Beneficiarios</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.1. Pueden ser beneficiarias de estas ayudas las entidades que se establecen a continuación, en función de los tipos de actuaciones definidas en el apartado 3 de esta convocatoria: </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Para las actuaciones 1 y 2</strong></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Las personas físicas o jurídicas de naturaleza privada o pública legalmente constituidas que sean propietarias de edificios existentes destinados a cualquier uso y que estén ubicados en las Illes Balears.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Las comunidades de propietarios o agrupaciones de comunidades de propietarios de edificios residenciales de uso vivienda, que se ubiquen en el ámbito territorial de la comunidad autónoma de las Illes Balears, constituidas conforme a lo dispuesto por el artículo 5 de la Ley 49/1960, de 21 de julio, de Propiedad Horizontal.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Los propietarios que de forma agrupada sean propietarios de edificios, que reúnan los requisitos establecidos en el artículo 396 del Código Civil y no hayan otorgado el título constitutivo de propiedad horizontal.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) Las empresas explotadoras, arrendatarias o concesionarias de edificios ubicados en las Illes Balears, que acrediten esta condición mediante un contrato vigente a largo plazo con la propiedad, que les otorgue facultad expresa para acometer las obras de reforma objeto de la actuación a incluir en el Programa.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) Las empresas de servicios energéticos (ESE), o proveedores de servicios energéticos definidos en el Real Decreto 56/2016, de 12 de febrero, por el que se transpone la Directiva 2012/27/UE del Parlamento Europeo y del Consejo, de 25 de octubre de 2012, relativa a la eficiencia energética, en lo referente a auditorías energéticas, acreditación de proveedores de servicios y auditores energéticos y promoción de la eficiencia del suministro de energía, en cuanto a la acreditación de proveedores de servicios. Para poder ser beneficiarias, estas empresas deberán actuar conforme al contrato que tengan establecido a tal fin con la propiedad y llevar a cabo las inversiones incluidas en la tipología de proyectos recogidos en esta convocatoria, debiendo acreditar su actuación como empresa de servicios energéticos y la inversión realizada en las Illes Balears.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">f) Las entidades locales conforme al artículo 3 de la Ley 7/1985, de 2 de abril, reguladora de las Bases del Régimen Local, y el sector público institucional de cualquier administración pública a que se refiere el artículo 2.2 de la Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">g) Las comunidades de energías renovables y las comunidades ciudadanas de energía, según la definición de la Directiva 2018//2001 del Parlamento Europeo y del Consejo, de 11 de diciembre de 2018, y de la Directiva 2019/944 del Parlamento Europeo y del Consejo, de 5 de junio de 2019, respectivamente, así como del artículo 4 del Real Decreto Ley 23/2020, de 23 de junio, por el que se aprueban medidas en materia de energía y en otros ámbitos para la reactivación económica.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.2. Los ayuntamientos o las entidades locales equivalentes y las mancomunidades o agrupaciones de municipios españoles, las administraciones de las comunidades autónomas y cualesquier organismos públicos y entidades de derecho público vinculados o dependientes de las administraciones públicas mencionadas podrán actuar en representación de comunidades de propietarios u otros propietarios de edificios para promover y gestionar la realización de actuaciones de rehabilitación energética; en este caso, deberán formalizar un convenio por el que se designe a la entidad pública como representante y destinataria del derecho de cobro de la ayuda, haciendo constar expresamente los compromisos de ejecución asumidos por cada una de las partes, y el reparto de la ayuda que realizará el representante una vez percibida.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.3. Cuando los beneficiarios de las ayudas sean personas físicas que pertenecen a una comunidad o agrupación de propietarios de las previstas en las letras b) o c) del apartado 2.1, deberán poseer la nacionalidad española o la de alguno de los estados miembros de la Unión Europea o del Espacio Económico Europeo o Suiza. En el caso de extranjeros no comunitarios, deberán tener residencia legal en España.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.4. En el caso de entidades que carezcan de personalidad jurídica propia, con excepción de las comunidades de propietarios, deberán constituirse en agrupación legalmente constituida y con estatutos vigentes, de acuerdo con cualquiera de las formas que admita la legislación en vigor, debiendo constar expresamente en la solicitud la composición y los porcentajes de participación de cada uno de los miembros. La responsabilidad de la ejecución total del proyecto y de la inversión recae sobre el conjunto de la agrupación, que debe designar y facultar a un representante para tramitar la solicitud de ayuda, realizar la justificación de la inversión, recibir la ayuda que se pudiera otorgar y proceder al reparto a cada uno de los miembros.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En todo caso, deberá cumplirse con lo dispuesto en la Ley 38/2003, de 17 de noviembre, General de Subvenciones, y en particular, con lo establecido en el artículo 11.3.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.5. No podrán ser beneficiarias de las ayudas:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Si se encuentra en alguna de las circunstancias previstas en el artículo 21 del Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, aprobado mediante el Real Decreto 887/2006, de 21 de julio.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Empresas en situación de crisis, de acuerdo con la definición que se realiza en las directrices comunitarias sobre ayudas estatales de salvamento y de reestructuración de empresas en crisis (Comunicación de la Comisión 2014/C 249/1, de 31 de julio de 2014).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Las empresas que se encuentren sujetas a una orden de recuperación pendiente sobre cualquier ayuda o subvención que se les hubiera otorgado con anterioridad, por haberse declarado ayuda ilegal e incompatible con el mercado interior, o bien por cualquier tipo de incumplimiento de las obligaciones atribuidas en la concesión.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Segundo</strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Objeto</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El objeto de esta Resolución es aprobar la convocatoria pública de subvenciones para actuaciones de rehabilitación energética en edificios existentes de las Illes Balears, correspondientes a la mejora de la eficiencia energética de la envolvente térmica, la mejora de la eficiencia energética y el uso de energías renovables en las instalaciones térmicas de calefacción, climatización, refrigeración, ventilación y agua caliente sanitaria, y la mejora de la eficiencia energética de las instalaciones de iluminación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Esta línea de ayudas está cofinanciada por el Instituto para la Diversificación y Ahorro de la Energía (IDAE) y por el Fondo Europeo de Desarrollo Regional (FEDER) dentro del Programa Operativo Plurirregional de España 2014-2020 (POPE).</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Tercero</strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Bases reguladoras</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Esta convocatoria está regulada por el Real Decreto 737/2020, de 4 de agosto, por el que se regula el programa de ayudas para actuaciones de rehabilitación energética en edificios existentes y se regula la concesión directa de las ayudas de este programa a las comunidades autónomas y ciudades de Ceuta y Melilla.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Cuarto</strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Cuantía</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El importe económico máximo de esta convocatoria es de 5.990.000 euros. Las subvenciones se concederán con cargo al presupuesto de la Comunidad Autónoma para los ejercicios de 2020, 2021 y 2022, concretamente, del centro de coste 19701, subprograma 731A01, capítulo 7* FF 20105, con la siguiente distribución de anualidades:</span></span></p> <p style="margin-left:40px;
