    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la cual se convocan subvenciones para Inversiones a las explotaciones agrícolas, para los años 2015-2019, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el Boletín Oficial de las Islas Baleares&amp;nbsp;de acuerdo con los términos que prevee el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantia Agraria y Pesquera de las Islas Baleares (FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en Materia Agraria del FOGAIBA, con fecha de 9&amp;nbsp;de marzo&amp;nbsp;de 2021, dicta lo siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha de 16 de julio de 2015 se publicó, en el Boletín Oficial de las Islas Baleares núm. 106, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias, modificada mediante las resoluciones de fecha 17 de diciembre de 2015 (BOIB núm. 185), en fecha 22 de junio de 2016, (BOIB núm. 81) y en fecha 26 de junio de 2018 (BOIB núm. 80).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.El 10 de septiembre de 2020, el secretario general de la Consejería de Agricultura, Pesca y Alimentación dictó una Resolución de concesión de ayudas para inversiones en las explotaciones agrarias, que se publicó en el Boletín Oficial de las Islas Baleares número 161, del 17 de septiembre de 2020, en la que figuraba una concesión a favor de los interesados señalados en el Anexo I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.El 29 de enero de 2021, el interesado RAFAEL IGNACIO TALTAVULL CAVALLER, con NIF*** 4381** con registro de entrada núm. L95E1418, ha presentado un escrito de renuncia parcial de la ayuda de concesión alegando que se han modificado las inversiones de la construcción de la nave agrícola reduciendo los importes de las inversiones previstas, aunque como es posterior a la concesión se trata de una renuncia parcial, lo que supone llevar a cabo la revocación parcial de la ayuda concedida.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.El 15 de octubre de 2020, el interesado JAIME JOSE LLABRÉS MIQUEL, con NIF***6693** con registro de entrada núm.22552/2020 ha presentado un escrito de renuncia parcial de la ayuda de concesión alegando que no llevará a cabo la adquisición del nebulizador y la pala cargadora, aunque como es posterior a la concesión se trata de una renuncia parcial, lo que supone llevar a cabo la revocación parcial de la ayuda concedida.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.Por&amp;nbsp;todo ello, se propone aceptar la renuncia parcialsol·licitada y hacer la revocación parcial de la ayuda concedida por los beneficiarios que se indican en el anexo I de esta resolución.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Orden del Consejero de Agricultura Medio Ambiente y Territorrio de 19 de febrero de 2015, por la que s'extebeixen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Propuesta de resolución&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente del desistimiento y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Aceptar la renuncia y revocar parcialmente la resolución de ayuda concedida a los beneficiarios detalladas en el anexo I, que son un total de 2 expedientes y que empieza por JAIME JOSÉ LLABRÉS MIQUEL, y termina con RAFAEL IGNACIO TALTAVULL CAVALLER y por el importe indicado en el anexo de esta resolución.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Determinar que, de acuerdo con lo establecido en la convocatoria de referencia, las obligaciones de los beneficiarios serán las indicadas en el anexo II.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.Notificar esta resolución mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante el conseller de Medio Ambiente, Agriculturay&amp;nbsp;Pesca, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares, y los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
