&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Resolución del consejero de Movilidad y Vivienda de 27 de noviembre de 2020 por la que se convocan las pruebas para la obtención del certificado de aptitud profesional acreditativo de la calificación inicial de los conductores de determinados vehículos destinados al transporte por carretera que se han de llevar a cabo el año 2021 en las islas de Mallorca, Eivissa y Formentera, publicada en el BOIB nº. 204, de 5 de diciembre de 2020, establece en el apartado 1 del anexo 2 los miembros del Tribunal calificador de estas pruebas, quedando pendiente de nombramiento el suplente de la presidencia.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Desde su publicación, se ha producido la jubilación de otro miembro del Tribunal, por lo que es necesario también, modificar la composición.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El Real Decreto 1032/2007, de 20 de julio, por el que se regula la calificación inicial y la formación continua de los conductores de determinados vehículos destinados al transporte por carretera (BOE nº.184, de 2 de agosto de 2007).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo lo expuesto, dicto la siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Modificar el punto 1 del anexo 2 de la Resolución del consejero de Movilidad y Vivienda de 27 de noviembre de 2020, referente a la composición del Tribunal calificador de las pruebas, en los términos siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Donde dice:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Publicar esta Resolución en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta Resolución —que agota la vía administrativa— se puede interponer un recurso potestativo de reposición ante el consejero de Movilidad y Vivienda, en el plazo de un mes contador desde el día siguiente a su publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala Contenciosa Administrativa del Tribunal Superior de Justicia de las Illes Balears, en el plazo de dos meses a contar desde el día siguiente de la publicación de la Resolución en el BOIB, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;
