nbsp;en&amp;nbsp;turno&amp;nbsp;de tarde.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.&amp;nbsp;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;El 22 de enero&amp;nbsp;de 2021, el Departamento de Formación Profesional y Cualificaciones Profesionales&amp;nbsp;emitió un informe favorable, dado que&amp;nbsp;el centro ya tiene autorizado el ciclo formativo de grado medio de Gestión Administrativa&amp;nbsp;y&amp;nbsp;dispone&amp;nbsp;de los equipamientos que establece la legislación vigente.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="line-height:normal"&gt;4.&amp;nbsp;&lt;span style="color:black"&gt;El 10 de marzo de 2021, el arquitecto del Servicio de Centros Educativos emitió&amp;nbsp;un&amp;nbsp;informe&amp;nbsp;de la visita realizada el mismo día, en el que&amp;nbsp;constataba la total coincidencia con&amp;nbsp;la documentación presentada&amp;nbsp;justificando&amp;nbsp;el cumplimiento de la normativa de aplicación vigente en materia de espacios para la ampliación de la configuración con el CFGS Administración y Finanzas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Referente a las condiciones de accesibilidad establecidas en la legislación vigente (CTE.DB-SUA y anexo A de la Ley 8/2017 de Accesibilidad Universal de las Illes Balears), en la documentación presentada se justifica el cumplimiento de las normativas aplicables y de la instalación reciente del ascensor.&amp;nbsp;También es presentó un documento respecto a la solidez y estabilidad del edificio, finalmente se justifica el cumplimiento del aislamiento acústico en las separaciones existentes entre las aulas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="line-height:normal"&gt;5.&amp;nbsp;&lt;span style="color:black"&gt;El&amp;nbsp;19&amp;nbsp;de abril de 2021, la jefa del Departamento de Planificación y Centros informó favorablemente sobre&amp;nbsp;la autorización de la modificación&amp;nbsp;de la configuración del centro privado concertado Aula Balear, de Palma, con la ampliación de una unidad del CFGS de Administración y Finanzas (ADG32).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.&amp;nbsp;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;La Ley Orgánica 8/1985, de 3 de julio, reguladora del derecho a la educación (BOE núm. 159, de 4 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.&amp;nbsp;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;La Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 44, de 3 de abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El Real Decreto 1147/2011, de 29 de julio, por el que se establece la ordenación general de la formación profesional del sistema educativo (BOE núm. 182, de 30 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.&amp;nbsp;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;El Decreto 91/2012, de 23 de noviembre, por el que se establece la ordenación general de la formación profesional del sistema educativo en el sistema integrado de formación profesional en las Illes Balears (BOIB núm. 177, de 29 de noviembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="line-height:normal"&gt;6.&amp;nbsp;&lt;span style="color:black"&gt;Las Instrucciones del jefe del Departamento de Planificación y Centros (NRS 175/2014, de 6 de marzo) referentes a la normativa de mínimos aplicable para la autorización de centros privados de FP, aplicación del principio de especialidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="line-height:normal"&gt;7.&amp;nbsp;&lt;span style="color:black"&gt;Real Decreto 1584/2011, de 4 de noviembre, por el que se establece el Título de Técnico Superior en Administración y Finanzas y se fijan sus enseñanzas mínimas (BOE núm. 301, de 15 de diciembre de 2011).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="line-height:normal"&gt;8.&amp;nbsp;&lt;span style="color:black"&gt;Orden ECD / 308/2012, de 15 de febrero, por la que se establece el currículum del ciclo formativo de Grado Superior correspondiente al título de Técnico Superior en Administración y Finanzas&amp;nbsp;(BOE núm. 45, de 22 de febrero de 2012).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;9. El Estatuto de autonomía de las Illes Balears, aprobado por la Ley Orgánica 1/2007, de 28 de febrero (BOE núm. 52, de 16 de marzo), el cual establece en el artículo 36.2 que, en materia de enseñanza, corresponde a la Comunidad Autónoma de las Illes Balears la competencia de desarrollo legislativo y de ejecución de la enseñanza en toda su extensión, niveles y grados, modalidades y especialidades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="line-height:normal"&gt;10.&amp;nbsp;&lt;span style="color:black"&gt;El Decreto 11/2021, de 15 de febrero, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 21, de 15 de febrero).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Por todo ello, y de acuerdo con la propuesta formulada por la Dirección General de Planificación, Ordenación y Centros de fecha&amp;nbsp;20&amp;nbsp;de abril&amp;nbsp;de 2021, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="line-height:normal"&gt;1.&amp;nbsp;&lt;span style="color:black"&gt;Autorizar, con efectos del inicio del curso 2021-2022, la modificación de la configuración del centro privado concertado Aula Balear, de Palma, con la ampliación de una unidad del CFGS de Administración y finanzas (ADG32)&amp;nbsp;en turno de tarde.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Adscripción administrativa:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;El bachillerato en las modalidades&amp;nbsp;de ciencias y humanidades y ciencias sociales y los ciclos formativos de grado medio&amp;nbsp;y grado superior&amp;nbsp;quedan adscritos al IES Arxiduc Lluís Salvador, de Palma (código: 07007930).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="line-height:normal"&gt;3.&amp;nbsp;&lt;span style="color:black"&gt;Inscribir esta modificación en el Registro de centros docentes (RCD) de la Dirección General de Planificación, Ordenación y Centros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="line-height:normal"&gt;4.&amp;nbsp;&lt;span style="color:black"&gt;Comunicar al centro mencionado que está obligado a cumplir la legislación vigente y a solicitar la revisión oportuna de su configuración cuando tenga de modificarse cualquiera de los datos que figuran en esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.&amp;nbsp;&lt;span style="color:black"&gt;Publicar esta Resolución en el&amp;nbsp;&lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición&amp;nbsp;ante el Consejero de Educación&amp;nbsp;y&amp;nbsp;Formación Profesional&amp;nbsp;en el plazo de un mes a contar desde el día siguiente al de su publicación en el BOIB, de acuerdo con los artículos 123 y 124 de la Ley 39/2015&amp;nbsp;,&amp;nbsp;de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;También puede interponerse directamente un recurso contencioso administrativo ante la Sala de lo Contencioso del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de la publicación en el BOIB, de acuerdo con los artículos 10 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
