    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de setiembre de 2015 por la cual se convocan subvenciones para la Creación de empresas de Jóvenes agricultores, para los años 2015-2019, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;em&gt;&lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;&lt;/em&gt;&amp;nbsp;de acuerdo con los términos que prevee el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantia Agraria y Pesquera de las Islas Baleares (FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en materia agraria del FOGAIBA, con fecha de 18&amp;nbsp;de enero&amp;nbsp;de 2021, dicta lo siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.El 15 de septiembre de 2015 se publicó en el Boletín Oficial de las Islas Baleares núm. 136 la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de septiembre de 2015, por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores . La Resolución mencionada se modificó en fecha 26 de abril de 2016 (BOIB núm. 54) de 30 de abril de 2016, modificada por la Resolución del Presidente del FOGAIBA de 26 dejunio de 2018 (BOIB núm. 80, de 28 de junio de 2018).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.El 26 de abril de 2018, el vicepresidente del FOGAIBA dictó una Resolución de concesión de ayudas para la creación de empresas de jóvenes agricultores (R3), que se publicó en el BOIB núm. 71, de 9 de junio de 2018, en la que se incluye una concesión a favor de MIQUEL BAUZÀ FLORIT con NIF ***7311**, con un importe de ayuda de 46.200,00 € y número de expediente CEJA2016_2/049.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.El 22 de junio de 2018 (con registro de entrada 17790) se presentó la solicitud del primer pago parcial de la prima (50%) y se hizo un pago por un importe de 23.100,00 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. El 1 de octubre de 2018 (con registro de entrada 22345) se presentó la solicitud de pago del segundo tramo correspondiente al 50% de la prima, esto es 23.100,00 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. El 28 de octubre de 2020, el vicepresidente en materia agraria del FOGAIBA dictó la Resolución de modificación de concesión con respecto a la financiación ya las anualidades a los beneficiarios de las ayudas concedidas y no pagadas, R3 de 28 de octubre de 2020, publicada en el BOIB núm. 191, de 7 de noviembre de 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. Una vez revisada la solicitud de pago, se ha observado que las inversiones concedidas: «de orientación ganadera» debe tener un mínimo de 25 UBM y sólo tiene 22,5, y «incorporación a una explotación que haga producción integrada »no consta en el registro, por un importe de 6.200,00€ y 5.000,00€ respectivamente, por lo que se deben revocar 11.200,00€.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7. Dado lo anterior, el 23 de noviembre de 2020 se notifica el beneficiario, mediante la publicación en la web del FOGAIBA del Informe propuesta provisional de resolución de revocación parcial de 17 de noviembre de 2020, por la que se revocan 11.200,00€, a efectos de cumplir con el trámite de audiencia para llevar a cabo las alegaciones.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8. El 15 de diciembre de 2020 (RGE núm. 25843), el beneficiario presentó escrito de alegaciones demostrando la actualización del censo y el RIA de explotación prioritaria de orientación ganadera. Ahora bien, la incorporación a una explotación que haga producción integrada no consta en el Registro, por lo que se deben revocar 5.000,00€&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, dispone que «procede la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ».&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;10. Por todo ello se propone hacer una revocación parcial de 5.000 euros, por lo tanto, el pago correspondiente al 2º tramo será de una cuantía de 18.100,00€.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Propuesta de Resolución &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y propongo al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Revocar parcialmente la resolución de ayuda concedida al beneficiari por el importe y con los datos detallados en el anexo de esta resolución, que es un total de 1 expediente y que comienza con MIQUEL BAUZA FLORIT y termina con MIQUEL BAUZA FLORIT, que suma un importe total de 5.000,00 euros , relativa a la línea de ayuda «Creación de empresas de jóvenes agricultores», ya que la incorporación a una explotación que haga producción integrada no consta en el registro.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
