&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1.-&lt;/strong&gt; El 13 de septiembre de 2011, el Pleno del Ayuntamiento de Selva aprobó la Relación de Puestos de trabajo, la que no estipulaba un complemento específico por las trabajadoras de las escuelas de educación infantil municipales ni tampoco los cargos de las directoras de las escuelas de educación infantil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.-&lt;/strong&gt; El 16 de abril del 2019 el Pleno del Ayuntamiento de Selva aprobó una nueva Relación de Puestos de trabajo (RLLT), la que una vez enviada a la Delegación del Gobierno, y al ver que la nueva RPT no cumplía con las prescripciones legales establecidas quedó sin efectos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3.-&lt;/strong&gt; El 20 de noviembre de 2020, un asesor externo al Ayuntamiento presenta propuesta de modificación de la RPT en en cuanto a las trabajadoras de las escuelas de educación infantil y las directoras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4.-&lt;/strong&gt; El 4 de enero de 2021, el alcalde dicta provisión de alcaldía en la que, se plantea la modificación puntual de la RPT en en cuanto a las trabajadoras de las escuelas de educación infantil municipales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5.- &lt;/strong&gt;El 12 de enero de 2021, se reunió la mesa sindical, la que acordó la modificación puntual de la RPT del Ayuntamiento de Selva, se establece un complemento específico por las trabajadoras de las escuelas de educación infantil municipales de 2.400,00 euros/anuales y se incorporan a la RPT las dos plazas de directoras que antes no se contemplaban debido a que era un servicio mancomunado y la normativa del sector ha cambiado. También se acuerda reconocer una retroactividad con fecha de 1 de julio de 2020. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Consideraciones jurídicas &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Legislación aplicable en el procedimiento de aprobación de la Relación de Puestos de trabajo es la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Los artículos 31 y siguientes, 69 y 74 del texto refundido de la Ley del Estatuto Básico del Empleado público aprobado por Real decreto legislativo 5/2015, de 30 de octubre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Los artículos 22.2.y) y 90.2 de la Ley de 7/1985, de 2 de abril, de Bases del Régimen Local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Los artículos 126.4, 127 y 129.3.a) del texto refundido de las disposiciones legales vigentes en materia de Régimen Local aprobado por Real decreto legislativo 781/1986, de 18 de abril.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— El artículo 15 de la Ley 30/1984, de 2 de agosto, de Medidas para la Reforma de la Función Pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Los artículos 61 a 64 del texto refundido de la Ley del Estatuto de los Trabajadores aprobado por Real decreto legislativo 2/2015, de 23 de octubre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— El Real Decreto 861/1986, de 25 de abril, por el cual se establece el régimen de las retribuciones de los funcionarios de Administración Local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo lo expuesto, el Pleno adopta el siguiente, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Acuerdo &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Primero.- &lt;/strong&gt;Aprobar la Relación de Puestos de trabajo de este Ayuntamiento, con las modificaciones introducidas después de la negociación colectiva y los informes que constan en el expediente, con el texto siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se incorporan dos plazas de directores/as de las escuelas de educación infantil y la homologación de los complementos específicos del puestos de trabajo de educador/a infantil, que cambian el nombre de auxiliar de educación infantil, esto a los efectos de los cambios académicos en las calificaciones profesionales, con un cantidad de 2.400,00.-€ anuales repartidos en 14 pagas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero.-&lt;/strong&gt; Publicar íntegramente la citada relación en el Boletín Oficial de las Islas Baleares y a la sede electrónica del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cuatro.- &lt;/strong&gt;Remitir una copia de esta a la Administración del Estado y al órgano competente de la Comunidad Autónoma de las Islas Baleares en el plazo de treinta días. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
