![CDATA[Resolución del director general del Servicio de Salud de las Islas Baleares de 14 de abril de 2021 por la cual se aprueban las listas definitivas de personas candidatas admitidas y de personas excluidas en el concurso oposición para cubrir plazas vacantes de la categoría de facultativo/facultativa especialista de área de geriatría, y se corrigen los errores relacionados con la sede del examen en Mallorca]] 14090 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong>Hechos </strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">1.- Por medio de la Resolución del director general del Servicio de Salud de las Islas Baleares de 12 de abril de 2019 (BOIB núm. 48/2019, de 13 de abril) se convocó un concurso oposición para cubrir plazas vacantes de diversas categorías de facultativo/facultativa especialista de área (FEA), entre las cuales está la de FEA de geriatría. Esta resolución se completó con otra de fecha de 6 de junio de 2019, publicada en el BOIB núm. 76 del mismo año. &nbsp;</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">2.- A través de la Resolución del director general del Servicio de Salud de las Islas Baleares de 2 de julio de 2020 (BOIB núm. 119/2020, de 7 de julio) se modificó la Resolución del director general del Servicio de Salud de 12 de abril de 2019 y se publicó la convocatoria conjunta de 32 concursos oposición de diversas categorías de facultativo/facultativa especialista de área, entre ellas la de FEA de geriatría. Esta resolución se completó con otras dos: la de fecha de 22 de julio de 2020, (BOIB núm. 132/2020, de 28 de julio), y la de 16 de marzo de 2021 (BOIB núm. 39/2021, de 20 de marzo). &nbsp;</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">3.- Con la Resolución del director general del Servicio de Salud de las Islas Baleares de 3 de marzo de 2021 (BOIB núm. 33/2021, de 9 de marzo) se aprobaron las listas provisionales de personas aspirantes admitidas y excluidas de este concurso oposición de FEA de geriatría y se designó a las personas que integran el Tribunal calificador. &nbsp;&nbsp;Asimismo, se informaba del día, lugar y hora de la prueba de la fase de oposición. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">4.- Ha finalizado el plazo para presentar reclamaciones o para subsanar los defectos detectados en las solicitudes.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">5.- De conformidad con la base 4.3 de la convocatoria, una vez finalizado el plazo para presentar alegaciones o para subsanar errores, el director general del Servicio de Salud ha de dictar una resolución para aprobar las listas definitivas de personas candidatas admitidas y de personas excluidas.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong>Fundamentos de derecho </strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1.-El artículo 109.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común establece que las administraciones públicas pueden rectificar, así mismo, en cualquier momento, de oficio o a instancia de los interesados, los errores materiales, de hecho o aritméticos existentes en sus actos.</span></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2.-El artículo 56 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares dispone que la revocación de los actos de gravamen o desfavorables y la rectificación de los errores materiales, aritméticos y de hecho en actas y disposiciones administrativas corresponde al órgano que ha dictado el acto o la disposición.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">3.-La Resolución del director general del Servicio de Salud de las Islas Baleares de 12 de abril de 2019 (BOIB núm. 48/2019, de 13 de abril) por la que se convoca un concurso oposición para cubrir plazas vacantes de diversas categorías de facultativo/facultativa especialista de área y las modificaciones posteriores &nbsp;&nbsp;mencionadas en el apartado anterior.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Por todo ello, dicto la siguiente</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong>Resolución</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">1.- Aprobar las listas definitivas de personas candidatas admitidas y de personas excluidas en el concurso oposición para cubrir plazas vacantes de la categoría de facultativo/facultativa especialista de área de geriatría, que se adjuntan a esta resolución como anexo 1. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">2.- Corregir los errores relacionados con la sede donde se desarrollará la prueba de la fase de oposición en la isla de Mallorca, que figura en el anexo 2.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">3.- Publicar esta resolución en el Boletín Oficial de las Islas Baleares y en el portal web del Servicio de Salud www.ibsalut.es.</span></span></p> <p><strong style="font-family:&quot;Times New Roman&quot;,Times,serif">Interposición de recursos</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">Contra esta resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el órgano que la dicta en el plazo de un mes a contar desde el día siguiente de la fecha de publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento&nbsp;</span></span><span style="font-family:&quot;Times New Roman&quot;,Times,serif">administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></p> <p><span style="font-family:Times New Roman,Times,serif;
