    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 10 de setiembre de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para la Creación de empresas de Jóvenes agricultores, correspondientes a los años 2015-2019, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;&lt;em&gt;&lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Islas Baleares&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en materia agraria del FOGAIBA, con fecha 18&amp;nbsp;de enero&amp;nbsp;de 2021, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.El 15 de septiembre de 2015 se publicó, en el Boletín Oficial de las Islas Baleares (BOIB) núm. 136, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de septiembre de 2015, por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores (modificada por la Resolución del presidente del FOGAIBA publicada en el BOIB núm. 54, de 30 de abril de 2016).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.El 9 de junio de 2018, se publicó en el Boletín Oficial de las Islas Baleares (BOIB) núm. 71, la Resolución del vicepresidente del FOGAIBA de concesión de la ayuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Con fecha 20&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;marz&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;o de 201&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;9&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, presentó la solicitud de pago del segundo tramo, con registrar RGE núm. &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;7546.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.Una vez revisada la solicitud de pago, se ha observado que no cumple los requisitos y condiciones establecidas el apartado décimo&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;punto 1, de obligaciones de los beneficiarios, de la Resoluci&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n del Presidente del FOGAIBA de 10 de septiembre de 2015, por la que se convocan, para los a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ñ&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;os 2015 a 2019, subvenciones para la &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;C&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;reaci&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;mpresas de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Jó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;venes &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;agricultores, ya que en el IRPF no tiene la actividad agraria (de acuerdo con el punto 3, b.2, del apartado undécimo), y además, no está inscrita en el RIA la actividad complementaria de transformación de almendras, y por último, la inscripción en el RIA está condicionada.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. Asimismo, se le informa que no se llevará a cabo la revocación de la ayuda concedida, ya que dispone de un plazo de 36 meses, desde la concesión de la ayuda y siempre antes del pago de la ayuda, en cuanto a que el IRPF no tiene la actividad agraria y además, no está inscrita en el RIA la actividad complementaria de transformación de almendras.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Propuesta de Resolución &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y propongo al vicepresidente en Materia Agraria del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Denegar el pago de la solicitud del segundo tramo del expediente núm CEJA2016_&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;2&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;29&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;correspondiente al beneficiario con NIF ***&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0472&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;**, relativa a la línea de ayuda «Creación de empresas de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;J&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;óvenes agricultores », ya que no cumple los requisitos establecidos en el &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;punto 1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;del &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;apartado décimo&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;y &amp;nbsp;el punto 3, b.2) del apartado once de la Resolución de la convocatoria del presidente del FOGAIBA de 10 de septiembre de 2015.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Publicar esta resolución en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante la&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;conse&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ll&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;er&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&amp;nbsp;de Agricultura, Pesca y Alimentación, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares, y los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
