font-size:12px"><span style="line-height:normal">Transcurrido El plazo de exposición pública&nbsp; del acuerdo adoptado por el Pleno del Ayuntamiento de Es Castell de fecha 4 de noviembre de 2020, de aprobación provisional de la ordenanza fiscal reguladora de las tasas de los Servicios Municipales de Enseñanza, Cultura y Deportes, y no habiéndose presentado reclamaciones ni sugerencias al mismo, se eleva a definitivo el mencionado acuerdo conforme a lo que dispone el articulo 49 de la Ley 7/1985, de 2 de abril, reguladora de la Bases de Régimen Local, y el artículo 102 de la Ley 20/2006, de 15 de diciembre, Municipal y de régimen local de las Islas Baleares.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">La presente ordenanza se dicta en base a las facultades concedidas por los artículos 133.2 y 142 de la Constitución y por el artículo 106 de la Ley 7/1985, de 2 de abril, reguladora de las Bases de Régimen Local, y teniendo en cuenta los artículos 15 a 19 del Real Decreto Legislativo 2/2004 de 5 de marzo, del Texto Refundido de la Ley Reguladora de las Haciendas Locales y según lo establecido por los artículos 57 y 20 a 27 de la misma, se establece la presente tasa.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Esta ordenanza tiene por finalidad la fijación de las tasas de los servicios municipales de enseñanza, cultura y deportes. </span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Artículo 2. </strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Hecho imponible.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Constituye el hecho imponible de estas tasa la prestación de los servicios municipales de enseñanza, cultura y deportes, incluidas en esta ordenanza, que se refieran, afecten o beneficien de forma particular al sujeto pasivo y no sean prestados por el sector privado. </span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:black">Artículo 3. </span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:black">Sujeto pasivo.</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Son sujetos pasivos en concepto de contribuyentes, las personas físicas y jurídicas y las Entidades a las que se refiere el artículo 36 de la Ley General Tributaria, que soliciten, disfruten o utilicen los servicios o actividades prestados a que se refiere en el artículo segundo. </span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Artículo 4. </strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Responsables.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">4.1.- Responderán solidariamente de las obligaciones tributarias del sujeto pasivo las personas físicas y jurídicas a las que se refiere el artículo 42 de la Ley General Tributaria.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">4.2.- Serán responsables subsidiarios de las obligaciones tributarias los administradores de las sociedades y los síndicos, interventores o liquidadores de quiebras, concursos, sociedades y entidades en general, en los supuestos y con el alcance que señala el artículo 43 de la Ley General Tributaria. </span></span></p> <p style="margin-bottom:0px; Cuotas reducidas para actividades deportivas y culturales:</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">a. Unidades familiares con dos o más usuarios inscritos: 20% de reducción en inscripciones y mensualidades para cada usuario.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">b. Familias más desfavorecidas socio-económicamente: reducción según baremo y condiciones del punto 6.1. anterior de esta ordenanza. font-size:12px"><span style="line-height:normal"><span style="color:black">Estas reducciones previstas en este apartado 2 del presente artículo no serán compatibles entre sí, por lo cual se aplicará la bonificación que resulte más ventajosa para el interesado. </span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:black">Artículo 7. </span></strong></span></span></p> <p style="margin-bottom:0px; font-size:12px"><span style="line-height:normal"><strong><span style="color:black">Régimen de declaración e ingreso. </span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">8.1 Escuela Infantil</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">a) El importe de la matrícula anual a liquidar, podrá abonarse con tarjeta de crédito de manera presencial en la oficina de Cultura, previa cita, o mediante transferencia bancaria a la cuenta que se indicará, librando el justificante de pago junto con la documentación requerida. Se realizará siempre antes del inicio del curso escolar, excepto si el alta se realiza con el curso ya iniciado, en que se realizará en el momento del alta. Excepto casos excepcionales o por motivos de salud del alumno/a que impidan su incorporación a la escuela infantil, no se devolverá el importe abonado en concepto de matrícula. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">b) Las cuotas se liquidarán mensualmente y anticipadamente. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">c) Cuando se hayan liquidado las cuotas mensuales no serán prorrateables.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">d) Las mensualidades se abonarán mediante cargo en cuenta bancaria; con cuyo objeto el sujeto pasivo tendrá que extender la correspondiente orden bancaria, domiciliando el pago en el momento de la inscripción.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">e) Cuando, por causas no imputables al obligado al pago de la tasa, la escuela no se desarrolle o celebre, se procederá a la devolución del importe correspondiente. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">8.2 Actividades deportivas y culturales. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">a. Para inscribirse a las actividades culturales y deportivas, deberá abonarse, junto con la primera mensualidad, un depósito de una mensualidad, que servirá para cubrir los posibles gastos de un mes impagado. En caso de no producirse ninguna carencia de pago, el depósito se compensará con el importe de la última mensualidad.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">b. El depósito y la primera mensualidad se abonarán con tarjeta de crédito en la oficina de Cultura, previa cita, o mediante transferencia bancaria en la cuenta que se indicará, librando el justificante de pago junto con el impreso de inscripción-domiciliación o a través de la carpeta ciudadana.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">c) La cuota mensual se abonará durante los diez primeros días de cada mes, mediante cargo en cuenta bancaria; con cuyo objeto, el usuario tendrá que extender la correspondiente orden bancaria, domiciliando el pago en el momento de la inscripción. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:black">9. Normas generales de gestión.</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Las solicitudes de baja deberán tramitarse ante el Servicio municipal correspondiente antes del día 25 del mes anterior a aquel en qué tengan que tener efecto. A tal efecto, habrá que llenar un impreso de baja que se podrá descargar de la web del Ayuntamiento o se podrá recoger en el Servicio correspondiente. Esta hoja rellenada deberá entregarse presencialmente o vía correo electrónico a los correos que sindican a las hojas de inscripción.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La obligación de pago persiste hasta que el usuario no cause baja voluntaria del servicio y tendrá efectos el día primero del mes siguiente. Esta obligación persiste si por causas justificadas no asisten en el centro, puesto que la matrícula incluye compromiso de asistencia en el centro y el pago de las cuotas mensuales.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Se gestionará la cobranza mediante la domiciliación bancaria a lo largo de los primeros días del mes. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">El impago o retorno de recibos domiciliados en los plazos establecidos al efecto, podrá dar lugar al cese de la prestación del servicio, sin perjuicio de la tramitación de los correspondientes expedientes de constreñimiento para la recaudación de las cuotas meritadas.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">A todos los efectos, para inscribirse en cualquier actividad se tendrá que estar al corriente del pago de las cuotas de todas las actividades comprendidas en esta ordenanza.
