    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la cual se convocan subvenciones para Inversiones a las explotaciones agrícolas, para los años 2015-2019, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;em&gt;&lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;&lt;/em&gt;&amp;nbsp;de acuerdo con los términos que prevé&amp;nbsp;el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en Materia Agraria del FOGAIBA, con fecha de 3&amp;nbsp;de marzo&amp;nbsp;de 2021, dicta lo siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias. La Resolución mencionada se modificó en fecha 17 de diciembre de 2015 (BOIB núm. 185), en fecha 22 de junio de 2016, (BOIB núm. 81) y 26 de junio de 2018 (BOIB núm. 80).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de Agro &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Qua&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;li&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;t&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;t&amp;nbsp;Balears SL, a la resolución de concesión INEA2016_2/R35; Id:8882 de fecha 22 de octubre de 2019, que fue notificada en fecha 14 de noviembre de 2019 en la publicación número 155 del Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.Considerando la Resolución de concesión de la ayuda mencionada, y de acuerdo con lo establecido en el apartado décimo de la convocatoria antes mencionada, el beneficiario se obliga, entre otras, a realizar las actuaciones auxiliadas dentro del plazo establecido y en justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en el modo y los plazos determinados en la convocatoria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.El 13 de julio de 2020, el interesado presenta la solicitud de pago así como la documentación exigida, pero, una vez examinada esta solicitud de pago, se comprueba que las facturas y las órdenes de transferencia son todas de fecha posterior al 14 de mayo de 2020, esto es posterior a la fecha límite para justificar la inversión que era de 6 meses desde la fecha de la concesión de fecha el 14 de noviembre de 2019, por lo tanto fuera del plazo establecido, según el punto 2 del apartado duodécimo, que establece que la actuación subvencionada deberá estar realizada y pagada por el beneficiario en el período comprendido entre la fecha de comienzo del período de elegibilidad previsto en el apartado cuarto de la Resolución, que en el punto 3 regula que de conformidad con lo dispuesto en la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del programa de Desarrollo Rural de las Islas Baleares 2014-2020, sólo serán subvencionables los gastos realizados después de la presentación de la solicitud de ayuda y el plazo, en este caso de inversión mueble, de seis meses, a contar desde la notificación de la resolución de concesión de la ayuda, computables de acuerdo con el artículo 30 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.Dado que las facturas de un remolque factura núm. 0/023409 y remolque cisterna núm.0/023411 de fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;09/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;07/2020; de un generador factura núm. TS 3 de fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;29/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;06/2020 y electrobomba factura nºRE 9 de fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;22/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;06/2020 y todas las órdenes de transferencia son de fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;10/07/2020, esto es, fuera de plazo, ya que la fecha límite para justificar la inversión era el 14 de mayo de 2020 y por lo tanto son posteriores a la fecha límite para justificar la inversión, incumple las actuaciones exigidas por ser una actuación subvencionable (obligación de realizar, pagar y justificar las inversiones concedidas dentro del plazo establecido), y por lo tanto se trate de una inversión no auxiliable.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. Según la Resolución de la Presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se acuerda la reanudación de los procedimientos de concesión de subvenciones, por razones de interés general y se dictan instrucciones de gestión y funcionamiento en el marco de la afectación de la Covid-19, de fecha 4 de abril de 2020, contempla tener en cuenta que todos los términos y plazos han quedado en suspenso en el período comprendido entre la entrada en vigor del Real decreto 463/2020, de 4 de marzo, del estado de alarma para la gestión de la situación de crisis sanitaria y la publicación de esta resolución, en esta solicitud no le afecta el periodo de estado de alarma , ya que disponía de seis meses para realizar las actuaciones.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7.El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, dispone que "Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho, el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ".&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8.Con fecha 8 de febrero de 2021 se notifica a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;interesad&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, mediante la publicación en la web, el Informe/Propuesta provisional de resolución de revocación total de 4 de febrero de 2021, a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l efecto de cumplir con el trámite de audiencia para llevar a cabo las alegaciones. Una vez transcurridos los 10 días hábiles, el interesado no ha presentando ninguna alegación.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9.Por todo ello, se propone hacer la revocaci&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n total a causa del incumplimiento de la obligaci&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n de que las actuaciones exigidas est&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;á&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fuera de plazo&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;para ser una actuaci&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n subvencionable (obligaci&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n de realizar,pagar y justificar las inversiones concedidas dentro del plazo establecido), y por lo tanto se trat&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de una inversi&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ón no auxiliable.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;2.Finalizar el procedimiento y archivar el expediente INEA2016_2/192.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;3.Notificar esta resolución a la persona beneficiaria mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
