font-size:12px"><strong>« ORDENANZA REGULADORA DEL PRECIO&nbsp;PUBLIC&nbsp;POR LA&nbsp;UTILITZACION DE LOS SERVICIOS DEL&nbsp;ESCOLETA&nbsp;INFANTIL”</strong><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 1.º- Concepto.</strong><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformidad con el que prevé el artículo 41 del RDL 2/2004, de 5 de marzo, texto rechazo de la ley reguladora de las haciendas locales, este Ayuntamiento seguirá aplicando el precio público por la utilización de los servicios municipales del&nbsp;Escoleta&nbsp;infantil, especificados a las tarifas contenidas en el artículo 3.º siguiente, la cual se regirá por la presente ordenanza.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 2.º- Obligados al pago.</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Están obligados al pago del precio público regulado en esta ordenanza, quienes se beneficien de los servicios y actividades prestadas o realizadas por el Ayuntamiento, a las cuales hace referencia el artículo anterior.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 3.º- Cuantía.</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- La cuantía del precio público regulado en esta ordenanza será lo fijado en las tarifas contenidas en el apartado siguiente, para cada uno de los diferentes servicios o actividades.</span></p> <p><span style="font-family:Times New Roman,Times,serif; Las altas, bajas o modificaciones de la modalidad contratada surgirán efectos a partir del día 1 del mes siguiente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 4.º- Obligación del pago. Devengo y normas de gestión.</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- La obligación del pago del precio público regulado en esta ordenanza, nace desde que se preste o se realice cualquier de los servicios o actividades especificadas en el artículo anterior.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- El pago del precio público se efectuará en el momento de utilizar los servicios correspondientes, mediante la presentación, al obligado de realizarlo, de la correspondiente factura.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- Por los&nbsp;niños&nbsp;y niñas&nbsp;que habitualmente utilicen los servicios del&nbsp;Escoleta&nbsp;Municipal, en cualquier de las modalidades enumeradas en el artículo anterior, el pago de las cuotas correspondientes se realizará entre el día 1 y 15 de cada mes, respecto a los servicios del mes anterior. Excepcionalmente, la cuota correspondiente al mes de septiembre será exigible y se abonará en el momento de la inscripción en el curso escolar.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- El pago de las cuotas correspondientes, cuando se trate de servicios eventuales, se realizará en el momento de solicitar el servicio. Cuando se trate de servicios contratados de forma habitual, las cuotas correspondientes serán exigibles independientemente de la utilización del mencionado servicio. Las bajas que se produzcan durante cualquier de los meses del año, surgirán efectos a partir del mes siguiente al de la solicitud de la baja.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.- Excepcionalmente, durante los meses de julio y agosto, la obligación de pago se meritará quincenalmente, en función de la matrícula previamente realizada.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.- Durante los meses de julio y agosto, los servicios de descanso / guardería de atardecer será prestado de las 13:30 a 16:00, y no será prestado el servicio de guardería de atardecer.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.- Las cuotas meritadas que por cualquier causa no hayan sido ingresadas, se exigirán por la vía de constreñimiento, en la forma prescrita por el Reglamento General de Recaudación, por las normas que lo complementen o lo sustituyan.<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 5.º- Bonificaciones y exenciones.</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. A instancia de parte, y en todo caso previo informe técnico favorable de los Servicios Sociales Municipales, el Ayuntamiento, a través del Alcalde-Presidente, podrá otorgar la exención total o parcial de las cuotas meritadas por asistencias y manutención, cuando las circunstancias socio - económicas del solicitante manifiesten una situación de subsistencia que aconseje la concesión de las mencionadas bonificaciones o exenciones. El Ayuntamiento podrá pedir cualquier tipo de prueba que acredite el estado socio - económico del solicitante.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Las familias que utilicen los servicios del&nbsp;Escoleta&nbsp;Municipal, con la excepción del de comedor, tendrán, previa solicitud de los interesados, una bonificación del 25% a partir del 2.º hijo/hija que asistan, a la vez, a la&nbsp;Escoleta&nbsp;.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Las familias numerosas disfrutarán de una bonificación del 25% de las cuotas meritadas en aplicación del artículo 3.º.2 de la presente ordenanza, exceptuando las de comedor. Esta bonificación queda limitada a las familias numerosas los ingresos anuales de las cuales no sobrepasen en cuatro veces el salario mínimo interprofesional fijado anualmente por el Gobierno Estatal. El porcentaje anterior se calculará sobre los ingresos de todos los miembros que formen la unidad familiar.<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los sujetos pasivos, titulares de familia numerosa, para poder disfrutar de la bonificación del presente apartado, lo tendrán que solicitar por escrito dirigido al Ayuntamiento adjuntando a la solicitud la siguiente documentación:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">• Certificado o cartilla de familia numerosa, expedida por el organismo competente.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">• La declaración del IRPF, correspondiendo al ejercicio inmediatamente anterior al de la solicitud, de todos los miembros que formen la unidad familiar. En el supuesto de no haber realizada la mencionada declaración, esta se sustituirá por un certificado expedido por el&nbsp;AEAT&nbsp;, a solicitud del propio interesado, donde quede de manifiesto los ingresos obtenidos y declarados por los agentes pagadores. Este certificado será de obligada presentación en el supuesto de que uno o más miembros de la unidad familiar haya realizado la declaración del IRPF y los otros no la hayan realizado.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 6.º- Infracciones y Sanciones Tributarias.</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.En materia de infracciones y la correspondiente sanción, se aplicará el que disponga la legislación sobre Régimen Local y disposiciones complementarias o supletorias.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La imposición de sanciones no impide, en ningún caso, la liquidación y el cobro de las cuotas defraudadas no prescritas.&nbsp;<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 7.º- Legislación supletoria.</strong><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En todo aquello no previsto en la presente ordenanza, se aplicará el que establezca la Ley de Régimen Local y otras disposiciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Disposición final.</strong><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. En todo aquello que no es previsto en este acuerdo se aplicará lo establecido en la vigente ley de régimen local y otras disposiciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Este acuerdo de regulación de precio público entrará en vigor el día de su publicación en el boletín oficial de la comunidad autónoma de las Islas Baleares (BOIB).
