text/html 2021-02-23 645347 2021-02-25 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Alcalde en fecha de 18/02/2021 ha aprobado la convocatoria de subvenciones que han de regir la concesión de subvenciones para fomentar el futbol federado, que ha sido enviada a la Base de Datos Nacional de Subvenciones con el número de código 550073 mediante la resolución que seguidamente se transcribe:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em>“Vista la Providencia de la Alcaldía de fecha 8 de enero de 2021 de acuerdo con la que el Ayuntamiento quiere continuar colaborando y otorgar ayudas económicas a los Clubes de Fútbol de Santa Margalida que con el fútbol federado contribuyen de forma efectiva en la dinamización del cabo y que, de una forma o de otra, ayudan al Ayuntamiento en el ejercicio de sus competencias, fomentando la participación y el bienestar de los ciudadanos, así como promoviendo la práctica del deporte.</em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em>Visto el informe de Intervención de la misma fecha de acuerdo con el que en el Presupuesto Municipal para el año 2021 del Ayuntamiento de Santa Margalida existe la aplicación presupuestaria 341 48900 "Clubes de Fútbol" con una consignación de 35.000,00.- €.</em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em>Dado que el Ayuntamiento Pleno, reunido en sesión ordinaria de día 29 de enero de 2021 aprobó las Bases específicas que deben regir la concesión de subvenciones para fomentar el fútbol federado del año 2021 y también la delegación al Alcalde aprobación de la convocatoria y los modelos de instancia de las subvenciones objeto de estas Bases.</em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em>Dado que las Bases y la delegación han sido publicadas en el BOIB Núm. 15 de día 02/04/2021 y en la sede electrónica de este Ayuntamiento, en uso de las facultades legalmente establecidas <strong>RESUELVO</strong></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em><strong>PRIMERO.- </strong>Aprobar la convocatoria que ha de regir la concesión de subvenciones para fomentar el fútbol federado de conformidad con las bases y los modelos de instancia de las subvenciones objeto de la presente Convocatoria que se adjuntan a la presente resolución.</em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em><strong>SEGUNDO.-</strong> Autorizar el gasto por importe de 35.000,00.- € con cargo a la aplicación presupuestaria 341 48900 "Clubes de Fútbol".</em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em><strong>TERCERO.-</strong> Publicar el presente acuerdo, junto con la convocatoria a la Base Nacional de Subvenciones, en el Boletín Oficial de la Comunidad Autónoma y en la sede electrónica del Ayuntamiento.</em><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></span></p> <p> </p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Santa Margalida, 22 de febrero de 2021</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>El alcalde</strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Joan Monjo Estelrich</span></p> <p> </p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>CONVOCATORIA&nbsp; DE SUBVENCIÓN PARA FOMENTAR EL FUTBOL FEDERADO EN EL TÉRMINO MUNICIPAL DE SANTA </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>1. OBJETO Y FINALIDAD</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">El objeto de las presentes bases es regular las ayudas económicas que el Ayuntamiento de Santa Margalida concederá durante el año 2021, en régimen de concurrencia competitiva, para sufragar los gastos derivados de la práctica del fútbol inscrito en la Federación de Fútbol de las Islas Baleares en el término municipal de Santa Margalida.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">La finalidad de estas subvenciones es fomentar y promover la práctica de este deporte, así como apoyar a las personas que lo practican y promueven su práctica en Santa Margalida</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>2. CONSIGNACIÓN PRESUPUESTARIA</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Durante el ejercicio presupuestario 2021, se destina la cantidad de 35.000,00.- € a las subvenciones objeto de las presentes bases, con cargo a la aplicación presupuestaria siguiente: 341 48900 Clubes Fútbol.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>3. BENEFICIARIOS.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">1. Pueden ser beneficiarios de las subvenciones objeto de las presentes bases aquellas personas jurídicas, entidades y asociaciones deportivas legalmente constituidas como entidades sin ánimo de lucro, que tengan su domicilio en el término de Santa Margalida, que tengan entre sus fines la el objeto de las presentes bases y que participen en competiciones oficiales de fútbol de la Federación de fútbol de las Islas Baleares.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2. No podrán obtener la condición de beneficiario de las subvenciones las personas o entidades en quienes concurra alguna de las circunstancias que se indican en los apartados 2 y 3 del artículo 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones y en el artículo 8 de la Ordenanza general reguladora de las subvenciones del Ayuntamiento de Santa Margalida.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>4. ACTIVIDADES SUBVENCIONABLES.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Son objeto de la presente subvención los gastos derivados del funcionamiento ordinario de los clubes de fútbol del término de Santa Margalida inscritos en la Federación de Fútbol de las Islas Baleares durante la temporada 2020-2021 (desde agosto de 2020 hasta junio 2021).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>5. ACTIVIDADES NO SUBVENCIONABLES.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">En ningún caso serán gastos subvencionables:</span></span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Gastos de las temporadas 2018-2019 y 2019 a 2020.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Los intereses deudores de las cuentas bancarias.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Intereses, recargos y sanciones administrativas y penales.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Gastos de procedimientos judiciales.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Los tributos, salvo que el beneficiario de la subvención los abone efectivamente.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Los impuestos indirectos cuando son susceptibles de recuperación o compensación, ni los impuestos personales sobre la renta.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Gastos de avituallamiento, cenas y comidas de inauguraciones, clausuras u otras celebraciones.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Premios en metálico para participantes.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Gastos de personal de la entidad que desarrolle funciones generales de gestión o administrativas (gerente, director, personal administrativo ...).</span></span></li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>6. RÉGIMEN DE LA CONCESIÓN. COMPATIBILIDAD O INCOMPATIBILIDAD CON OTRAS SUBVENCIONES.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">1. Las subvenciones objeto de las presentes bases se concederán en régimen de concurrencia competitiva de todas las solicitudes que cumplan los requisitos exigidos en estas bases y en su convocatoria.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2. Las subvenciones, tal y como permite la Base de Ejecución N. 37 del Presupuesto Municipal de 2021 podrán cubrir el 100% del coste del proyecto subvencionado, teniendo en cuenta las limitaciones presupuestarias y las contenidas en estas bases.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">3. Las ayudas económicas objeto de las presentes bases son compatibles con otras ayudas efectuadas por cualquier otra administración pública o entidad privada, siempre que el importe de las ayudas concedidas sea de tal cuantía que, aisladamente o en concurrencia con otras, no supere el coste de la actividad subvencionada.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>7. PRESENTACIÓN DE SOLICITUDES. PLAZO, LUGAR Y FORMA.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">1. El plazo para presentar las solicitudes será de 20 días naturales, a contar desde el día siguiente de la publicación de la convocatoria de esta subvención en el Boletín Oficial de la Comunidad Autónoma de las Islas Baleares. Si el último día fuera inhábil, se entenderá prorrogado hasta el primer día hábil siguiente.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2. Las solicitudes se formularán mediante instancia, deberán dirigirse al Sr. Alcalde-Presidente del Ayuntamiento y deberán presentarse en el Registro Electrónico del Ayuntamiento de Santa Margarita o en los lugares señalados en el artículo 16.4 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">3. Las solicitudes se formularán de acuerdo con los modelos de instancia que sean aprobados con la convocatoria. Junto con la solicitud, que irá firmada por el legal representante de la entidad, se deberá presentar la siguiente documentación:</span></span></p> <ol style="list-style-type:lower-alpha"> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Fotocopia del NIF de la entidad solicitante y fotocopia del DNI / NIE / Pasaporte de la persona que firma la solicitud.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Documentación acreditativa de la representación en virtud de la cual actúa la persona que firma la solicitud. Se debe acreditar el nombramiento y la vigencia del cargo.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Fotocopia de los Estatutos o Acta Fundacional inscritos en el Registro Oficial Correspondiente. No será necesario presentar este documento si la entidad solicitante lo ha acreditado en anteriores convocatorias de subvenciones y ayudas económicas del Ayuntamiento de Santa Margalida y no se ha producido ninguna modificación desde entonces.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Proyecto explicativo de las actividades o actuaciones para las que se solicita la ayuda económica. Entre otros aspectos, deben constar, una breve descripción de la actividad para la que se solicita la subvención, el presupuesto (donde se indicarán los gastos y los ingresos, desglosando, en su caso, la parte correspondiente a impuestos) y las fechas de realización.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">En el caso de que a la fecha de solicitud ya se haya realizado el proyecto por el que se solicita la subvención, se adjuntará una memoria descriptiva de las actuaciones realizadas. En ella deben constar, en la medida en que sea posible, los aspectos indicados en el párrafo anterior.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Certificado bancario que acredite la cuenta corriente o libreta en que se ingresará el importe de la subvención. No será necesario presentar este certificado bancario si la entidad solicitante lo ha acreditado en anteriores convocatorias de subvenciones y ayudas económicas del Ayuntamiento de Santa Margalida y no se ha producido ninguna modificación desde entonces.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Declaración que la entidad solicitante no recibe ninguna ayuda por el mismo concepto, o el importe de la ayuda recibida o solicitada con relación al total y declaración responsable ante autoridad administrativa de no incurrir en ninguna de las prohibiciones establecidas en la Ley 38/2003, de 17 de noviembre, general de subvenciones.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Declaración responsable de encontrarse al corriente en el cumplimiento de las obligaciones tributarias ante la Tesorería General de la Seguridad Social, ante la Agencia Tributaria y ante este Ayuntamiento. Si la cuantía a otorgar es superior a 3.000,00.- € la presentación de la declaración responsable no sustituirá la presentación <span style="color:#000000">la certificación</span>. Sin embargo, la presentación de la solicitud de la subvención implicará, salvo que expresamente se manifieste lo contrario, la autorización del solicitante para que el órgano otorgante obtenga de forma directa la acreditación del cumplimiento de estas obligaciones.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Documentación acreditativa de los criterios que se tendrán en cuenta a la hora de cuantificar el importe de la subvención de acuerdo con las presentes bases. Es decir, inscripciones a la Federación Balear de Fútbol de los equipos y de los jugadores del fútbol base.</span></span></p> </li> </ol> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">4. De acuerdo con lo establecido en el artículo 28.3 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, en el caso de que la documentación exigida ya esté en poder de la Ayuntamiento, los solicitantes, siempre que no hayan transcurrido más de cinco años desde la finalización del procedimiento de que formen parte, podrán hacer uso de su derecho a no presentarla, haciendo constar la fecha, el procedimiento y el órgano o dependencia en que fueron presentados o emitidos. En los supuestos de imposibilidad material de obtener el documento, el órgano competente podrá requerir al solicitante su presentación, o, en su defecto, la acreditación por otros medios de los requisitos a que se refiere el documento, con anterioridad a la formulación de la propuesta de resolución.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">5. Son de uso obligatorio los modelos específicos que se aprobarán y adjuntarán como anexos a la convocatoria. La falta de presentación de este modelos implicará la aplicación de lo dispuesto en el artículo 68 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">6. Si la solicitud no reúne los requisitos que se establezcan en la convocatoria, se requerirá al interesado para que en el plazo máximo de 10 días subsane las deficiencias, advirtiendo de que si no lo hace se le tendrá por desistido de su petición, previa resolución que se dictará en los términos previstos en el artículo en el artículo 21 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">7. Cualquiera de los órganos que intervienen en el procedimiento de concesión podrá, en cualquier momento del proceso, solicitar al interesado la información complementaria, los datos y las acreditaciones que estime necesarias.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">8. El Ayuntamiento podrá exigir la presentación de documentación original y expresamente se establece la obligación de presentar los documentos originales justificativo</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>8.- PROCEDIMIENTO DE CONCESIÓN. INICIO, INSTRUCCIÓN Y RESOLUCIÓN.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">1. El procedimiento de concesión de la subvención objeto de las presentes bases se iniciará de oficio, mediante acuerdo del Ayuntamiento Pleno, que aprobará las bases, que después serán publicadas en el BOIB y en la sede electrónica del Ayuntamiento. Posteriormente será aprobada la convocatoria que también deberá ser publicada en el BOIB, en la sede electrónica del Ayuntamiento y en la Base Nacional de Subvenciones.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2. El órgano instructor del procedimiento de concesión corresponde a la Concejalía de Deportes</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Una comisión evaluadora se reunirá para examinar si los beneficiarios cumplen todos los requisitos necesarios para acceder a las subvenciones y evaluar las solicitudes conforme a los criterios establecidos en estas Bases y en la Convocatoria. El instructor incorporará al expediente una diligencia firmada por la persona responsable en que conste lugar y fecha de publicación.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">En cuanto a la presentación de alegaciones se estará a lo que se ha establecido para la presentación de solicitudes.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Si no se presentan alegaciones dentro del plazo concedido, la propuesta de resolución formulada tendrá el carácter de definitiva. En otro caso, una vez examinadas las alegaciones presentadas por los interesados, el órgano instructor formulará propuesta de resolución definitiva, que deberá expresar el solicitante o la relación de solicitantes para los que se propone la concesión de la subvención , su cuantía, especificando su evaluación y los criterios de valoración seguidos para efectuarla.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">La propuesta de resolución definitiva se publicará en la sede electrónica del Ayuntamiento otorgando a los beneficiarios un plazo de 10 días naturales para que comuniquen su aceptación. Se entenderá aceptada si dentro de este plazo no se expresa lo contrario.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">3. La competencia para resolver el procedimiento y conceder la subvención se atribuye a la Junta de Gobierno Local, que dictará esta resolución una vez dictada la propuesta de resolución definitiva y emitido informe de fiscalización por la Intervención Municipal. La resolución se publicará en la web del Ayuntamiento de Santa Margalida.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>9.- CRITERIOS QUE DEBEN REGIR EL OTORGAMIENTO Y CUANTÍA DE LAS SUBVENCIONES.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">1. La concesión de las subvenciones de estas bases se rige por los principios de publicidad, concurrencia, objetividad, igualdad y no discriminación.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2. Con el fin de resolver el importe de la ayuda a otorgar, se establecen los siguientes criterios:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">a. Se otorgarán 1.000.- € por cada equipo de fútbol inscrito en la Federación Balear de Fútbol y que participe en alguna competición oficial de fútbol.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">b. Se otorgará 60.- € por cada jugador de fútbol inscrito en la Federación Balear de Fútbol, ​​excepto que el crédito consignado no fuera suficiente para atender todas las solicitudes, en este caso, el importe del crédito consignado una vez descontado el importe correspondiente a los equipos, se dividiría entre la cifra resultante de la suma del número de jugadores total por los que se justifican las solicitudes de subvención, el resultado sería la ayuda otorgada para cada jugador.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">3. La cuantía de la subvención tendrá como límite máximo el crédito consignado contemplado en estas bases.&nbsp;</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>10.- PLAZO DE RESOLUCIÓN Y NOTIFICACIÓN.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">1. El plazo máximo para resolver y notificar la resolución del procedimiento no podrá exceder de seis meses, a contar desde la publicación de la convocatoria.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2. El vencimiento del plazo máximo sin haberse notificado la resolución legitima a los interesados ​​para entender desestimada por silencio administrativo la solicitud de la subvención.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>11.- OBLIGACIONES DE LOS BENEFICIARIOS.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Las entidades beneficiarias deben cumplir las obligaciones establecidas en las disposiciones normativas que son de aplicación y, en concreto, de la Ordenanza general reguladora de la concesión de subvenciones del Ayuntamiento de Santa Margalida (BOIB Núm. 142 de 29 / 09/2012), y de las siguientes:</span></span></p> <ol style="list-style-type:lower-alpha"> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Aceptar y cumplir la normativa del Ayuntamiento de Santa Margarita.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Llevar a cabo el objeto de la subvención de acuerdo con las condiciones establecidas.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Acreditar ante el Ayuntamiento que han ejecutado o realizado la actividad subvencionada con la documentación correspondiente.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Comunicar al órgano competente para resolver de acuerdo con el artículo 6.3 de la presente convocatoria la obtención de subvenciones o ayudas para la misma finalidad no previstas inicialmente, así como cualquier eventualidad que altere el desarrollo de la actividad subvencionada.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Facilitar toda la información complementaria que requiera el Ayuntamiento.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Hacer constar que la actividad está subvencionada por el Ayuntamiento de Santa Margalida mediante el logotipo o las identificaciones corporativas del Ayuntamiento.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Informar e invitar a las autoridades del Ayuntamiento la presentación, inauguración y clausura de la actividad subvencionada.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Hacer la publicidad de la actividad subvencionada con lengua catalana.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Presentar, una vez concluida la actividad subvencionada, la documentación justificativa requerida en base siguiente.</span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">&nbsp;</span></span></p> </li> </ol> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>12.- JUSTIFICACIÓN DE LA SUBVENCIÓN.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">1. La justificación de los gastos subvencionados deberá realizarse con anterioridad a día 30 de julio de 2021.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2. El abono de la subvención se hará previa justificación por parte de la entidad beneficiaria de la realización de la actividad subvencionada, del cumplimiento de la finalidad y del gasto en los términos que se indican a continuación.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">3. Para justificar la subvención se presentará una cuenta justificativa simplificada integrado por la siguiente documentación: Relación clasificada de los gastos de la actividad subvencionada, con identificación del acreedor y del documento, su importe, fecha de emisión y fecha de pago.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">4. El Ayuntamiento de Santa Margalida comprobará, mediante una técnica de muestreo, los justificantes que estime oportunos y que permitan obtener una evidencia razonable sobre la adecuada aplicación de la subvención. A tal efecto, requerirá al beneficiario para que remita los justificantes de gasto que se seleccionen y que como mínimo deberán ser equivalentes al importe de subvención a otorgar.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">5. Sin embargo, el Ayuntamiento de Santa Margalida podrá pedir cualquier otra documentación que considere necesaria, según las circunstancias y características del caso.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">6. Si la documentación presentada es incompleta o incorrecta, el Ayuntamiento de Santa Margalida requerirá a la entidad beneficiaria para que la complete o subsane la deficiencia en el plazo improrrogable de 10 días naturales.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">7. Si de la documentación presentada para la justificación de la subvención se desprende que no se han cumplido las previsiones de aspectos que se han tenido en cuenta, se modificará la cuantía de la subvención concedida en función de la que efectivamente habría obtenido. El importe correspondiente a la minoración devolverá a la aplicación presupuestaria correspondiente.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>13.- REVOCACIÓN Y REINTEGRO.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Las subvenciones son de concesión voluntaria, revocables y reducibles si la entidad beneficiaria se ve afectada por alguna de las causas previstas en la Ley, a la Ordenanza Municipal, así como en el caso de que incumpla alguna de las obligaciones previstas en estas bases.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">En estos casos, previa tramitación del correspondiente procedimiento administrativo, la entidad beneficiaria deberá reintegrar las cantidades percibidas y los intereses de demora que correspondan.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>14.- INFRACCIONES O SANCIONES.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">El incumplimiento de los requisitos establecidos en estas bases, en la convocatoria o en la normativa de aplicación, dará lugar a la aplicación del régimen de infracciones y sanciones establecido en el Título V de la Ordenanza Municipal.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>15.- NORMATIVA APLICABLE.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Es de aplicación a estas bases la Ley 38/2003, de 17 de noviembre, general de subvenciones; el Real Decreto 877/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003; la Ordenanza general reguladora de la concesión de subvenciones del Ayuntamiento de Santa Margalida (BOIB Núm. 142 29/09/2012); la Ley 39/2015, 1 de octubre, del procedimiento administrativo común de las administraciones públicas; el Real Decreto Legislativo 2/2004 por el que se aprueba el texto refundido de la Ley Reguladora de las Haciendas Locales; las Bases de Ejecución del Presupuesto Municipal para el año 2021; la Convocatoria de la subvención y demás normativa que resulte de aplicación.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>16.- RECURSOS.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">La resolución que recaiga en este procedimiento no pone fin a la vía administrativa.
