![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Con la promulgación del Real Decreto 463/2020, de 14 de marzo, de declaración del primer estado de alarma en España y por el Real Decreto 926/2020, de 25 de octubre, del segundo estado de alarma ahora en vigor hasta el mes de mayo de 2021, así como las posteriores normas dictadas, tanto por el Gobierno central como por el Govern Balear, para dictar medidas temporales y excepcionales por razones de salud pública para contención de la crisis sanitaria, se inició una difícil situación que aún se mantiene. </span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La crisis sanitaria de la COVID 19 ha dado como resultado una crisis también económica, y en consecuencia, social. El confinamiento y las medidas sanitarias que se han ido implantando han conseguido una mejora en la gestión sanitaria de la crisis, prioritaria para detener la pandemia con éxito, aunque el parón productivo ha sido una realidad para todos los sectores, afectando gravemente a la economía de las Baleares. </span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Afrontamos una situación complicada para nuestra comunidad, región donde más del 25% de la economía depende del sector turístico y más de 200.000 personas trabajan en empresas relacionadas con este sector. La situación de pandemia ha provocado que los países emisores de turistas cerraran sus fronteras no permitiendo la circulación de personas, y por tanto, la llegada de turismo en las Baleares.</span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Todo ello ha propiciado una crisis sin precedentes dentro de la economía mundial, y en concreto de las Islas Baleares, que no prevé una recuperación de sus niveles de economía y ocupación hasta la mitad de 2021.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Dentro de este escenario, es prioritario que el Govern, desde la Conselleria de Modelo Económico, Turismo y Trabajo, actúe facilitando herramientas para que, tanto las personas trabajadoras como las empresas, puedan activarse durante el segundo trimestre del año. Es por ello que esta convocatoria es excepcional, con el objetivo de facilitar la realización de cualquier evento.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las Islas Baleares se encuentran ante el reto de aprovechar esta crisis sanitaria, como una oportunidad para mejorar el modelo económico y turístico, teniendo como objetivo la sostenibilidad medioambiental, pero también la sostenibilidad económica y social, una oportunidad de mejora que ya planteábamos, antes de la crisis de la Covid-19, mediante los Objetivos de Desarrollo Sostenible de la Agenda 2030. Queremos mejorar el posicionamiento internacional de las Islas Baleares, por ello todas las acciones incorporadas al plan van ligadas a la sostenibilidad.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Agencia de Estrategia Turística de las Islas Baleares (en adelante AETIB), en virtud de lo establecido en el Decreto 18/2018, de 22 de junio, tiene entre sus finalidades la elaboración de la estrategia turística para la mejora del posicionamiento internacional de las Islas Baleares. Es por eso que uno de los objetivos de la AETIB es crear una oferta diferenciada que cree valor y que se dirija a segmentos específicos; además, las Islas Baleares disponen de activos turísticos que deben ser recuperados, valorados y potenciados.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El turismo ha sido una de las actividades más afectadas por la pandemia y el futuro de los destinos está en gran parte en manos de agentes externos y circunstancias que no se pueden controlar hoy en día.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white">La política turística de este gobierno es conseguir el equilibrio y la sostenibilidad de nuestro territorio. Los recursos culturales, naturales, patrimoniales pueden convertirse en productos turísticos rentables, sostenibles e innovadores.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El turismo constituye una herramienta esencial para el cambio y la reorientación de la sociedad actual hacia un mundo más resiliente y sostenible. La cantidad de recursos que son necesarios para el desarrollo de la actividad turística lo convierten en una actividad que requiere planificación exhaustiva y continuada, para poder contribuir de forma eficaz a la consecución de los ODS (Objetivos de Desarrollo Sostenible).</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La OMT define el turismo sostenible como aquél que se orienta a satisfacer las necesidades de los turistas actuales, generando ingresos y bienestar social en el destino, pero, a la vez, que se protege y mejora las oportunidades del futuro. Es decir, está enfocado hacia la gestión de todos los recursos, de forma que se satisfagan las necesidades económicas y sociales, y a la vez se respete la integridad cultural, los procesos ecológicos esenciales, la diversidad biológica y los sistemas de apoyo de la vida.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La voluntad de la AETIB es que la participación en esta convocatoria para la formalización de contratos privados de patrocinio con entidades privadas, esté sujeta a los principios de publicidad, transparencia, cooperación y eficiencia de la utilización de los recursos públicos. La participación en esta convocatoria supone la aceptación de los términos y condiciones establecidos, que se anexan a esta Resolución.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="line-height:115%"><span style="line-height:115%">A efectos de esta convocatoria, son “eventos estratégicos” aquellos que presentan unas características diferenciadoras por su notoriedad y repercusión mediática y que hacen que estén por delante de pequeños eventos y por debajo de los considerados eventos singulares con una elevadísima repercusión. Los <span style="background-color:white">considerados eventos estratégicos deberán tener una clara vocación de continuidad en el tiempo, es decir, que se realicen o se quieran realizar de forma periódica (anualmente). Quedan excluidos de esta definición los eventos que tengan una duración que se prolongue en el tiempo y sea superior a 10 días anuales, a excepción de aquéllos con consideración de ciclos culturales. </span></span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El planteamiento de los proyectos involucrados en el turismo desde un criterio de sostenibilidad requiere entender la actividad turística, no como un resultado de unas actuaciones concretas, sino como un modelo de gestión por procesos y procedimientos, impregnados de principio a fin por la esencia del respecto al entorno donde se desarrollan y a las personas que los impulsan.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Estos eventos deberán reportar un alto grado de satisfacción a las personas residentes y a los turistas, representando una experiencia significativa que los haga más conscientes de los problemas de la sostenibilidad y fomente en ellos unas prácticas turísticas sostenibles.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La convocatoria va dirigida a las entidades privadas (con ánimo de lucro o sin ánimo de lucro), con las cuales la AETIB realizará contratos de patrocinio privado de la actividad que desarrollan, y que, por su importancia y relevancia en cuanto al público que participa y su repercusión en los medios de comunicación, supondrán una gran repercusión/un buen retorno publicitario de nuestras marcas turísticas.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La tramitación de los expedientes se realizará de acuerdo con lo establecido en el Anexo A de esta resolución y lo establecido en la Instrucción 2/2018 del director gerente de la ATB (actual AETIB) por la cual se establece la regulación específica y tramitación de los expedientes de los contratos privados de patrocinio que formalice la ATB (actual AETIB) de 5 de abril de 2018, con la ratificación previa del consejo de dirección de la ATB (actual AETIB) de 5 de abril de 2018.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, con la aprobación del Consejo de Dirección de la AETIB de 3 de marzo de 2021 y la autorización previa del gasto para esta convocatoria, autorizada por Acuerdo del Consejo de Gobierno de 9 de abril de 2021, se aprueban anexos a esta resolución, los pliegos de condiciones generales de la convocatoria y los anexos que lo acompañan.</span></p>
<p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resuelvo</strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Primero</strong>.- Aprobar los pliegos de condiciones generales que han de regir la tramitación de los expedientes de contratación que se deriven de las solicitudes de patrocinios con entidades privadas para los proyectos que generen repercusión mediática para las marcas de las Islas Baleares y la Agencia de Estrategia Turística de las Islas Baleares (AETIB), -ANNEX A- y los anexos que la acompañan. </span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Segundo.</strong>- Ordenar la publicación en el BOIB de esta Resolución y de los anexos que la acompañan. </span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Esta resolución tendrá efectos desde el día siguiente a su publicación en el BOIB.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta resolución —que agota la vía administrativa— se puede interponer recurso potestativo de reposición ante el Presidente de la AETIB en el plazo de un mes a contar desde el día siguiente de su publicación en el BOIB, de acuerdo con lo que establecen el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares (BOIB n.º 44, de 3 de abril) y el artículo 123 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas (BOE n.º 236, de 2 de octubre).</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">También se puede interponer recurso contencioso-administrativo ante el juzgado de lo contencioso-administrativo, en el plazo de dos meses desde el día siguiente de la publicación en el BOIB, de acuerdo con lo que establece el artículo 46 de la Ley 29/1998, de 13 de julio, de la jurisdicción contencioso-administrativa.</span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">1. ÁMBITO OBJETIVO, TIPOLOGÍA Y NECESIDADES A SATISFACER</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">El objeto de esta convocatoria, pública y abierta, es ofrecer la posibilidad de formalizar contratos privados de patrocinio con entidades privadas que lleven a cabo eventos estratégicos en las Islas Baleares y que generen repercusión mediática y notoriedad para las marcas de Mallorca, Menorca, Ibiza, Formentera y/o Islas Baleares y la AETIB, mejorando la competitividad turística de las islas. Estos eventos se podrán desarrollar desde el 26 de abril de 2021 hasta el 31 de diciembre de 2021.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">La intención con el patrocinio de estos eventos es potenciar la estrategia turística de las Islas Baleares a través del impulso de los eventos que dinamizan la agenda de actividades en las islas o generan la captación de la demanda creando una oferta atrayente. Asimismo, es fundamental que esta estrategia esté vinculada directamente con los productos prioritarios que se potencian desde las Islas Baleares mediante los Segmentos Estratégicos Turísticos (SETs), por este motivo todos los eventos patrocinados por la AETIB deberán estar vinculados a uno de los productos estratégicos.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="line-height:115%"><span style="line-height:115%">Los patrocinios de eventos estratégicos son una plataforma muy útil y versátil que permite transmitir los valores inherentes a las marcas turísticas de Mallorca, Menorca, Ibiza, Formentera y/o Islas Baleares de forma dinámica, próxima y directo al público objetivo.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="line-height:115%"><span style="background-color:white"><span style="line-height:115%">A efectos de esta convocatoria, son “eventos estratégicos” aquéllos que presentan unas características diferenciadoras por su notoriedad y repercusión mediática y que hacen que estén por encima de pequeños eventos y por debajo de los considerados eventos singulares con una elevadísima repercusión. En el supuesto de que el evento se desarrolle en más de una isla, y cumpla con los porcentajes de inversión indicados al apartado 3, se considerará que se promociona, y por tanto, se vincula a la marca Islas Baleares.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">1.1 Requisitos de los eventos</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Se consideran eventos estratégicos susceptibles de obtener patrocinio, aquellos que cumplan todos los requisitos generales siguientes:</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">A) Los que se ajusten a la definición de evento estratégico, con voluntad de continuidad y con una duración inferior a 10 días anuales, a excepción de aquéllos con consideración de ciclos culturales. </span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">B) Que sean eventos cuyo promotor sea una empresa/entidad privada.</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">C) Que estén vinculados directamente a algunos de los productos estratégicos (SETs) de la AETIB.</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">D) Que fomenten la creación, diversificación y comercialización de algunos de los productos estratégicos de la AETIB.</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">E) Que incluyan el desarrollo de actuaciones vinculadas a los Objetivos de Desarrollo Sostenible (ODS).</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">F) Que el evento esté avalado por otras entidades públicas según se detalla en el apartado 6.2.</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">G) Que se desarrollen entre el 26 de abril de 2021 al 31 de diciembre de 2021.</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">H) El ámbito territorial de esta convocatoria se circunscribe a los eventos que se desarrollan de forma efectiva en el territorio de la Comunidad Autónoma de las Islas Baleares.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">I) Que el evento cumpla con los requisitos mínimos presupuestarios que se detallan a continuación:</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Quedan excluidos de esta convocatoria:</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1.- Eventos que no cumplan los requisitos mínimos y/o condiciones establecidas en esta convocatoria. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2.- Proyectos y acciones que no se puedan clasificar como un evento estratégico. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3.- Eventos de contenido político o religioso.</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">6.- Eventos que vayan en contra de la imagen que la AETIB quiere trasladar respecto de sus marcas y los destinos que las conforman. </span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">8.- Patrocinios a clubes deportivos, cuando éstos tengan la finalidad de patrocinar el equipo o equipos que formen parte del club. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">9.- Equipos deportivos.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">10.- Torneos y campeonatos deportivos que no tengan como objeto principal de la competición la categoría absoluta.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">11.- Torneos y campeonatos de los siguientes deportes: fútbol, baloncesto, fútbol americano, rugby, voleibol, waterpolo.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">12.- Las entidades u organismos públicos en general, y más concretamente los que pertenecen al Gobierno de las Islas Baleares, los Consells Insulars y Ayuntamientos.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">13.- Las entidades que no estén al corriente del pago de las obligaciones económicas contraídas con la AETIB, y/o al corriente de las obligaciones tributarias con la CAIB, con el Estado y con la Seguridad Social.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">14.- Las entidades que no hayan entregado la justificación en tiempo y forma, y por tanto, hayan incumplido con las obligaciones propias de los beneficiarios de subvenciones o patrocinios concedidos por la AETIB durante las dos últimas anualidades.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">15.- Los eventos que no hayan alcanzado la totalidad de la cuantía a justificar en alguna de las dos anualidades anteriores.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">16.- Eventos que ya hayan obtenido algún patrocinio/colaboración/subvención por parte de la AETIB para la misma edición.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">2. PRINCIPIOS GENERALES DE LA CONVOCATORIA</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Esta convocatoria pública se lleva a cabo sobre la base de los principios de publicidad, transparencia, concurrencia, objetividad y eficiencia para el desarrollo del objeto del proyecto/acción que mejore la competitividad turística de las Illes.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Esta convocatoria parte de la base que son los promotores del proyecto o la acción quienes asumen la organización y sus costes. Por ello, solicitan la aportación / colaboración para apoyar la celebración del proyecto/acción, ya que consideran que tiene repercusión turística y que la aportación pública mejora la rentabilidad, en concepto de imagen y notoriedad.</span></span></span></p>

PRESUPUESTO DE LA CONVOCATORIA</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">La presente convocatoria tiene un presupuesto máximo de </span></span><strong><span style="line-height:115%">1.000.000 €</span></strong><span style="line-height:115%"> (impuestos incluidos<span style="color:black">) financiados de la siguiente forma</span>:</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Un importe máximo de 1.000.000€ (impuestos incluidos) al Capítulo VI – Inversiones Reales del presupuesto de la AETIB para el ejercicio 2020-2021, vinculada al eje 7 del </span><em><span style="line-height:115%">Pacto para la reactivación de las islas y la diversificación económica y social de las Islas Baleares</span></em><span style="line-height:115%">. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En el caso de que la partida reservada sea insuficiente, ésta podrá ser ampliada, a criterio de la dirección, en función de la disponibilidad presupuestaria.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Asimismo, en el caso de que a fecha 1 de septiembre de 2021 no se haya agotado la totalidad de la disponibilidad presupuestaria, la AETIB podrá disponer de los remanentes, que serán destinados a otros proyectos según las necesidades, teniendo en cuenta la partida presupuestaria y capítulo al que fueron asignados. </span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Debido a las consecuencias derivadas de la pandemia de la COVID-19 en las Islas Baleares, y especialmente las económicas, que han supuesto una contracción del PIB del 23,7%, muchas empresas que organizan eventos se han visto profundamente afectadas por las restricciones establecidas y el incremento de los gastos para el correcto y seguro desarrollo de los eventos. Para impulsar y promover el crecimiento económico y dinamizar la oferta de las Islas Baleares, de forma excepcional, se han incrementado, tanto los porcentajes, como los importes máximos de patrocinio. Con esta medida se quiere dar apoyo a todos aquellos eventos que, dentro del año 2021, abren el camino hacia la recuperación del destino.</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">**Impuestos incluidos</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Las entidades privadas interesadas en participar en esta convocatoria podrán solicitar un patrocinio dentro de los límites establecidos en la tabla superior, de acuerdo con la isla/islas con la que se vincula el evento a desarrollar. El importe del patrocinio nunca podrá superar el 60% respecto del presupuesto indicado en la solicitud (impuestos incluidos) y tampoco podrá superar el máximo establecido por marca. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Excepcionalmente, y debido a la situación actual derivada de la Covid-19, este porcentaje se establece a un nivel muy elevado con el fin de apoyar lo máximo posible, desde las instituciones públicas, a la realización de eventos y la consecuente reactivación económica. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"> <strong><span style="color:black">3.1 Territorialización</span></strong></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Para cumplir con la territorialización entre islas, se dedicará un porcentaje mínimo a eventos por isla, de acuerdo con el siguiente cuadro:</span></span></span></p>

<p><span style="font-family:"Times New Roman",Times,serif">En caso de que el 31 de mayo de 2021 no se hayan agotado los presupuestos correspondientes a los porcentajes por islas, el importe sobrante se destinará a los eventos solicitantes al margen de esta territorialización. </span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">4. ÁMBITO SUBJETIVO</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Pueden ser beneficiarios de esta convocatoria pública las personas jurídicas privadas organizadoras de los eventos presentados que se ajusten al objeto y cumplan los requisitos de esta convocatoria.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En esta convocatoria una misma entidad puede presentar hasta 2 eventos por marca vinculada, pero nunca más de una empresa o entidad puede solicitar patrocinios para el mismo evento.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En el supuesto de que dos entidades diferentes soliciten el patrocinio para un mismo evento, sólo se valorará la primera de las propuestas presentadas, según el registro de entrada a la AETIB, mientras que la otra propuesta quedará excluida.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En el supuesto de entidades que gestionen diversos eventos, deben presentar una solicitud para cada uno de los eventos para los que soliciten el patrocinio, excepto si éstos conforman un programa único de varias actuaciones.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">5. PLAZO Y LUGAR DE PRESENTACIÓN DE LA DOCUMENTACIÓN</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">La convocatoria para la presentación de los eventos permanecerá abierta desde el día siguiente de la publicación de esta Resolución en el BOIB hasta agotar la dotación económica <strong>con plazo máximo hasta el 1 de octubre de 2021.</strong></span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El lugar de presentación será el registro de la AETIB (Edificio AETIB C/ Rita Levi s/n Parc-Bit 07121 Palma de Mallorca) o en los lugares previstos en el artículo 16 de la Ley 39/2015. En este último supuesto, se debe enviar el mismo día una copia de la solicitud en que conste el registro de entrada, y así justificar la fecha de envío de la solicitud dentro del plazo establecido. La dirección de envío es: juridico@aetib.caib.es<span style="color:black"> .</span> En caso de no recibir este justificante en la dirección descrita en tiempo y forma, el evento quedará excluido. No se aceptarán como entrada las solicitudes o documentación que hayan sido enviadas mediante correo electrónico a cualquiera de las direcciones de la AEITB. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Todos los eventos deberán presenta toda la documentación necesaria para su tramitación en el registro de entrada de la AETIB con un <strong>mínimo de 30 días naturales de antelación a la fecha de inicio del evento</strong>. En caso de incumplimiento del plazo, la solicitud quedará excluida, a excepción de:</span></span></span></p>

<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Los eventos que se desarrollan del 26 al 30 de abril, deberán presentar la solicitud con un mínimo de 10 días naturales de antelación a la fecha de inicio del evento. </span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Los eventos que se desarrollan del 1 al 15 de mayo, deberán presentar la solicitud con un mínimo de 16 días naturales de antelación a la fecha de inicio del evento. </span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Los eventos que se desarrollen a partir del 30 de octubre deberán presentar la solicitud antes del 1 de octubre, con el objetivo de poder disponer, si es el caso, del remanente de crédito reservado para esta convocatoria. </span></span></span></li>
</ul>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Los eventos presentados se valorarán por orden de entrada en el registro de la AETIB. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">6. </span>SOLICITUD Y FORMA DE PRESENTACIÓN DE LA DOCUMENTACIÓN</strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Los solicitantes deben utilizar los modelos que se adjuntan en estos pliegos y que se describen a continuación. Éstos podrán ser descargados por los interesados en la página web de la AETIB:</span></span></span></p>

Debe identificarse en el exterior de cada sobre la razón social, persona de contacto, número de teléfono, correo electrónico, marca a la que se vincula la solicitud y nombre del evento.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">6.1. Solicitud de patrocinio (ANEXO A1)</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Se realizará mediante solicitud dirigida a la presidencia de la AETIB siguiendo el modelo de <strong>ANEXO A1 </strong>Formulario de solicitud, contenido en estos pliegos, en el que se debe hacer constar lo siguiente:</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">La entrega de la solicitud por sí misma no será objeto de valoración, sino que servirá únicamente como documento formal de solicitud.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">6.2. </span>Documentación Administrativa (sobre 1): Documentación relacionada con la entidad solicitante</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">En el caso de personas físicas y jurídicas españolas:</span></strong></span></span></p>
<ul>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Fotocopia del certificado de inscripción en el registro correspondiente (registro de asociaciones, registro mercantil u otro dependiendo del tipo de entidad).</span></span></span></li>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En virtud del Decreto 6/2013, de 8 de febrero, de medidas de simplificación documental de los procedimientos administrativos, las entidades que hayan formado parte de un proceso selectivo en la AETIB pueden presentar el Anexo D que se adjunta en el que se debe indicar el número de expediente donde se encuentra la documentación administrativa, siempre que no haya sufrido ninguna modificación o la documentación presentada no haya agotado su vigencia. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El resto de documentación que a continuación se relaciona se debe presentar también en el sobre 1:</span></span></span></p>

<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"> Declaración responsable de no incurrir en las prohibiciones para contratar con la administración según el art.71 LCSP. </span></span></span></li>

<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Esta declaración responsable, u otro documento, debe incluir la manifestación expresa de que la empresa no incurre en ninguno de los supuestos al hecho que se refiere la Ley 2/1996, de 19 de noviembre, de incompatibilidades de los miembros del Gobierno y de los altos cargos de la CAIB.</span></span></span></p>
<ul>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Declaración responsable que acredite las razones técnicas o artísticas o los motivos por los que solo pueda encomendarse a un empresario determinado, para justificar la no competencia por razones técnicas de conformidad con lo establecido en el artículo 168.4.2 de la Ley 9/2017 de contratos del sector público. </span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Acreditación conforme se está al corriente de las obligaciones tributarias con la Administración autonómica, Estatal y la Seguridad Social, emitidas por los organismos competentes.</span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Declaración responsable conforme se está al corriente de los pagos con la AETIB, así como de la justificación de contratos de patrocinio con la AETIB anteriores. Esta declaración será comprobada de oficio por el área económica de la AETIB. En el caso en que se constatase la existencia de deudas pendientes o la incorrecta justificación sin renuncia expresa, se considerará motivo de exclusión de la participación en la convocatoria de patrocinio.</span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Declaración responsable en que se haga constar si ha recibido y/o solicitado ayudas o colaboraciones de instituciones públicas o privadas para realizar el proyecto/acción con el que podrá colaborar la AETIB y las cantidades económicas si se conocen.</span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Declaración responsable conforme la entidad no tiene ningún expediente sancionador abierto con la administración pública.</span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Acreditación conforme el evento esté avalado por corporaciones locales, insulares, autonómicas, nacionales o internacionales.</span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Documento acreditativo de estar en alta en el DRIAT (Declaración responsable de inicio de actividad turística), en el caso en el que la entidad esté obligada, en caso contrario se tendrá que aportar declaración responsable de este extremo.</span></span></span></li>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">En el caso de personas jurídicas no españolas con actividad en España:</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En el supuesto que la entidad pertenezca a un estado miembro de la UE, la capacidad jurídica de la empresa se acreditará mediante la presentación de constitución de la entidad de acuerdo con la normativa de su país, haciendo constar los estatutos de la misma y la acreditación correspondiente, así como fotocopia compulsada del CIF, ambos traducidos por intérprete jurado o traducción oficial y apostillada de acuerdo con el convenio de la Haya de 1961.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En el caso en el que la entidad pertenezca a un estado que no es miembro de la UE, la capacidad jurídica de la entidad se acreditará mediante la documentación relativa a la sucursal o filial de la entidad en España o en cualquier país perteneciente a la Unión europea, debidamente inscrita en el registro correspondiente y fotocopia compulsada del CIF. La documentación se debe presentar traducida por traductor jurado. De conformidad con el Reglamento (CE) nº1008/2008.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En cualquier de los dos casos anteriores, se tendrá que acreditar la capacidad de la persona que representa la entidad solicitando legalmente para actuar en nombre suyo, así como se tendrá que presentar una copia cotejada de su pasaporte/DNI/NIE, traducido por intérprete jurado o mediante una traducción oficial y apostillada de acuerdo con el convenio de la Haya de 1961.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Las empresas no españolas de estados miembros de la Unión Europea y los restantes empresarios extranjeros tendrán que acreditar la documentación que se detalla:</span></span></span></p>

En caso de que se tratara de un agente autorizado para actuar en nombre de la entidad no residente que opere mediante una oficina de representación, tendrá que aportar la correspondiente certificación acreditativa de estar al corriente de pago con la Administración del Estado, la autonómica y la Seguridad Social, emitida por el órgano competente.</span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Declaración responsable de que la entidad se encuentra al corriente de pagos con la AETIB, así como de la justificación de contratos de patrocinio formalizados en ejercicios anteriores con la AETIB. Esta declaración será comprobada de oficio por el área económica de la AETIB. En el supuesto de que se constatará la existencia de deudas pendientes se considerará motivo de exclusión de la participación en esta convocatoria de patrocinio.</span></span></span></li>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Atendiendo a la diversidad de eventos que se pueden patrocinar, la definición o la versión definitiva de los contenidos y el alcance de su publicación en los medios de la AETIB y del propio patrocinador, se fijarán una vez realizada la fase técnica (apartado 7.2) y previamente a la firma del contrato. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">7. </span></span><span style="background-color:white"><span style="line-height:115%">PROCEDIMIENTO ADMINISTRATIVO PARA LA FORMALIZACIÓN DE LOS PATROCINIOS PRIVADOS</span></span></strong></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="line-height:115%"><span style="line-height:115%">La tramitación administrativa para la formalización de los contratos de patrocinio se realizará de acuerdo con lo establecido en la Instrucción 2/2018 del director gerente de la ATB (actual AETIB) por la cual se establece la regulación específica y tramitación de los expedientes de los contratos privados de patrocinio que formalice ATB (actual AETIB) de 5 de abril de 2018, con la ratificación previa del consejo de dirección de ATB (actual AETIB) de 5 de abril de 2018.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En el supuesto de que la solicitud de patrocinio sea por un importe igual o inferior a los 14.999,99€ (impuestos excluidos), es decir, 18.149,98€ (impuestos incluidos) se procederá de acuerdo con lo establecido en el artículo 118 de LCSP y la Instrucción 1/2019, del director de la AETIB por la cual se establece la regulación específica y la tramitación de los expedientes de los contratos menores que formalice la AETIB.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En el supuesto de que la solicitud de patrocinio sea por un importe superior a los 18.149,98€ (impuestos incluidos), se procederá de acuerdo con lo que se establece en la Instrucción 2/2018 del director gerente de la ATB (actual AETIB) por la cual se establece la regulación específica y la tramitación de los expedientes de los contratos privados de patrocinio que formalice la ATB (actual AETIB).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="line-height:115%"><span style="background-color:white"><span style="line-height:115%">En este caso se tendrá que aportar por parte del solicitante una declaración responsable que acredite las razones técnicas o artísticas o los motivos por los cuales sólo pueda encomendarse a un empresario determinado.</span></span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">7.1 FASE ADMINISTRATIVA: revisión de la documentación administrativa</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Una vez finalizado el plazo de presentación de las propuestas, el área jurídica de la AETIB examinará la documentación administrativa correspondiente al sobre nº1, según el orden de registro de entrada en la AETIB de las solicitudes. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En el supuesto de que sea necesaria la enmienda de algún documento de carácter administrativo, la Dirección de la AETIB, requerirá a la entidad interesada, la documentación administrativa que falte, concediéndole un plazo de 3 días naturales para la presentación de la documentación requerida, con la advertencia expresa que, en caso de no hacerlo así, se la considerará desistida y se archivará su solicitud, según lo que dispone el artículo 68 de la Ley 39/2015.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El requerimiento de la documentación se realizará por medios electrónicos, de forma que quedará constancia en el expediente.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">7.2 </span>FASE TÉCNICA: revisión de la documentación técnica</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Una vez finalizada la revisión de la documentación administrativa, el órgano de contratación designará el área y el técnico encargado de la revisión de la propuesta técnica, para determinar el cumplimiento o no de los requisitos técnicos exigidos de acuerdo con lo que se establece en estos pliegos.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En el supuesto de que el importe solicitado sea superior a los 14.999,99 € (impuestos excluidos), es decir 18.149,98€ (impuestos incluidos), el área/técnico designado, tal como recoge la Instrucción 2/2018, realizará un pliego específico de patrocinio (pliego previo y pliego definitivo) en función del evento a patrocinar, en el cual deben quedar recogidas las contraprestaciones que se propone que reciba la AETIB en función del importe que se solicita.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En caso de que en la documentación técnica se detecten deficiencias (carencia de documentación a aportar), se requerirá para su enmienda, la cual se deberá realizar en el plazo de 3 días naturales. En el supuesto de que no se enmiende la documentación requerida por el área/técnico designado, la solicitud se excluirá del procedimiento de contratación. En ningún caso se podrá enmendar el contenido de la documentación entregada en la fase de solicitud y valoración.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El requerimiento de la documentación se realizará por medios electrónicos, de forma que quedará constancia en el expediente.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Seguidamente se procederá a la valoración del evento y de la solicitud. </span></span></span></span></p>

Esta valoración subjetiva se hará con relación a la documentación entregada por la entidad solicitante. Se valorarán, como máximo con 10 puntos, los siguientes conceptos:</span></span></span></span></p>

<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Una vez valorada la solicitud presentada, se convocará a la entidad solicitante para una reunión de negociación previa a la adjudicación y formalización del contrato, en la cual se tratarán las contraprestaciones propuestas que recibirá la AETIB, la repercusión mediática por la presencia de sus marcas y el importe que finalmente se propone para la adjudicación. En esta reunión participarán un representante de la dirección de la AETIB, el área/técnico designado, el área económica y el área jurídica de la AETIB. El área/técnico designado será el responsable de dejar constancia en el expediente de los acuerdos a los que han llegado, de tal forma que también consten en el pliego definitivo.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">7.3 ADJUDICACIÓN Y FORMALIZACIÓN DEL PATROCINIO</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">De acuerdo con lo establecido en las instrucciones internas mencionadas, el órgano de contratación realizará la adjudicación del contrato privado, y posterior formalización del contrato en el cual constarán las obligaciones de ambas partes, las contraprestaciones que recibirá la AETIB y la forma de justificar el patrocinio en función de las características del evento. En el contrato constará expresamente la cesión a la AETIB de las imágenes del evento para usos no comerciales. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Asimismo, en el supuesto de que la adjudicación fuera superior a 14.999,99 €, se tendrá que publicar en el portal de contratación de la AETIB.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Este contrato deberá firmarse en el plazo máximo de 15 días hábiles desde la adjudicación del contrato y siempre antes del inicio del evento. En caso contrario, la AETIB podrá resolver no llevarlo a cabo.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El patrocinado facilitará el seguimiento y control del contrato firmado y, concretamente, de la presencia de las marcas a la acción patrocinada. Por lo tanto, se debe reflejar la presencia de las marcas/logotipos de ambas entidades en todos los medios y materiales correspondientes a la organización de los diferentes actos y acciones previstas en el evento y que se establezcan en el contrato.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Las marcas de la AETIB podrán figurar, tanto en los elementos de promoción previa al evento, como en los de la promoción que se llevará a cabo durante el desarrollo del mismo, o bien en la repercusión posterior en los diferentes medios de comunicación. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">8. CONTRAPRESTACIÓN PARA LA AETIB</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">La AETIB y la entidad privada formalizarán un contrato de patrocinio privado en el que se regulará su presencia en todos los medios y materiales correspondientes a la organización de los diferentes actos y acciones previstas en el evento, como invitaciones, inserciones publicitarias, paneles u otros elementos promocionales confeccionados con motivo del evento presentado, en los que se citará el patrocinio de AETIB y se reflejarán sus respectivos logotipos corporativos y marcas promocionales.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">La entidad deberá especificar en la memoria que presente con la solicitud, cuáles serían las contraprestaciones/acciones en las que estarán presentes las marcas.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Asimismo, están obligados a invitar a la dirección de la AETIB a los actos de apertura y clausura, ruedas de prensa, presentaciones y similares. </span></span></span></p>
<p><span style="display:none"> </span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El uso de las marcas/logo de la AETIB se ajustará a lo que se establece en las <em>Directrices sobre el uso de las marcas </em>(ANEXO A8) que formarán parte del contrato. Si surgiese cualquier duda, se deberá contactar con el departamento de Imagen y Publicaciones de la AETIB <span style="color:null">(ip@aetib.caib.es).</span></span></span><span style="display:none"> </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Todas las creatividades deberán integrar las siguientes marcas/menciones:</span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- </span>Marca de destino</span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- </span>Los logotipos que determina la AETIB según toque (GOIB)</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Previa a la publicación del material gráfico/emisión del material audiovisual, se supervisará por parte del área de Imagen y Publicaciones de la AETIB la ubicación de las marcas/logotipos y los borradores de diseño, dando la conformidad. Por este motivo, se deberá entregar a la AETIB como mínimo con 5 días de antelación a la fecha prevista de publicación, para solicitar la conformidad. En caso de no remitir el material al área de Imagen y Publicaciones, será la entidad colaboradora quién asuma la responsabilidad del mismo.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En el supuesto de que la AETIB comunicara discrepancias respecto a la aplicación de sus marcas/logo, la entidad se compromete a realizar las actuaciones necesarias de alteración o rectificación de la presencia de marca.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En caso de no cumplir con las Directrices establecidas por parte de la AETIB, la acción publicitaria/promocional no se tendrá en cuenta a efectos de justificación, y por tanto, como repercusión mediática del evento. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">9. CRITERIOS DE VALORACIÓN</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">La valoración se puntuará como máximo con <strong>100 puntos</strong> y se realizará según los siguientes criterios:</span></span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Todos los cálculos se realizarán teniendo en cuenta como máximo dos decimales. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">10. </span>JUSTIFICACIÓN Y FORMA DE PAGO</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">La justificación técnica del evento deberá presentarse con anterioridad a la presentación de la factura. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La aportación de la AETIB se hará efectiva una vez finalizado el evento objeto del patrocinio y previa presentación por parte de la entidad privada de una memoria justificativa del evento realizado. </span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La entidad privada deberá acreditar, en cualquier caso, el cumplimiento de las condiciones relativas a la presencia de las marcas, económicas y de medición de resultados mediante:</span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Se debe adjuntar un dossier explicativo y justificativo que incluya: </span></span></span></span></p>

El material gráfico y audiovisual (preferiblemente en alta resolución) realizado durante el desarrollo del evento patrocinado.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d. Justificación del cumplimiento de las disposiciones del Decreto 49/2018, de 21 de diciembre, (apartado 11 de esta convocatoria). </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">e. Justificación de las contraprestaciones indicadas en los pliegos definitivos y/o en el contrato.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">f. Resumen de la repercusión mediática: <em>Clipping</em> con valor económico equivalente e inversión publicitaria en medios (impresos, audiovisuales y online) con el valor económico equivalente.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Respecto al apartado “f) Resumen de la repercusión mediática”, sólo se tendrán en cuenta las justificaciones publicadas/emitidas desde el 1 de enero de 2021 hasta la entrega de la documentación justificativa, siempre que vayan dirigidas a promocionar el evento patrocinado (edición 2021) y cumplan con las <em>Directrices sobre el uso de las marcas</em> de la AETIB para justificar la repercusión mediática para las marcas de destino de las Islas Baleares.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Los patrocinados deberán enumerar cada una de las acciones promocionales/publicitarias que se presenten. También deberán hacer corresponder la misma enumeración con la documentación acreditativa relativa al concepto indicado.</span></span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">10.1.1 La repercusión mediática se contabilizará de la siguiente forma: </span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">1. Soportes/medios dirigidos al público local de las Illes Balears: sólo se tendrá en cuenta el 25% del valor de tarifa oficial, impuestos no incluidos.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">2. Soportes/medios dirigidos al público local, nacional y/o internacional fuera de las Illes Balears: se tendrá en cuenta el 100% del valor de tarifa oficial, impuestos no incluidos.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">3. Web propia del evento/redes sociales/gestores de contenido: se tendrá en cuenta el 100 % de su valor, impuestos no incluidos.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">4. El importe a justificar en relación a la repercusión mediática total de las marcas de la AETIB se deberá justificar de la siguiente forma: </span></span></span></span></p>

<p><span style="color:black; font-family:"Times New Roman",Times,serif">El valor económico de la repercusión mediática del patrocinio debe ser igual o superior a la cantidad otorgada por la AETIB. Esta valoración se hará sobre el precio de tarifa oficial, impuestos no incluidos.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">5. Sólo se tendrán en cuenta las acciones </span>que cumplan con las <em>Directrices sobre el uso de las marcas de la AETIB</em><em> </em>(<strong>ANEXO A8</strong>).<em> </em><span style="color:black">En caso de no cumplir con las <em>Directrices</em> establecidas por parte de la AETIB, la acción publicitaria/promocional no se tendrá en cuenta a efectos de justificación, y por tanto, como repercusión mediática del evento. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">6. En el caso de que el evento haya recibido otros patrocinios y/o ayudas (convenios de colaboración, subvenciones, entre otros) para el evento, por parte de alguno de los Consells Insulars (Mallorca, Menorca, Ibiza y/o Formentera) o entidades en las que éste participe, el valor económico de la repercusión mediática del patrocinio debe ser igual o superior a la suma de la cantidad otorgada por la AETIB y el Consell Insular correspondiente. Por este motivo, el patrocinador deberá informar a la AETIB de las condiciones y el importe (impuestos incluidos) del patrocinio y/o ayudas firmados con la entidad pública insular.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">El valor económico de la repercusión mediática del patrocinio debe cumplir con los requisitos de justificación estipulados en este punto. </span></span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">10.1.2 En el caso de que el valor económico de la repercusión mediática sea inferior, la AETIB procederá a la aplicación de las siguientes penalidades: </span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">a) En el caso de que el valor económico de la repercusión </span>mediàtica (RMTIB)<span style="color:black"> sea inferior, únicamente se abonará la cantidad proporcional equivalente a lo justificado según el precio de tarifa oficial, más impuestos, y sin que se pueda superar el importe de adjudicación.</span></span> </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">10.2. RESPECTO AL ANEXO 4 “MEMORIA ACREDITATIVA DE LOS PUNTOS OBTENIDOS EN LA FASE TÉCNICA DE VALORACIÓN”</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Los criterios de valoración descritos en el <strong>ANEXO A2</strong>, que se deberán acreditar según se determina en el apartado 9.1 de estos pliegos y que corresponden a: </span></span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">- 9.1.1. Las características del evento.</span></span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">- 9.1.2 La alineación del evento con los objetivos del desarrollo sostenible (ODS) y la Agenda 2030. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En caso de que la entidad no pudiese acreditar o no acreditase de forma suficiente alguno de los apartados puntuados en la fase de valoración, se procederá a la aplicación de las siguientes penalidades: </span></span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">a) En caso de no acreditar o acreditar de forma insuficiente algunos de los criterios puntuados en la fase de valoración objetiva, se recalculará la puntuación obtenida, restando del total la puntuación del criterio no justificado, y por lo tanto, el importe de la equivalencia económica de la aportación adjudicada se verá reducido. </span></span></span></span></p>
<ul style="margin-left:40px">
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"> Además, si la falta de acreditación afecta a entre 11 y 20 puntos ponderados (ambos incluidos), se aplicará una penalización del 20% sobre el importe de la equivalencia económica de la aportación adjudicada a abonar (impuestos incluidos). </span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"> En caso de que la falta de acreditación supere los 20 puntos ponderados, se aplicará una penalización del 50% sobre el importe de la equivalencia económica de la aportación adjudicada a abonar (impuestos incluidos). </span></span></span></li>
</ul>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">b) En caso de no acreditar o acreditar de forma insuficiente alguna contraprestación indicada en el contrato:</span></span></span></span></p>
<ul style="margin-left:40px">
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"> <span style="line-height:115%"><span style="color:black">Si el importe conformado por los técnicos con relación a la repercusión mediática de las marcas de la AETIB es igual o superior al importe adjudicado, se aceptará de oficio la cancelación sin penalización. </span></span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"> <span style="line-height:115%"><span style="color:black">Si el importe conformado por los técnicos con relación a la repercusión mediática de las marcas de la AETIB es inferior al importe adjudicado, se aplicará una penalización del 2% con relación al importe que finalmente se abonará por parte de la AETIB (impuestos incluidos). </span></span></span></span></li>
</ul>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">10.3 RESPECTO AL ANEXO A5 “DECLARACIÓN RESPONSABLE DE LA MEMORIA ECONÓMICA DEL EVENTO”</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">La entidad que recibe el patrocinio deberá justificar como gasto efectivo del evento, el importe mínimo correspondiente al presupuesto establecido como requisito en el apartado 1.1 letra I) de esta convocatoria, siempre según la marca a la que se haya vinculado el patrocinio. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">La AETIB se reserva la potestad de realizar a posteriori una comprobación de la justificación económica. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Asimismo, la entidad solicitante deberá tener en cuenta que los patrocinios/ayudas/ subvenciones/colaboraciones de todas las entidades de carácter público o con participación pública, </span>no puede superar el 70% de la partida de gasto real del evento. Excepcionalmente, y debido a la situación actual derivada de la Covid-19, este porcentaje se establece a un nivel muy elevado para dar el máximo apoyo posible, desde las instituciones públicas, a la reactivación económica del sector. <span style="color:black">Con relación a la justificación económica, la AETIB procederá a la aplicación de las siguientes penalidades: </span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">a) En caso de no acreditar o acreditar por debajo del importe mínimo requisito en la convocatoria correspondiente al presupuesto según la marca vinculada, la AETIB no abonará el patrocinio. </span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) En caso de que el importe del patrocinio supere el 60% del gasto efectivo realizado del evento, el importe a abonar se reducirá hasta llegar a este porcentaje. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">c) En caso de que el importe total de las participaciones/ayudas/subvenciones/colaboraciones de todas las entidades de carácter público o con participación pública en el evento, sea superior al 70% del gasto real del evento, la AETIB sólo abonará el importe hasta llegar como máximo a este 70%.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">10.4 RESPECTO AL ANEXO A6 “MEDICIÓN DE RESULTADOS”</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">La entidad que recibe el patrocinio deberá entregar el anexo rellenado con los datos referentes al evento y edición patrocinada por la AETIB.</span></span></span></span></p>
