    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Pleno del Ayuntamiento en sesión celebrada el día 19 de octubre acordó aprobar provisionalmente la modificación de la ordenanza 05.POD reguladora del Precio Público por la prestación del servicio de Escuela Municipal de música y danza y Conservatorio Municipal de música para el ejercicio 2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Pleno del Ayuntamiento en sesión de día 29 de octubre de 2020 acordó rectificar el acuerdo aprobado en fecha 19 de octubre por un error y aprobar provisionalmente el texto rectificado de la modificación de la ordenanza 05.POD reguladora del Precio Público por la prestación del servicio de Escuela Municipal de música y danza y Conservatorio Municipal de música para el ejercicio 2021, en los términos siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;«Acuerdo:&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;1. Rectificar el Acuerdo núm 4 de la propuesta en los siguientes términos:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Donde dice:&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;4. Aprobar inicialmente la modificación del artículo 6, en el sentido de eliminar el apartado 1, relativo al pago de la matrícula, modificándose por lo tanto la estructura del artículo, e introducir el apartado 2 para el caso que la modalidad presencial se tenga que ver sustituida por otras modalidades en base a las indicaciones de las autoridades competentes y los cambios no coincidan con el periodo de pago mensual, se prorrateará el pago por días, distinguiendo entre los días en que se ha podido impartir las enseñanzas presencialmente y aquellos en que se haya tenido que hacer con otras modalidades, cuando sea el caso y siempre que así se informe por parte de la Escuela al departamento de Gestión tributaria a se hora de emitir los correspondientes padrones mensuales. En estos casos, el departamento de Gestión Tributaria emitirá los padrones mensuales en base al informe del Director de la Escuela de Música en el cual s‘indicará el tiempo concreto (días) en que se tenga que aplicar la tarifa correspondiente a cada una de las modalidades, para el caso en que el tiempo de confinamiento o medidas restrictivas de aforo impongan una modalidad u otra. Así mismo, se elimina el apartado 5 de este artículo 6, dado que se han eliminado las tarifas para personas no empadronadas;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Debe decir:&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;4. Aprobar inicialmente la modificación del artículo 6, en el sentido de añadir un parágraf al apartado 2 para el caso que la modalidad presencial se tenga que ver sustituida por otras modalidades en base a las indicaciones de las autoridades competentes y los cambios no coincidan con el periodo de pago mensual, se prorrateará el pago por días, distinguiendo entre los días en que se ha podido impartir las enseñanzas presencialmente y aquellos en que se haya tenido que hacer con otras modalidades, cuando sea el caso y siempre que así se informe por parte de la Escuela al departamento de Gestión tributaria a se hora de emitir los correspondientes padrones mensuales. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;1.El pago de la matrícula se hará en el momento de su formalización, y el pago de las cuotas se realizará mensualmente por el importe detallado en el artículo 3 dentro de la segunda quincena del mes.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Las matriculaciones que se produzcan una vez iniciado el curso escolar, y siempre que sean conformadas por la Escuela de Música en función de la prestación del servicio, serán objeto de prorrateo trimestral, computándose el trimestre natural en que se matricule el alumno/a.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Para el caso que la modalidad presencial se tenga que ver sustituida por otras modalidades en base a las indicaciones de las autoridades competentes y los cambios no coincidan con el periodo de pago mensual, se prevé el prorrateo del pago por días, distinguiendo entre los días en que se ha podido impartir las enseñanzas presencialmente y aquellos en que se haya tenido que hacer con otras modalidades, cuando sea el caso y siempre que así se informe por parte de la Escuela al departamento de Gestión tributaria a se hora de emitir los correspondientes padrones mensuales. En estos casos, el departamento de Gestión Tributaria emitirá los padrones mensuales en base al informe del Director de la Escuela de Música en el cual se indicará el tiempo concreto (días) en que se tenga que aplicar la tarifa correspondiente a cada una de las modalidades, para el caso en que el tiempo de confinamiento o medidas restrictivas de aforo impongan una modalidad u otra.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Las bajas que se produzcan en el curso escolar se tendrán que formalizar por escrito por parte de las personas usuarias y/o de los suyos/de sus responsables legales. Una vez comprobadas por la dirección de la escuela y tramitada la documentación oportuna, se remitirá informe al Departamento de Gestión Tributaria y se dará lugar a la baja de la cuota de las mensualidades restantes del curso escolar.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;4. En caso de que la prestación del servicio no se realice por causas imputables a la Administración, las personas usuarias y/o los suyos/sus responsables legales podrán solicitar la devolución del importe de la matrícula o cuota pertinente»&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Concluido el debate, se somete a votación y la propuesta se aprueba por once votos a favor (MÉS-Esquerra, Grupo Municipal Socialista y Unidas Podemos), ningún voto en contra y diez abstenciones (Partido Popular, El PI Manacor y AIPC/SYS)».&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dicho acuerdo fue publicado en el Tablón de anuncios de la Sede Electrónica en fecha 1 de noviembre de 2020 y en el&amp;nbsp; BOIB n.º 189 de fecha 3 de noviembre de 2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Transcurrido el plazo de exposición pública sin que se hayan interpuesto reclamaciones, el referido acuerdo se eleva a definitivo, de&amp;nbsp;conformidad con el artículo 49 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De conformidad con el informe de la Técnica de gestión tributaria, de 17 de diciembre de 2020, el texto de la modificación puede ser aprobado sin más trámite, dado que el informe sobre el impacto de género emes por el Instituto Balear de la Mujer en fecha 20 de noviembre de 2020 concluye que en la redacción de la norma no se ha detectado ninguna situación de desigualdad por cuestión de género, y se considera que su aplicación no producirá efectos diferenciadores sobre las mujeres y los hombres, ni incidirá en la posible situación de desigualdad en que se encuentren.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las modificaciones de las ordenanzas entrarán en vigor día 1 de enero de 2021, previa publicación en el Boletín Oficial de las Islas Baleares, de acuerdo con el artículo 70.2 y 65.2 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El texto íntegro de la ordenanza fiscal modificada es el siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 1. FUNDAMENTO LEGAL&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En conformidad con el artículo 41 del Texto Refundido de la Ley Reguladora de las Haciendas Locales, aprobado por el RDL 2/2004, de 5 de marzo, se establece el precio público para la prestación de los servicios y realización de actividades en la Escuela Municipal de Música.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 2. OBLIGADOS AL PAGO&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Están obligadas al pago del precio público las personas que se beneficien de los servicios que ofrece la Escuela. En su defecto, los familiares que tengan la obligación legal o pactada de atender los usuarios de estos servicios.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 3. CUANTÍA&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1.a Familias numerosas:&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De conformidad con el artículo 12.1b) de la Ley 4/2003, de 18 de noviembre, de protección a las familias numerosas se establece una bonificación del 20% de la cuota a favor de las personas integrantes de familias numerosas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.b Ingresos unidad familiar:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por ingresos anuales per capita inferior a 4.000€: 30% de reducción del precio de la cuota.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para la aplicación de estos beneficios se tiene que aportar la documentación siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se devenga el precio público, y surge la obligación de pago en el momento de la solicitud de los servicios o actividades relacionados.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ARTÍCULO 6. NORMAS DE GESTIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.El pago de la matrícula se hará en el momento de su formalización, y el pago de las cuotas se realizará mensualmente por el importe detallado en el artículo 3 dentro de la segunda quincena del mes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las matriculaciones que se produzcan una vez iniciado el curso escolar, y siempre que sean conformadas por la Escuela de Música en función de la prestación del servicio, serán objeto de prorrateo trimestral, computándose el trimestre natural en que se matricule el alumno/a.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.Una vez realizadas las liquidaciones serán presentadas al cobro mediante cargos de 9 periodos mensuales (periodo 1, corresponderá al mes de octubre, y así hasta el periodo 9 que corresponderá al mes de junio)&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para el caso que la modalidad presencial se tenga que ver sustituida por otras modalidades en base a las indicaciones de las autoridades competentes y los cambios no coincidan con el periodo de pago mensual, se prevé el prorrateo del pago por días, distinguiendo entre los días en que se ha podido impartir las enseñanzas presencialmente y aquellos en que se haya tenido que hacer con otras modalidades, cuando sea el caso y siempre que así se informe por parte de la Escuela al departamento de Gestión tributaria a se hora de emitir los correspondientes padrones mensuales. En estos casos, el departamento de Gestión Tributaria emitirá los padrones mensuales en base al informe del Director de la Escuela de Música en el cual se indicará el tiempo concreto (días) en que se tenga que aplicar la tarifa correspondiente a cada una de las modalidades, para el caso en que el tiempo de confinamiento o medidas restrictivas de aforo impongan una modalidad u otra.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.Las bajas que se produzcan en el curso escolar se tendrán que formalizar por escrito por parte de las personas usuarias y/o de los suyos/de sus responsables legales. Una vez comprobadas por la dirección de la escuela y tramitada la documentación oportuna, se remitirá informe al Departamento de Gestión Tributaria y se dará lugar a la baja de la cuota de las mensualidades restantes del curso escolar.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. En caso de que la prestación del servicio no se realice por causas imputables a la Administración, las personas usuarias y/o los suyos/sus responsables legales podrán solicitar la devolución del importe de la matrícula o cuota pertinente.&lt;/span&gt;&lt;/p&gt;
