    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Pleno de la Corporación, en sesión ordinaria de 28 de enero de 2021, ha aprobado las bases para la convocatoria de subvenciones a los titulares de licencias de auto-taxi que tengan adscrito un vehículo adaptado, para la adquisición de nuevos vehículos adaptados. (Base datos nacional de subvenciones núm. 550483)&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;BASES PARA LA CONVOCATORIA DE SUBVENCIONES A LOS TITULARES DE LICENCIAS DE AUTO-TAXI QUE TENGAN ADSCRITO UN VEHÍCULO ADAPTADO, PARA LA ADQUISICIÓN DE NUEVOS VEHÍCULOS ADAPTADOS&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ayuntamiento de Pollença, en cumplimiento de los principios de publicidad, concurrencia y objetividad en la concesión de subvenciones, convoca ayudas económicas destinadas a que los titulares de las licencias de auto-taxi que tengan adscrito un vehículo adaptado a personas de movilidad reducida (euro-taxis) puedan adquirir un nuevo vehículo de acuerdo con las siguientes,&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;BASES&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Primera.- Necesidad de la convocatoria&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las presentes bases corresponden a una necesidad de interés social, para hacer frente, por parte del Ayuntamiento de Pollença, a una medida para promover y favorecer el cumplimiento del artículo 8 del RD 1544/2007, de 23 de noviembre por el que se regulan las condiciones básicas de accesibilidad y no discriminación para el acceso y utilización de los modos de transporte para personas con discapacidad. Este precepto dispone que "los Ayuntamientos promoverán que al menos un cinco por ciento o fracción de las licencias de taxis, correspondan a vehículos adaptados". (Art.8)&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Segunda.- Objeto y finalidad&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La presente convocatoria tiene por objeto la concesión de subvenciones a las personas titulares de licencias de auto-taxi del Ayuntamiento de Pollença que tengan adscritos un vehículo adaptado a personas con movilidad reducida (euro-taxis), para la adquisición de nuevos vehículos adaptados.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La finalidad de la subvención es compensar el esfuerzo económico que debe realizar el titular de la licencia auto-taxi que tienen adscrito un vehículo adaptado a personas con movilidad reducida (euro-taxis), al tener que adscribir a la misma un automóvil accesible.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La subvención municipal consistirá en la concesión a la persona titular de la licencia de auto-taxi en una cantidad pecuniaria en concepto de subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La concesión de las subvenciones se efectuará mediante el régimen de concurrencia no competitiva entre los titulares de las licencias municipales de autotaxi que tengan adscritos vehículos adaptados.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las ayudas se otorgarán dentro de las previsiones presupuestarias previstas en la aplicación presupuestaria 132 48921 del presupuesto prorrogado para el año 2020. El importe máximo comprometido para esta convocatoria es de 6.000 euros ampliables según disponibilidad presupuestaria mediante modificación de crédito pertinente .&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La cantidad a subvencionar será como máximo de 2.000 €. No se incluirá en ningún caso el importe del IVA.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tercera.- Requisitos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para ser beneficiario de estas ayudas deberá reunir los siguientes requisitos:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.- Ser titular de una licencia de auto-taxi del Ayuntamiento de Pollença y tener adscrito un vehículo adaptado a personas con movilidad reducida (euro-taxis) de conformidad con el Reglamento Municipal.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.- Estar al corriente de obligaciones fiscales, sociales y laborales.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.- No tener sanciones pecuniarias pendientes de pago, por infracciones previstas en el Reglamento Municipal de Servicio Público de Transportes de Viajeros en Automóviles de Turismo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4.- Formular la correspondiente solicitud voluntaria de ayuda y aceptar expresamente las obligaciones contempladas para los beneficiarios.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.- La subvención se otorgará para aquellas adquisiciones de vehículos que se hayan realizado a partir del 1 de enero de 2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6.- No estar incurso en cualquiera de las causas de prohibición para recibir subvenciones determinadas en el artículo 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7.- No haber recibido otra subvención anterior por el mismo concepto.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estos requisitos deberán reunirse en el momento de presentación de las solicitudes de esta convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Cuarta.- Solicitud de ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los titulares de las licencias municipales de auto-taxi que tengan adscritos vehículos adaptados a personas con movilidad reducida (euro-taxis) interesados ​​en obtener ayudas deberán presentar la solicitud de subvención en el plazo de diez (10) días naturales desde del día siguiente de la publicación de la convocatoria de estas ayudas en el Boletín Oficial de la Islas Baleares y en la página web del Ayuntamiento de Pollença.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las solicitudes, junto con la documentación que las acompañe, se presentará en el Registro General de la Corporación, de manera presencial, o en cualquiera de las formas establecidas en el artículo 16,4 de la Ley 39/2015, de 1 de octubre el procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Quinta.- Documentación a presentar&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;o Fotocopia del DNI de la persona titular de la licencia de auto-taxi.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;o Fotocopia de la factura de adquisición del vehículo y / o transformación y adaptación del vehículo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;o Factura / s, acreditativa / as del gasto subvencionado, expedidas a nombre de las personas o entidades subvencionadas y con su NIF, expresarán claramente: &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;o Fecha de emisión, que deberá corresponder al periodo comprendido entre el 1 de enero de 2020 y 31 de diciembre de 2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;o Datos fiscales (nombre, domicilio, NIF, etc.) de la entidad emisora ​​y de la entidad pagadora. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;o Número de la factura. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;o Concepto detallado por el que se expide, que deberá ser suficientemente claro. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;o Importe, desglosando la parte que corresponde a IVA, en su caso. Si la operación está exenta de IVA se debe mencionar a la factura.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;o Aportar conformidad de la Inspección Técnica del vehículo, una vez adaptado para el transporte de personas con movilidad reducida.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;o Certificado de la empresa transformadora que el vehículo adaptado cumple con la norma UNE 26.494. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;o Declaración responsable haciendo constar que la persona responsable no incurre en ninguna de las prohibiciones para obtener la condición de beneficiario a que se refiere el artículo 13 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones (Anexo 1)&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;o Cuenta Justificativa (anexo 2) &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Sexta.- obligaciones&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los perceptores de la subvención están obligados a:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Aceptar la subvención. En caso de que esto no sea posible deberán renunciar expresamente, en el plazo de quince días contados a partir del día siguiente a la notificación de la subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Cumplir con el objeto de la adaptación. Deberá tener adscrito a la licencia municipal de taxi un vehículo adaptado y comprometerse a mantenerlo en servicio durante cuatro años, pudiendo prolongar el servicio de manera indefinida.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Atender, de manera preferente, las llamadas de las personas con movilidad reducida y usuarias de sillas de ruedas.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) Acreditar ante el Ayuntamiento, la adquisición del vehículo y / o su transformación mediante factura que indique marca, modelo, precio, número de bastidor y transformaciones efectuadas. En la factura deberá detallarse la fecha de emisión de la factura, su importe y la fecha de pago de la correspondiente factura (incluido el justificante de este pago).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e) Cuidar en todo momento del perfecto funcionamiento técnico y mecánico del vehículo, así como su apariencia externa.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;f) Justificar ante el órgano concedente el cumplimiento de los requisitos y condiciones, así como la realización de la actividad y el cumplimiento de la finalidad que determina la concesión de la subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;g) Comunicar la obtención de subvenciones o ayudas para la misma finalidad, procedentes de otras administraciones, entidades públicas o privadas, nacionales o internacionales.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;h) Conservar los documentos justificativos de la aplicación de los fondos recibidos, incluidos los documentos electrónico.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Séptima.- Procedimiento de concesión. Inicio, Instrucción y Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7.1.- Las bases y el inicio del procedimiento de concesión de subvenciones se produce de oficio. El Pleno del Ayuntamiento será el órgano encargado de su aprobación. Estas bases serán publicadas en el BOIB, en la Base de Datos Nacional de Subvenciones (BDNS), en el tablón de anuncios del Ayuntamiento y en la web www.ajpollenca.net, para que se puedan presentar las solicitudes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7.2.- El solicitante presentará una instancia en el registro de entradas del Ayuntamiento con la que deberá adjuntar la documentación relacionada en la base quinta&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7.3.- El órgano instructor del procedimiento de concesión será el Área de Policía &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El órgano instructor, a la vista del expediente, efectuará un informe donde evaluará si los beneficiarios cumplen todos los requisitos necesarios para acceder a las subvenciones. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7.4.- La competencia para resolver el procedimiento y conceder la subvención se atribuye a la Junta de Gobierno Local, que dictará esta resolución una vez formulada la propuesta de resolución por parte del órgano instructor y fiscalizada por la intervención.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Octava.- Justificación de la subvención&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8.1.- El plazo para justificar los gastos subvencionados acaba día 30 de junio de 2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8.2.- El importe de la subvención se abonará después de que el beneficiario haya justificado la realización de la actividad subvencionada y haya cumplido su finalidad. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8.3.- Para justificar la subvención otorgada se presentarán:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Las facturas o documentos de valor probatorio equivalente en el tráfico jurídico mercantil o con eficacia administrativa, en original y / o copia compulsada y la documentación acreditativa del pago. Si se han de devolver las facturas o justificantes originales, a petición de la entidad subvencionada, se reflejará con un sello la fecha de concesión de la subvención así como el importe del justificante que se imputa a la subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-Modelo de cuenta justificativa (Anexo 2).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-Solicitud de transferencia bancaria para pagos (Anexo 3).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-resto de documentación expresada en la base quinta&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8.4.- Las facturas originales, acreditativas del gasto subvencionado, expedidas a nombre de las personas o entidades subvencionadas y con su NIF, expresarán claramente: &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;o Fecha de emisión, que deberá corresponder al periodo comprendido entre 01 de enero de 2020 y 31 de diciembre de 2020.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;o Datos fiscales (nombre, domicilio, NIF, etc.) de la entidad emisora ​​y de la entidad pagadora. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;o Número de la factura. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;o Concepto detallado por el que se expide, que deberá ser suficientemente claro. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;o Importe con desglose de la parte que corresponde al IVA, en su caso. Si la operación está exenta de IVA se debe mencionar a la factura.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si la entidad beneficiaria únicamente dispone de la factura o documento justificativo que acredita el gasto recibida por correo electrónico, se admitirá siempre que la impresión de la factura se adjunte un certificado firmado por el representante legal de la entidad en la que manifieste imposibilidad o dificultad grave para obtener el documento original y declare que la factura ni se ha utilizado ni se utilizará para justificar ninguna otra subvención. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8.5.- No obstante, el Ayuntamiento de Pollença podrá pedir cualquier otra documentación que considere necesaria, según las circunstancias y características del caso.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Novena.- Procedimiento de gestión presupuestaria &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La aprobación del gasto deberá efectuarse con carácter previo a la convocatoria de la subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La resolución de la concesión de la subvención conllevará el compromiso de gasto correspondiente.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El pago de la subvención se realizará cuando el beneficiario haya justificado los gastos totales generados por la actividad, y se haya certificado por parte del jefe de la policía hacia la realización de la actividad y el cumplimiento de la finalidad que determinó la concesión de la subvención de acuerdo con el artículo 32 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones y 88 del RD 887/2006, de 21 de julio, por el que se aprueba el Reglamento General de Subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;El pago de las subvenciones o ayudas económicas se hará, como norma general, después de que el solicitante haya justificado los gastos totales generados por la actividad.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;DÉCIMA.- plazo y notificación&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.- El plazo máximo para dictar y notificar la resolución es de seis meses a contar desde la fecha en que termine el plazo para presentar solicitudes. Transcurrido este plazo sin que se haya publicado la resolución expresa, la solicitud debe entenderse desestimada por silencio administrativo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.-La resolución de concesión y pago debe comunicarse a la persona interesada mediante la publicación en la página web del Ayuntamiento de Pollença.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.- Contra esta resolución que pone fin a la vía administrativa, se puede interponer recurso potestativo de reposición ante el mismo órgano que la ha dictado en el plazo de un mes a contar desde el día siguiente de su publicación la resolución, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. También se pude interponer directamente recurso contencioso administrativo ante el Juzgado Contenciosos Administrativo de Palma en le plazo de dos meses desde el día siguiente de haberse publicado la resolución, de acuerdo con el artículo 46 de la Ley 29/98 , de 13 de julio, reguladora de la jurisdicción contencioso administrativa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Undécima Reintegro de subvenciones&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se deberá aplicar el artículo 37 de la LGS respecto de las causas de reintegro de las subvenciones, entre otros:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Obtención de la subvención falseando las condiciones requeridas u ocultando aquellas circunstancias que lo hubieran impedido.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Incumplimiento total o parcial del objetivo de la actividad.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Incumplimiento de la obligación de justificación o la justificación insuficiente.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) Resistencia, excusa, obstrucción o negativa a las actuaciones de comprobación y control financiero, o la concurrencia de subvenciones, ayudas, ingresos o recursos para la misma finalidad, procedentes de cualquier administración o ente público o privado, nacional, de la Unión Europea o de organismos internacionales.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e) El incumplimiento de las obligaciones impuestas por la Administración a las entidades colaboradoras y beneficiarios, así como de los compromisos asumidos por estos, con motivo de la concesión de la subvención, siempre que afecten o se refieran al modo en que han de conseguir los objetivos, realizar la actividad, ejecutar el proyecto o adoptar el comportamiento que fundamenta la concesión de la subvención&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El derecho de reconocer o liquidar el reintegro prescribe a los cuatro (4) años, art. 39 de la Ley General de Subvenciones 38/2003, de 17 de noviembre.&lt;/span&gt;&lt;/p&gt;
