Fundamentos de derecho.</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Base octava de la convocatoria, y artículo 21,1, de Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Resolución.&nbsp;</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Vista la abstención del alcalde, por razón de parentesco con persona interesada (artículo 23,2 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público), de acuerdo con lo que prevé el artículo 23,3 de la Ley 7/1985, de 2 de abril, resuelvo:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Lo que hacemos público para general conocimiento.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Recursos.</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta resolución, que es definitiva en vía administrativa, se pueden interponer, alternativamente, los recursos siguientes:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Directamente el recurso contencioso-administrativo ente el Juzgado de lo Contencioso Administrativo de Palma, en el plazo de dos meses, a contar a partir del día siguiente de la notificación o publicación de la presente resolución.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) El recurso de reposición potestativo ante la alcaldía, en el plazo de un mes, a contar a partir del día siguiente de la notificación o publicación de la presente resolución. Contra la desestimación por silencio del recurso de reposición, que se producirá por el transcurso de un mes des de su presentación sin que se haya resuelto expresamente ni se haya notificado, podrá interponerse el recurso contencioso-administrativo ante el Juzgado de lo Contencioso Administrativo de Palma, en el plazo de seis meses, a contar a partir del día siguiente a la desestimación presunta.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">No obstante lo anterior, se puede ejercitar, si procede, cualquier otro recurso que se estime pertinente.
