    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la cual se convocan subvenciones para Inversiones a las explotaciones agrícolas, para los años 2015-2019, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;em&gt;&lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;&lt;/em&gt;&amp;nbsp;de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en materia agraria del FOGAIBA, con fecha de 26 de febrero&amp;nbsp;de 2021, dicta lo siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;“Resolución de Revocación parcial&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;Programa de Desarrollo Rural de las Islas Baleares 2014-2020&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;CONVOCATORIA: INEA2017_1&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias. La Resolución mencionada se modificó en fecha 17 de diciembre de 2015 (BOIB núm. 185), en fecha 22 de junio de 2016, (BOIB núm. 81) y 26 de junio de 2018 (BOIB núm. 80).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de los interesados que figuran en el anexo de la Resolución con los datos y los importes correspondientes.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Considerando la Resolución de concesión de la ayuda mencionada, y de acuerdo con lo establecido en el apartado décimo de la convocatoria antes mencionada, el beneficiario se obliga, entre otras, a realizar las actuaciones auxiliadas dentro del plazo establecido y en justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en el modo y los plazos determinados en la convocatoria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, la interesada presenta la solicitud de pago, así como la documentación exigida, pero, una vez revisada la misma, se comprueba que el tractor adquirido es NEW HOLLAND modelo T6.155 por un importe de 112.000,00 euros; un modelo diferente al modelo del tractor concedido NEW HOLLAND modelo T6.175 con un coste elegible de 112.000,00 euros, dado este cambio se emitió el informe de moderación de costes con fecha 3 de agosto de 2020, que determina que la importe del tractor NEW HOLLAND modelo T6.155 es de 68.562,27 euros, el valor de mercado del producto es inferior al importe que se ha justificado. Así también, se comprueba que la abonadora adquirida es SOLA D903/2000 por un importe de 22.310,00 euros; un modelo diferente al modelo de abonadora concedida ACCORD Kverneland TL1500l con un coste elegible de 13.202,20 euros, dado este cambio se emitió el informe de moderación de costes con fecha 3 de agosto de 2020, que determina que el importe de la abonadora SOLA D903 / 2000 es de 9.892,30 euros, el valor de mercado del producto es inferior al importe que se ha justificado.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, dispone que "Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ".&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. En fecha 10 de agosto de 2020 se notifica al interesado, mediante la publicación en la web, el Informe/Propuesta provisional de resolución de revocación parcial de 5 de agosto de 2020 por el incumplimiento de la obligación de haber realizado, pagado y justificado las inversiones concedidas dentro del plazo establecido, a efectos de cumplir con el trámite de audiencia para llevar a cabo las alegaciones.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7. El 14 de agosto de 2020, en tiempo y en forma, el interesado presentó escrito de alegaciones, donde expone que las circunstancias de la oferta del mercado y la disponibilidad del distribuidor no han hecho posible adquirir los modelos de maquinaria por los que se pidió la ayuda. Que finalmente se ha apostado por comprar un modelo de tractor y una abonadora diferentes, ya que se adecuaban mes a la situación de mercado actual. Aporta documentación para demostrar el valor de mercado real del tractor New Holland T6155 y de la abonadora SOLA D903/200.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8. En fecha 3 de agosto de 2020 se realiza un nuevo informe de moderación de costes, atendiendo a las alegaciones presentadas. Según el informe técnico de fecha 15 de febrero de 2021, se admiten parcialmente las alegaciones presentadas por la cancelación de la revocación parcial, el importe elegible del tractor New Holland T6.155 es de 92.982,27 euros (68.562,27 euros coste elegible más 24.420,00 euros extras elegibles) y el importe elegible de la abonadora Sola D903/200 es de 11.520,30 euros (9.892,30 euros coste elegible más 1.628,00 euros extras elegibles).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9. Por todo ello, se propone hacer la revocación parcial ya que la actuación subvencionable no se ajusta a lo establecido en el punto 2.b del apartado cuarto de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para Inversiones en las explotaciones agrarias.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014 a 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, dicto la siguiente&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Resolución &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.&lt;/em&gt;&amp;nbsp;&lt;em&gt;Revocar parcialmente la resolución de ayuda concedida al beneficiario por el importe y con los datos detallados en el anexo de esta resolución, que es un total de 1 expediente y que comienza con Monserrat Mascaro Cerda y termina con Monserrat Mascaro Cerda, que suma un importe total de 10.350,06 euros, relativa a la línea de ayuda "Inversiones en las explotaciones agrarias", ya que el importe elegible del gasto es inferior a la aprobada.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. &amp;nbsp;Notificar esta resolución a la persona beneficiaria mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución -que no agota la vía administrativa- se podrá interponer recurso de alzada ante la consellera de Agricultura, Pesca y Alimentación, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y los artículos 121 y 122, de la Ley 39/2015 del procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
