![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">El Pleno del Ayuntamiento en sesión ordinaria celebrada el día 28 de octubre de 2020 aprobó inicialmente la Ordenanza municipal de vehículos de movilidad personal (VMP).</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En el BOIB núm. 189, de día 03.11.20, se publica el anuncio de dicha aprobación.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Atendiendo que durante el período establecido al efecto no se han presentado alegaciones, la ordenanza se entiende aprobada definitivamente.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">A continuación, se publica íntegramente la ordenanza indicada:</span></span></p>
<p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">ORDENANZA MUNICIPAL DE VEHÍCULOS DE MOVILIDAD PERSONAL (VMP)</span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#00000a">PREÁMBULO</span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#000000">El objeto de la presente ordenanza reside en dar adecuada respuesta</span></span><span style="color:#000000"> a la problemática que plantea la circulación por las vías urbanas del <span style="background-color:white">término municipal de Sant Lluís</span> de los vehículos de movilidad personal (VMP).</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La rápida proliferación y la tendencia creciente en el municipio de estos nuevos aparatos, junto con la débil situación legal con respecto a su regulación, provocan ciertas incidencias y disfunciones en la movilidad: peatones y ciclistas comparten su espacio con vehículos de características muy diferentes. Y, por otra parte, las personas usuarias de los nuevos medios de desplazamiento <span style="background-color:white">sufren</span> un vacío normativo con respecto a la regulación de sus condiciones de circulación.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Se desea dejar constancia que se han atendido las recomendaciones de la Federación Española de Municipios y Provincias (FEMP), acuerdos adoptados por la Junta de Gobierno de la FEMP en reuniones de 29 de octubre de 2018 y de 26 de marzo de 2019, sobre acera y prioridad peatonal y sobre espacios públicos urbanos y modos de desplazamiento, respectivamente. Asimismo, se han tenido en consideración la Instrucción 16/V-124, de 3 de noviembre de 2016, sobre “ Vehículos de movilidad personal” y la Instrucción 2019/S-149 TV-108, de 3 de diciembre de 2019, sobre “Aclaraciones técnicas y criterios para la formulación de denuncias de vehículos ligeros propulsados por motores eléctricos”, ambas de la Dirección General de Tráfico.</span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Los vehículos de movilidad personal (VMP) son vehículos de una o mas ruedas dotados de una única plaza y propulsados exclusivamente por motores eléctricos que pueden proporcionar al vehículo una velocidad máxima por diseño comprendida entre los seis y los veinticinco kilómetros por hora (6-25 Km/h).</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Quedan excluidos:</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- Vehículos sin sistema de auto-equilibrio y con sillín.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- Vehículos concebidos para competición.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- Vehículos para personas con movilidad reducida.</span></span></p>

Están equipados con un motor eléctrico y su capacidad máxima de transporte es de una plaza. Dispondrán de sistema de frenado. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Tipo B:</strong> vehículos autoequilibrados y patinetes eléctricos de mayor tamaño. Están equipados con un motor eléctrico y su capacidad máxima de transporte es de una plaza. Dispondrán de sistema de frenado.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#000000">Cualquier otro aparato que no queden recogido en los tipos expuestos, deberán acreditar, mediante certificado de la Consejería de Industria, la categoría a la que pertenecen. Caso de no disponer de dicho certificado, no se considerarán aptos para la circulación.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 3. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Condiciones generales </span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1.- Como norma general, los VMP podrán circular por las zonas que se detallan en la presente ordenanza, siempre con la diligencia y precaución necesarias para no provocar daños propios o ajenos, evitando poner en peligro a la propia persona usuaria y al resto de las personas que transitan por la vía. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2.- Se prohíbe el uso de auriculares, teléfonos móviles o cualquier otro aparato que suponga una distracción, mientras se conduce cualquier VMP.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3.- Se prohíbe circular con tasas de alcohol superiores a las establecidas en la normativa general de tráfico, así́ como bajo los efectos de drogas tóxicas, estupefacientes o sustancias psicotrópicas. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4.- No se permite la circulación con ocupantes. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">5.- Cuando los VMP circulen por el carril bici, o por calzadas en las que estén autorizados, lo harán por su derecha, advirtiendo con antelación suficiente los giros o cualquier maniobra que se vaya a realizar y respetando en todo momento las indicaciones de los/las agentes encargados/as del tráfico, las señales y los semáforos. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">6.- Cuando pretenda hacer un adelantamiento, la persona que conduce un VMP deberá advertirlo con antelación suficiente, comprobando que existe espacio libre suficiente y que no se pone en peligro, ni se entorpece, a las personas usuarias que circulan en el mismo sentido o en sentido contrario. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">7.- Se respetarán, en todo momento, las normas generales de circulación establecidas por la presente ordenanza y por la normativa y legislación vigentes en materia de tráfico. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">8.- Queda prohibida la circulación en compañía, al mismo tiempo, <span style="background-color:white">de animales </span>sujetos por correa. Tampoco se permite el arrastre de cualquier otro vehículo o de personas usuarias que utilicen patín, monopatín, patinete, patines o similares, </span><span style="background-color:white"><span style="color:#000000">así como de animales.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 4. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Zonas de circulación, dirección de la marcha y velocidad máxima </span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1.- Circulación prohibida: No se permite la circulación de los VMP por las aceras y calles o zonas peatonales,</span> <span style="color:#000000">excepto que se autorice expresamente.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2.- Circulación permitida: Se permite la circulación de los VMP por las calzadas cuya regulación de la velocidad se encuentre limitada a 30 km/h o inferior y por las calles de plataforma única en las que este permitida la circulación de vehículos, así como por los carriles bici.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3.- Dirección de la marcha: Con carácter general, se prohíbe la circulación en sentido contrario al de los vehículos; no obstante, en los carriles bici se permitirá la circulación en ambos sentidos cuando la anchura de los carriles lo permita; a cuyos efectos se colocarán las señales verticales u horizontales pertinentes. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4.- Velocidad máxima:</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4.1. Circulación por la calzada:</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a. Los VMP de tipo A nunca podrán superar los 25 km/hora.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">b. Los VMP de tipo B deberán acomodar su velocidad máxima a la fijada para cada vía, sin que, en ningún caso, puedan superar los 25 km/h.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4.2. Circulación por las aceras autorizadas, por vías de plataforma única cerradas al tráfico de vehículos y en parques o zonas verdes:</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Se permite la circulación de estos vehículos de tipo A y B a velocidad de peatón. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">5.- Deben respetarse: La preferencia de la persona viandante, el patrimonio natural y el mobiliario urbano. Debe respetarse la señalización y se deben usar las vías ciclistas y los itinerarios de las zonas pavimentadas o de tierra, si las hubiere. No se puede circular sobre parterres, áreas o zonas con vegetación de cualquier tipo, ni por todas aquellas zonas señalizadas con prohibición expresa. </span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 5. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Prioridad </span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Las personas que conducen vehículos de movilidad personal de dos o más ruedas tienen un deber de cautela y están obligadas a circular con diligencia y precaución, para evitar daños propios o a terceros, no poner en peligro al resto de personas usuarias de la vía y respetar siempre la preferencia de paso de las personas viandantes.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Es obligatorio reducir la velocidad cuando se aproximen a un paso de peatones, para evitar situaciones de conflicto con las personas viandantes, así como tomar las precauciones necesarias.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Siempre que se comparta espacio con peatones, deberán respetar la prioridad de éstos, adecuar la velocidad del VMP a su paso y no hacer ninguna maniobra que afecte negativamente a su seguridad.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En todo caso se debe mantener una distancia de separación mínima de un metro respecto de las personas viandantes.</span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 6. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Estacionamiento </span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Los vehículos VMP solo podrán estacionarse en los espacios habilitados para ello.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Se prohíbe atarlos a árboles, semáforos, bancos y otros elementos de mobiliario urbano; se prohíbe aparcarlos en zonas de carga y descarga o en lugares reservados a otras personas usuarias, como los taxis o las personas con movilidad reducida; o en zonas de estacionamiento prohibido y salidas de emergencia, así como en las aceras, salvo que ello se encuentre expresamente autorizado.</span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 7. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Uso del casco</span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Para las personas usuarias de vehículos de los tipos A y B, el uso del casco homologado será obligatorio.</span></span></p>

<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Elementos reflectantes, luces y timbres</strong> </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Todas las tipologías de vehículos deben llevar elementos reflectantes, luces delanteras y traseras, así como timbres, de manera obligatoria y debidamente homologados. </span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 9.</span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Seguro </span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La contratación de un seguro de responsabilidad civil es obligatoria para todas las personas físicas y jurídicas titulares de vehículos VMP, ya sea a título de propiedad o cualquier otro título. I</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">También debe cubrirse la indemnización de carácter subsidiario por los daños y perjuicios derivados del uso de aquellos vehículos VMP por parte de las personas usuarias a quienes se los cedan o alquilen. </span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 10. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Edad mínima necesaria </span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La edad permitida para conducir un VMP o un ciclo de más de dos ruedas es de 15 años, en todos los casos. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#000000">Las personas menores de 15</span> <span style="color:#000000">años pueden utilizarlos fuera de las zonas de circulación, en espacios cerrados al tráfico, bajo la responsabilidad de los progenitores o tutores/as, siempre que el vehículo resulte adecuado a su edad, altura y peso.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"> </span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">CAPÍTULO II. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">DE LAS CONDICIONES ESPECIALES PARA ACTIVIDADES DE EXPLOTACIÓN ECONÓMICA </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"> </p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 11. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Condiciones especiales de circulación </span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Cuando con los vehículos VMP se realice una actividad de explotación comercial, turística o de ocio, con ánimo de lucro, deben seguirse unas condiciones especiales de circulación:</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1.-Los grupos formados por hasta diez personas, incluido el/la guía, con vehículos de tipo A o B, deberán ir obligatoriamente acompañados por un/a guía y solo podrán circular por los itinerarios previamente autorizados por la autoridad municipal. </span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"> </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2.-No se adquiere derecho alguno sobre los itinerarios, autorizándose los mismos en precario, pudiendo ser anulados y/o modificados unilateralmente por el <span style="background-color:white">Ayuntamiento de Sant Lluís,</span> a través de la Concejalía correspondiente de Movilidad</span><span style="color:#00cc00">.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3.-Debe mantenerse una distancia entre grupos de más de 50 metros. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4.-Puede haber restricciones específicas en ámbitos o en temporadas, <span style="background-color:white">que se fijarán, en su caso,</span> a consideración de la Concejalía correspondiente de Movilidad.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">5.- Las personas titulares de la explotación económica deben velar por que las personas usuarias de los vehículos de movilidad personal y ciclos de más de dos ruedas dispongan de un nivel de habilidad mínimo, que garantice su seguridad y la del resto de personas usuarias de la vía pública. Asimismo, deben informar de las rutas autorizadas y de las condiciones de circulac<span style="background-color:white">ión.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#000000">6.-Se prohíbe el acopio de la flota en la vía pública, salvo en los casos de empresas de alquiler de dicho tipo de vehículos que cuenten con la preceptiva autorización municipal de ocupación de vía pública.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 12. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Identificación y registro para vehículos y ciclos que desarrollen una actividad económica </span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#000000">El Ayuntamiento de Sant Lluís creará un registro de ciclos y vehículos de movilidad personal afectos a actividades económicas, mediante sus departamentos competentes en dicha materia (Policía Local, Promoción Económica, Comercio y Turismo).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Aquellos ciclos a los que se les esté dando un uso de actividad de explotación económica deberán registrarse de forma inmediata, junto con los vehículos de movilidad personal y ciclos de más de dos ruedas que desarrollen este tipo de actividad. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">El nuevo registro permitirá comprobar que los vehículos cumplen los requisitos técnicos normativos <span style="background-color:white">solicitados,</span> identificarlos y registrarlos. Los vehículos se identificarán con un código QR.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La Policía Local dispondrá de un sistema que permitirá obtener una lectura rápida de las características técnicas de los vehículos y de su titularidad, y comprobar que cumplan todos los requisitos establecidos en la ordenanza. </span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 13. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Uso de los VMP por personas con dificultad de movilidad personal </span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En el caso de personas con dificultad <span style="background-color:white">de movilidad personal, los VMP </span>podrán circular igual que un peatón y a la velocidad de éste, un máximo de 5 km/h, respetando, en todo caso, la prioridad del peatón no motorizado. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Esta dificultad se acreditará mediante certificado médico, en el que se refleje la necesidad de usar un medio auxiliar, indicando el tiempo necesario. Este tiempo no superará los dos años; y, si fuera necesario, se realizará un nuevo certificado médico actualizado. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"> </span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">CAPÍTULO III. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Régimen sancionador </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 14. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Disposiciones generales</span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Las acciones y omisiones contrarias a lo dispuesto en esta ordenanza constituyen una infracción administrativa, y serán sancionadas en los términos previstos en la legislación sobre tráfico, circulación de vehículos a motor y seguridad vial.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Las infracciones a los preceptos regulados en esta ordenanza se clasifican en leves, graves y muy graves.</span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 15. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Responsabilidad</span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La responsabilidad por las infracciones cometidas contra lo dispuesto en la presente ordenanza se determinará conforme prevé la legislación sobre tráfico, circulación de vehículos a motor y seguridad vial.</span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 16. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Procedimiento sancionador</span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La imposición de sanciones por la comisión de infracciones tipificadas en esta ordenanza sólo podrá acordarse en virtud del procedimiento instruido con arreglo a lo dispuesto en la legislación sobre tráfico, circulación de vehículos a motor y seguridad vial y sus ordenanzas de desarrollo, y supletoriamente, en la normativa de procedimiento administrativo común.</span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 17. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Infracciones leves</span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Se considerarán infracciones leves las siguientes conductas:</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a) Circular sin mantener una distancia de separación mínima de un metro respecto de las personas viandantes, <span style="background-color:white">perjudicando o entorpeciendo su tránsito por esas zonas,</span> siempre que no tenga consideración más grave.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">b) Parar o estacionar sobre aceras, paseos y demás zonas destinadas al paso de peatones, <span style="background-color:white">perjudicando o entorpeciendo su tránsito</span> por dichas zonas.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">c) Estacionar fuera de la zona habilitada específicamente para ello.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">d) Circular con VMP en grupos, no respetando la distancia mínima entre grupos establecida en la presente ordenanza.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">e) Circular con VMP en grupos superiores al número establecido por la presente ordenanza.</span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"> </p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 18. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Infracciones graves</span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Se considerarán infracciones graves:</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a) Circular incumpliendo las normas establecidas sobre las limitaciones de velocidad, cuando no se considere como infracción muy grave.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">b) Circular con un VMP sin tener la edad mínima exigida en la presente ordenanza.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">c) Circular transportando viajeros/as.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">d) Circular con un VMP que carezca de sistema de frenado.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">e) Circular con un VMP utilizando cascos <span style="background-color:white">reproductores,</span> auriculares conectados a aparatos receptores o reproductores de sonido.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">f) Circular por vías o zonas prohibidas.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">g) Circular de forma negligente.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">h) Circular con un VMP que exceda de las características técnicas establecidas o que no cumpla las condiciones de circulación exigidas por la presente ordenanza y demás normativa de aplicación.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">i) Circular con VMP sin el casco de protección obligatorio.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">j) Conducir un VMP utilizando un teléfono móvil u otro medio o sistema de comunicación.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">k) Circular con un VMP que se utilice para una actividad de explotación económica, sin estar identificado y/o sin disponer de la correspondiente autorización municipal.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">l) Circular con un VMP que carezca de sistema de alumbrado, reflectantes o timbre.</span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"> </span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 19. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Infracciones muy graves</span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Se consideran infracciones muy graves las siguientes conductas:</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a) Circular incumpliendo las normas establecidas sobre las limitaciones de velocidad, excediendo en más de un 50 por ciento la velocidad máxima permitida.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">b) Circular con un VMP sin el seguro obligatorio.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">c) Circular con una tasa de alcohol superior a las establecidas reglamentariamente o con presencia de drogas.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">d) Circular con temeridad, provocando circunstancias de riesgo propio o para terceros, y que puedan poner en peligro al resto de personas usuarias de la vía.</span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"> </p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 20. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Sanciones</span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1.- Las sanciones por la comisión de infracciones reguladas en esta ordenanza quedarán graduadas de la siguiente forma:</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a) La comisión de infracciones leves se sancionará con multas de hasta 100 €.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">b) La comisión de infracciones graves se sancionará con multas de 101 a 200 €.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">c) La comisión de infracciones muy graves se sancionará con multas de 201 a 500 €.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2.- Las sanciones se graduarán considerando especialmente los siguientes criterios:</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a) Aquellos previstos en la legislación vigente sobre tráfico, circulación de vehículos a motor y seguridad vial.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">b) La existencia de intencionalidad o reiteración.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">c) La naturaleza de los perjuicios causados.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">d) La reincidencia, por comisión en el término de un año de más, de una infracción de la misma naturaleza, cuando así haya sido declarado por resolución firme.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3.- La competencia sancionadora por la comisión de infracciones de esta Ordenanza corresponde a la Alcaldía, que podrá delegar sus atribuciones.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4.- Con independencia de la sanción que pudiera corresponder, procederá la inmovilización, retirada y depósito municipal del vehículo, y demás medidas provisionales, en los casos previstos en la normativa estatal de tráfico y seguridad vial.</span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 21. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Inmovilización y retirada</span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. Los y las agentes de la autoridad podrán proceder a la inmovilización de los vehículos de movilidad personal cuando, como consecuencia del incumplimiento de los preceptos de esta ordenanza o normas de aplicación subsidiaria, <span style="background-color:white">pueda derivarse de su utilización </span>un riesgo grave para la circulación, las personas o los bienes, especialmente en los siguientes supuestos:</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a) En caso de accidente o avería del vehículo, que impida continuar la marcha.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">b) En el supuesto de pérdida, por la persona conductora, de las condiciones físicas necesarias para conducir, cuando pueda derivarse un riesgo grave para la circulación, las personas o los bienes.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">c) Cuando la persona conductora del vehículo se niegue a someterse a las pruebas de detección a que se refiere la Ley sobre tráfico, circulación de vehículos a motor y seguridad vial; o si el resultado de estas superase los límites reglamentariamente establecidos.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">d) Cuando el vehículo exceda la altura, longitud o ancho reglamentariamente autorizado.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">e) Cuando, por las condiciones del vehículo, se considere que constituye peligro para la circulación o produzca daños en la calzada.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">f) Cuando el vehículo circule con carga superior a la autorizada o su colocación exceda en altura o anchura a las permitidas reglamentariamente.</span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"> </span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">g) Cuando se circule con uno o más personas.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">h) Cuando las posibilidades de movimiento o el campo de visión de la persona conductora resulten sensible y peligrosamente disminuidos por la colocación de la carga transportada.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">i) Cuando la persona infractora no acredite su residencia legal en territorio español, salvo si deposita el importe de la sanción y de los gastos de inmovilización o garantiza su pago por cualquier medio admitido en derecho.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">j) Cuando el vehículo carezca del alumbrado reglamentario o éste no funcione, en los casos en que su utilización sea obligatoria.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">k) Cuando el vehículo requiera un seguro obligatorio civil para poder circular y<span style="background-color:white"> carezca del mismo.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">l) Cuando <span style="background-color:white">la persona conductora</span> circule sin casco homologado, hasta que se subsane la deficiencia.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">m) Cuando el vehículo se encuentre en una zona de uso público en la que esté prohibida la circulación de vehículos.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">n) Cuando el vehículo hubiera sido objeto de una reforma de<span style="background-color:white"> importancia, no autorizada.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">o) Cuando existan indicios de cualquier manipulación en los instrumentos de control.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">p) Cuando el vehículo esté dotado de mecanismos o sistemas encaminados a eludir la vigilancia de los y las agentes de la autoridad que se encargan de la vigilancia del tráfico, en el ejercicio de las funciones que tienen encomendadas, y de los medios de control a través de captación de imágenes.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="background-color:white">q) Cuando los VMP</span> no cumplan los requisitos técnicos que se establecen en la presente ordenanza y, como consecuencia de ello, obstaculicen o dificulten la circulación o supongan un peligro para ésta o un riesgo grave para las personas o los bienes.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">r) Cuando se estacionen más de 72 horas en el mismo lugar de la vía pública, entorpeciendo las condiciones de uso apropiado para el libre estacionamiento del resto de personas usuarias.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. La inmovilización podrá acarrear la retirada del vehículo de movilidad personal -<span style="background-color:white">-y su traslado al depósito correspondiente--, si no se subsanan</span> las causas que la motivaron, o constituyan un peligro, o causen graves perturbaciones a la circulación de vehículos o viandantes o al funcionamiento de algún servicio público; o deterioren el patrimonio público; y cuando pueda presumirse racionalmente su abandono.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. Los/las agentes de la autoridad levantarán la correspondiente acta de inmovilización/retirada, la cual no perderá efecto hasta que no sea cumplimentada la diligencia de “Levantamiento de la inmovilización”.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4. Los gastos que se originen como consecuencia de la inmovilización/retirada del vehículo serán por cuenta de la persona titular, que deberá abonarlos o garantizar su pago, como requisito previo a levantar tal medida, sin perjuicio del derecho de defensa que le asiste y de la posibilidad de repercutirlo sobre la persona responsable que haya dado lugar a la adopción de tal medida por parte de la Administración.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">5. La inmovilización/retirada se llevará a cabo en el lugar que indique la autoridad municipal; y no se levantará hasta que no queden subsanadas las deficiencias que la motivaron o se proceda a la retirada del vehículo en las condiciones que dicha autoridad determine, previo pago de la tasa correspondiente, si así estuviere establecido.</span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Artículo 22. </span></strong></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Prescripción y caducidad</span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#000000">Para determinar el plazo</span></span><span style="color:#000000"> de prescripción de las infracciones y sanciones previstas en esta ordenanza, se estará a lo dispuesto en la legislación sobre tráfico, circulación de vehículos a motor y seguridad vial, y a su reglamento de desarrollo; y, supletoriamente, <span style="background-color:white">a lo dispuesto en </span>la normativa de procedimiento administrativo común.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Disposición adicional</span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La presente normativa municipal estará supeditada, en todo caso, a lo establecido para los VMP en la normativa europea, nacional y autonómica vigente, aplicable en la materia.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Disposición final</span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La presente ordenanza, tras su aprobación definitiva, entrará en vigor al día siguiente de su completa publicación en el Boletín Oficial de las Islas Baleares, a excepción de lo establecido en el capítulo “Infracciones y sanciones”, que entrará en vigor a los quince (15) días siguientes </span><span style="background-color:white"><span style="color:#000000">de la fecha</span></span><span style="color:#000000"> de su publicación en el Boletín Oficial de las Islas Baleares.</span></span></p>
