El 19 de diciembre de 2019 (RE 40021), Redexis Gas, SA, solicitó una autorización de ejecución de instalaciones y, en concreto, de declaración de utilidad pública para el proyecto de extensión de red para la distribución de gas canalizado para el centro Amadip Esment en Son Ferriol, en el término municipal de Palma (Mallorca).</span></p> <p><span style="line-height:normal">Las características principales de la instalación, indicadas en el proyecto de ejecución firmado digitalmente el día 18/12/2019 por el ingeniero industrial José Roig Gómez, col. 12392 por el Colegio de Ingenieros Industriales de Madrid (COIMM), sin visar, son las siguientes:</span></p> <p><strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Gas a suministrar:</span></strong></p> <p><span style="line-height:normal">Gas natural con un PCS (Hs) entre un mínimo de 10,26 kWh/m³ y un máximo de 13,26 kWh/m³, en función de su procedencia.</span></p> <p><strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Descripción de la instalación:</span></strong></p> <p><span style="line-height:normal">Conexión consistente en una red de distribución MOP 5 bar de 1.107 metros lineales de tubería de polietileno de alta densidad PE100 DN 90 SDR 17/17,6.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">El trazado discurre en su inicio en dirección sureste, por el margen derecho de la calle del General Weyler y la carretera Ma-3013, para discurrir posteriormente por fincas privadas, y gira en sentido suroeste hasta el final del trazado, a la altura del paralelismo con la carretera Ma-30. A excepción del inicio del trazado, el cual discurre bajo suelo urbano municipal, y el tramo final de este, que discurre en terreno de categoría rústica, el resto del trazado discurre bajo viales asfaltados categorizados como suelo rústico agrario.</span></p> <p><strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Presupuesto:</span></strong></p> <p><span style="line-height:normal">84.428,49 €</span></p> <p><span style="line-height:normal">2. El 13 febrero de 2020, el Servicio de Transporte y Distribución de Energía y Generación Térmica requirió la subsanación de deficiencias en la solicitud realizada por Redexis Gas, SA, donde, entre otras cuestiones, se le requieren las separatas técnicas del proyecto relativas a las afecciones de organismos y empresas de servicios públicos.</span></p> <p><span style="line-height:normal">3. Redexis Gas, SA, subsanó las deficiencias detectadas por el Servicio en el requerimiento de 13 de febrero de 2020.</span></p> <p><span style="line-height:normal">4. Dado que el proyecto objeto de autorización no figura entre los incluidos en los anexos de la Ley 12/2016, de 17 de agosto, de Evaluación Ambiental de las Illes Balears, ni en los anexos de la Ley 21/2013, de 9 de diciembre, de Evaluación Ambiental, puede considerarse excluido de evaluación ambiental.</span></p> <p><span style="line-height:normal">5. El 4 de junio de 2020, se publicó en el BOIB el anuncio de información pública de la solicitud de aprobación del proyecto de extensión de red para la distribución de gas canalizado para el centro Amadip Esment en Son Ferriol, en el término municipal de Palma (Mallorca). El 15 de junio de 2020, se publicó el anuncio de información pública en el BOE. El 9 de junio se publicaron los anuncios de información pública en el diario <em>Última Hora</em> y en el <em>Diario de Mallorca</em>. Se publicó en la página web de la Dirección General de Energía y Cambio Climático. De día 10/07/2020 a 07/08/2020 el Ayuntamiento de Palma publicó en su tablón de anuncios la información pública del proyecto, según certificado de publicación en el tablón de anuncios registrado en la Dirección General de Energía y Cambio Climático el 08/09/2020. De día 24/06/2020 a 23/07/2020 el Ayuntamiento de Marratxí publicó en su tablón de anuncios la información pública del proyecto, según el certificado de publicación en el tablón de anuncios registrado en la Dirección General de Energía y Cambio Climático el 04/08/2020. A este servicio no le consta presentación de ninguna alegación al respecto.</span></p> <p><span style="line-height:normal">7. El director general de Energía y Cambio Climático solicitó informes a:</span></p> <ul> <li><span style="line-height:normal">Ayuntamiento de Palma.</span></li> <li><span style="line-height:normal">Ayuntamiento de Marratxí.</span></li> <li><span style="line-height:normal">Endesa Distribución Eléctrica SLU.</span></li> <li><span style="line-height:normal">Servidumbres aeronáuticas, Agencia Estatal de Seguridad Aérea.</span></li> <li><span style="line-height:normal">Depto. de Movilidad e Infraestructuras del Consejo Insular de Mallorca.</span></li> <li><span style="line-height:normal">Depto. de Urbanismo y Territorio del Consejo Insular de Mallorca.</span></li> <li><span style="line-height:normal">EMAYA.</span></li> <li><span style="line-height:normal">FACSA.</span></li> <li><span style="line-height:normal">2020 Vodafone España SAU.</span></li> </ul> <p><span style="line-height:normal">8. El 29 de mayo de 2020, el Ayuntamiento de Marratxí informa favorablemente el proyecto presentado siempre que se dé cumplimiento a las condiciones indicadas en el informe 2020/00003171V del 28 de mayo de 2020.</span></p> <p><span style="line-height:normal">9. El 30 de junio de 2020, servidumbres aeronáuticas de la Agencia Estatal de Seguridad Aérea solicita aportar la siguiente información adicional:</span></p> <ul> <li><span style="line-height:normal">Aportar la documentación con la tabla de solicitud de coordenadas.</span></li> </ul> <p><span style="line-height:normal">Se remite a Redexis Gas, SA, para poder subsanar.</span></p> <p><span style="line-height:normal">10. El 7 de julio de 2020, FACSA informa dando su conformidad para la extensión de red de distribución de gas canalizado en el Centro Amadip Esment en Son Ferriol, siempre que se cumplan las condiciones mencionadas en su informe y su documentación adjunta. Además, comunica a Redexis Gas, SA, informe de los servicios existentes de agua potable, saneamiento y pluviales que afectan al trayecto de la red.</span></p> <p><span style="line-height:normal">11. El director general de Energía y Cambio Climático solicitó por segunda vez informes a:</span></p> <ul> <li><span style="line-height:normal">Ayuntamiento de Palma.</span></li> <li><span style="line-height:normal">Endesa Distribución Eléctrica SLU.</span></li> <li><span style="line-height:normal">Depto. de Movilidad e Infraestructuras del Consejo Insular de Mallorca.</span></li> <li><span style="line-height:normal">Depto. de Urbanismo y Territorio del Consejo Insular de Mallorca.</span></li> <li><span style="line-height:normal">EMAYA.</span></li> <li><span style="line-height:normal">2020 Vodafone España SAU.</span></li> </ul> <p><span style="line-height:normal">12. El 4 de agosto de 2020, la Comisión Insular de Ordenación del Territorio y Urbanismo del Departamento del Territorio del Consejo Insular de Mallorca informa favorablemente siempre que el proyecto sea informado por el Departamento de Infraestructuras del Consejo Insular de Mallorca.</span></p> <p><span style="line-height:normal">13. El 12 de agosto de 2020, 2020 Vodafone España SAU agota por caducidad la notificación del segundo informe; por lo tanto, se puede evacuar el trámite de autorización de la instalación.</span></p> <p><span style="line-height:normal">14. El 14 de agosto de 2020, Endesa Distribución Eléctrica SLU informa favorablemente, siempre que:</span></p> <ul> <li><span style="line-height:normal">Si fuera necesario desplazar o modificar alguna de las instalaciones de media y baja tensión, el promotor deberá solicitarlo formalmente a E-Distribución Redes Digitales, SLU, que realizará el estudio de viabilidad y el presupuesto de esta modificación.</span></li> <li><span style="line-height:normal">Antes del inicio de las obras, deberá solicitarse a E-Distribución Redes Digitales, SLU, un replanteo <em>in situ</em>, para evitar posibles daños, tanto en las personas como en las instalaciones.</span></li> </ul> <p><span style="line-height:normal">15. El 16 de agosto de 2020, vence el plazo de reiteración marcado por el artículo 80 del Real Decreto 1434/2002, de 27 de diciembre, por el que se regulan las actividades de transporte, distribución, comercialización, suministro y procedimientos de autorización de instalaciones de gas natural. Según indica este artículo, EMAYA, vencido este plazo, da conformidad a la autorización de la instalación.</span></p> <p><span style="line-height:normal">16. El 1 de septiembre de 2020, el Ayuntamiento de Palma informa favorablemente condicionado a presentar los certificados de materiales utilizados y cumplir las condiciones generales que figuran en el documento del informe del 26 de agosto de 2020.</span></p> <p><span style="line-height:normal">17. El 9 de octubre de 2020, la Dirección Insular de Infraestructuras del Departamento de Movilidad e Infraestructuras del Consejo Insular de Mallorca autoriza las obras del ramal de distribución de gas canalizado para el centro Amadip Esment de Son Ferriol, a la Ma-30 ramal PK 4+200 a PK 4+500 y rotonda, en el término municipal de Palma, siempre que se ajusten a las condiciones mencionadas en el informe 479/2020 de 06/08/2020.</span></p> <p><span style="line-height:normal">18. El 21 de diciembre de 2020, servidumbres aeronáuticas de la Agencia Estatal de Seguridad Aérea informa favorablemente la instalación del ramal de distribución presentado con el cumplimiento de las siguientes condiciones:</span></p> <ul> <li><span style="line-height:normal">No superar los valores de altura y elevación indicados en la tabla presentada por el ramal y por la maquinaria, incluidos todos sus elementos o cualquier añadido sobre estos.</span></li> <li><span style="line-height:normal">Si es necesaria la utilización otros medios auxiliares que superen la altura y elevación autorizadas, deberá solicitarse la correspondiente autorización de manera previa y preceptiva a su instalación, haciendo referencia a este expediente.</span></li> </ul> <p><span style="line-height:normal">19.El Servicio de Transporte y Distribución de Energía y Generación Térmica de la Dirección General de Energía y Cambio Climático examinó la solicitud y emitió un informe favorable sobre la autorización administrativa de construcción y de declaración de utilidad pública sobre el proyecto de extensión de red para la distribución de gas canalizado para el centro Amadip Esment en Son Ferriol, en el término municipal de Palma (Mallorca).</span></p> <p><span style="line-height:normal"><strong>Fundamentos de derecho</strong></span></p> <p><span style="line-height:normal">1. La Ley 34/1998, de 7 de octubre, del Sector de Hidrocarburos.</span></p> <p><span style="line-height:normal">2. El Real Decreto 1434/2002, de 27 de diciembre, que regula las actividades de transporte, distribución, comercialización, suministro y autorización de instalaciones de gas natural.</span></p> <p><span style="line-height:normal">3. El Real Decreto 919/2006, de 28 de julio, por el que se aprueba el Reglamento técnico de distribución y utilización de combustibles gaseosos y sus instrucciones técnicas complementarias ICG 01 a 11.</span></p> <p><span style="line-height:normal">4. El Decreto 96/2005, de 23 de septiembre, de aprobación definitiva de la revisión del Plan Director Sectorial Energético de las Islas Baleares.</span></p> <p><span style="line-height:normal">5. El Decreto Ley 3/2014, de 5 de diciembre, de medidas urgentes destinadas a potenciar la calidad, la competitividad y la desestacionalización turística en las Illes Balears.</span></p> <p><span style="line-height:normal">Por todo ello, dicto la siguiente</span></p> <p style="text-align:center"><span style="line-height:normal"><strong>Resolución</strong></span></p> <p><span style="line-height:normal">1. Otorgar la autorización administrativa de construcción al proyecto de ejecución de extensión de red para la distribución de gas canalizado para el centro Amadip Esment en Son Ferriol, en el término municipal de Palma, redactado en diciembre de 2019 por el señor José Roig Gómez, ingeniero industrial, con los siguientes condicionantes:</span></p> <ul> <li><span style="line-height:normal">Las condiciones indicadas en el informe 2020/00003171V del 28 de mayo de 2020 del Ayuntamiento de Marratxí.</span></li> <li><span style="line-height:normal">Cumplir las condiciones mencionadas en el informe de FACSA de 28 mayo de 2020 y su documentación adjunta.</span></li> <li><span style="line-height:normal">Si fuera necesario desplazar o modificar alguna de las instalaciones de media y baja tensión, el promotor deberá solicitarlo formalmente a E-Distribución Redes Digitales, SLU, que realizará el estudio de viabilidad y el presupuesto de esta modificación.</span></li> <li><span style="line-height:normal">Antes del inicio de las obras, deberá solicitarse a E-Distribución Redes Digitales, SLU, un replanteo <em>in situ</em>, para evitar posibles daños, tanto en las personas como en las instalaciones.</span></li> <li><span style="line-height:normal">Deberán presentarse los certificados de materiales utilizados y cumplir las condiciones generales que figuran en el documento del informe del 26 de agosto de 2020 del Ayuntamiento de Palma.</span></li> <li><span style="line-height:normal">Se tendrá que ajustar a las condiciones mencionadas en el informe 479/2020 del 06/08/2020 de la Dirección Insular de Infraestructuras del Departamento de Movilidad e Infraestructuras del Consejo Insular de Mallorca.</span></li> <li><span style="line-height:normal">No superar los valores de altura y elevación indicados en la tabla presentada por servidumbres aeronáuticas de la Agencia Estatal de Seguridad Aérea por el ramal y por la maquinaria, incluidos todos sus elementos o cualquier añadido sobre estos.</span></li> <li><span style="line-height:normal">Si fuera necesaria la utilización otros medios auxiliares que superen la altura y elevación autorizadas, deberá solicitarse la correspondiente autorización de manera previa y preceptiva a su instalación, haciendo referencia a este expediente a servidumbres aeronáuticas de la Agencia Estatal de Seguridad Aérea.</span></li> </ul> <p><span style="line-height:normal">Esta autorización habilita al titular para la construcción de la instalación, sin perjuicio de otras autorizaciones, licencias o permisos si son necesarios para su ejecución.</span></p> <p><span style="line-height:normal">2. Reconocer, en concreto, la utilidad pública de esta instalación, de acuerdo con el artículo 103 de la Ley 34/1998, de 7 de octubre, del Sector de Hidrocarburos.</span></p> <p><span style="line-height:normal">3. Determinar que, de acuerdo con la disposición adicional segunda del Decreto&nbsp;96/2005, de 23 de septiembre, de aprobación definitiva de la revisión del Plan Director Sectorial Energético de las Illes Balears, modificada por el artículo 19 del Decreto Ley 3/2014, de 5 de diciembre, de medidas urgentes destinadas a potenciar la calidad, la competitividad y la desestacionalización turística en las Illes Balears, los ramales de cañería que conectan gasoductos de transporte primario y secundario, así como las redes de distribución de gas natural, pueden ser declarados de utilidad pública y tener los mismos efectos previstos en los artículos 25, 26.5 y 26.6 del Plan Director Sectorial Energético. Por lo tanto, en este caso, al tratarse de una instalación de distribución de gas natural y se ha seguido el procedimiento de declaración de utilidad pública regulado en el artículo 3 de la Ley 13/2012, de 20 de noviembre, de medidas urgentes para la activación económica en materia de industria y energía, nuevas tecnologías, residuos, aguas, otras actividades y medidas tributarias, la declaración de utilidad pública debe tener los mismos efectos que los previstos en los artículos 25, 26.5 y 26.6 del Plan Director Sectorial Energético de las Illes Balears.</span></p> <p><span style="line-height:normal">En consecuencia, de acuerdo con la disposición adicional y los apartados 5 y 6 del artículo 26 del Decreto 96/2005, como quiera que la obra autorizada se hará en ejecución de las determinaciones del Plan Director Sectorial, y dado que está recogido con el grado de detalle suficiente para evaluar sus características fundamentales, son de aplicación plena, directa e inmediata y, además, la obra autorizada no se someterá a los actos de control preventivo municipal a que se refiere el artículo 84.1.<em>b)</em> de la Ley 7/1985, de 2 de abril, reguladora de las Bases de Régimen Local, porque se trata de actividades de interés supramunicipal, y queda exenta de la sujeción al régimen de licencias, autorizaciones e informes que establece la Ley 8/1995, de 30 de marzo, de atribución de competencias a los consejos insulares en materia de actividades clasificadas y parques acuáticos, reguladora del procedimiento y de las infracciones y sanciones. Por otro lado, las obras autorizadas quedarán sujetas al régimen impositivo establecido en el artículo 29 del Decreto&nbsp;96/2005.</span></p> <p><span style="line-height:normal">4. Otorgar el plazo de dos años, contado desde la notificación de esta resolución, para la ejecución de la instalación. La Dirección General de Energía y Cambio Climático, por causas justificadas y motivadas, puede ampliar dicho plazo.</span></p> <p><span style="line-height:normal">5. Indicar que, una vez ejecutadas total o parcialmente las instalaciones objeto de esta autorización, el titular presentará la solicitud de puesta en servicio, a la cual acompañará un certificado de final de obra subscrito por un técnico facultativo, así como las pruebas reglamentarias y el resto de documentación que exige la reglamentación vigente.</span></p> <p><span style="line-height:normal">6.
