    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;De conformidad con lo establecido en el artículo 9.3 de la Ley 38/2003, del 17 de noviembre, general de subvenciones, a continuación se hacen públicas las bases reguladoras de ayudas económicas individuales dirigidas a la formación técnica deportiva, a los éxitos deportivos y a la estancia de deportistas en centros de tecnificación o centros de alto rendimiento para el año 2021 aprobadas por acuerdo del Consejo Ejecutivo del Consell Insular de Ibiza de fecha 12 de marzo de 2021, siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;1. Justificación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;La importancia del deporte fue recogida en el conjunto de principios rectores de la política social y económica de la Constitución española, y en este sentido el artículo 43.3 establece que los poderes públicos fomentarán la educación física y el deporte, y facilitarán la adecuada utilización del ocio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;El Consell Insular de Ibiza, tiene competencias propias dentro de su ámbito territorial en materia de deporte, el ocio y en concreto en el fomento y la promoción de las actividades deportivas y de ocio, en virtud del artículo 70.9, de la Ley orgánica 1/2007, del 28 de febrero, de reforma del Estatuto de Autonomía de las Islas Baleares, que va ejerciendo desde la atribución competencial efectuada por la Ley 6/1994, de 13 de diciembre, de atribución de competencias a los Consejos Insulares en materia de patrimonio histórico, de promoción sociocultural, de animación sociocultural, de depósito legal de libros y de deportes. Además, el artículo 73 la EAIB le atribuye el ejercicio de la actividad de fomento, sin perjuicio de la actividad que corresponde a la Comunidad Autónoma en las materias que este Estatuto le atribuye como competencia propia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;La mencionada Ley 6/1994, de 13 de diciembre, prevé en su artículo 6 que los consejos insulares asumirán todas las competencias que habían sido asumidas por la Comunidad Autónoma de las Islas Baleares en materia de deportes, y entre estas, las que determine la Ley balear del deporte.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Por su parte, la Ley 14/2006, de 17 de octubre, del deporte de las Islas Baleares, ya en su exposición de motivos, destaca que "El deporte, entendido como la expresión de la actividad física, reglada o no, es un bien para la sociedad y hay que cuidarlo, potenciarlo y posibilitar que toda la ciudadanía de las Islas tenga opciones de practicarlo, de forma individual o formando parte de las diferentes y necesarias organizaciones deportivas que lo gestionan y que son igualmente valoradas y necesarias en la sociedad".&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Así mismo, el artículo 3 dice que &lt;/span&gt;&lt;span style="color:#000000"&gt;"La actividad física y el deporte son funciones sociales que contribuyen al desarrollo y a la formación integral de las personas y a la mejora de su calidad de vida".&lt;/span&gt;&lt;span style="color:#000000"&gt; Y su artículo 11 establece&lt;/span&gt;&lt;span style="color:#000000"&gt; que una de les competencias de los consells insulares&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;s:&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;“&lt;/span&gt;&lt;span style="color:#000000"&gt;Definir, planificar y ejecutar los programas dirigidos a una mejor práctica deportiva en los diferentes ámbitos y sectores sociales y para participar".&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Por eso, el Consell Insular de Ibiza, mediante su Departamento de Hacienda, Gestión Económica, Deportes y Juventud, quiere dar soporte a &lt;/span&gt;&lt;span style="color:#000000"&gt;la formación técnica deportiva, a los éxitos deportivos, a la estancia de deportistas en centros de tecnificación o centros de alto rendimiento&lt;/span&gt;&lt;span style="color:#000000"&gt;. Y en este sentido, en el presupuesto general para el año 2021 y en el plan estratégico de subvenciones 2020 - 2021 - 2022 (BOIB núm. 20, de 15 de febrero 2021)&lt;/span&gt;&lt;span style="color:#c9211e"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;se previó la línea de acción de estas ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;2. Objeto y modalidades&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2.1. El objeto de estas bases es la concesión de ayudas económicas a la formación técnica deportiva, a los éxitos deportivos, a la estancia de deportistas de la isla de Ibiza en centros de tecnificación y alto rendimiento y a la práctica de deporte adaptado con el objetivo de dar soporte a la práctica deportiva, facilitar la mejora del rendimiento y optimizar su participación en competiciones deportivas, así como su adecuada tecnificación en su especialidad deportiva, y potenciar la formación del personal técnico deportivo de la isla de Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2.2. &lt;/span&gt;&lt;span style="color:#000000"&gt;Se prevén las modalidades de ayuda siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Modalidad A:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Ayudas económicas para deportistas de la isla de Ibiza por los resultados conseguidos en el año 2020.&lt;/span&gt;&lt;span style="color:#c9211e"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Ayudas económicas para personas deportistas de la isla de Ibiza inscritas en centros de tecnificación deportiva (CTE) o en centros de alto rendimiento (CAR) fuera de Ibiza, durante la temporada deportiva 2020-2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Modalidad B: ayudas económicas para personal técnico deportivo de la isla de Ibiza para participar en actividades de formación técnica deportiva fuera de las islas Pitiusas durante los años 2020 y 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2.3. A efectos de estas bases se considera como &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;personal técnico deportivo &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;aquellas personas que realizan funciones de entrenador/a o de monitor/a o de árbitro/a o juez/a dentro del ámbito deportivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;3. Personas beneficiarias y obligaciones de éstas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3.1. Podrán beneficiarse de las ayudas establecidas en estas bases el personal técnico deportivo y las persones deportistas, nacidas en la isla de Ibiza o que tengan, como mínimo, una antigüedad de residencia de seis años en la isla de Ibiza antes del día de la publicación del extracto de esta convocatoria en el BOIB, que cumplan, las condiciones establecidas en cada modalidad en concreto, y que además:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Cumplan los requisitos para obtener la condición de beneficiario previstos en el artículo 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, en relación al artículo 10 del Decreto legislativo 2/2005, del 28 de diciembre, por el cual se aprueba el texto refundido de la Ley de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Y estén al corriente de las obligaciones tributarias con la hacienda estatal y autonómica y con la Seguridad Social y no tengan deudas con el Consell Insular de Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3.2. Obligaciones de las personas beneficiarias:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a)&lt;/em&gt; Cumplir los requisitos que fundamentan la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b)&lt;/em&gt; Comunicar al Consell Insular de Ibiza cualquier eventualidad que altere o dificulte el desarrollo de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c)&lt;/em&gt; Someterse a las actuaciones de comprobación, de seguimiento y de inspección que pueda efectuar el Consell Insular de Ibiza y aportar toda la información y la documentación que le sea requerida en el ejercicio de estas actuaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d)&lt;/em&gt; Comunicar al Consell Insular de Ibiza la solicitud y/o la obtención de otras subvenciones para la misma finalidad procedentes de cualquier administración o entidad pública o privada, nacional o internacional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;e)&lt;/em&gt; Reintegrar, si es el caso, los fondos percibidos en los supuestos previstos legalmente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;f&lt;/em&gt;) Y, en cualquier caso, cumplir con las obligaciones de los beneficiarios previstos en el artículo 11 Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones, en relación con el artículo 14 de la Ley 38/2003, de 17 de noviembre, general de subvenciones (LGS).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;4. Créditos presupuestarios y cuantías de las subvenciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;4.1. La cantidad total del presupuesto del 2021 destinada para estas ayudas es de 80.000 euros, la cual se distribuye de la forma siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Modalidad A: 70.000 euros con cargo a la aplicación presupuestaria 3410 48100&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Modalidad B: 10.000 euros con cargo a la aplicación presupuestaria 3410 48100&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;4.2. En el caso que la concesión de las ayudas de la modalidad A o B no agote la cantidad que tiene destinada, el sobrante del importe podrá incorporarse a la cantidad de la otra modalidad, si el crédito establecido para esta fuese insuficiente para cubrir el total de personas beneficiarias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;5. Régimen de las ayudas y compatibilidad&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;5.1. Las ayudas no generan ningún derecho para la obtención de otras subvenciones en ejercicios posteriores y no se pueden alegar como precedente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;5.2. Estas ayudas son compatibles con otras ayudas, ingresos o recursos para la misma finalidad, procedente de cualquier otra administración, ente público o privado, nacional o de la Unión Europea o de organismos internacionales. A este efecto, la persona beneficiaria tendrá que comunicar al Consell Insular de Ibiza la solicitud o la obtención de otras subvenciones para la misma finalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;5.3. En ningún caso, el importe de las subvenciones no podrá ser de tal cuantía que, aisladamente o en concurrencia con otras subvenciones, ayudas, ingresos o recursos, supere el coste de la actividad subvencionada (artículo 20 del Decreto Legislativo 2/2005, de 28 de diciembre, en relación al artículo 19 de la LGS), excepto en los supuestos de la modalidad A en los cuales se premia los éxitos deportivos (a tenor de la disposición adicional séptima de la LGS).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;5.4. En el caso que las personas que resulten beneficiarias de estas ayudas hayan recibido otras de otras administraciones o de otras entidades, tendrán que tener en cuenta si aquellas otras ayudas son compatibles o no con las del Consell y, en caso que no sean compatibles, tendrán que de optar por la ayuda que consideren más apropiada y si procede, renunciar a la del Consell (anexo 7).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;5.5. El hecho de solicitar estas ayudas significa la aceptación plena de las condiciones contenidas en las bases de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;6. Presentación de solicitudes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6.1. &lt;/span&gt;Las solicitudes de las ayudas de formalizarán mediante instancia, debidamente cumplimentada, según el modelo normalizado que figura como Anexo 1 de estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Se dirigirán a la Presidencia del Consell Insular de Ibiza y se presentarán en el Registro General del Consell de Ibiza (av. España, 49, 07800 Ibiza), en Sede Electrónica en la dirección&lt;/span&gt;&lt;span style="color:null"&gt; seu.conselldeivissa.es&lt;/span&gt;&lt;span style="color:#000000"&gt; o en el resto de lugares establecidos a la artículo 16 de la Ley 39/2015, de1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;7. Documentación a presentar&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7.1. &lt;/span&gt;La documentación general que se tiene que presentar, además de la específica para cada modalidad de subvención, es la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;a) Impreso de solicitud debidamente cumplimentado y firmado por la persona solicitante (Anexo 1). &lt;span style="color:#000000"&gt;Si la persona solicitante es menor de edad la solicitud, la tendrá que cumplimentar y firmar su representante legal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;b) Documentación acreditativa de la identidad de la persona solicitante de su persona representante legal, si es el caso. Para personas extranjeras: NIE y pasaporte/tarjeta de identidad del solicitante, y del representante legal, si es el caso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;c) Libro de familia si el deportista es menor de edad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;d) Para el caso de que la persona solicitante no haya nacido en la isla de Ibiza pero tenga una antigüedad de residencia de seis años en la isla, se tendrá que presentar certificado de empadronamiento expedido por el ayuntamiento correspondiente de la isla de Ibiza, en el que conste la antigüedad de residencia en el municipio correspondiente. Para el caso de que la persona solicitante haya residido en diferentes municipios en los últimos seis años, se tendrá que presentar los certificados acreditativos respectivos de cada ayuntamiento. No se admitirán a tal efecto los certificados de residente. Los nacidos en Ibiza no necesitarán presentar este documento ya que el lugar de nacimiento quedará reflejado en la documentación acreditativa de la identidad presentada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;e) En el caso de que en la solicitud no se autoriza al Consell Insular de Ibiza a consultar si la persona solicitante se encuentra al corriente de sus obligaciones tributarias, documentación acreditativa de estar al corriente de las obligaciones tributarias con la Comunidad Autónoma de las Islas Baleares, con el Estado español y con la Seguridad Social. Si la petición de ayuda es igual o inferior a 3.000 €, esta documentación acreditativa podrá substituirse por una declaración responsable de estar al corriente en el cumplimiento de las obligaciones tributarias ante la Comunidad Autónoma de las Islas Baleares, con el Estado español y con la Seguridad Social, según el modelo que figura como Anexo 5 de estas bases, todo de conformidad con el artículo 11.&lt;em&gt;f&lt;/em&gt; del Decreto legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el texto refundido de la Ley de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;f) Declaración responsable firmada por la persona solicitante o por su representante legal, si acaso, que reúne los requisitos para obtener la condición de beneficiario de conformidad con lo establecido en el artículo 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, en relación con el artículo 10 del Decreto legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el texto refundido de la Ley de subvenciones, que conoce y se compromete a cumplir las obligaciones contenidas en el artículo 14 de la Ley 38/2003, en relación con el artículo 11 del Decreto legislativo 2/2005, y que se encuentra al corriente con sus obligaciones tributarias con la Hacienda estatal y autonómica, con la seguridad Social y con el Consell Insular de Ibiza; también de haber solicitado o no ayuda económica a otras entidades públicas o privadas para llevar a cabo las mismas actuaciones de la presente subvención, según el modelo que figura en el anexo de estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;g) Solicitud de alta o modificación como acreedor del Consell Insular a efectos económicos a nombre de la persona solicitante, debidamente rellenada, firmada y sellada por la entidad bancaria. Esta solicitud o modificación se puede realizar a través de la sede electrónica del Consell Insular de Ibiza (seu.conselldeivissa.es) y se dirigirá directamente a la Tesorería de este Consell. Únicamente deberá presentarse si no consta en el Consell o bien se ha producido alguna modificación en la que ya consta. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;De conformidad con los artículos 53.&lt;em&gt;d&lt;/em&gt; de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas, y 23.3 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, no hará falta presentar los documentos mencionados en los apartados &lt;em&gt;b&lt;/em&gt; y &lt;em&gt;c &lt;/em&gt;cuando esta documentación ya conste en el Consell Insular de Ibiza y no haya habido ningún cambio; siempre que se indique según el modelo del Anexo 4 la fecha en que se presentó y no hayan transcurrido más de cinco años desde la finalización del procedimiento por el cual se presentaron, y se autorice expresamente al Consell para su utilización en esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;8. Plazo de presentación de solicitudes y publicidad de la convocatoria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8.1. El plazo para presentar las solicitudes será de &lt;strong&gt;diez días hábiles&lt;/strong&gt;, que se inicia al día siguiente de la fecha de publicación del extracto de la convocatoria de las ayudas reguladas en estas bases en el &lt;em&gt;Boletín Oficial de las Islas Baleares &lt;/em&gt;(BOIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;8.2. Una vez aprobadas las bases, se publicarán en el BOIB. Posteriormente se remitirán la convocatoria y su extracto en la Base de Datos Nacional de Subvenciones, que dará traslado al BOIB del extracto para su publicación, tal como establece la normativa vigente de subvenciones. La eficacia de la convocatoria queda supeditada a la publicación del extracto en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;9. Enmienda y mejora de la solicitud&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;9.1. Después que haya finalizado el plazo de presentación de solicitudes, el Departamento de Hacienda, Gestión Económica, Deportes y Juventud dará a conocer una lista en la que se requerirá a las personas interesadas, si la solicitud no reúne los requisitos establecidos en estas bases, que la enmienden.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;9.2. Esta lista de enmiendas, que contendrá los identificativos de las personas solicitantes y el detalle de las enmiendas a realizar, se publicará en el tablón de anuncios del Consell y en la página web&lt;span style="color:null"&gt; www.conselldeivissa.es &lt;/span&gt;(Convocatorias y ayudas).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;9.3. De acuerdo con lo que dispone el artículo 68.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, las personas interesadas podrán enmendar su solicitud en el plazo de diez días hábiles, a contar desde el día siguiente de haberse publicado la lista de enmiendas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;9.4. Si en el plazo de diez días hábiles la persona interesada no hace la rectificación reclamada o no presenta la complementación requerida, el Consell Insular de Ibiza, después de haber tomado la resolución pertinente, considerará que la persona solicitante desiste de su petición. El conseller ejecutivo del Departamento de Hacienda, Gestión Económica, Deportes y Juventud dictará esta resolución por delegación del Consell Ejecutivo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;9.5. El órgano instructor podrá requerir, en cualquier momento de la tramitación del expediente, los documentos complementarios que se consideren necesarios, al efecto de garantizar la inversión correcta de los recursos presupuestarios destinados a las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;10. Procedimiento de concesión de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;10.1. De acuerdo con el artículo 22.1 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, el procedimiento de concesión de estas ayudas se tramitará en régimen de concurrencia no competitiva, de acuerdo con los principios de publicidad, de objetividad, de transparencia, de igualdad y de no discriminación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="color:#000000"&gt;10.2. Se entiende por &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;concurrencia competitiva &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;el procedimiento mediante el cual la concesión de las subvenciones se realiza por comparación de las solicitudes presentadas, con la finalidad de establecer una prelación entre sí, de acuerdo con los criterios de valoración y adjudicar, con el límite fijado en las bases, el crédito disponible según la valoración obtenida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;10.3. La comisión evaluadora después de examinar la documentación presentada por cada persona solicitante adjudicará las cantidades económicas correspondientes de acuerdo a los criterios siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;10.3.1. Modalidad A: &lt;span style="color:#000000"&gt;A cada persona solicitante se le adjudicará la ayuda correspondiente de acuerdo a los criterios establecidos en la base 19.A.4.2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="color:#000000"&gt;10.3.2 &lt;/span&gt;&lt;span style="color:#000000"&gt;Modalidad B: &lt;/span&gt;&lt;span style="color:#000000"&gt;A cada persona solicitante se le adjudicará la ayuda correspondiente de acuerdo a los criterios establecidos en la base 19.B.4.2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;En el caso que la persona beneficiaria pida ayuda para más de una acción formativa, la ayuda concedida no podrá superar la cantidad de 1.000 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;En el caso que la persona solicite una ayuda inferior a 1.000 euros la cantidad concedida será la solicitada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;10.3.3. En el caso que la cuantía total establecida en la modalidad A y/o B no fuese suficiente para cubrir el número de solicitudes con derecho a obtener la condición de persona beneficiaria, se prorrateará el importe de la modalidad que corresponda entre todas las solicitudes con derecho a obtener la condición de persona beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;La fórmula de prorrateo a aplicar será la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="color:#000000"&gt;DT&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;A = ------ X CB&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;CS&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Donde:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;A = importe de la ayuda a conceder.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;DT = dotación económica de la modalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;CS = cuantía total resultante de todas las solicitudes con derecho a ser persona beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;CB = cantidad correspondiente a la persona beneficiaria según los criterios de valoración establecidos a cada una de las modalidades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;10.3.4. La persona beneficiaria puede recibir una ayuda para cada una de las modalidades pero la suma total no podrá superar la cantidad de 10.000 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;10.3.5. En el caso que la concesión de las ayudas de la modalidad B no agote la cantidad que tiene destinada, el sobrante del importe podrá incorporarse a la cantidad de la modalidad A si el crédito establecido para ésta fuera insuficiente para cubrir el total de personas beneficiarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;11. Comisión evaluadora&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;11.1. La comisión evaluadora es el órgano colegiado al cual corresponden las funciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Estudiar, evaluar y cualificar las solicitudes y la documentación necesaria para la justificación, de acuerdo con los criterios establecidos en estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Emitir una acta con un informe que debe servir de base para elaborar la propuesta de resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;11.2. La comisión evaluadora puede instar al órgano instructor para que requiera a las personas solicitantes los informes o las aclaraciones que se consideren convenientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;11.3. La comisión estará autorizada a resolver las dudas que se presenten y a adoptar los acuerdos necesarios para el buen orden del proceso previsto en estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;11.4. La comisión evaluadora estará constituida por:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#0d0a0a"&gt;Presidente/a&lt;/span&gt;&lt;span style="color:#0d0a0a"&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#0d0a0a"&gt;- Titular: Ricardo Gómez Romero, técnico superior de deportes del &lt;/span&gt;&lt;span style="color:#0d0a0a"&gt;Departamento de Hacienda, Gestión Económica, Deportes y Juventud &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;12. Instrucción, resolución y notificación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;12.1. Órganos competentes para la ordenación, la instrucción y la resolución&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El Departamento de Hacienda. Gestión Económica, Deportes y Juventud del Consell Insular de Ibiza es el competente para instruir el procedimiento de concesión de estas ayudas, de conformidad con lo establecido en el apartado 8.&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;g &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;del a&lt;/span&gt;&lt;span style="color:#000000"&gt;rtículo tercero del Decreto de Presidencia núm. 2020000768, de modificación del Decreto de Presidencia núm. 2019000471, de fecha 10-07-2019, de estructura de gobierno del Consell Insular de Ibiza y de creación de departamentos, y del Decreto de Presidencia núm. 2019000484, de fecha 16-07-2019, de determinación de las atribuciones correspondientes a los diferentes órganos del Consell Insular de Ibiza (BOIB núm. 153, de 5 de septiembre de 2020). Dentro de este Departamento corresponde al conseller ejecutivo la ordenación del procedimiento, en virtud del artículo primero&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; i &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;del Decreto de Presidencia núm 484/2020, de fecha 16 de julio de 2020, de determinación de las atribuciones correspondientes a los diferentes órganos del Consell Insular de Ibiza (BOIB núm. 98 EXT., de 17-07-2020; modificaciones en el BOIB núm. 175, de 31-12-2019, y en el BOIB núm. 101, de 4-06-2020).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En lo referente a la competencia para aprobar esta convocatoria, de conformidad con lo establecido en el artículo tercero, apartado &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;, del Decreto de Presidencia núm. 484/2020, de fecha 16 de julio, de determinación de las atribuciones correspondientes a los diferentes órganos del Consell Insular de Ibiza, corresponde al Consell Ejecutivo "Aprobar y resolver las convocatorias de ayudas o subvenciones a particulares o entidades públicas o privadas de importe superior a quince mil euros (15.000 euros)".&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;12.2 Con fundamento en el informe de la comisión evaluadora, y de conformidad con el artículo 24.4 de la LGS, el órgano instructor formulará la propuesta de resolución provisional, debidamente motivada, que expresará la relación de personas beneficiarias para las cuales se propone la concesión de la ayuda y su cuantía; igualmente, si es el caso, en las solicitudes excluidas o para las cuales se propone la desestimación/denegación, se indicará la causa de exclusión o desestimación/denegación. Esta propuesta de resolución provisional se expondrá en sede electrónica del Consell Insular de Ibiza, y se abrirá un plazo de diez días hábiles para presentar alegaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Las personas que se proponen como beneficiarias de estas ayudas en la propuesta de resolución provisional dispondrán de un plazo de diez días hábiles, a partir del día siguiente de su publicación, para comunicar al Departamento de Hacienda, Gestión Económica, Deportes y Juventud la aceptación de la ayuda. Así mismo, la aceptación se entenderá producida automáticamente si en dicho plazo no se hace constar lo contrario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Así mismo, en el caso que quiera renunciar a esta ayuda, tendrá que presentar el anexo 7 de estas bases, también dentro del plazo de diez días hábiles, contadores a partir del día siguiente de la publicación de la propuesta de resolución provisional. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Si alguna de las personas solicitantes presenta alegaciones dentro del plazo establecido, la comisión evaluadora las examinará y emitirá un nuevo informe en que, de manera razonada, las estimará o desestimará. Basándose en este nuevo informe se formulará la propuesta de resolución definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Si no hay ninguna alegación, el órgano instructor formulará la propuesta de resolución definitiva. Con fundamento en la propuesta de resolución definitiva del órgano instructor, las ayudas se concederán, por delegación del Consell Ejecutivo, mediante la resolución del conseller ejecutivo del Departamento de Hacienda, Gestión Económica, Deportes y Juventud donde expresará la relación de entidades subvencionadas y la cuantía de la ayuda; igualmente, si es el caso, en las solicitudes excluidas y/o desestimadas/denegadas, se indicará la causa de exclusión y/o desestimación/denegación, así como las entidades que hayan renunciado a la ayuda concedida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;12.3. De acuerdo con el artículo 25.4 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, el plazo máximo para resolver y notificar el procedimiento no excederá los seis meses, contados a partir de la publicación del extracto de la convocatoria en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;12.4. La notificación de la resolución se tiene que hacer con las exigencias y en la forma prevista en los artículos 40 a 46 de la Ley 39/2015, del 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;12.5. En cumplimiento del artículo 34 del Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones se tiene que publicar en la Base de Datos Nacional de Subvenciones (BDNS) la convocatoria, el crédito presupuestario al cual se imputan, la relación de personas subvencionadas, y la cuantía de la ayuda concedida y el objetivo o finalidad de la subvención, incluidas las inferiores a 3.000 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;12.6. La presentación de la solicitud de las ayudas de esta convocatoria comportará la autorización de las personas solicitantes en el Departamento de Hacienda, Gestión Económica, Deportes y Juventud, a publicar los datos relativos a su identidad que resulten imprescindibles para tramitar este procedimiento administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:0.18cm"&gt;12.7. El Consell Insular de Ibiza podrá utilizar en cualquier momento del procedimiento los medios de control oportunos (inspecciones, visitas, solicitud de aportación de nuevos documentos y/o aclaraciones, etc.) para la aplicación correcta de la ayuda concedida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;13. Pago de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;13.1 Modalidad A:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;El pago de las ayudas concedidas se realizará conjuntamente a la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;13.2. Modalidad B:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Antes de efectuarse el pago y una vez ejecutadas las actuaciones subvencionadas será necesario presentar una cuenta justificativa simplificada con la siguiente información para poder efectuar el pago:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Una memoria de actuación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Una relación clasificada del total de los gastos de la actividad subvencionada, con identificación del acreedor y del documento, del concepto, de su importe, de la fecha de emisión y de la fecha de pago, según el modelo del anexo 6.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Relación detallada de otros ingresos o subvenciones que hayan financiado la actividad subvencionada, con indicación del importe y su procedencia, según el modelo del Anexo 6.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Facturas por la totalidad del gasto de la actividad subvencionada. Se&lt;/span&gt;&lt;span style="color:#000000"&gt; requerirá la justificación del pago de los gastos realizados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Certificado de asistencia a la actividad formativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Las facturas han de estar emitidas entre el 1 de enero de 2020 y el 1 de octubre de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;El plazo para justificar será de 20 días hábiles a partir de la notificación de la subvención concedida. Si la actividad formativa todavía no ha finalizado, el plazo será de 20 días hábiles a partir de su realización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;El pago tiene que haberse realizado antes de finalizar el correspondiente plazo de justificación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Con la documentación presentada y con el informe técnico favorable del Departamento de Hacienda, Gestión Económica, Deportes y Juventud sobre el cumplimiento del objeto de la subvención y los criterios de las bases de esta convocatoria se emitirá informe propuesta y, por delegación del Consell Ejecutivo, se hará efectivo el pago mediante resolución del consejero ejecutivo del Departamento de Hacienda, Gestión Económica, Deportes y Juventud del Consell Insular de Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;La acreditación del pago de los justificantes de los gastos aportados por las personas beneficiarias se tiene que llevar a cabo a través de la documentación que a continuación se indica, dependiendo de los medios de pago que se hayan utilizado:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;a)&lt;/em&gt; Pago mediante transferencia bancaria o ingresos en cuenta bancaria:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Documento bancario acreditativo del pago en el cual figuren el concepto de la transferencia o el ingreso, la fecha del documento, el importe, los datos del ordenante y del destinatario, que tienen que coincidir con el beneficiario y con el emisor de la factura, respectivamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;b)&lt;/em&gt; Pago en metálico (hasta un máximo de 2.500 €)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Documento justificativo del gasto (por ejemplo, factura) con la expresión “recibido en metálico”, “pagado” o similar, firmada por el proveedor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;c)&lt;/em&gt; Pago mediante cheque nominativo:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Documento justificativo del gasto (por ejemplo, factura) con la expresión “recibido en cheque nominativo” o similar, firmada por el proveedor con la fecha y con indicación del nombre y del número de acreditación de identidad de la persona que firma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;13.3. El pago de las ayudas se realizará mediante transferencia bancaria y al número de cuenta bancaria que conste en la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;13.4. La percepción de estas ayudas está sujeta a la normativa fiscal vigente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;14. Ré&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;gimen de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;14.1. El acuerdo del Consejo ejecutivo que apruebe las bases reguladoras de estas ayudas no agota la vía administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;14.2. Las resoluciones del conseller ejecutivo del Departamento de Hacienda, Gestión Económica, Deportes y Juventud,&lt;/span&gt; dictadas por delegación, y que se tienen que considerar dictadas por el órgano delegante (en este caso el Consell Ejecutivo), no agotan la vía administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;14.3. Contra el acuerdo del Consell Ejecutivo de aprobación de las bases reguladoras de las ayudas y las resoluciones del conseller ejecutivo del Departamento de Hacienda, Gestión Económica, Deportes y Juventud, dictadas por delegación del Consell Ejecutivo, se podrá interponer ante la Comisión de Gobierno el recurso de alzada previsto en los artículos 112.1, 121 y 122 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, en el plazo de un mes desde el día siguiente de su notificación, todo esto en virtud de lo que disponen los artículos 22.2 de la Ley 8/2000, de 27 de octubre, de consells insulares y el artículo 147.1 del Reglamento orgánico del Consell Insular de Ibiza (publicado en el BOIB núm. 136, de 18-09-10; corrección en el BOIB núm. 148, de 14-10-10; modificación en el BOIB núm. 48, de 16-04-16). El recurso tendrá que resolverse en el plazo de tres meses, transcurridos los cuales sin que se haya dictado resolución expresa, se entenderá desestimado y quedará abierta la vía contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;15. Régimen jurídico&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;15.1. Estas ayudas se rigen por las presentes bases, por la Ley 38/2003, de 17 de noviembre, general de subvenciones, por el Real Decreto 887/2006, de 21 de julio, que aprueba el Reglamento de la Ley General de Subvenciones, por el Decreto Legislativo 2/2005, de 28 de diciembre, que aprueba el texto refundido de la Ley de Subvenciones de las Islas Baleares, de aplicación a estas ayudas en virtud de su disposición adicional segunda, al tratarse de una competencia transferida por la Comunidad Autónoma de las Islas Baleares a los consells insulares, y por la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;15.2. Respecto de la protección y el tratamiento de datos de carácter personal para la realización de las actividades objeto de esta convocatoria se tienen que observar las prescripciones contenidas en la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos y garantía de los derechos digitales, en el Reglamento (UE) 2016/679 del Parlamento y del Consell, de 27 de abril de 2016, relativo en la protección de las personas físicas por el que hace al tratamiento de datos personales y a la libre circulación de estos datos y por el cual se deroga la Directiva 95/46/CE (Reglamento general de protección de datos - DOUE 4.5.2016), y al resto de legislación vigente en materia de protección de datos personales, que sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;16. Revocación y reintegro de las ayudas.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;16.1. Las ayudas concedidas se podrán revocar, por delegación del Consejo Ejecutivo, mediante resolución del consejero ejecutivo del Departamento de Hacienda, Gestión Económica, Deportes y Juventud. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;16.2. De acuerdo con lo que dispone el artículo 43 del texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, se revocará la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho, la persona beneficiaria incumpla las obligaciones o los compromisos contraídos en los cuales está condicionada la eficacia del acto de concesión de la subvención. En tal caso, quedará sin efecto el acto de concesión, &lt;/span&gt;como consecuencia de la revocación corresponderá reintegrar la ayuda recibida por las personas beneficiarias y, si procede, la exigencia del interés de demora, en los casos previstos en el artículo 44 del Decreto ley 2/2005, de 28 de diciembre, por el cual se aprueba el texto refundido de la Ley de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;16.3. El reintegro se realizará por el procedimiento establecido en el título II de la Ley general de subvenciones, en el cual se tiene que garantizar la audiencia a las personas interesadas. Las cantidades reintegrables tienen la consideración de ingresos de derecho público y pueden ser exigidas por la vía de apremio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;17. Gradación de los posibles incumplimientos de las condiciones impuestas con motivo de la concesión de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;17.1. De conformidad con el artículo 17.3.&lt;em&gt;n &lt;/em&gt;de la Ley general de subvenciones, en relación con el artículo 37.2 de la misma ley, se establecen los siguientes criterios de graduación del posible incumplimiento material de la actividad objeto de esta subvención, y siempre que los beneficiarios acrediten una actuación inequívoca tendente a la satisfacción de sus compromisos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;​​​​​​​&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;18. Régimen de infracciones y sanciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;18.1. El régimen de infracciones y sanciones administrativas aplicables será el establecido en el título IV de la Ley 38/2003, de 17 de noviembre, general de subvenciones, y en el título V del texto refundido de la Ley de Subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre. Todo esto sin perjuicio de las responsabilidades penales o civiles en que se pueda incurrir.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;19. &lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;Condiciones específicas para cada una de las modalidades&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;19.1. &lt;/span&gt;Además de las condiciones generales contenidas en las cláusulas anteriores, cada modalidad está sujeta al cumplimiento de las siguientes condiciones específicas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;A. MODALIDAD A: ayudas económicas individuales para promocionar a las personas deportistas destacadas de la isla de Ibiza y las personas deportistas de la isla de Ibiza inscritas en centros de tecnificación deportiva (CTE) o centros de alto rendimiento (CAR) fuera de Ibiza.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;A.1. Objeto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;A.1.1. El objeto de esta convocatoria es, por una parte, la concesión de ayudas económicas a las personas deportistas destacadas de la isla de Ibiza, premiando su rendimiento y progreso deportivo, obtenido durante el año 2020, con el objetivo de incentivar su práctica deportiva, facilitar la mejora de su rendimiento y optimizar su participación en competiciones deportivas; y por otra, la concesión de ayudas económicas a las personas deportistas de la isla de Ibiza que realicen su formación en cualquier centro oficial, clasificado por Consejo Superior de Deportes (de ahora en adelante CSD) como centro de tecnificación deportiva (de ahora en adelante CTE) o centro de alto rendimiento (de ahora en adelante CAR), fuera de Ibiza, durante el curso 2020-21, para que puedan desarrollar sus potencialidades al máximo, consiguiendo el más alto nivel deportivo y fomentando la formación integral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;A.2. Personas beneficiarias&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;A.2.1. Pueden ser beneficiarias de estas ayudas las siguientes personas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Personas deportistas de la isla de Ibiza clasificadas en el año 2020, en su categoría deportiva, entre las ocho primeras del campeonato de Europa o del Mundo correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Personas deportistas de la isla de Ibiza clasificadas en el año 2020, en su categoría deportiva, entre las cinco primeras del campeonato de España correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Personas deportistas de la isla de Ibiza que hayan estado convocadas con la selección española respectiva durante el año 2020.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Persona deportista nombrada como mejor deportista de la isla de Ibiza a los Premios del Deporte del Consell de Ibiza en el año 2020.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Personas deportistas de la isla de Ibiza que hayan estado inscritas durante el curso 2020-2021 en cualquier CTE o CAR fuera de las islas Pitiusas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="color:#000000"&gt;A.2.2. Las personas beneficiarias de estas ayudas tienen que cumplir con los requisitos establecidos en la base tercera&lt;/span&gt; y además:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Los deportes en que participan deben ser federados y reconocidos por el CSD.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Cuando su participación en un campeonato de España sea dentro de una selección autonómica, tendrá que ser en representación de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Cuando su participación en competiciones internacionales sea en representación de una selección, tendrá que ser como integrante de la selección española correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;A.2.3. Quedan excluidos de esta línea de ayudas los resultados conseguidos en los campeonatos de España universitarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;A.3. Solicitud y documentación necesaria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;A.3.1. En el momento de presentación de la solicitud, junto con la documentación prevista en la base séptima, hay que presentar la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Certificado de la Federación Balear o Española correspondiente acreditativo de la posición obtenida por la persona solicitante en el campeonato de España, de Europa o del Mundo del año 2020, si es el caso. Este certificado deberá especificar el nombre del deportista, &lt;/span&gt;&lt;span style="color:#000000"&gt;países participantes (si es el caso),&lt;/span&gt;&lt;span style="color:#000000"&gt; el resultado obtenido y la categoría en la cual ha participado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Certificado del responsable del CTE o del CAR que indique que la persona solicitante ha sido inscrita durante el curso 2020-2021 en el mencionado centro, si es el caso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Certificado de mejor deportista de los Premios del Deporte del Consell Insular de Ibiza del año 2020, si es el caso. Con solicitud previa, el Departamento de Hacienda, Gestión Económica, Deportes y Juventud adjuntará el certificado correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;​​​​​​​&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;A.4. Criterios para determinar el importe de la adjudicación de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;A.4.1. Para determinar el importe de las ayudas que correspondan a cada persona beneficiaria se valorará solo el mejor resultado deportivo de cada año obtenido de entre los que se indican en la tabla que figura a continuación, a excepción del importe correspondiente a estar inscrito/a en un CTE o en un CAR, y el resultado por haber sido nombrado/a como mejor deportista del año 2020, que se sumarán a las cantidades del mejor resultado deportivo obtenido, si es el caso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

La cantidad adjudicada como consecuencia de resultados conseguidos por formar parte de un equipo (selecciones autonómicas, de clubs, etc.), tendrá una reducción del 20% sobre el baremo anterior.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;A.4.4. No se han de evaluar los resultados de equipo que se calculen a partir de los resultados individuales de sus deportistas componentes, cuando, además de la clasificación por equipos, haya una clasificación individual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

MODALIDAD B: Ayudas económicas individuales para el personal técnico deportivo de la isla de Ibiza por participar en cursillos y/o actividades de formación técnica deportiva fuera de las islas Pitiusas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;B.1. Objeto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;B.1.1. El o&lt;/span&gt;&lt;span style="color:#00000a"&gt;bjeto de esta convocatoria es la concesión de ayudas económicas al personal técnico deportivo de la isla de Ibiza para la participación en actividades formativas relacionadas con el deporte (presenciales y/o semipresenciales) durante los años 2020 y 2021 fuera de las islas Pitiusas&lt;/span&gt;&lt;span style="color:#00000a"&gt;, con la finalidad de &lt;/span&gt;&lt;span style="color:#00000a"&gt;fomentar su formación continua y permanente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;B.1.2. L&lt;/span&gt;a formación incluida en estas ayudas son:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Las enseñanzas deportivas de nivel I, II i III, según la Orden ECD/158/2014, de 5 de febrero, de su correspondiente deporte.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#4f81bd"&gt;&lt;span style="color:#000000"&gt;- Actividades formativas relacionadas con el deporte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Doctorados en materia deportiva&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;B.1.3 Queda excluida del objeto de estas ayudas la realización de la formación siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Grado de ciencias de la actividad física y del deporte.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Grado de educación primaria y/o infantil.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Formación profesional deportiva (ciclos formativos de grado medio y/o superior).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;B.1.4. Se podrá solicitar ayuda económica para la participación dentro de un máximo de cuatro actividades formativas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;B.1.5. Quedan fuera de esta convocatoria las solicitudes de ayuda de cursillos y/o actividades de formación que hayan sido ya efectivamente subvencionadas (reconocimiento de la obligación y pago) por el Consell Insular en la convocatoria de ayudas correspondiente al año 2020.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;B.2. Personas beneficiarias&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="color:#000000"&gt;B.2.1. Pueden ser personas beneficiarias de estas ayudas el personal técnico deportivo &lt;/span&gt;de la isla de Ibiza que quieran realizar actividades formativas relacionadas con el deporte de las previstas en el punto B.1.2, impartida fuera de las islas Pitiusas durante los años 2020 y 2021, y&lt;span style="color:#000000"&gt; que además cumplan con los requisitos establecidos en la base 3.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;B.2.2. No podrá solicitar la ayuda económica de esta modalidad el personal funcionario o laboral adscrito al Departamento de Hacienda, Gestión Económica, Deportes y Juventud del Consell de Ibiza, en la Conselleria de Deportes o en cualquier organismo deportivo del Gobierno de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;B.3. Solicitud y documentación necesaria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;B.3.1. En el momento de la presentación de la solicitud, juntamente con la documentación prevista en la base 7, es necesario presentar la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Descripción de la actividad formativa relacionada con el deporte a la cual se pretende asistir (contenido, fechas, lugar, etc.), firmada por la persona solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Presupuesto de ingresos y gastos de la actividad formativa para la cual se pide ayuda, firmado por la persona solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;B.4. Criterios para determinar el importe de la adjudicación de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Las personas titulares de los datos objeto de tratamiento podrán ejercitarse los derechos de acceso, rectificación, portabilidad, cancelación y oposición, dirigiendo escrito, de forma electrónica (seu.conselldeivissa.es) o presencial según corresponda, al Consell Insular de Ibiza, av de España 49 07800 Ibiza. Así mismo, tienen el derecho a presentar reclamación ante la autoridad de control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
