&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantia Agraria y Pesquera de las Islas Baleares (FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en Materia de Pesca del FOGAIBA, con fecha de 15&amp;nbsp;de febrero&amp;nbsp;de 2021, dicta lo siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;1.Con fecha de 16 de julio de 2015 se publicó, en el Boletín Oficial de las Islas Baleares núm. 106, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias, modificada mediante las resoluciones de fecha 17 de diciembre de 2015 (BOIB núm. 185), co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha 22 de junio de 2016, (BOIB núm. 81) y con fecha 26 de junio de 2018 (BOIB núm. 80).&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;2.El 30 de septiembre de 2019, el vicepresidente del FOGAIBA dictó una Resolución de concesión de ayudas para inversiones en las explotaciones agrarias (R30), que se publicó en el Boletín Oficial de las Islas Baleares número 151, del 7 de noviembre de 2019, en la que figuraba una concesión a favor de FORMATIERRA SERVICE SC, con NIF J57335069, con un importe de ayuda de 53.089,16 € y un plazo de 6 meses, con número de expediente INEA 2017_1/141.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.El 8 de febrero de 2021, con registro de entrada núm. L95E2069, DAVIDE FANCHINI con DNI***3984**, en representación de FORMATIERRA SERVICE SC, con NIF J57335069 presentó su desistimiento de la ayuda, aunque como es posterior a la concesión se trata de una renuncia, lo supone llevar a cabo la revocación total de la ayuda concedida.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.El artículo 21.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, establece la obligación de la Administración a dictar resolución expresa y a notificarla. En su párrafo segundo especifica que «En los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como la desaparición sobrevenida del objeto del procedimiento, la resolución consistirá en la declaración de la circunstancia que concurra en cada caso, con la indicación de los hechos producidos y las normas aplicables ».&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.El 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que «Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ».&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6.Por&amp;nbsp;todo ello, se propone hacer la revocación total debido a la renuncia de la ayuda concedida por el beneficiario que se indica en el anexo de esta resolución.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. Resolució&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n de 10 de julio de 2015 del presidente del Fondo de Garant&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;í&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias modificada mediante las resoluciones de 17 de diciembre de 2015, 22 de junio de 2016 y 26 de junio de 2018.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Orden del Consejero de Agricultura Medio Ambiente y Territorrio de 19 de febrero de 2015, por la que s'extebeixen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Propuesta de resolución&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente del desistimiento y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Aceptar la renuncia presentada por DAVIDE FANCHINI,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;con DNI***3984**, en representación de FORMATIERRA SERVICE, con NIF J57335069,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a la ayuda concedida por la Resolución del vicepresidente del FOGAIBA de día &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;30&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;setiem&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;bre de 2019, (R30).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Revocar la ayuda concedida en la resolución del vicepresidente del FOGAIBA de día 30&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;setiem&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;bre de 2019, (R&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;30&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;), correspondiente al expediente INEA2017_1/141&amp;nbsp;y por el importe indicado en el anexo de esta resolución.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.&lt;/em&gt;&amp;nbsp;&lt;em&gt;Declarar concluido el procedimiento y archivar el expediente INEA2017_1/141.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.Publicar esta resolución en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante la&amp;nbsp;conseller&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de Agricultura&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Pesca&amp;nbsp;y Alimentación, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares, y los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
