    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Dado que al punto 3º del acuerdo del Consejo Ejecutivo del Consejo de Mallorca de día 30 de diciembre de 2020, relativo al convenio por el cual se lleva a cabo la permuta de la titularidad en relación a traveseras de la red de carreteras del Consejo de Mallorca y viales municipales entre el Consejo de Mallorca y el Ayuntamiento de Porreres, se ordena la publicación en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt; del contenido de éste, así como de la correspondiente acta de entrega a los efectos de su general conocimiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Con el fin de dar cumplimiento a esta previsión, visto que día 21 de enero de 2021 se formalizó el convenio i el acta de entrega mediante la firma del consejero ejecutivo del Departamento de Movilidad e Infraestructuras del Consejo de Mallorca y el segundo teniente de alcalde del Ayuntamiento de Porreres que se expone a continuación y el acta de entrega, se procede a su publicación:&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;“&lt;/strong&gt;&lt;strong&gt;CONVENIO POR EL CUAL SE LLEVA A CABO LA PERMUTA DE LA TITULARIDAD EN RELACIÓN A TRAVESÍAS DE LA RED DE CARRETERAS DEL CONSEJO DE MALLORCA Y VIALES MUNICIPALES ENTRE EL CONSEJO DE MALLORCA Y EL AYUNTAMIENTO DE PORRERES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Palma, a 21 de enero de 2021&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;REUNIDOS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Por una parte, el honorable. Señor Iván Sevillano Miguel, consejero ejecutivo de Movilidad e Infraestructuras, de acuerdo con el Decreto de la presidenta del Consejo Insular de Mallorca, de 9 de diciembre de 2019, por el cual se determina la organización del Consejo Insular de Mallorca (BOIB nº. 167, de 12 de diciembre de 2019), modificado por los decretos de día 6 de marzo, 22 de mayo y 9 de julio, todos de 2020 (BOIB núms. 29, 95 y 131, de días 7 de marzo, 28 de mayo y 25 de julio, respectivamente),&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Y de la otra, el Sr. Jaume Martorell Mesquida, segundo teniente de alcalde del Ayuntamiento de Porreres, como representante de esta entidad local en virtud del decreto de alcaldía de 17 de enero de 2021, con domicilio en la Plaza de la Villa nº. 17, CP 07260 de Porreres y con NIF P0704300C.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las partes se reconocen por la representación con que actúan, la capacidad suficiente para formalizar este convenio, por lo cual,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;EXPONEN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1.&lt;/strong&gt; El Consejo de Mallorca es el titular de las carreteras Ma-5020, de la Ma-5030-A y de la Ma-5100, según consta en el Inventario General de Bienes de esta institución.&lt;/span&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.&lt;/strong&gt; El Ayuntamiento de Porreres es el titular de los viales denominados “Ronda Estació” que une la Ma-5020 con la Ma-5040 y el “Tramo nuevo, primera fase Ronda Nord”, que une la Mi 5030-A y el Camino del Puente.&lt;/span&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3.&lt;/strong&gt; Fecha 23 de octubre de 2020, nº. registro general 42009, tuvo entrada el escrito de 6 de octubre de 2020 del Ayuntamiento de Porreres mediante el cual se solicita de esta administración insular que se tramite el expediente correspondiente para llevar a cabo la permuta de la titularidad de varías travesías ubicadas el núcleo de Porreres por varios viales de titularidad municipal. Con dicho escrito se acompaña certificación del acuerdo de plenario de día 28 de enero de 2019.&lt;/span&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4.&lt;/strong&gt; El día 8 de octubre de 2020, la Dirección Insular de Infraestructuras, emitió informe relativo a la cesión, por parte del Consejo de Mallorca, de la titularidad en el Ayuntamiento de Porreres de las travesías Ma-5020 (pk. inicial 11,310; pk. final 11,910), de la Ma-5030 A (pk. inicial 5,672, pk. final 5,980), de la Ma-5100 (pk. inicial 0,000, pk. final 0,760) y de la cesión por parte del Ayuntamiento de Porreres al Consejo de Mallorca de la “Ronda Estació” que une la Ma-5020 con la Ma-5040 y el “Tramo nuevo, primera fase Ronda Nord”, que une la Mi 5030-A y el Camino del Puente, adjuntando planos de coordenadas topográficas en relación a las diferentes infraestructuras objeto de este convenio.&lt;/span&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5.&lt;/strong&gt; Que esta permuta de la titularidad supondrá una mejora y una gestión más eficaz de las respectivas redes viales de ambas administraciones.&lt;/span&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6.&lt;/strong&gt; Las travesías Ma-5020 (pk. inicial 11,310; pk. final 11,910), de la Ma-5030 A (pk. inicial 5,672, pk. final 5,980), de la Ma-5100 (pk. inicial 0,000, pk. final 0,760) objeto de la permuta con el Ayuntamiento de Porreres, y según consta en el Plan Director Sectorial de Carreteras forma parte de la “Red Secundaria” y no le es exigible la conectividad que impone la norma balear sobre las carreteras de la Red Primaria. No obstante lo anterior, esta conectividad se mantendrá excepto para la Ma-5030-A. Asimismo, la corporación está tramitando la modificación del planeamiento que posibilitará la ejecución de la segunda fase de la ronda norte que producirá la conexión de la Ma-5030-A con la Ma-5101 y Ma-5040, con lo cual, se recuperará la conexión integral de la red vial. En este sentido, se tiene que reseñar que el Ayuntamiento de Porreres es el competente y responsable de la ejecución del proyecto de esta segunda fase de la “Ronda Nord”.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Por todo eso, acuerdan suscribir este convenio, que se revuelve por las siguientes,&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;CLÁUSULAS&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;PRIMERA. Objeto del convenio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El objeto de este convenio es la permuta entre el Consejo de Mallorca y el Ayuntamiento de Porreres de la titularidad de las travesías y viales que a continuación se describen, adjuntando los planos de estas infraestructuras y que forman parte integrante de este convenio:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;A) Cesión del Consejo de Mallorca al Ayuntamiento de Porreres&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Ma-5020&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Ronda Estación: une la Ma-5020 con la Ma-5040. Una vez cedida adoptará la nomenclatura:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Ma-5020&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El Consejo de Mallorca sólo asume la titularidad de la calzada y la señalización en relación a los corderos cedidos por el Ayuntamiento de Porreres. En consecuencia, quedan excluidas las aceras, los bordillos, el mobiliario, el arbolado, el alumbrado público y los servicios urbanos (cañerías de agua, líneas eléctricas, líneas de telecomunicaciones...), según consta en los planos topográficos que se adjuntan.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;TERCERA. Vigencia&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La vigencia de este convenio no es otro que el tiempo establecido para realizar el objeto del convenio, iniciándose a partir de la fecha de firma de este documento y, en consecuencia, obligante en las partes desde aquel momento.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;CUARTA. Obligaciones de las partes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El Consejo de Mallorca cederá la titularidad al Ayuntamiento de Porreres de las travesías descritas en el apartado A) de la cláusula primera y, en consecuencia, pasarán a integrarse en la red local del Ayuntamiento de Porreres desde el momento en que se formalice la recepción, mediante la firma, por ambas Administraciones públicas, de la correspondiente “Acta de Entrega”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El Ayuntamiento de Porreres cederá al Consejo de Mallorca, con las especificidades de la cláusula segunda, los viales descritos en el apartado B) de la cláusula primera y, en consecuencia, pasarán a integrarse en la red vial secundaria del Consejo de Mallorca desde el momento en que se formalice la recepción, mediante la firma, por ambas Administraciones públicas, de la correspondiente “Acta de Entrega”.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;QUINTA. Compromiso del Consejo de Mallorca&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El Consejo de Mallorca asume el compromiso de extender la capa de aglomerado asfáltico de rodada con cargo en el contrato de conservación y por un importe estimado de 25.000 €, una vez el Ayuntamiento de Porreres haya procedido a la canalización del drenaje y alcantarillado y haya colocado el arcén que delimite la calzada y la acera&lt;strong&gt; &lt;/strong&gt;de la calle Sala (Ma-5100).&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;SEXTA. Gestión del Convenio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Con la finalidad de tratar todas aquellas cuestiones que se puedan derivar del presente convenio y proponer, si procede, el caso en los órganos competentes las medidas a adoptar, se podrá constituir una comisión de seguimiento, bilateral y paritaria.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;SÉPTIMA. Extinción&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El convenio quedará extinguido una vez transcurrido el periodo de vigencia mencionado en la cláusula tercera, o por la concurrencia de cualquiera de las siguientes circunstancias:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-alpha" start="1"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Por mutuo acuerdo entre las partes.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Por incumplimiento de sus obligaciones por cualquiera de las partes.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;OCTAVA. Resolución de conflictos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las partes acuerdan resolver de mutuo acuerdo las cuestiones que suban surgir de la interpretación y el cumplimiento de este convenio o plantearlas, en su caso, ante la comisión de gestión del convenio que se cree.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Como prueba de conformidad con el contenido de este convenio, las partes lo firman por duplicado y a un solo efecto, en el lugar y fecha indicados al encabezamiento, de manera que queda una copia en poder de cada parte que interviene.&lt;strong&gt;”&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Señor Iván Sevillano Miguel, consejero ejecutivo de Movilidad e Infraestructuras, de acuerdo con el Decreto de la presidenta del Consejo Insular de Mallorca, de 9 de diciembre de 2019, por el cual se determina la organización del Consejo Insular de Mallorca (BOIB nº. 167, de 12 de diciembre de 2019), modificado por los decretos de día 6 de marzo, 22 de mayo y 9 de julio, todos de 2020 (BOIB núms. 29, 95 y 131, de días 7 de marzo, 28 de mayo y 25 de julio, respectivamente),&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Y de la otra, el Sr. Jaume Martorell Mesquida, segundo teniente de alcalde del Ayuntamiento de Porreres, como representante de esta entidad local en virtud del decreto de alcaldía de 14 de enero de 2021, con domicilio en la Plaza de la Villa nº. 17, CP 07260 de Porreres y con NIF P0704300C.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las partes se reconocen, para la representación con que actúan, la capacidad suficiente para formalizar este convenio, por lo cual,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El Sr. Jaume Martorell Mesquida, en nombre y representación del Ayuntamiento de Porreres, mediante la presente acepta la entrega, por parte del Consejo Insular de Mallorca, de las travesías Ma-5020 (pk. inicial 11,310; pk. final 11,910), de la Ma-5030 A (pk. inicial 5,672, pk. final 5,980), de la Ma-5100 (pk. inicial 0,000, pk. final 0,760) y, en consecuencia, se entienden cedidas desde ahora a dicha entidad local la titularidad de las susodichas travesías integrándose en la red local del Ayuntamiento de Porreres a todos los efectos, con todas las competencias y deberes que comporta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El Sr. Iván Sevillano Miguel, en nombre y representación del Consejo de Mallorca, mediante la presente acepta la entrega, por parte del Ayuntamiento de Porreres, de la calzada y de la señalización de la “Ronda Estació” que une la Ma-5020 con la Ma-5040 y el “Tramo nuevo, primera fase Ronda Nord”, que une la Ma-5030 A y el Camino del Puente, la cesión de los cuales no incluye las aceras, los bordillos, el mobiliario, el arbolado, el alumbrado público y los servicios urbanos (cañerías de agua, líneas eléctricas, líneas de telecomunicaciones...), según consta en los mencionados planos topográficos de coordenadas, con lo cual se entienden cedidos desde ahora al Consejo de Mallorca la titularidad de los susodichos viales, a todos los efectos, con las especificidades señalas, y con todas las competencias y deberes que comporta.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
