    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Publicación del acuerdo adoptado por el Consell Executiu del Consell Insular d'Eivissa de &lt;span style="color:black"&gt;fecha 12 de marzo de 2021, en relación con la &lt;/span&gt;concesión de ayudas económicas para el mantenimiento y la recuperación de los bienes inmuebles del patrimonio histórico en el ámbito territorial de la isla de Eivissa para los años 2020-2021&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;De conformidad con el artículo 45 de la Ley 39/2015, &lt;/span&gt;de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, se hace público el acuerdo del&amp;nbsp; &lt;span style="color:black"&gt;Consell Executiu del Consell Insular d'Eivissa de fecha 12 de marzo de 2021, de &lt;/span&gt;concesión de ayudas económicas para el mantenimiento y la recuperación de los bienes inmuebles del patrimonio histórico en el ámbito territorial de la isla de Eivissa para los años 2020-2021, aprobado en virtud de los artículos 88 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas i 25 de la Ley 38/2003, de 17 de noviembre, general de subvenciones i con la base 12.5 de la convocatoria de ayudas, respetando la normativa vigente de protección de datos personales:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;"(...)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;12. Propuesta de la vicepresidenta 3ª y consellera executiva del Departament de Cultura, Educació i Patrimoni, en relación a la concesión de ayudas económicas para el mantenimiento y la recuperación de los bienes inmuebles del patrimonio histórico en el ámbito territorial de la isla de Eivissa para los años 2020-2021. Exp. 2020/0003286V&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;Habiéndose presentado la siguiente propuesta, con la declaración previa de urgencia:&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;"En fecha 10 de julio de 2020, por acuerdo del Consell Executiu, se aprobaron las bases reguladoras y la convocatoria de ayudas para el mantenimiento y la recuperación de los bienes inmuebles de patrimonio histórico en el ámbito territorial de la isla de Eivissa para los años 2020-2021 (publicadas en el BOIB núm. 131, de 25 de julio de 2020). En el mismo acuerdo se delegó en la consellera executiva de Cultura, Educación y Patrimonio la concesión de las ayudas y su pago, así como, si es el caso, las revocaciones de las ayudas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El ejercicio 2020 acabó sin que se pudieran conceder las ayudas previstas y es voluntad de este Departamento continuar con la tramitación administrativa de este expediente. De acuerdo con la base 23 de las Bases de ejecución del presupuesto se podrá reconocer la obligación con cargo al ejercicio corriente mediante el acuerdo del órgano competente en el que se aprueben las tres fases del gasto(ADO). &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A la vista del acta de reunión de la Comisión Evaluadora de día 4 de diciembre de 2020, en la que, una vez estudiadas las solicitudes presentadas en la citada convocatoria, se acuerda la concesión de las ayudas, se emitió la &lt;strong&gt;propuesta de resolución provisional&lt;/strong&gt; de estas ayudas, que se publicó en el tablón de anuncios de la Sede Electrónica del Consell d'Eivissa en fecha 11 de diciembre de 2020, y se abrió un plazo de diez días hábiles para presentar alegaciones, si era el caso. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dentro de este plazo para formular alegaciones a la propuesta de resolución provisional se presentaron las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- El señor José Antonio Roig (...), en representación de la Sra. Maria Victoria Escandell (...) (DNI 50.***.909-T), con RGE 2020029319, de 18-12-2020, formuló alegaciones a la propuesta de resolución provisional por la que se denegaba la ayuda económica solicitada para la restauración de la &lt;em&gt;casa pagesa&lt;/em&gt; can Lluís o Cas Català,&amp;nbsp; pol. 4, parc. 153,TM Sant Josep de sa Talaia. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- La señora Inés Vidal (...), en representación del senyor Antoni Marí (...) (DNI 41.***.541-Q), con RGE 2020029862, de 28-12-2020, formuló alegaciones a la propuesta de resolución provisional por la que se denegaba la ayuda económica solicitada para la restauración de can Nadal, km. 8,5, ctra. ses Salines, TM Sant Josep de sa Talaia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En fecha 3 de febrero de 2021, la Comisión Evaluadora se volvió a reunir para estudiar y evaluar las alegaciones presentadas a la propuesta de resolución provisional y emitió un informe con su propuesta de resolución, en el que ratifica el acuerdo que dio pie a la propuesta de resolución provisional y no se admiten las alegaciones presentadas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Así mismo, en fecha 2 de marzo de 2021, con la operación contable 2/2021000000890, se hizo una retención de crédito por importe de 171.610,47 € a cargo de la aplicación presupuestaria 3360 78900 del presente ejercicio, por lo que se entiende que existe crédito adecuado y suficiente para hacer efectiva la concesión y el pago a las entidades beneficiarias. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En fecha 4 de diciembre de 2020 se emitió informe técnico favorable sobre la instrucción del expediente y sobre el cumplimiento, por parte de las personas solicitantes, de los requisitos para poder ser beneficiarios de la ayuda. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Visto el informe propuesta emitido por el jefe de sección del Departament de Cultura, Educació i Patrimoni de fecha 5 de marzo de 2021. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En relación con el artículo 88.3 del Real Decreto 887/2006, de 21 de julio, que aprueba el Reglamento de la Ley General de Subvenciones, las personas o entidades a las cuales se concede la ayuda han acreditado su condición para poder ser beneficiarias; la base 14.2 de las que regulan esta convocatoria establece un primer pago del 30% de la ayuda en el momento de la concesión y el 70% restante una vez justificada correctamente el 100% de la actividad subvencionada, y no se ha dictado resolución declarativa de la procedencia de reintegro de subvención o de pérdida del derecho a su cobro, ni el órgano concedente de la subvención ha acordado, como medida cautelar, retención de las entregas de pago o de las cantidades pendientes de abonar a los beneficiarios. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;A pesar que la base 11.2 de las bases de regulación de estas ayudas indica que el órgano competente para la resolución es la consellera executiva (por la delegación de esta competencia hecha por el Consell Executiu en fecha 10 de julio de 2020), una vez cerrado el ejercicio 2020 y de conformidad con la base 23 de las Bases de ejecución para 2021 y con el Decreto de Presidencia núm. 2020000768, de modificación del Decreto de Presidencia núm. 2019000471, de fecha 10-7-2019, de estructura del gobierno del Consell Insular d'Eivissa y creación de departamentos, y el Decreto de Presidencia núm. 2019000484, de fecha 16-7-2019, de determinación de las atribuciones correspondientes a los diferentes órganos del Consell Insular d'Eivissa (BOIB núm. 153, de 5-09-2020) en estos momentos corresponde al Consell Executiu resolver la concesión de estas subvenciones, una vez emitido el oportuno informe propuesta. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En virtud de todo lo anterior, y de conformidad con el artículo 72.&lt;em&gt;d &lt;/em&gt;del Reglamento orgánico del Consell Insular d'Eivissa (BOIB núm. 136, de 18-9-2010; corrección en el BOIB núm. 148, de 14-10-2010; modificación en el BOIB núm. 48, de 16-4-2016), con carácter previo a la emisión del correspondiente informe de fiscalización previo, preceptivo y necesario, de la Intervención de la corporación, y para el caso que el mencionado informe sea favorable y de conformidad, elevo al Consell Executiu del Consell Insular d'Eivissa, si lo estima adecuado, la siguiente &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;PROPUESTA DE ACUERDO: &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1.&lt;/strong&gt; &lt;strong&gt;APROBAR &lt;/strong&gt;la dotación económica para el pago de estas ayudas por un total de 171.610,47 € a cargo de la aplicación presupuestaria 3360 78900 del ejercicio 2021 (RC 2/2021000000890, de fecha 2 de marzo de 2021 por un importe de 171.610,47 €), para el pago de las ayudas económicas para el mantenimiento y la recuperación de los bienes inmuebles de patrimonio histórico en el ámbito territorial de la isla de Eivissa para los años 2020-2021. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2. AVOCAR&lt;/strong&gt; la delegación en la &lt;span style="color:black"&gt;consellera executiva del Departament de Cultura, Educació i Patrimoni,&amp;nbsp; hecha por acuerdo del Consell Executiu de fecha 10 de julio de 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

DAR por desistidas&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt; las siguientes solicitudes de ayudas para el mantenimiento y la recuperación de los bienes inmuebles de patrimonio histórico en el ámbito territorial de la isla de Eivissa para los años 2020-2021, como consecuencia de no haber subsanado la solicitud dentro del plazo establecido a este efecto, de acuerdo con la base 6.5 de estas ayudas y con los artículos 68.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas y 23.5 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

(DNI 50.***.909-T) a la propuesta de resolución provisional por la que se denegaba la ayuda económica solicitada para la restauración de la &lt;em&gt;casa pagesa&lt;/em&gt; can Lluís o cas Català, pol. 4, parc. 153, Sant Jordi de ses Salines, TM Sant Josep de sa Talaia, ya que, según el acta de la Comisión Evaluadora de 03-02-2021, «después de haber aplicado los criterios de valoración establecidos en la base décima ha obtenido una puntuación inferior a 10 puntos conforme a la base octava de las bases reguladoras des estas ayudas».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- La formulada en fecha 28-12-2020, con 2020029862, por la señora Inés Vidal (...), en representación del senyor Antoni Marí (...) (DNI 41.***.541-Q), a la propuesta de resolución provisional por la que se deniega la ayuda solicitada para la restauración de can Nadal, km. 8,5, ctra. ses Salines, TM Sant Josep de sa Talaia, ya que, según el acta de la Comisión Evaluadora de 03-02-2021, «las obras realizadas para la restauración de la vivienda objeto de la ayuda no respetan la base 2.2 de las bases de esta convocatoria, ya que los muros han sufrido una alteración grave cromática y tipológica con la aplicación de un rejuntado muy amplio con cal que oculta la mayor parte de las piedras (la construcción original se basaba en muros de piedra calcárea azul unida con mortero que originalmente no sobresalía de las paredes), actuación que ha provocado un efecto general de la casa que nada tiene que ver con sus valores patrimoniales originales, además porque originalmente las puertas y ventanas no tenían enmarcado y toda restauración debe respetar la manufactura original del edificio».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;7. Reconocer &lt;span style="color:black"&gt;la obligación y hacer el pago del 30 % de la ayuda concedida&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt; a las personas beneficiarias que se detallan a continuación, conforme a la base 14.2 de las que regulan esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;8. Publicar&lt;/strong&gt; estas subvenciones en la Base de Datos Nacional de Subvenciones, de acuerdo con lo que establece el artículo 18 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones y &lt;span style="color:#00000a"&gt;el artículo 7 del Real Decreto 130/2019, de 8 de marzo, por el que se regulan la Base de Datos Nacional de Subvenciones y la publicidad de las subvenciones y el resto de ayudas públicas (BOE núm. 77, de 30-03-19). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;9. Notificar&lt;/strong&gt; a las personas y entidades solicitantes este acuerdo, mediante su publicación en el Boletín Oficial de las Illes Balears (BOIB) y en la Sede Electrónica del Consell (https://seu.conselldeivissa.es), conforme a la base 11.5 de la convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Este acto no agota la vía administrativa y en contra se puede interponer, ante la Comissió de Govern, el recurso de alzada previsto en los artículos 112.1, 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, en el plazo de un mes desde el día siguiente de su notificación, todo en virtud de lo que disponen los artículos 22.2 de la Ley 8/2000, de 27 de octubre, de consejos insulares y el artículo 147.1 del Reglamento orgánico del Consell Insular d'Eivissa (publicado en el BOIB núm. 136, de 18-09-10; corrección en el BOIB núm. 148, de 14-10-10; modificación en el BOIB núm. 48, de 16-04-16). El recurso tendrá que resolverse en el plazo de tres meses, transcurridos los cuales se entenderá desestimado y quedará abierta la vía contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Todo ello sin perjuicio de cualquier otro recurso o acción que se considere pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
