2021-01-14 673 es ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aprobada inicialmente por el pleno de este Ayuntamiento de 4 de noviembre de 2020, la <em>Ordenanza fiscal reguladora de la tasa por la prestación de servicio de escoleta municipal de educación infantil de primer ciclo</em>, expuesta al público mediante la publicación del anuncio correspondiente en el BOIB núm. 194, de fecha 12 de noviembre de 2020 por el plazo de treinta días para la presentación de reclamaciones y sugerencias sin que se hayan presentado, y visto el informe sobre el impacto de género del Instituto Balear de la Mujer de 15 de diciembre de 2020, se publica el texto íntegro de la mencionada ordenanza.</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ORDENANZA FISCAL REGULADORA DE LA TASA POR LA PRESTACIÓN DEL SERVICIO DE ESCOLETA MUNICIPAL DE EDUCACIÓN INFANTIL DE PRIMER CICLO</strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 1. </strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamento legal</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Haciendo uso de las facultades concedidas per los artículos 133.2 i 142 de la Constitución y por el artículo 106 de la Ley 7/1985, de 2 de abril, reguladora de las Bases de Régimen Local, y de conformidad con lo dispuesto en los artículos 15 al 19 del RDL 2/2004, de 5 de marzo, por el que se aprueba el Texto Refundido de la Ley reguladora de las Haciendas Locales, este Ayuntamiento establece la tasa por la prestación del servicio de escoleta municipal infantil, que se regirá por lo dispuesto en esta ordenanza fiscal, las normas de la cual se atienen a lo que dispone el artículo 57 de la mencionada Ley&nbsp; RDL 2/2004. </span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 2. </strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Hecho imponible</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Constituye el hecho imponible de la tasa la prestación del servicio de escoleta municipal infantil.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 3. </strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Sujetos pasivos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Son sujetos pasivos y obligados al pago de la tasa regulada en esta Ordenanza, las personas que se beneficien de los servicios o actividades prestados o realizados por este Ayuntamiento, a los que hace referencia el artículo anterior.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 4. </strong></span></p> <p style="margin-bottom:0px; margin-left:0px; font-size:12px">El Ayuntamiento, por causas de promoción del uso de las escoletas, podrá exonerar o bonificar las matrículas de una o varias escoletas municipales.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Tendrán preferencia para la ocupación de las plazas de las escoletas municipales las niñas y los niños empadronados en el municipio de Santanyí.</span></p> <p><span style="font-family:Times New Roman,Times,serif; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo</strong> <strong>5. </strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Exenciones y bonificaciones</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Bonificaciones:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-Tendrán una bonificación del 20% de la cuota y matrícula, las familias que tengan dos o más hijos y/o hijas matriculados/as en las escuelas municipales. Por tanto pagarán una tarifa especial del 80% de la cuota mensual y matrícula por cada hija o hijo.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-Tendrán una bonificación del 10% de la cuota y matrícula, las familias numerosas, tanto de categoría general como de categoría especial, según la legislación vigente, y/o cuando la tutoría recaiga sobre los abuelos u otros parientes. O sea, pagarán una tarifa especial del 90% de la cuota mensual y matrícula por cada hija o hijo.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-Tendrán una bonificación del 10% de la cuota y matrícula, las familias monoparentales con un único hijo o hija menor. Y del 20% en caso&nbsp; de tener dos hijos y/o hijas menores o más. La justificación se hará con el libro de familia o cualquier otro documento admitido en vía procedimental.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-Disfrutarán de una bonificación del 100% aquellos alumnos provenientes de familias con problemática socioeconómica acentuada, y que hayan estado previamente derivados por los servicios sociales municipales.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Estas ayudas son acumulables en caso de concurrir las citadas condiciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las bonificaciones se aplicarán únicamente a los obligados al pago que estén empadronados en el&nbsp; término de Santanyí.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 6. </strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Obligación de pago</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Nace&nbsp; desde que se inicia la prestación del servicio. Están obligadas al pago las personas que ejerzan la patria potestad, persona que tenga la tutela o representantes legales de los niños beneficiados.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 7. </strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Normas de gestión y devengo</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El pago de las tasas indicadas se efectuará por los interesados mediante recibo mensual domiciliado. El importe correspondiente a la matrícula se pagará el primer mes que se reciban los servicios mediante domiciliación bancaria, independientemente de si se hace el curso completo o no.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Las altas que se produzcan dentro de los primeros cinco días de cada mes causarán el devengo de la cuota mensual, que será satisfecha durante los diez días siguientes. Los que se produzcan después del día cinco de cada mes, causarán devengo de cuotas por los días que resten hasta final de mes, y se liquidarán aplicando la proporción correspondiente dentro de los diez primeros días del mes siguiente conjuntamente con la cuota el propio mes. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Las bajas en la prestación del servicio de los niños inscritos se tendrán que&nbsp; notificar a la administración de la escoleta infantil, al menos con quince días de antelación. Si causan baja dentro de los&nbsp; primeros quince días, se les hará la parte proporcional. En cambio, si es posterior devengará todo el mes. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.
