    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. La señora Ana Isabel Lefort Potot falleció en Inca, el día 31 de julio de 2018.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. La causante, en el momento del fallecimiento, tenía la nacionalidad española y vecindad civil balear-mallorquina. Por tanto, son aplicables los preceptos del derecho civil de las Islas Baleares y, en aquello que este no regula, el Código civil.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. La señora Lefort falleció después de otorgar su último testamento ante el notario Bartolomé Bibiloni Guasp, en escritura de testamento, de fecha 27 de septiembre de 2017, con el número de protocolo 1.996.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4.En la cláusula novena del testamento, se señala lo que se transcribe a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;NOVENA.- Que instituye por sus herederos universales, en la totalidad, o en su caso, en el remanente de sus bienes, a las instituciones que a continuación se mencionarán, por partes iguales entre ellas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.- Al HOSPITAL DE SON ESPASES, concretamente al departamento encargado de investigar contra el cáncer.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;5. En la escritura de Manifestación de herencia y aceptación del cargo de albacea, otorgada ante el notario Bartolomé Bibiloni Guasp, el 16 de noviembre del 2018, con el número de protocolo 2.367, se nombró albacea testamentario. Como albacea se comprometió a entregar los legados establecidos por la causante en su testamento, y se comprometió a entregar el remanente, una vez entregados los impuestos y gastos pertinentes al respecto, a los herederos nombrados por la testadora en el testamento, uno de los cuales es el Hospital Universitario Son Espases.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6. De conformidad con lo señalado en la escritura de fecha 16 de noviembre de 2018, por lo que hace referencia al patrimonio relicto, al morir, la causante era titular de los bienes y derechos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.- Bienes inmuebles: EL PLENO DOMINIO DE UNA MITAD INDIVISA Y EL USUFRUCTO VITALICIO DE DOS SEXTAS PARTES INDIVISAS DE LA SIGUIENTE FINCA:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;C.- INSCRIPCIÓN.- Consta inscrita en el Registro de la Propiedad de Alcudia, folio 37, finca: 13.105/BIS, inscripción 2ª. CRU: 07043000153065&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;D.- CARGAS Y GRAVÁMENES.- Libre de ellos, aunque sujeto a las correspondientes afecciones fiscales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;F.- SITUACIÓN ARRENDATICIA.- Declara el compareciente que la finca descrita no está arrendada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;G.- DATOS CATASTRALES.- La finca descrita consta en el catastro de fincas urbanas con la referencia catastral 0722405EE1102S0001JR&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.- Dinero y acciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.- Una acción de la entidad Banco de Santander, SA por importe de 41,29 euros, en la que aparece conjuntamente con su esposo, ya fallecido, correspondiendo, por tanto, al patrimonio relicto el importe de 2,15 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.- Saldo de la cuenta de la entidad Banco Santander, S.A. por importe de 21.707,93 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Total importe del dinero y acciones existentes en el caudal relicto.- 21.710,08 euros&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7. En escritura de aceptación y de entrega de herencia a cargo del albacea, otorgada ante el notario Bartolomé Bibiloni Guasp, en fecha 16 de mayo de 2019, con el número de protocolo 957, se señala lo que se transcribe a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;IV.- PATRIMONIO HEREDITARIO.- Que, una vez entregados los legados y satisfechos todos los gastos e impuestos devengados por ello, queda como remanente hereditario de la causante, a disposición de los herederos, lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.- Una acción de la entidad Banco de Santander S.a. por importe de 4,29 euros, en la que aparece conjuntamente con su esposo, ya fallecido, y de quién ella era la heredera, correspondiendo, por tanto, al patrimonio relicto el importe total de dicha acción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.- Saldo de la cuenta de la entidad Banco Santander S.A., número ES10 0049 3978 62 2114105417, por importe de 8.664,75 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.- Saldo de la cuenta de la entidad Banco Sabadell, S.A. número ES74 0081 0325 3200 0156 6067, por importe de 45.002,60 euros&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Total del importe del dinero y acciones existentes en el caudal relicto.- 53.671,64 euros, correspondiendo a cada heredero la cantidad de 26.835,82 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;8. El 18 de septiembre de 2020, el director general del Servicio de Salud, dicta resolución de inicio de la tramitación de la aceptación de la herencia de la señora Ana Isabel Lefort Potot, a favor del Servicio de Salud de las Islas Baleares para su destino al departamento del Hospital Universitario Son Espases encargado de investigar contra el cáncer.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;9. El 22 de octubre de 2020 el Hospital Universitario Son Espases emite la memoria justificativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;10. En fecha 15 de marzo de 2021, el subdirector de Presupuestos y Control del Gasto emite el informe favorable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Por todo ello, el Consejo de Dirección del Servicio de Salud de las Islas Baleares adopta el siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Acuerdo&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Autorizar la aceptación de la herencia de la señora Ana Isabel Lefort Potot, a favor del Servicio de Salud de las Islas Baleares, por el importe aproximado de 26.000,00 euros, para su destino al departamento del Hospital Universitario Son Espases encargado de investigar contra el cáncer.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Determinar que la aceptación de la herencia se debe entender hecha a beneficio de inventario, de conformidad con lo dispuesto en el artículo 40.4 del Decreto 39/2006, de 21 de abril, por el que se aprueban los estatutos del ente público Servicio de Salud de las Islas Baleares y se efectuará siempre que el valor global de las cargas o gravámenes o de las afecciones que se impongan sobre ellos no exceda el valor intrínseco del bien.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Autorizar al director general del Servicio de Salud de las Islas Baleares para firmar todos los documentos necesarios para la aceptación de la herencia, tales como, a modo meramente enunciativo, la firma de documentos públicos, la representación ante entidades financieras… y cualquier otra diligencia encaminada a hacer efectivo este acuerdo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
