    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por acuerdo de Pleno de 28 de enero de 2021 se acordó la modificación de la Ordenanza municipal del servicio público de viajeros en automóviles de turismo, del siguiente tenor literal:&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cumplimiento de lo dispuesto en el artículo 49c) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local, y al art. 102d) de la Ley 20/2006, de 15 de diciembre, Municipal y de Régimen Local de les Illes Balears, se publica íntegramente, conforme a lo dispuesto en el art. 70.2 de la mencionada Ley y art. 103 de la Ley 20/2006, de 15 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ORDENANZA MUNICIPAL DEL SERVICIO PÚBLICO DE VIAJEROS EN AUTOMÓVILES DE TURISMO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;TÍTULO I&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 1&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La presente ordenanza se dicta conforme a lo dispuesto por la siguiente normativa: artículo 25.2.LL de la Ley 7/1985, del 2 de abril, Reguladora de Bases de régimen local; Real Decreto 763/1979, de 16 de marzo, por el cual se aprueba el Reglamento nacional de los servicios urbanos de transporte en automóviles ligeros; Ley 16/1987, de 30 de julio, de Ordenación de los Transportes Terrestres; Real Decreto 1211/1190, de 28 de septiembre, por el cual se aprueba el Reglamento de ordenación de los transportes terrestres; el Decreto Ley 6/2012, de 8 de junio, de Medidas Urgentes sobre el Régimen Sancionador en materia de transporte público discrecional de viajeros en vehículo de turismo al ámbito territorial de la Comunidad Autónoma de las Islas Baleares; y Orden del Consejero de Agricultura, Medio Ambiente y Territorio, de 19 de enero de 2012, sobre régimen de tarifas máximas obligatorias de los servicios interurbanos de transporte público discrecional de viajeros en vehículos de turismo (VT), que se desarrollan íntegramente en el territorio de la Isla de Mallorca (BOIB nº 13, de 28.01.12) o las que se aprueben con posterioridad a esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El objeto de la presente ordenanza es regular el transporte público de viajeros efectuado en automóviles de turismo con conductor en el término municipal de Capdepera (vehículos taxi).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 2&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se entiende por ‘autotaxi' o ‘taxi' el vehículo dedicado a transporte público urbano de viajeros en automóviles de turismo, con capacidad máxima para 7 plazas incluida la del conductor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 3&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La siguiente ordenanza establece las siguientes normas de policía administrativa:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Deberá obtenerse licencia previa, mediante una técnica autorizada estrictamente regulada, que proscriba la arbitrariedad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Se estará sujeto a un régimen tarifario que vincule a los titulares de las licencias y usuarios, protegiendo la posición de los dos grupos, el cual será sometido a los órganos competentes sobre el control de los precios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Existirá una actuación inspectora, a fin de garantizar el cumplimiento de las presentes normas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Se establecerá un procedimiento sancionador que defienda la dignidad de la profesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Existirán unas medidas de precaución que aseguren el cumplimiento de estas normas, aunque sea en contra de la voluntad de aquellos que están obligados a cumplirlas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Se informará a los propietarios de las licencias de los responsables a la hora de efectuar las oportunas revisiones, a quienes deberán dirigir las posibles quejas y reclamaciones; indicando también sus horarios de trabajo y donde localizarlos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 4. Órganos de representación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Los titulares de licencias municipales deberán comunicar al Ayuntamiento de Capdepera, en el plazo máximo de un mes desde la entrada en vigor de la presente ordenanza, la persona &amp;nbsp;designada como interlocutor válido que les represente ante la Corporación.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Asimismo, vendrán obligados a comunicar cualquier cambio que pueda producirse al respeto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Ayuntamiento, siempre que sea necesario, efectuará reuniones con todos los titulares de las licencias que haya otorgado.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;TÍTULO II. LICENCIAS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 5. Licencias&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para poder prestar el servicio de transporte urbano de viajeros mediante un vehículo de turismo deberá obtenerse previamente la LICENCIA DE AUTOTAXI correspondiente, a otorgar por el Ayuntamiento de Capdepera.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Esta licencia habilitará a la prestación del servicio para un vehículo concreto, vinculado a una licencia, el cual deberá incluir esta identificación.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las licencias de autotaxi serán propiedad del Ayuntamiento de Capdepera y cedidas para la explotación de este servicio. Por lo tanto, el Ayuntamiento y el Gobierno podrán suspender, prohibir o restringir total o parcialmente, y para el tiempo que resulte estrictamente necesario, el ejercicio de las actividades amparadas a las licencias otorgadas por motivos de defensa nacional, orden público u otras causas graves de utilidad pública o de interés social que lo justifiquen.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se concederán a título personal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las licencias municipales de autotaxi se otorgarán para un tiempo indefinido, pero su validez quedará condicionada al cumplimiento de las condiciones y requisitos establecidos para obtenerla.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Todo titular de licencia vendrá obligado a realizar una inspección municipal periódica anual, así como tantas inspecciones extraordinarias no programadas que se consideren necesarias, en la cual se inspeccionará el vehículo adscrito a la licencia y se solicitará toda la documentación en vigor tanto del vehículo como del conductor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 6. Ámbito de las licencias&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El régimen de otorgamiento, utilización, suspensión, modificación y extinción de las licencias de autotaxi se realizará conforme a lo dispuesto en la presente ordenanza.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La pérdida o retirada de la autorización de transporte interurbano, por cualquier causa legal tanto penal como administrativa, comportará la revocación y retirada de la licencia.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Asimismo, la pérdida o retirada de esta licencia municipal, por cualquier causa legal, comportará la retirada de la autorización de transporte urbano.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 7. Ampliación de licencias&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se establecerá un total de 40 licencias para este municipio. Mediante acuerdo de pleno, previa audiencia a los titulares de las licencias y asociaciones profesionales de empresarios y trabajadores, el número de licencias podrá incrementarse o reducirse.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 8. Transmisión de licencias&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las licencias municipales de autotaxi podrán transmitirse en los siguientes supuestos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Por defunción del titular, a favor de su cónyuge viudo/a o herederos legítimos.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La adquisición de licencias por vía hereditaria no faculta por sí misma la prestación del servicio sin la concurrencia de los demás requisitos exigidos para el ejercicio de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Cuando el cónyuge viudo/a, sus herederos legítimos o el jubilado no puedan explotar las licencias como actividad única y exclusiva, previa autorización del Ayuntamiento, se otorgarán a favor de los solicitantes señalados en el artículo 12 del Real Decreto 763/1979, de 16 de marzo, por el cual se aprobó el Reglamento nacional de los servicios urbanos e interurbanos de transportes en automóviles ligeros, teniendo en cuenta el derecho de cualquier tanteo de otro heredero forzoso en posesión del permiso local de conductor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Cuando se imposibilite al titular de la licencia para el ejercicio de la profesión por enfermedad, accidente u otras causas que puedan calificarse de fuerza mayor (entre las cuales la retirada definitiva del carnet de conducir necesario), lo cual se tendrá en cuenta en su expediente. En consecuencia la licencia se otorgará a favor de los solicitantes de los apartados anteriores (conforme al art. 12 del RD 763/1979).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) Cuando la licencia tenga una antigüedad superior a 5 años, previa autorización del Ayuntamiento de Capdepera, el titular podrá transmitirla al conductor asalariado de esta licencia con carnet de conducir y que haya desempeñado la profesión al menos durante 1 mes en esta misma licencia, lo cual podrá justificarse con la aportación de la última nómina. Asimismo, el primero no podrá volver a obtener una nueva licencia en este Ayuntamiento durante 10 años ni transmitirla nuevamente, si no se dan los supuestos anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En estos dos últimos supuestos, cuando el titular de una licencia desee transmitirla deberá asalariar a un conductor que disponga del permiso de conductor municipal, en cualquier mes del año, siempre justificando la adquisición de la licencia, previa autorización del Ayuntamiento de Capdepera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La transmisión de las licencias de autotaxi quedará condicionada, en todo caso, al pago de las tasas, derechos y otros tributos municipales resultantes de la aplicación de las Ordenanzas fiscales en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No serán transmisibles las licencias cuyo titular incurra en un expediente sancionador, mientras esté en trámites.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 9. Otorgamiento de las licencias por el Ayuntamiento&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El otorgamiento de las licencias se determinará por la necesidad y conveniencia del servicio a prestar al público.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para acreditar estos supuestos se analizarán los siguientes aspectos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Situación del servicio, en cuanto a su calidad y extensión, antes de otorgar nuevas licencias.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Tipos, extensión y crecimiento del municipio de Capdepera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Necesidades reales de un servicio más amplio y mejor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Repercusión de las nuevas licencias a otorgar en el conjunto del transporte y la circulación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 10. Solicitantes de las licencias de autotaxi&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Podrán solicitar licencias de autotaxi:&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cualquier persona física, mayor de edad, que no padezca dolencia infecto-contagiosa o impedimento físico que le imposibilite o dificulte el ejercercicio de la profesión con normalidad. Deberá disponer de los carnets de conducir y del carné municipal de conductor correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los conductores asalariados de los titulares de una licencia de autotaxi que presten el servicio con dedicación a la profesión total y exclusiva, acreditados mediante la posesión y vigencia del permiso de conductor expedido por el Ayuntamiento de Capdepera y la inscripción y cotización en este concepto a la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 11. Otorgamiento de las licencias&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las licencias de autotaxi podrán otorgarse por concurso, previa convocatoria pública, a fin de garantizar la libre concurrencia entre los interesados en el otorgamiento; o por transmisión de licencias, en los supuestos permitidos por la ley.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 12. Permiso municipal de conductor&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ayuntamiento de Capdepera será el encargado de conceder el permiso municipal de conducir. Requisitos para su obtención:&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Ser mayor de 18 años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Disponer del carnet de conducir exigido por el Código de circulación para este tipo de vehículos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Superar el examen de conocimientos del municipio de Capdepera, así como de la isla de Mallorca: listado de calles de Capdepera, lugares de interés turístico, centros oficiales, Reglamento de circulación, monumentos históricos, playas, hoteles, etc.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La periodicidad máxima de dichos exámenes será de 2 veces al año (1 de ellas antes del comienzo de la temporada estival).&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Este permiso se renovará cada 5 años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) No padecer dolencia infecto-contagiosa o impedimento físico que imposibilite o dificulte el ejercicio de la profesión con normalidad. Este requisito deberá acreditarse mediante el certificado médico correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una vez iniciado el desempeño de la actividad deberá aportarse el alta en la Seguridad Social, en la cual se expresen los extremos mencionados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e) Además del castellano, deberán poseer conocimientos demostrables (examen o certificado), como mínimo a nivel de conversación, de la lengua propia de las Islas Baleares, así como conocimientos básicos orales de otras lenguas de algunos de los países de la CEE, preferiblemente de inglés o alemán.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A fin de poder garantizar que todos los profesionales de los Taxis de Capdepera puedan acceder al nivel de conocimiento de los idiomas exigidos en este párrafo, el Ayuntamiento de Capdepera promoverá cursos voluntarios de lenguas, primeros auxilios y otros de su interés para mejorar el servicio, los cuales serán subvencionados o de bajo coste, y se realizarán preferentemente en temporada baja (de los meses de octubre hasta abril).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Corresponderá a la Alcaldía, junto con la Concejalía de Movilidad, fijar las fechas de los exámenes.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 13. Duración, caducidad y revocación de las licencias&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las licencias municipales de autotaxi se otorgarán por un tiempo indefinido.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1- La licencia de autotaxi se extinguirá en los siguientes supuestos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Por renuncia voluntaria del titular de la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Por imposición de sanción que comporte la pérdida de titularidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2- Podrá revocarse y retirarse la licencia por las causas siguientes:&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Por utilizar un vehículo de una clase determinada para el desempeño de una actividad&amp;nbsp;diferente a la autorizada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Por no disponer de la póliza de seguro obligatoria en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Por no disponer de la tarjeta de transporte en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) Por alquilar, arrendar o apoderarse de una licencia que suponga la explotación no&amp;nbsp;autorizada por esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e) Por efectuar una transmisión de licencia no autorizada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;f) Por incumplimiento de las obligaciones inherentes a la licencia y otras obligaciones&amp;nbsp;referentes al vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;g) Por contratar a personal asalariado sin disponer de los carnets de conducir y&amp;nbsp;municipal o sin el alta correspondiente a la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;h) Para manipular o falsear de forma intencionada el taxímetro en cualquiera de sus&amp;nbsp;efectos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;i) Por conducir bajo los efectos del alcohol o estupefacientes. El estado de alcoholismo se determinará en cada caso conforme a las normas de circulación que regulan el grado &amp;nbsp;&amp;nbsp; &amp;nbsp;máximo de alcohol en sangre o aire espirado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;j) No estar el titular de la licencia dado de alta a la Seguridad Social durante el plazo en que esta licencia le haya sido otorgada; es decir, tanto en temporada alta como en &amp;nbsp;&amp;nbsp; &amp;nbsp;temporada baja.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;k) Por prestar servicio con un vehículo que no haya superado la Inspección ITV.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;l) Por prestar servicio con un vehículo que no haya superado la revisión obligatoria ordinaria o aquellas revisiones extraordinarias exigidas por el Ayuntamiento de &amp;nbsp;&amp;nbsp; &amp;nbsp;Capdepera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;m) Por pérdida o retirada, por cualquier causa legal tanto penal como administrativa, de&amp;nbsp;la autorización de transporte interurbano.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;TÍTULO III. CONDICIONES DE LA PRESTACIÓN DEL SERVICIO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 14. Explotación de la licencia&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los titulares de una licencia de autotaxi deberán explotarla personalmente o conjuntamente mediante la contratación de conductores asalariados, los cuales deberán disponer del permiso municipal expedido por este Ayuntamiento y estar afiliados a la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cuando no pueda cumplirse esta obligación procederá la transmisión de la licencia conforme a lo dispuesto en esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para autorizar la conducción del vehículo adscrito a la licencia se establecerá lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. De día 1 de abril al 31 de octubre, un máximo de dos conductores, incluido el titular de la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Del 1 de noviembre al 31 de marzo, el titular de la licencia. En el supuesto que la no-prestación del servicio sea por causa mayor, el titular de la licencia podrá solicitar una autorización, previamente justificada, para que el servicio de autotaxi pueda ser prestado por otro titular; ésta no podrá exceder de un máximo de 2 meses improrrogables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 15. Prestación de los servicios&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los titulares de una licencia municipal de autotaxi empezarán a prestar el servicio en un plazo máximo de 60 días naturales, que se aplicarán a partir de la fecha de la concesión, y con un vehículo vinculado a esta licencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En caso de no poderse cumplir dicha obligación, el titular deberá justificar ante esta Alcaldía los motivos de incumplimiento y solicitar una prórroga por escrito para la concesión de un segundo plazo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el supuesto de que alguno de los vehículos autorizados para prestar este servicio de autotaxi al Ayuntamiento de Capdepera sufriera una avería o accidente que impidiera la realización del servicio con este vehículo podrá realizarse el cambio, por un tiempo máximo de 6 meses, por un vehículo de alquiler debidamente autorizado a prestarlo (por la Consellería de Movilidad de las Islas Baleares).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los titulares de las licencias deberán presentar el vehículo en orden. Se considerará que lo prestan bajo esta condición cuando:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El vehículo lleve la dotación exigida por el Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Esté claramente identificado con los distintivos obligatorios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Cumpla con una limpieza exhaustiva de su interior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estos titulares en todo momento deberán contar en el vehículo con la siguiente documentación:&amp;nbsp;&amp;nbsp; &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Licencia otorgada por el Ayuntamiento de Capdepera y permiso &amp;nbsp;municipal del&amp;nbsp;conductor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La tarjeta de VT, si presta servicio interurbano.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La documentación relativa al vehículo y a su conductor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. La presente Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Guía del Ayuntamiento de Capdepera y plano de las carreteras de la isla de Mallorca (preferiblemente actualizada) o aparatos electrónicos tipos GPS.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Libro de reclamaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El titular o conductor asalariado deberán exhibir ante los agentes de la autoridad, cuando así se les requiera, los documentos mencionados en el apartado anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los conductores y asalariados de la licencia de autotaxi deberán ir debidamente vestidos y con la uniformidad reglamentaria que la administración considere.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En los meses de verano: polo con el escudo del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En invierno: jersey y sudadera con el escudo del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 16. Condiciones de la prestación de los servicios&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ayuntamiento de Capdepera dispondrá de puntos habilitados como zonas de estacionamiento de vehículos taxi del municipio. En ellas SIEMPRE deberá existir un mínimo del 50% de las plazas cubiertas. Todas las paradas tendrán los mismos derechos y obligaciones. Los puntos habilitados serán los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- En Capdepera: 2 taxis para los miércoles de mercado en la plaza Constitución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- A Cala Rajada: 32/34 taxis en la plaza de los Pinos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Y en temporada estival (del 1 de abril al 31 de octubre) se incluirán 3 puntos más obligatorios de estacionamiento:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Font de Su Cala: 2 Taxis.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Cala Mesquida: 2 Taxis.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Canyamel: 2 Taxis.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para establecer los turnos rotatorios de prestación del servicio en los estacionamientos de Font desa Cala, Cala Mesquida y Canyamel durante la temporada estival se realizará un sorteo durante el mes de enero de cada año. El resultado del mismo se comunicará a los taxistas mediante un acuerdo de la Junta de Gobierno Local.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se contratará el servicio de autotaxi a través de estos dos sistemas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Llamando a la centralita del servicio de Taxis del Ayuntamiento de Capdepera: 971. 82.69.69.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) A través de las zonas habilitadas para estacionamiento de autotaxis. Con este fin los vehículos deberán permanecer apagados, procurando el ahorro de consumo de energía, evitando el cansancio del conductor, impidiendo riesgos de accidentes y procurando la máxima fluidez del tráfico a las vías públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los vehículos que lleguen a las zonas de estacionamiento deberán colocarse por orden de llegada y recoger al pasajero por este mismo orden.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Quedará prohibido abandonar el vehículo en la zona de estacionamiento, si no es posible mantener un contacto visual con el mismo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Quedará prohibida la recogida de pasajeros a menos de 50 m de cualquiera de las zonas habilitadas para el estacionamiento de taxis en la cual ya existan otros vehículos a la espera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si un conductor o titular llegara con una carrera contratada con anterioridad vendrá obligado a avisar a los demás usuarios mediante un plànning en papel situado en la parada principal (plaza dels Pins – Cala Rajada), indicando la hora prevista de salida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los conductores solicitados para realizar un servicio, personalmente o por teléfono, no podrán negarse a realizarlo, salvo causa justificada. Se entenderá por causa justificada:&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.- Ser requerido por individuos perseguidos por agentes de la autoridad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.- Ser solicitados para transportar a un mayor número de personas del permitido por la capacidad del vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.- Cuando cualquiera de los pasajeros esté bajo los efectos del alcohol o estupefacientes. En casos de peligro grave o inminente para la vida o integridad física del viajero se avisará inmediatamente a la Policía o al Centro Médico más próximo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4.- Cuando por la forma de vestir de los viajeros o por la naturaleza y carácter de los paquetes, equipajes o animales que puedan llevarse éstos sean capaces de deteriorar o causar desperfectos en el interior de los vehículos. En este caso los conductores siempre deberán tener un correcto comportamiento con el público, y si fueran requeridos por el usuario, justificar su negativa ante un agente de la autoridad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.- Cuando un establecimiento hotelero no cumpla con las obligaciones de llamar a Taxis de Capdepera: el 971.82.69.69&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6.- Si durante el trayecto solicitado por el cliente se llegara a una calle, carretera o camino cuyas características lo hicieran intransitable, el conductor podrá negarse a continuar conduciendo por este, buscando otro alternativo para llegar al destino. De no existir otro alternativo se daría por finalizada la carrera y se realizaría el cobro del trayecto solo hasta el punto donde en aquel momento se encontraran.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Un conductor de taxi, si fuera requerido para realizar un servicio para invidentes y/o minusválidos, no podrá negarse a realizarlo por el hecho de ir acompañados de perro guía o silla de ruedas, y en ningún caso podrá cobrarse un extra por su transportarlos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Quedará totalmente prohibido para los conductores exigir o pedir mayor remuneración de la estipulada en la tarifa, directamente o indirecta, y bajo cualquier pretexto. Asimismo, también quedará totalmente prohibido pagar “comisiones” a establecimientos para llamar a un servicio público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 17. Obligaciones de los taxistas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los conductores en todo momento deberán:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Abrir y cerrar los cristales del vehículo si el usuario se lo indicara.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Ayudar a subir o bajar del vehículo a personas mayores, enfermos, minusválidos, embarazadas o niños.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Recoger y colocar de forma correcta las maletas, equipaje u otras pertenencias del usuario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Encender la luz interior del vehículo en horas nocturnas para facilitar la visión de los usuarios al subir y bajar del vehículo y cuando efectúen el pago.&amp;nbsp;&amp;nbsp; &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Bajar el volumen de la emisora o desconectarla a voluntad del usuario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Durante el servicio, los conductores no podrán proferir ofensas verbales o entrar en ningún tipo de discusión con otros conductores, pasajeros ni público en general.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Los conductores deberán examinar el vehículo antes de alejarse los viajeros que lo hayan utilizado, a fin de comprobar si han olvidado o perdido algún objeto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Todos los objetos encontrados y no reclamados en el cabo de 48 horas de ser encontrados serán entregados automáticamente a las dependencias de la Policía Local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. Los conductores deberán respetar y admitir indistintamente el uso de las lenguas catalana y castellana por parte de los clientes. Será imprescindible disponer del conocimiento de ambas para poder atender las indicaciones necesarias para el desempeño del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. Las personas afectadas por dolencias contagiosas deberán ser transportadas en ambulancia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cuando el conductor del taxi sea requerido para trasladar una persona con dolencia de este tipo deberá rechazar de forma cortés y aconsejar el uso de un transporte sanitario. Si una vez realizado el servicio este conductor observara que el usuario padecía una dolencia infecto-contagiosa vendrá obligado a comunicarlo de forma inexcusable ante las autoridades sanitarias, quienes ordenarán de forma inmediata la desinfección del vehículo, y este no podrá volver a prestar servicio hasta que haya finalizado esta desinfección.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. Durante la prestación del servicio los conductores deberán portar los siguientes documentos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Referentes al vehículo: licencia, póliza de seguro y recibo en vigor, permiso de circulación del vehículo, placa con el número de licencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Referentes al conductor: carnet de conducir correspondiente y permiso municipal de conductor de taxis.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;11. El conductor del vehículo vendrá obligado a proporcionar cambio de moneda al cliente de hasta 100€. Si tuviera que abandonar el vehículo para obtener cambio por una cuantía superior, detendrá el taxímetro. Si fuera un cliente quién tuviera que abandonar &amp;nbsp;&amp;nbsp; &amp;nbsp;el vehículo para obtener cambio, el taxímetro podrá continuar en funcionamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;12. No se podrá fumar dentro del vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;13. Los titulares de las licencias deberán hacerse cargo de todos los gastos (mantenimiento, reparaciones, etc) derivados de la emisora municipal y líneas de teléfono.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 18. Jornada&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los mismos titulares de las licencias serán quienes determinen los días de descanso mínimo asignados a los vehículos vinculados a las licencias otorgadas por este Ayuntamiento. Este descanso, si procede, afecta al titular de la licencia, a su asalariado y colaborador familiar.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las vacaciones anuales de los titulares de licencias serán planificadas conforme a la propuesta que eleven los órganos de representación de los taxistas. En esta propuesta deberá tenerse presente en todo momento que todos los servicios queden suficientemente atendidos. La propuesta de vacaciones se entregará con suficiente antelación al Ayuntamiento de Capdepera, para que pueda tener constancia de los servicios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los titulares que dispongan de conductores asalariados y/o familiares colaboradores durante la temporada estival deberán comunicar el alta y baja correspondiente ante el Ayuntamiento de Capdepera. Asimismo, deberán facilitar los horarios de jornada laboral de tales conductores especificando los días de descanso marcados por la Ley, debiendo elaborar un calendario laboral de la temporada en el que se indiquen los días en que no conducirán el vehículo, hora de inicio y finalización de la jornada laboral a fin de controlar el descanso de los conductores, necesario para no poner en peligro a los usuarios del servicio ni a los ciudadanos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;TÍTULO V. VEHÍCULOS Y TARIFAS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 19&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La capacidad del vehículo será de un máximo de 7 plazas, incluida la del conductor. Los vehículos de 7 plazas deberán tener capacidad en el maletero para el equipaje de todas las plazas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por cada 10 taxis podrá haber 1 especializado en transporte especial de personas minusválidas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 20&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La carrocería de los vehículos prestadores del servicio de autotaxi en el Ayuntamiento de Capdepera será de color blanco y llevar una franja de color verde esperanza en cada puerta delantera, de 10 cm de ancho. Se colocará desde la finalización de los cristales del conductor y el copiloto hasta la finalización de la puerta en posición vertical; deberá incluir además el número de licencia de autotaxi, de color blanco, y los números tendrán las medidas de 5 cm de alto por 5 cm de ancho. Asimismo, se incluirá el escudo del Ayuntamiento de Capdepera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En la parte posterior del vehículo se llevará un distintivo horizontal de 20 cm de largo por 5 cm de ancho, del mismo fondo verde que las franjas delanteras, con el escudo del Ayuntamiento del Ayuntamiento de Capdepera y el número de licencia visible en color blanco.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 21. Requisitos de los vehículos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los vehículos que presten el servicio de autotaxi deberán ser de marcas y modelos homologados, en cumplimiento de los requisitos exigidos por la normativa correspondiente, que en cualquier serán los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La carrocería deberá ser cerrada, con puertas de fácil acceso y funcionamiento que faciliten la maniobra con suavidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. De las dimensiones mínimas. Las características del interior del vehículo y asientos será la adecuada para proporcionar al usuario la seguridad y comodidad&amp;nbsp;suficientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Tanto las puertas delanteras como las posteriores deberán disponer de ventanas que garanticen la visibilidad, luminosidad y ventilación suficientes; de un material transparente y laminado (si se lleva un vidrio tintado o semitintado siempre será homologado). Deberán incluir mecanismos para accionarlos a voluntad de los&amp;nbsp;particulares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Deberán llevar instalada una iluminación eléctrica interna suficiente para la visión &amp;nbsp;de documentos y monedas.&amp;nbsp;&amp;nbsp; &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Podrán equiparse mamparas de seguridad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Deberán disponer de herramientas propias para la reparación de averías frecuentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Deberán llevar en un lugar visible para el usuario las tarifas vigentes y suplementos aplicables a cada kilometraje.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. Deberán llevar en un lugar visible en el interior del vehículo el permiso municipal de&amp;nbsp;conductor, la licencia otorgada, número de plazas autorizadas y un cartel indicativo de disponer de hojas de reclamación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 22. Publicidad en los vehículos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los vehículos de autotaxi podrán llevar incorporada publicidad en la puerta posterior, siempre que se cumplan los siguientes puntos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Que exista acuerdo de unanimidad entre los titulares de las licencias para llevar esta publicidad en los vehículos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Que la publicidad expuesta no sea de tipo sexual u otro tipo que pueda resultar ofensiva por religión, sexo, racismo...&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) La publicidad expuesta no podrá superar las dimensiones de 50 x 50 cm.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 23. Tarifas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se pactarán las tarifas mínimas con el Ayuntamiento para las salidas dentro del municipio.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 24. Taxímetros&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Será obligatorio incorporar el aparato contador taxímetro de la tarifa interurbana máxima autorizada cuando ello sea exigido por el Ayuntamiento que otorga la licencia municipal para la tarifa urbana.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El taxímetro deberá recoger la tarifa interurbana kilométrica vigente en cada momento por kilómetro recorrido, completando el precio final con el importe total de ida y vuelta y, si procede, con los suplementos autorizados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La tarifa correspondiente a la prestación del servicio se identificará en el módulo indicador externo, de modo que sea visible desde el exterior del vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4.1. Se situará el taxímetro en la parte delantera del interior del vehículo, de modo que en todo momento sea visible para el viajero la clase de tarifa que se le está aplicando e importe del servicio. En todo caso, el taxímetro deberá permitir la aplicación de 3 tarifas, la tercera de las cuales corresponderá al recorrido interurbano.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4.2. El módulo indicador se situará en la parte delantera del techo del vehículo, y estará destinado a indicar en el exterior del vehículo la tarifa que indique el taxímetro y su situación de “libre”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El taxímetro tendrá las siguientes características mínimas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Señalar en todo momento la tarifa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Estar debidamente precintado por el órgano de la Administración competente en materia de inspección de vehículos. Se precintará el taxímetro cada vez que se autorice &amp;nbsp;&amp;nbsp; &amp;nbsp;la aplicación de nuevas tarifas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Estar homologado por la autoridad competente y cumplir con los requisitos previstos&amp;nbsp;por el Real Decreto 1596/1982, de 18 de junio, por el cual se aprueba el Reglamento&amp;nbsp;para la aprobación de los contadores taquicronométricos denominados “taxímetro”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) Incluir una impresora homologada para facilitar el recibo correspondiente en los&amp;nbsp;usuarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. El órgano competente para realizar la inspección técnica de vehículos comprobará previamente que el vehículo esté adscrito a una autorización de la clase VT.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;TÍTULO VI. ACTUACIÓN INSPECTORA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 25. Revisiones e inspecciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ayuntamiento de Capdepera limitará su intervención en la revisión del taxímetro a la comprobación de los siguientes extremos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El buen estado de los precintos oficiales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Si el diámetro de las cubiertas es el indicado en la última verificación oficial que consta en la libreta o tarjeta que acompaña el aparato.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Si la funda protectora del cable de accionamiento cumple con lo prescrito anteriormente en esta Ordenanza; además el precinto no podrá estar roto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Si la caja del aparato presenta agujeros, golpes o señales de violencia y si hay roturas de luna.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Denunciar ante la Dirección General de Industria y Energía de la CAIB las sospechas que los agentes municipales puedan tener sobre posible fraude motivado por mal funcionamiento de los aparatos taxímetro.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 26&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Independientemente de la Inspección técnica periódica o de aquellas inspecciones que se efectúen por otro motivo, el Ayuntamiento de Capdepera podrá requerir al titular del vehículo que Industria practique una inspección técnica, siempre que se tenga sospecha fundada de que no se reúne alguna de las condiciones técnicas exigidas para permitir la circulación y que se ponga en peligro la seguridad vial. En estos casos, la inspección se limitará al elemento o al conjunto supuestamente defectuoso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 27&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Independientemente de las inspecciones técnicas a superar los vehículos y correspondientes taxímetros ante los servicios de Industria de la CAIB, todos los vehículos aplicados a las licencias otorgadas por este Ayuntamiento serán objeto de una revisión anual en las dependencias de la Policía Local de Capdepera, en la cual se comprobará el cumplimiento de las prescripciones de esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 28&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En este acto de revisión, ya sea ordinaria o extraordinaria, los titulares de las licencias acudirán personalmente y deberán portar los siguientes documentos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Carnet de conducir del titular y, si cabe, del familiar colaborador y/o asalariado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Licencia municipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Permiso de circulación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Tarjeta de inspección técnica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Certificado del seguro obligatorio de automóviles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Justificante de pago del impuesto municipal de circulación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Justificante de los 6 últimos meses de cotizaciones a la Seguridad Social del titular de &amp;nbsp;&amp;nbsp; &amp;nbsp;la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. Guía del municipio de Capdepera y plano de la isla de Mallorca (podrá ser en formato &amp;nbsp;&amp;nbsp; &amp;nbsp;digitalizado).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. Un ejemplar de la presente Ordenanza (podrá ser en formato digitalizado).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. Talonario de recibos y libro de reclamaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 29&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una vez consultados los servicios técnicos municipales, la Alcaldía podrá ordenar en cualquier momento la adopción de las medidas correctoras apropiadas para enmendar las deficiencias apreciadas en cuanto a las condiciones de seguridad, higiénico-sanitarias o estructurales de los vehículos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 30&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cuando se considere que las deficiencias citadas en el artículo anterior sean de tal magnitud que el hecho de usar el vehículo puede afectar a la seguridad del transporte, condiciones higiénico-sanitarias o imagen del servicio, podrá disponerse la inmovilización, siempre previa audiencia del interesado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dicha medida implicará el depósito de los vehículos inmovilizados de forma inmediata en el garaje del titular, taller de reparaciones o dependencias municipales, donde permanecerán mientras no sean subsanadas las deficiencias y así lo establezca el nuevo informe emitido por los Servicios Técnicos Municipales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 31&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si durante las revisiones se detectaran anomalías en los vehículos y/o en la documentación &amp;nbsp;podrá ordenarse la inmovilización del vehículo en la forma prevista en el artículo anterior e intervenir la documentación a efectos de revisión, todo ello debiendo constar en acta. Se levantará la inmovilización del vehículo y se devolverá a documentación una vez subsanadas las anomalías y/o efectuadas las comprobaciones pertinentes, salvo que de la revisión resulte procedente la adopción de medidas correctoras o sancionadoras.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 32&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La adopción de medidas correctoras y cautelares será compatible con la apertura de expedientes sancionadores, y podrán mantenerse mientras no exista resolución firme.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Corresponderá a la Alcaldía la imposición de las medidas cautelares, así como ordenar su levantamiento. Ello no podrá realizarse mientras los servicios técnicos y/o administrativos no hayan comprobado que hayan desaparecido las causas que las motivaron.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los agentes de la Policía Local de Capdepera ejercerán las tareas de inspección de transporte público de viajeros y sus servicios complementarios regulados por esta Ordenanza y serán los encargados de vigilar su cumplimiento, actuando bajo la dirección y responsabilidad del jefe del Servicio de Inspección.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 33&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El jefe del Servicio de inspección será el jefe de la Policía Local o, en su defecto, la persona delegada por el Ayuntamiento de Capdepera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La función inspectora podrá ser ejercida de oficio o como consecuencia de petición fundada de: los usuarios, asociaciones, titulares de licencias, asociaciones profesionales de trabajadores y empresarios, y los agentes que desempeñen esta función estarán facultados para notificar las infracciones cometidas contra esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;TÍTULO VII. INFRACCIONES Y SANCIONES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 34. Infracciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Será constitutivo de infracciones leves:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. No disponer de la documentación exigida en lo referente al vehículo y su conductor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. No proporcionar cambio al cliente con la cantidad exigida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La prestación del servicio sin la corrección y normas básicas de educación social, faltando al respecto del viajero.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Asimismo, la falta de higiene personal y/o vestir indumentaria inadecuada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. La falta de limpieza del vehículo, tanto interior como del maletero.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Fumar dentro del vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. No depositar ante las dependencias municipales dentro del plazo correspondiente&amp;nbsp;aquellos objetos olvidados por los viajeros dentro de su vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Negarse a prestar el servicio solicitado personalmente o telefónicamente sin causa justificada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. No llevar los distintivos obligatorios en los vehículos o llevarlos deteriorados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. No llevar las tarifas exhibidas en el interior del vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. Utilizar el aparcamiento de taxis fuera de horas de servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;11. Ofrecer mala imagen mientras se esté en la parada a la espera para realizar algún&amp;nbsp;servicio (estar totalmente tumbado con los pies elevados sobre el cuadro de mando o&amp;nbsp;sacando los pies por la ventanilla, durmiendo dentro del vehículo...).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Será constitutivo de infracciones graves:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Seguir el trayecto más largo para llegar al destino marcado por el viajero, salvo que el usuario manifieste el contrario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. No respetar el calendario laboral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Incumplir con la tarifa.&amp;nbsp;&amp;nbsp; &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Prestar el servicio sin disponer de los seguros obligatorios.&amp;nbsp;&amp;nbsp; &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Reincidir en una infracción leve, dentro del mismo año.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Comisionar o gratificar económicamente a establecimientos para que llamen de manera privada al conductor o titular de un autotaxi para realizar algún servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Cobrar más de lo estipulado cuando se transporten sillas de ruedas, por asiento u otras&amp;nbsp;causas ajenas al usuario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. No disponer del libro de reclamaciones, negar u obstaculizar su uso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. Recoger pasajeros fuera del término municipal de Capdepera, excepto posibles acuerdos con otros municipios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. No responsabilizarse de la prestación de un servicio quien haya atendido una llamada, sin causa justificada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;11. No admitir el número de pasajeros autorizados para el vehículo, o admitir uno superior. &amp;nbsp;&amp;nbsp; &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;12. No presentar el vehículo a la inspección obligatoria anual cuando sea requerido para&amp;nbsp;ello.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;13. No respetar el turno en la parada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;14. No aceptar que el usuario haga uso de cualquiera de las dos lenguas oficiales de la&amp;nbsp;CAIB -catalana o castellana-, u ofrecer un mal servicio alegando que no se conoce la lengua&amp;nbsp;el pasajero.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;15. Hacer caso omiso de hecho o de palabra de los agentes de la policía local encargados de la vigilancia sobre las normas contenidas en la presente Ordenanza y en el Código de Circulación. &amp;nbsp;&amp;nbsp; &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;16. Haber transcurrido más de 48 horas desde que se inició o extinguió la relación&amp;nbsp;laboral del trabajador asalariado o del autónomo colaborador de la licencia sin que el titular haya comunicado el alta o baja al Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;17. Presentar deficiencias en el estado de la carrocería del vehículo, cierre de puertas o limpieza interior y exterior del vehículo, siempre que con anterioridad se haya dado cumplimiento al procedimiento establecido en esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;18. Prestar el servicio con la ITV caducada y/o sin haber superado la revisión municipal anual obligatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;19. Proferir palabras, o gestos groseros o de amenaza en el trato con los usuarios, peatones o conductores de otros vehículos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;20. Usar la emisora municipal para finalidades diferentes a las estrictamente&amp;nbsp;profesionales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se considerará infracción muy grave:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Cometer 4 faltas graves en el mismo periodo de un año.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Prestar el servicio sin estar dado de alta y sin afiliación profesional en el régimen de Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. No dar cuenta ante las autoridades par que desinfecten el vehículo si se hubiera&amp;nbsp;transportado a una persona con dolencia infecto-contagiosa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Falsificar el título habilitado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Cometer delitos, calificados por el Código Penal como dolosos, en ocasión o motivo de la profesión.&amp;nbsp;&amp;nbsp; &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Abandonar un viajero sin cumplir el servicio por el cual había sido requerido, sin&amp;nbsp;causa justificada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Conducir el vehículo en estado de embriaguez o bajo los efectos de drogas tóxicas u&amp;nbsp;otras sustancias que produzcan efectos análogos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. Retener cualquier objeto abandonado en el vehículo sin haberlo comunicado a la&amp;nbsp;autoridad competente dentro del plazo de 72 horas siguientes al hallazgo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. Desobedecer de forma manifiesta las órdenes de esta Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. Manipular o falsear el taxímetro de forma intencionada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;11. Prestar los servicios en casos de suspensión, intervención o revocación de la licencia&amp;nbsp;o autorización del conductor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;12. Negociar con los clientes o agencias los precios estipulados en las tarifas (tanto urbanas como interurbanas).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;13. Al llegar a la parada, no avisar de que se tiene contratada una carrera con anterioridad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 35. Cuantía y tipo de sanciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Previa ponderación del daño producido, la cuantía de las sanciones respetando las limitaciones siguientes será:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Sanciones leves: se sancionarán con multas de hasta 3.000€, debiendo permanecer el vehículo 2 días sin realizar el servicio (anulando el servicio de radiotaxi e inmovilizado en su domicilio habitual).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Sanciones graves: se sancionarán con multas de 3.001€ a 6.000€, debiendo el vehículo permanecer 2 semanas sin realizar el servicio (anulando el servicio de radiotaxi e inmovilizado en su domicilio habitual).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Sanciones muy graves: se sancionarán con multas de 6.001€ a 12.000€, debiendo el vehículo permanecer sin poder realizar los servicios duarnte un mes (anulando el servicio de radiotaxi e inmovilizado en su domicilio habitual).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cuando se dé el caso de cualquier conductor haber tenido más de 2 sanciones muy graves se estudiará el caso para que la sanción a imponer sea directamente la retirada de la licencia municipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Asimismo, también podrán ser sancionados aquellos establecimientos que hagan un mal uso del servicio, y se impondrán las siguientes multas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.ª Infracción: Advertencia (solo una).&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.ª Infracción: Multa hasta 750 €.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.ª Infracción y posteriores: Multa hasta 1.500 €.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 36. Procedimiento sancionador&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- El procedimiento sancionador se iniciará de oficio o a instancia de parte, conforme a lo dispuesto por la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y por el Reglamento del procedimiento para el ejercicio de la potestad sancionadora, aprobado por el Real Decreto 1389/1993.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Por denuncias de personas interesadas. Toda denuncia deberá incluir una explicación de los hechos, lugar, fecha y hora donde hayan sido cometidos; matrícula del vehículo que intervino, destino e identificación del denunciante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ayuntamiento de Capdepera ejercitará la acción penal oportuna o comunicará los hechos ante el Ministerio Fiscal, cuando ello pudiera ser constitutivo de delito o falta penal.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La incoación del procedimiento penal dejará en suspenso la tramitación del procedimiento administrativo hasta que la Administración citada se haya pronunciado. Sin embargo, &amp;nbsp;podrán adoptarse las medidas cautelares urgentes que aseguren la conservación del bien y el restablecimiento a su anterior estado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;DISPOSICIÓN TRANSITORIA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Todos los titulares de licencias dispondrán de un plazo de 5 meses desde la entrada en vigor de la presente Ordenanza para adaptarse a las condiciones que establecidas en la misma, con independencia de la fecha de otorgamiento de la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;DISPOSICIÓN DEROGATORIA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Quedará derogado expresamente el Reglamento municipal del servicio público de viajeros en automóviles de Turismo (publicado en el BOIB nº 84, de 12.06.2012).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. También quedará derogada cualquier otra disposición de igual o inferior rango que se oponga a esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;DISPOSICIONES FINALES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. En todo lo dispuesto por la presente Ordenanza se estará a la Ley de Bases de Régimen Local y normativa complementaria, así como a las disposiciones generales, autonómicas o locales aplicables en la materia regulada en el presente reglamento municipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Conforme al artículo 70.2 de la Ley 7/1985, de 2 de abril, el presente reglamento entrará en vigor una vez aprobado definitivamente por la corporación, a partir de la fecha de publicación del texto íntegro en el BOIB, y transcurrido el plazo previsto en el artículo 65.2 de la mencionada ley.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
