    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En el BOIB núm. 161, de 17 de septiembre de 2020, se publicó la Resolución de la directora general de Personal Docente de 16 de septiembre de 2020 por la cual se prevé el procedimiento de adjudicación de plazas a los aspirantes a funcionarios interinos docentes de la bolsa para sustituciones inaplazables y de corta duración de tutores responsables de grupo de las enseñanzas de infantil y de primaria y de profesores que impartan enseñanzas en la educación secundaria obligatoria que deban estar en cuarentena por causas directamente relacionadas con la COVID-19.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Asimismo, en el BOIB núm. 204, de 5 de diciembre de 2020, se publicó la Resolución de la directora general de Personal Docente de 2 de diciembre de 2020, por la cual se prorroga el nombramiento de los funcionarios interinos a los cuales se han adjudicado plazas para sustituciones inaplazables y de corta duración de tutores responsables de grupo de las enseñanzas de infantil y de primaria y de profesores que imparten enseñanzas en la educación secundaria obligatoria que deban estar en cuarentena por causas directamente relacionadas con la COVID-19.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Después de dos &lt;span style="background-color:white"&gt;trimestres escolares&lt;/span&gt; se debe poner en valor la eficacia del procedimiento y el compromiso de los funcionarios interinos que han optado voluntariamente a estas sustituciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;A pesar de todo, desde la última resolución de prórroga se ha producido una mejora de la situación sanitaria con una evolución a la baja de todos los datos relativos a la incidencia del virus SARS-CoV-2 en las Illes Balears, lo que hace aconsejable conciliar la eficacia del procedimiento con las necesidades reales de los centros en estos momentos del curso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Por todo ello, se considera necesario prorrogar el nombramiento de un número determinado de funcionarios interinos seleccionados mediante este procedimiento, de acuerdo con las necesidades previstas, hasta la finalización del tercer trimestre escolar. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;La competencia para dictar esta resolución corresponde a la directora general de Personal Docente, de acuerdo con la &lt;/span&gt;Resolución del consejero de Educación y Formación Profesional de 19 de marzo de 2021 &lt;span style="color:black"&gt;de delegación de determinadas competencias en materia de gestión de personal docente en la directora general de Personal Docente (BOIB núm. 41, de 25 de marzo).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Por todo ello, y con el acuerdo de Mesa Sectorial de Educación, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;​​​​​​​&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;1. Prorrogar&lt;strong&gt; &lt;/strong&gt;el nombramiento&lt;strong&gt; &lt;/strong&gt;de los funcionarios interinos que aparecen en el anexo de esta Resolución, a los que se adjudicaron, en la convocatoria ordinaria de sustituciones de los días 18 al 21 de septiembre de 2020, plazas para sustituciones inaplazables y de corta duración de tutores responsables de grupo de las enseñanzas de infantil y de primaria que debían estar en cuarentena por causas directamente relacionadas con la COVID-19, hasta la finalización del tercer trimestre escolar y siempre que, dadas las necesidades de sustituciones, la Dirección General de Personal Docente considere esencial la prórroga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. Establecer que, a los efectos de lo que dispone el punto anterior, la finalización de los trimestres escolares se rige por la base 17.6 del anexo I de la Resolución de la directora general de Personal Docente de 19 de diciembre de 2019 por la cual se aprueba la convocatoria pública para formar una bolsa de aspirantes a funcionarios interinos docentes con el fin de cubrir, en todas las islas, vacantes y sustituciones de todas las especialidades o funciones a centros públicos de enseñanza no universitaria dependientes de la Consejería de Educación, Universidad e Investigación del Gobierno de las Islas Baleares para el curso 2020-2021 (BOIB núm. 171, de 21 de diciembre), de forma que el nombramiento se debe prorrogar hasta el 30 de junio de 2021, este día incluido.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. Establecer que los funcionarios interinos pueden renunciar, sin alegar ninguna causa, a la prórroga de su nombramiento. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. Publicar esta Resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante la directora general de Personal Docente en el plazo de un mes contador desde el día siguiente de su publicación en el BOIB, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y los artículos 25.5 y 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;También se puede interponer directamente un recurso contencioso-administrativo ante el Juzgado Contencioso-Administrativo en el plazo de dos meses contadores desde el día siguiente de su publicación en el BOIB, de acuerdo con los artículos 8 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-Administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
