    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;8.4. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 17 de marzo de 2015 por la&amp;nbsp;que se aprueba la convocatoria&amp;nbsp;para la Protección de variedades autóctonas en riesgo de Erosión Genética, para el año 2015, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;&lt;em&gt;&lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Islas Baleares&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 25&amp;nbsp;de marzo&amp;nbsp;de 2021, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha 19 de marzo de 2015 se publicó, en el BOIB núm. 38, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria para el año 2015 de las ayudas destinadas a la protección de variedades autóctonas en riesgo de erosión genética.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Con fecha 11 de junio de 2015 se publicó en el BOIB núm. 87, una modificación de la Resolución citada anteriormente.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Con fecha 4 de febrero de 2020 se publicó en el BOIB núm. 15, la Resolución de la Presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria, para el año 2020, de las ayudas para prorrogar los compromisos asumidos para la protección de variedades autóctonas en riesgo de erosión genética.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Con fecha 27 de mayo de 2020, el Sr. ANTONIO MUNTANER &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;C&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;O&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;RRÓ&amp;nbsp;con NIF 78206246J, presentó en el Registro del FOGAIBA, una solicitud de ayuda para poder acogerse a la prórroga de los compromisos asumidos para la protección de variedad autóctonas en riesgo de erosión genética al amparo de la Resolución de la presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de día 3 de febrero de 2020 por la que se aprueba la convocatoria de 2020, publicada en el BOIB Núm. 15 día 4 de febrero de 2021.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.Con fecha 4 de enero de 2021 se publicó en la web del FOGAIBA la propuesta provisional de denegación del anexo I, otorgando 10 días para presentar alegaciones.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.Con fecha 29 de enero de 2021 el vicepresidente del FOGAIBA dictó Resolución de denegación a los beneficiarios de las ayudas, al amparo de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 17 de marzo de 2015, por la que se aprueba la convocatoria de las ayudas destinadas a la protección de variedades autóctonas en riesgo de erosión genética, para el año 2015, Prórroga 2020, en la que se incluye la denegación de la subvención a ANTONIO MUNTANER &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;C&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;O&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;RRÓ&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, con NIF***0624**.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7.Según consta en la resolución antes mencionada, el motivo por el que se denegó la ayuda fue por el incumplimiento del el Apartado Tercero, punto 6 de la Resolución de la Presidenta del FOGAIBA por la que se aprueba la convocatoria , para el año 2020, de las ayudas para prorrogar los compromisos asumidos para la protección de variedades autóctonas en riesgo de erosión genética, al amparo de la Resolución del presidente del FOGAIBA de día 17 de marzo de 2015.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8.Con fecha 19 de febrero de 2021 el interesado presentó en el Registro del FOGAIBA documentación que acreditaba el cumplimiento del requisito de estar al corrientes de las obligaciones tributarias. El Sr. ANTONIO MUNTANER &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;C&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;O&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;RRÓ&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;con NIF***0624** aportó la Resolución de la Tesorería del ayuntamiento de Pollença de fecha 26 de enero de 2021quan por la que se estima el recurso interpuesto por el Sr. ANTONIO MUNTANER &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;C&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;O&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;RRÓ&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;con DNI***0624** contra la providencia de apremio en relación a la notificación efectuada por la Agencia Tributaria de las Islas Baleares según la cual el Sr. MUNTANER no había abonado la tasa correspondiente a una licencia de obras conce&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;dida por el Ayuntamiento de Pollença. De acuerdo con la Resolución de tramitación del recurso se da de baja la liquidación de día 3 de octubre de 2017 por un importe de 841,31 euros y se procede a su devolución más los intereses de demora.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9.En el Anexo I de la Resolución de denegación de día 29 de enero de 2021 figura el sr. ANTONIO MUNTANER &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;C&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;O&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;RRÓ&amp;nbsp;como interesado a quien se le ha denegado la solicitud de la ayuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
