El Consejo Ejecutivo del Consejo Insular de Menorca , en la sesión de día 9 de noviembre de 2020, aprobó la convocatoria de ayudas del CIM para las agrupaciones de defensa vegetal de Menorca para el año 2020 (BOIB núm. 197 de 19 de noviembre de 2020), que se rige por las bases reguladoras aprobadas el año 2018 (BOIB núm. 75 de 19 de junio de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. En el plazo de presentación de solicitudes, que era de 10 días naturales a contar a partir del día siguiente de haberse publicado la convocatoria en el BOIB, se han presentado dos solicitudes: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- ADV FRUTA MENORCA NIF G07609183&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- ADV HORTIGRUP NIF G07522188&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las solicitudes presentadas se acompañan de la justificación establecida en la base 15 y que fijaba que el plazo para justificar las ayudas finalizaba día 30 de noviembre de 2020.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. El Consejo Insular de Menorca aprobó una convocatoria de las mismas características el año 2019. Los dos solicitantes de la convocatoria del año 2020 obtuvieron una ayuda de la convocatoria del año 2019 y lo justificaron el su totalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. El importe máximo de la ayuda y el crédito presupuestario es:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Partida 5.41200.4890002 Soporte a las producciones vegetales&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Cantidad máxima : 50.000 euros&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El objeto de estas ayudas de &lt;em&gt;minimis&lt;/em&gt; es apoyar a las actuaciones que lleven a cabo, entre el 1 de diciembre del año anterior al de la convocatoria y el 30 de noviembre del año de la convocatoria, las agrupaciones de defensa vegetal de Menorca constituidas de acuerdo con el Decreto 52/2013, de 29 de noviembre, que regula las agrupaciones de defensa vegetal en el ámbito de las Islas Baleares y crea el Registro Oficial de Agrupaciones de Defensa Vegetal de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5. Esta convocatoria tiene por finalidad la prevención y la lucha contra los agentes nocivos de los vegetales mediante la utilización racional de técnicas de aplicación, productos y medios fitosanitarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;6. La base 4 de esta convocatoria fija las actividades subvencionables :&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;)Los sueldos y las cuotas patronales de la Seguridad Social correspondientes al personal técnico contratante por la ADV.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;) Contratos de arrendamiento de servicios de dirección técnica o de asistencia técnica de la ADV.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c&lt;/em&gt;) Los gastos de los técnicos de la ADV para asistir a cursos y seminarios relativos a la actividad de la ADV.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d&lt;/em&gt;) Los gastos generados por los desplazamientos de los técnicos a las explotaciones socias de la ADV.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e&lt;/em&gt;) La asistencia a ferias por parte del personal técnico y de los socios de la ADV.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;f&lt;/em&gt;) El coste de la compra de material para la prevención de plagas y la lucha biológica contra plagas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;g&lt;/em&gt;) Compra de contenedores para la recogida selectiva en la finca de envases de fitosanitarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;i&lt;/em&gt;) Gastos de gestión ordinaria de la ADV: gastos de mensajería, material de oficina, gastos de transporte de material, gastos de gestoría.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;j&lt;/em&gt;) Promoción de la ADV y sus productos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;7. Los gastos subvencionables vienen fijados en la base 8 y el importe máximo que puede recibir cada una de las actividades subvencionables se rige por la base 9 y son las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Apartados &lt;em&gt;a&lt;/em&gt; y &lt;em&gt;b&lt;/em&gt;: el 60 % del coste total hasta un máximo de 15.000 €&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Apartados del &lt;em&gt;c&lt;/em&gt; al &lt;em&gt;j&lt;/em&gt; : conjuntamente hasta un máximo de 15.000 €, con las siguientes condiciones :&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a. Las actuaciones serán subvencionables con un máximo del 75 %.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b. Para los gastos generados por los desplazamientos del técnico a las explotaciones socias de la ADV, hasta un máximo de 800 € (apartado &lt;em&gt;d&lt;/em&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La ayuda total máxima que podrá recibir cada agrupación se establece en 25.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;8. La base 10 fija los criterios que se tendrán en cuenta para la concesión de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Visto que los solicitantes presentan la justificación de las ayudas junto con su solicitud, visto el informe de concesión y justificación del pago emitido por la instructora de esta convocatoria día 3 de diciembre de 2020, y vista la propuesta de la Comisión Evaluadora de las ayudas que se reunió el mismo día 3 de diciembre de 2020;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Vista la propuesta del consejero ejecutivo del Departamento de Economía y Territorio;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El Consejo Ejecutivo, por unanimidad y en votación ordinaria, adopta los siguientes acuerdos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primer.&lt;/strong&gt; Conceder y tramitar el pago de las ayudas de &lt;em&gt;minimis&lt;/em&gt; siguientes, a las agrupaciones de defensa vegetal de Menorca, con la finalidad de prevenir y luchar contra los agentes nocivos de los vegetales mediante la utilización racional de técnicas de aplicación, productos y medios fitosanitarios, con cargo a la partida 5.41200.4890002 del presupuesto del Consejo Insular de Menorca para el año 2020:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Estas ayudas, en virtud de su naturaleza específica, como ayudas de &lt;em&gt;minimis&lt;/em&gt;, están sometidas al Reglamento (UE) núm. 1408/2013 de la Comisión, de 18 de diciembre de 2013, relativo a la aplicación de los artículos 107 y 1085 del Tratado de funcionamiento de la Unión Europea de las ayudas de &lt;em&gt;mínimos&lt;/em&gt; en el sector agrícola, modificado por el Reglamento (UE) núm. 2019/316 de 21 de febrero.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt; Comunicar el acuerdo anterior a la Consejería de Agricultura, Pesca y Alimentación del &lt;em&gt;Go&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;bierno &lt;/em&gt;&lt;/span&gt;&lt;em&gt;de les I&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;slas Baleares &lt;/em&gt;&lt;/span&gt;para que tenga los efectos oportunos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero.&lt;/strong&gt; Remitir a la BDNS la resolución del expediente en cumplimiento del art. 20.8 de la LGS y publicarla en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt; a los efectos de notificación (art. 1 &lt;em&gt;b&lt;/em&gt; de la LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra este acuerdo - que no agota la vía administrativa – se podrá interponer un recurso de alzada delante de la Comisión de Gobierno en el plazo de un mes a contar desde el día siguiente que se haya publicado, de acuerdo con el artículo 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas y el artículo 22 de la Ley 8/2000, de 27 de octubre, de &lt;em&gt;conse&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;jos&lt;/em&gt;&lt;/span&gt;&lt;em&gt; insulares&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El mencionado recurso se entenderá desestimado, si no se notifica la resolución correspondiente, cuando hayan transcurrido tres meses desde su interposición. Contra la desestimación del recurso de alzada por el silencio administrativo podréis interponer recurso contencioso-administrativo ante el Juzgado Contencioso Administrativo de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
