&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Los días 6, 9, 10 y 11 de noviembre de 2020 se enviaron notificaciones de requerimientos de documentos y actuaciones, motivadas por solicitudes de autorización de la apertura y el funcionamiento de centros de educación infantil de primer ciclo, a los representantes de los centros que figuran en el anexo 1.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El día 10 de noviembre de 2020, se enviaron notificaciones de requerimientos de documentos y actuaciones, motivadas por solicitudes de ampliación de la configración de los centros que figuran en el anexo 2, a los representantes de estos centros.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. En estas notificaciones se informaba a los interesados de la posibilidad de desistir de la solicitud en el caso de no querer continuar con el procedimiento. También se les advertía de que la inactividad del interesado en un plazo de tres meses produciría la caducidad del procedimiento.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Han transcurrido más de tres meses sin que los interesados hayan realizado ninguna actuación necesaria para reanudar la tramitación y continuar con el procedimiento.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El día 15 de febrero de 2021, la jefa del Departamento de Planificación y Centros emitió un informe favorable sobre la declaración de la caducidad y el archivo de los expedientes relativos a los centros que figuran en los anexos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El Real decreto 332/1992, de 3 de abril, sobre autorizaciones de centros docentes privados para impartir enseñanzas de régimen general no universitario, modificado por el Real decreto 131/2010, de 12 de febrero.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Los artículos 93, 94 y 95 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La disposición transitoria cuarta, referente a la normativa de materias transferidas, de la Ley orgánica 1/2007, de 28 de febrero, de reforma del Estatuto de autonomía de las Illes Balears (texto consolidado), publicada en el BOIB nº. 32 ext., de 1 de marzo de 2007, y con corrección de errores en el BOIB nº. 29, de 28 de febrero de 2008.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, y de acuerdo con la propuesta formulada por la Dirección General de Planificación, Ordenación y Centros con fecha de 16 de febrero de 2021, dicto la siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.&amp;nbsp;Declarar la caducidad de los procedimientos indicados y disponer el archivo de los expedientes relativos a las autorizaciones de los centros que figuran en los anexos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.&amp;nbsp;Notificar esta Resolución a los interesados, de conformidad con lo que establecen los puntos 1 y 2 del artículo 40 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.&amp;nbsp;Publicar esta Resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Educación y Formación Profesional en el plazo de un mes a contar desde el día siguiente al de su publicación en el BOIB, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También se puede interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente al de su publicación en el BOIB, de acuerdo con los artículos 10 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/p&gt;
