    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cumplimiento de aquello que disponen el artículo 17.4 del texto refundido de la Ley&amp;nbsp;reguladora de las Haciendas Locales aprobado por el Real decreto legislativo 2/2004, de&amp;nbsp;5 de marzo, el artículo 111 de la Ley 7/1985, de 2 de abril, reguladora de las bases del&amp;nbsp;régimen local se hace público que el Pleno del ayuntamiento de Maó en sesión ordinaria&amp;nbsp;celebrada el día 22 de desembre de 2020 aprobó inicialmente la modificación de la&amp;nbsp;Ordenanza fiscal n.º 27, no habiéndose presentado ninguna reclamación contra el&amp;nbsp;acuerdo de aprobación inicial ha quedado aprobada definitivamente en fecha 26 de&amp;nbsp;febrero de 2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se procede a publicar íntegramente el texto de la Ordenanza fiscal en el Boletín Oficial&amp;nbsp;de las Islas Baleares y en el tablón de anuncios digital del Ayuntamiento, entrando en&amp;nbsp;vigor desde la citada publicación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra la aprobación de la Ordenanza Fiscal, se podrá interponer recurso contenciosoadministrativo&amp;nbsp;ante el Tribunal Superior de Justicia de las Islas Baleares, en el plazo de&amp;nbsp;dos meses contados desde el día siguiente al de publicación de este anuncio en el&amp;nbsp;Boletín Oficial de la Provincia.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:106%"&gt;&lt;strong&gt;PRECIO PÚBLICO POR LA PRESTACIÓ DE SERVICIOS QUE SE REALIZAN EN CA N'OLIVER&amp;nbsp;&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:106%"&gt;&lt;strong&gt;COLECCIÓN HERNÁNDEZ SANZ-HERNÁNDEZ MORA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 1º- Fundamento y naturaleza&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:106%"&gt;&lt;span style="line-height:106%"&gt;De acuerdo con el que dispone 41 del texto refundido de la Ley reguladora de las Haciendas Locales aprobado por el Real decreto legislativo 2/2004, de 5 de marzo (TRHL), el Ayuntamiento establece precios públicos por la prestación de servicios y actividades que se realicen a Can Oliver Colección Hernández Sanz-Hernández Mora, la especificación de los cuales se contiene en las tarifas del artículo 4 de esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 2º.- Concepto&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:106%"&gt;&lt;span style="line-height:106%"&gt;Los precios públicos regulados en esta Ordenanza constituyen prestaciones patrimoniales de carácter público que se satisfarán por los usuarios que voluntariamente soliciten alguna de las actividades o servicios que habilitan la exigencia del abono del precio público regulado en la presente Ordenanza serían los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Visita de la exposición permanente.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Visita de exposiciones temporales:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Uso de la sala de actos.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Uso del patio interior.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Uso del inmueble.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Derechos por uso comercial de las imágenes murales del edificio.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;- Derechos por uso comercial de las imágenes de las colecciones artísticas.&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;- &amp;nbsp;Derechos por uso comercial de la imagen del edificio o de cualquiera de sus elementos o instalaciones.&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Venta de publicaciones: libros, postales, láminas...&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Venta de objectos de merchandising&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 3º.- Obligados al pago&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Están obligados al pago de los precios públicos regulados en esta Ordenanza las personas o entidades que soliciten o se beneficien de la prestación de servicios o realización de actividades a que se refiere el artículo 1.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con el previsto en el artículo 46.3 del TRLRHL, las deudas por precios públicos no abonados conforme al previsto en el artículo anterior, podrán exigirse por el procedimiento administrativo de constreñimiento, incluidos aquellos supuestos en que se detecten personas dentro del recinto que no estén en posesión de la entrada correspondiente, cuando esta sea exigible conforme al establecido en el anexo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 4º.- Cuantía&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La cuantía del precio público regulado en esta Ordenanza será la fijada en la Tarifa contenida en el apartado siguiente, por cada uno de los diferentes servicios o actividades.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Las Tarifas de estos precios públicos serán las siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Los grupos estudiantes que participen en las campañas educativas promovidas por el Ayuntamiento.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Las visitas organizadas por entidades sin ánimo de lucro, previamente autorizadas y&amp;nbsp;concertadas con el Ayuntamiento.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) Profesores, investigadores, monitores y guías turísticos en el ejercicio de sus funciones, que acrediten esta condición mediante carnet o documento oficial.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e) Miembros de asociaciones locales, nacionales o internacionales de museos (ICOM, ICOMOS, asociaciones de amigos de los museos, Fons cultural Hernández Mora etc.), que acrediten esta condición mediante carnet o documento oficial.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;f) Las personas en situación de paro que acrediten esta condición mediante la documentación permanente.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;g) Las visitas realizadas:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• En domingo.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• El día 18 de mayo. Dia Internacional de los Museos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2º) Tendrán una reducción del 50%:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Mayores de 65 años, que acrediten esta condición mediante el Documento Nacional de Identidad o documento adecuado.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Titulares del Carnet Joven, carnet de estudiante o sus correspondientes internacionales que acrediten esta condición mediante el carnet correspondiente.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Las familias numerosas y las familias educadoras que acrediten esta condición mediante el correspondiente carnet.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) Abonos conjuntos con otras equipaciones culturales.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:106%"&gt;&lt;span style="line-height:106%"&gt;3°) Tendrán una reducción del 25% las visitas concertadas y organizadas mediante la colaboración de operadores turísticos, empresas hoteleras o de comercialización de productos culturales o de ocio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 5º.- Régimen de declaración y de ingreso&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:106%"&gt;La obligación de pago del precio público se producirá desde el momento en que el visitante solicite su entrada en el recinto municipal o cualquiera de los servicios, entendiéndose producida tal solicitud y cumplida la obligación de pago con la adquisición de los tickets u otros documentos justificativos del pago del precio público correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 6º.- Responsabilidad de los usuarios.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:106%"&gt;Los visitantes en el edificio vendrán obligados a reintegrar en el Ayuntamiento los desperfectos o daños que causaran a instalaciones, objetos o al inmueble con motivo de su permanencia, para lo cual se tramitará el correspondiente expediente con audiencia de los interesados. A efectos de la evaluación de los daños causados se atenderá al valor del Inventario Municipal o a la tasación específica de los mismos, en caso de ser necesaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;strong&gt;Disposición Adicional primera. ‐ Modificación de los preceptos de la ordenanza y de las referencias que hace a la normativa vigente, con motivo de la promulgación de normas posteriores&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:106%"&gt;Los preceptos de esta Ordenanza que, por razones sistemáticas reproduzcan aspectos de la legislación vigente y otras normas de desarrollo, y aquellos en que se hagan remisiones a preceptos de esta, se entenderá que son automáticamente modificados y/o sustituidos, en el&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;momento en que se produzca la modificación de los preceptos legales y reglamentarios de que llevan causa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Disposición Adicional segunda. Interoperabilidad.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:106%"&gt;Las personas beneficiarias de los servicios y/o actividades incluidos en esta ordenanza tienen derecho a no aportar documentos que ya se encuentren en poder del Ayuntamiento de Maó o hayan sido elaborados por cualquier otra Administración. El Ayuntamiento consultará o recaudará estos documentos electrónicamente a través de sus redes corporativas o mediante consulta a las plataformas de intermediación de datos u otros sistemas electrónicos&amp;nbsp; habilitados a tal efecto, salvo que el interesado se opusiera a esto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Disposición Adicional tercera. Delegación a la Junta de gobierno.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El establecimiento o modificación de los precios públicos queda delegado a la Junta de Gobierno local, conforme al artículo 23.2.b) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Disposición final&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La presente Ordenanza fiscal, aprobada provisionalmente por el Pleno de la Corporación en sesión celebrada&amp;nbsp; el 22/12/2020 i que ha quedado definitivamente aprobada en fecha 26/02/2021 , entrará en vigor al día siguiente al de publicación en el Boletín Oficial de Les Illes Balears y regirá hasta su modificación o derogación exprés.&lt;/span&gt;&lt;/p&gt;
