&lt;p style="margin-bottom:0,0000pt; margin-top:3,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-top:3,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en materia agraria del FOGAIBA, con fecha 17 de marzo&amp;nbsp;de 2021, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;"PROPUESTA&amp;nbsp;DE MODIFICACIÓN &lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;Y&amp;nbsp;DE REVOCACIÓN PARCIAL&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-top:3,0000pt; text-align:justify"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Hechos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-top:3,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.El 15 de septiembre de 2015 se publicó en el Boletín Oficial de las Islas Baleares núm. 136 la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de septiembre de 2015, por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores . La Resolución mencionada se modificó en fecha 26 de abril de 2016 (BOIB núm. 54, de 30 de abril de 2016), modificada por la Resolución del Presidente del FOGAIBA de 26 de junio de 2018 (BOIB núm. 80, de 28 de junio de 2018).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-top:3,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.El 26 de junio de 2019 (con registro de entrada núm. 17.680), PERE ANTONI MULET MONSERRAT presentó la solicitud de ayuda correspondiente al expediente núm. CEJA2019_1/101. En el Plan Empresarial que adjunta manifiesta que el inicio de la actividad es la instalación como joven agricultor de una explotación no prioritaria, y por otra parte, que también se dedica o dedicará a la producción integrada.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-top:3,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. El 15 de diciembre de 2020, el vicepresidente en materia agraria del FOGAIBA dictó la Resolución de concesión de ayudas para la creación de empresas de jóvenes agricultores (R1), publicada en el BOIB núm. 215, de 29 de diciembre de 2020, en la que se incluye una concesión a favor de PERE ANTONI MULET MONSERRAT, con NIF***7627**, con un importe de ayuda por concurrencia de 50.000,00 €, con núm . de expediente CEJA2019_1/101.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-top:3,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. El expediente mencionado ha sido objeto de una revisión sistemática por parte de un superior, de acuerdo con lo establecido en el artículo 3.2 de la Circular de Coordinación 18/2019, para la campaña 2019, se ha detectado que en la concesión se produjeron los siguientes errores:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;a) Se concedieron 10.000,00€ en concepto de incorporación a una explotación agraria prioritaria, pero como explica el hecho 2 de esta resolución, el interesado manifestaba en el Plan Empresarial la instalación de una explotación no prioritaria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;b) Se concedieron 5.000,00€ por dedicación a la producción integrada, ya que el interesado lo manifiesta en el Plan Empresarial, pero se ha comprobado que no está inscrito en el Registro de Producción Integrada ni ha presentado la solicitud de inscripción de la producción integrada.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-top:3,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que "Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ".&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-top:3,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.Co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha 22 de febrero de 2021 se notifica al interesado, mediante la publicación en la web, el Informe/Propuesta provisional de resolución de modificación y de revocación parcial de 17 de febrero de 2021, de 15.000€, por los conceptos antes mencionados (apartados ayb de esta resolución). &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Con fecha 8 de marzo de 2021 y registro electrónico núm. REGAGE21e00002209559, dentro del plazo establecido, el interesado presenta alegaciones junto con una fotocopia de la solicitud de inscripción en el RIA como prioritaria, de inscripción de la producción integrada y un nuevo plan empresarial con incorporación a una explotación agraria prioritaria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-top:3,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7.Dado que por incorporación de joven agricultor tiene cinco años desde la concesión de la ayuda para cumplir el plan empresarial, se puede aceptar la solicitud de inscripción de la producción integrada pero no se puede aceptar la modificación de la solicitud de la incorporación a una explotación agraria prioritaria, lo que implicaría un perjuicio para otras personas beneficiarias por la selección por concurso (punto set, apartado noveno de la convocatoria). Por todo ello, corresponde hacer la modificación de la Resolución del vicepresidente en materia agraria de concesión de 15 de diciembre de 2020, por un importe de ayuda de 40.000,00€, y llevar a cabo una revocación parcial de 10.000,00€.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-top:3,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Modificar la Resolución del vicepresidente en materia agraria de 15 de diciembre de 2020 de concesión (R1), por el importe y los datos detallados en el anexo 1 de esta resolución, que es un total de 1 expediente y comienza con Pere Antoni Mulet Monserrat y termina con Pere Antoni Mulet Monserrat, que suma un importe total de 40.000,00 €, relativa a la línea de ayuda «Creación de empresas de jóvenes agricultores», a consecuencia de la revisión sistemática.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-top:3,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Revocar parcialmente la Resolución de ayuda concedida antes mencionada concedida al beneficiario por el importe y con los datos detallados en el anexo 2 de esta resolución, que es un total de 1 expediente y que comienza con PERE ANTONI MULET MONSERRAT y termina con PERE ANTONI MULET MONSERRAT, por un importe de 10.000,00 €, relativa a la línea de ayuda «Creación de empresas de jóvenes agricultores», por no haber solicitado la incorporación a una explotación agr`ària prioritaria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-top:3,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Notificar esta resolución al interesado, mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
