&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. El día 30 de enero de 2021 se ha publicado la convocatoria extraordinaria de ayudas para paliar los efectos de la covid-19 al sector de los gimnasios y escuelas de danza de Mallorca. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. En la redacción de la convocatoria hay un error a la hora de exigir la documentación justificativa a los interesados en la subvención. Según el artículo 10 de la Ordenanza General de Subvenciones del Consejo Insular de Mallorca &lt;em&gt;la presentación de la declaración responsable sustituye la presentación de los certificados que acreditan el cumplimiento de obligaciones tributarias y con la seguridad social cuando la cuantía que se otorga a cada persona beneficiaria no supera en la convocatoria el importe de 3.000 €.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;3. En el texto de la convocatoria no se ha tenido en cuenta este hecho a la hora de especificar la documentación que tienen que presentar los solicitantes de la ayuda para dos establecimientos que es de (6.000 €) y por eso es necesario modificar la convocatoria en este sentido,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, &lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resuelvo&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Primero.&lt;/strong&gt; Modificar la convocatoria extraordinaria de ayudas para paliar los efectos de la covid-19 al sector de los gimnasios y escuelas de danza de Mallorca, en el siguiente sentido,&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Punto 6.5 de la convocatoria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Allí donde dice&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;6.5 La solicitud tiene que ir acompañada de los anexos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;...&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;b) Anexo III. Declaración responsable de estar al corriente de las obligaciones con la Agencia Estatal de la Administración Tributaria, con la Seguridad Social, con el Consejo Insular de Mallorca y con la Fundació Mallorca Turisme.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Tiene que decir:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;6.5 La solicitud tiene que ir acompañada de los anexos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;...&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Sólo cuando se pide la ayuda para un establecimiento: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;b) Anexo III. Declaración responsable de estar al corriente de las obligaciones con la Agencia Estatal de la Administración Tributaria, con la Seguridad Social, con el Consejo Insular de Mallorca y con la Fundació Mallorca Turisme.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Punto 6.7 de la convocatoria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Allí donde dice:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;6.7 La solicitud se tiene que entregar con la documentación siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Personas físicas: copia del DNI o NIE, por las dos caras. Si es una persona jurídica: CIF. Ambos supuestos se tienen que poder leer correctamente. (formado PD).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Certificado de situación censal de la Agencia Estatal de la Administración Tributaria, donde conste el gimnasio o escuela de danza por el cual se pide la ayuda, del mes de diciembre de 2020 o posterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Fotografía actual de la fachada del gimnasio o escuela de danza donde se vea el nombre comercial, si estuviera y tiene, y una fotografía del interior del establecimiento (en formato jpg).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Si se trata de una comunidad de bienes o entidad sin personalidad jurídica, contrato firmado entre los miembros y designación del representante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Certificado expedido por la entidad bancaria de titularidad bancaria. No se admiten otros documentos para acreditar la titularidad de cuenta bancaria como puede ser un recibo, un documento elaborado por la persona interesada, una captura de pantalla, etc.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Tiene que decir:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Personas físicas: copia del DNI o NIE, por las dos caras. Si es una persona jurídica: CIF. Ambos supuestos se tienen que poder leer correctamente. (formado PD)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Fotografía actual de la fachada del gimnasio o escuela de danza donde se vea el nombre comercial, si estuviera y tiene, y una fotografía del interior del establecimiento (en formato jpg).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Si se trata de una comunidad de bienes o entidad sin personalidad jurídica, contrato firmado entre los miembros y designación del representante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Certificado expedido por la entidad bancaria de titularidad bancaria. No se admiten otros documentos para acreditar la titularidad de cuenta bancaria como puede ser un recibo, un documento elaborado por la persona interesada, una captura de pantalla, etc.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Cuando se pide la ayuda para dos establecimientos: Certificado de estar al corriente de obligaciones con la Agencia Estatal de la Administración Tributaria y con la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt; Modificar el anexo III de la convocatoria por la redacción que se adjunta a esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Tercero.&lt;/strong&gt; Publicar esta Resolución en el &lt;em&gt;Boletín oficial de las Islas Baleares&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta resolución, que no pone fin a la vía administrativa, se puede interponer un recurso de alzada ante el presidente de la Fundació Mallorca Turisme en el plazo de un mes, contado a partir del día siguiente de su publicación en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra la desestimación expresa de este recurso de alzada, se puede interponer un recurso contencioso administrativo, ante el Juzgado Contencioso Administrativo de Palma que corresponda o la Sala Contenciosa Administrativa del Tribunal Superior de Justicia de las Islas Baleares, en el plazo de dos meses, contados a partir del día siguiente de recibir la notificación de la desestimación del recurso de alzada.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si han transcurrido tres meses desde la interposición del recurso de alzada y no se ha recibido la notificación de resolución expresa, se entiende desestimado por silencio y se puede interponer el recurso contencioso administrativo delante el Juzgado Contencioso Administrativo de Palma que corresponda o la Sala Contenciosa Administrativa del Tribunal Superior de Justicia de las Islas Baleares, en el plazo de seis meses, contados a partir del día siguiente de la desestimación presunta.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No obstante, se puede interponer, si procede, cualquier otro recurso que se considere oportuno. Todo ello de conformidad con la Ley 29/1998, de 13 de julio, Reguladora de la Jurisdicción Contenciosa Administrativa y de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;
