font-size:12px"><span style="line-height:normal"><strong>&lt;&lt;1.-</strong> <strong>Subvención </strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">En el marco de la convocatoria de subvención 2021 dirigida a los ayuntamientos de Mallorca para paliar las consecuencias de las restricciones motivadas por la crisis sanitaria de la Covid-19 en los sectores económicos, aprobar y conceder a los siguientes ayuntamientos con cargo en la partida presupuestaria 65.23199.46205 las cantidades que acto seguido se mencionan para la finalidad de aprobar convocatorias para ayudar a paliar las pérdidas producidas en los sectores económicos de su ámbito territorial, especialmente la restauración, el comercio, las actividades culturales, ocio infantil, transporte y otros, como consecuencia de las restricciones aprobadas por el Gobierno Balear en 2021 para parar la expansión de la crisis sanitaria ocasionada por la COVID-19 o que sean especialmente afectados por la pandemia: </span></span></p> <table border="1" cellspacing="0" class="Table"> <thead> <tr> <th scope="col" style="height:15.75pt; font-size:12px"><span style="line-height:normal">1.2 Anular la diferencia entre el importe autorizado de 2.474.697,91 euros y la cantidad dispuesta de 2.419.373,02 euros: 55.324,89 euros</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1.3 Desestimar las solicitudes de los ayuntamientos de Bunyola y Fornalutx por haberse presentado fuera del plazo establecido.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>2. Justificación de las actuaciones </strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1. La justificación de la ejecución de las actuaciones objeto de esta convocatoria por parte de las entidades locales beneficiarias de las subvenciones se tiene que hacer mediante la expedición de un certificado del interventor o la interventora de la corporación, de acuerdo con el modelo que se adjunta como Anexo V, que acredite:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">a) Que la cantidad entregada por el Consejo de Mallorca por este concepto se ha destinado íntegramente a la financiación del objeto de la subvención. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">b) Que ha convocado ayudas o subvenciones financiadas con recursos propios de la Corporación por un importe igual o superior a la cantidad recibida del Consejo de Mallorca.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">c) La convocatoria o convocatorias realizadas, el importe de cada una de ellas y su objeto, la relación de los beneficiarios con indicación del importe percibido por cada uno de ellos de las ayudas financiadas, con el desglose de la parte de la cantidad subvencionada por el Consejo y la parte correspondiente a los fondos propios del Ayuntamiento.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2. Este certificado se tiene que presentar ante el Departamento de Promoción Económica y Desarrollo Local del Consejo de Mallorca antes de día 1 de julio de 2022.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">3. Obligaciones de las entidades beneficiarias</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Los ayuntamientos a los cuales se les han concedido las subvenciones estarán obligados a:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">a) Convocar y publicar en el Boletín Oficial de las Islas Baleares, antes del día 31 de julio de 2021, una o varias convocatorias de subvenciones dirigidas en los sectores económicos afectados por las restricciones aprobadas por el Gobierno Balear en 2021 o que sean especialmente afectados por la pandemia de la COVID-19 destinadas a paliar su situación económica y garantizar su sostén.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">No obstante, si el Ayuntamiento lo solicita antes de que finalice el plazo por convocar y publicar, el consejero de Promoción Económica y Desarrollo Local podrá prorrogar dicho plazo mediante una resolución.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">b) Que el total de las ayudas convocadas por el Ayuntamiento, antes del día 31 de julio de 2021, para esta finalidad tiene que suponer una cantidad total igual o superior a la cantidad concedida por el Consejo de Mallorca.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">c) Facilitar al Consejo de Mallorca la información relativa a los expedientes que requiera.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">d) Justificar ante el Consejo de Mallorca el cumplimiento del objeto de la subvención en la forma que se especifica en la cláusula anterior.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">e) Hacer constar en la convocatoria o convocatorias que estas son financiadas por el Consejo de Mallorca.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">f) Acabar las actuaciones y presentar la justificación de los gastos antes de día 1 de julio de 2022. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">g) Comunicar al Departamento de Promoción Económica y Desarrollo Local del Consejo de Mallorca, en cualquier momento, la obtención de subvenciones o ayudas para la misma finalidad y no consignadas en la solicitud.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">h) Cumplir el resto de obligaciones que se prevén en el artículo 9 de la vigente Ordenanza general de subvenciones del Consejo de Mallorca aprobado por acuerdo de lleno de día 23 de diciembre de 2016 (BOIB nº. 21, de día 18 de febrero de 2017 y nº. 96, de 4 de agosto de 2018).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>4. Reintegro</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1.- Las cantidades no dispuestas por el Ayuntamiento se tienen que reintegrar al Consejo de Mallorca.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2.- En caso de que las entidades locales beneficiarias de las subvenciones no puedan certificar la aprobación y la publicación al BOIB de la convocatoria o convocatorias de ayudas para los sectores mencionados financiados con fondo propios municipales por un importe igual o superior a la cantidad concedida por el Consejo de Mallorca, se tendrá que tramitar el reintegro en el Consejo del importe que exceda del realmente convocado con recursos propios de las entidades locales.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">3.- En cualquier momento el Consejo podrá inspeccionar la documentación de estas subvenciones que obren en poder de los ayuntamientos beneficiarios o requerirlos para que presenten los documentos relacionados con las actuaciones subvencionadas por el Consejo de Mallorca que considere convenientes.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>5. Ampliaciones de plazos</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Las ampliaciones de los plazos establecidos en esta convocatoria se regirán por lo que dispone el artículo 32 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas. En todo caso, las solicitudes de ampliación de plazos tienen que tener entrada oficial en el Consejo de Mallorca con una antelación mínima de quince (15) días naturales a la fecha de su finalización. Se autoriza al consejero ejecutivo de Promoción Económica y Desarrollo Local para la resolución de las peticiones de ampliaciones de plazos. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Las entidades locales beneficiarias de la subvención pueden solicitar en el órgano que la concede, antes de que concluya el plazo para llevar a cabo la actividad subvencionada, modificaciones del acuerdo de concesión, reducción del importe concedido, modificación de la actuación objeto de la ayuda, que se autorizan cuando tienen la causa en circunstancias imprevistas o son necesarias para el buen final de la actuación, siempre que no se altere el objeto o la finalidad de la subvención y no se dañe el derecho de terceros. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><em>De conformidad con el artículo 44 en relación con el 46.6 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contenciosa Administrativa, contra este acuerdo no se podrá interponer recurso en vía administrativa, si bien se podrá formular potestativamente REQUERIMIENTO para su anulación o revocación en el plazo de dos meses contadores desde el día que se publique en el Boletín Oficial de las Islas Baleares con carácter previo a la interposición de recurso contencioso administrativo.</em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><em>El requerimiento se entenderá desestimado si en el plazo de un mes desde su presentación no se notifica resolución expresa.
