    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El Pleno del Ayuntamiento en sesión celebrada el día 19 de octubre de 2020 acordó aprobar provisionalmente la modificación de la ordenanza fiscal 10TOD reguladora de la Tasa por paradas de venta en la plaza de abastos y en determinados lugares de la vía pública, en los siguientes términos:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;1. Aprobar inicialmente la modificación el apartado A) del art. 4 de la Ordenanza Fiscal 10T.OD reguladora de la tasa de paradas de venta en la Plaza de Abastos y en determinados lugares de la vía pública en el sentido de añadir una categoría de vendedores y vendedoras para diferenciar la modalidad de vendedores y vendedoras que ocupen un trast dentro del edificio principal de los que ocupan parte de la vía pública fuera del edificio de la plaza, así como modificar el redactado relativo a los vendedores y vendedoras de los sábados, para que se adecue mejor a la realidad. Con estas modificaciones resultaría la siguiente redacción del apartado A) del art. 4:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Aprobar inicialmente la modificación de los apartados C) y D) del art. 4 de la Ordenanza Fiscal 10T.OD reguladora de la tasa de paradas de venta en la Plaza de Abastos y en determinados lugares de la vía pública en el sentido de reducir en un 57,42% la cuota tributaria que se aplica a las paradas de los mercados semanales de Porto Cristo y Manacor para el año 2021 debido a los efectos provocados por la crisis sanitaria de la COVID-19. Esta reducción supondrá que la cuota sea de un 42,58% de la cuota actual:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;3. Introducir a la Ordenanza Fiscal una Disposición Transitoria que establezca que : «La reducción de las cuotas prevista en este apartado será de aplicación exclusiva para el ejercicio 2021, volviendo a las cuotas ordinarias existentes actualmente y que serán de aplicación para el ejercicio 2022 de manera automática y sin necesidad de proceder a una nueva modificación de la Ordenanza.»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;4. Solicitar al Instituto Balear de la Mujer en conformidad con el artículo 7.g de la Ley 12/2006, de 20 de septiembre, de la mujer, y el art. 5 de la Ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres, el informe de evaluación de impacto de género respecto de la mencionada normativa, incorporándose las sugerencias que se formulen sobre el texto de la normativa con carácter previo a la aprobación definitiva.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;5. Exponer por un plazo de 30 días hábiles el acuerdo de aprobación provisional de la modificación de las ordenanzas, mediante su publicación en el Boletín Oficial de las Islas Baleares, en un diario de los de mayor difusión de la Comunidad Autónoma y al tablón de anuncios de la sede electrónica de este ayuntamiento a los efectos de que los interesados puedan examinar el expediente y presentar las reclamaciones oportunas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;En el caso de que no se presenten reclamaciones en el plazo mencionado se entenderá definitivamente aprobado el acuerdo provisional adoptado, de forma automática y sin necesidad de un nuevo acuerdo expreso,. Si se presentan reclamaciones serán resueltas por el pleno.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;Las modificaciones aprobadas entrarán en vigor el día 1 de enero de 2021 , previa publicación en el Boletín Oficial de la Comunidad Autónoma de las Islas Baleares del acuerdo de aprobación definitiva o de la provisional elevado automáticamente a tal categoría.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;Las modificaciones de los acuerdos primero, segundo y tercero son las siguientes:&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;En la aplicación de esta tasa no se admitirá ninguna exención ni beneficio tributario, a excepción de los expresamente previstos en las normas con rango de Ley o los derivados de la aplicación de los tratados internacionales.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;La reducción de las cuotas prevista en este apartado será de aplicación exclusiva para el ejercicio 2021, volviendo a las cuotas ordinarias existentes actualmente y que serán de aplicación para el ejercicio 2022 de manera automática y sin necesidad de proceder a una nueva modificación de la Ordenanza.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;Concluido el debate, se somete a votación y el Pleno acuerda por unanimidad aprobar la precedente propuesta». &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Dicho acuerdo fue publicado en el Tablón de anuncios de la Sede Electrónica en fecha 26 de octubre de 2020, en uno de los diarios de mayor difusión de la provincia en fecha 27 de octubre de 2020 y en el BOIB núm. 182 de fecha 24 de octubre de 2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Transcurrido el plazo de exposición pública sin que se hayan interpuesto reclamaciones, el referido acuerdo se eleva a definitivo, de conformidad con el artículo 17.3 del RDL 2/2004, de 5 de marzo, por el que aprueba el texto refundido de la Ley Reguladora de las Haciendas Locales y con el artículo 49 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;De conformidad con el informe de la Técnica de gestión tributaria, de 9 de diciembre de 2020, el texto de la modificación puede ser aprobado sin más trámite, dado que el informe sobre el impacto de género emes por el Institut Balear de la Dona en fecha 19 de noviembre de 2020 concluye que en la redacción de la norma no se ha detectado ninguna situación de desigualdad por cuestión de género, y se considera que su aplicación no producirá efectos diferenciadores sobre las mujeres y los hombres, ni incidirá en la posible situación de desigualdad en que se encuentren.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Las modificaciones de las ordenanzas entrarán en vigor día 1 de enero de 2021, previa su publicación en el Boletín Oficial de las Islas Baleares, de acuerdo con el artículo 17.4 del RDL 2/2004, de 5 de marzo, por el que se aprueba el texto refundido de la Ley Reguladora de las Haciendas Locales y del artículo 70.2 y 65.2 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;ARTÍCULO 1&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;FUNDAMENTO LEGAL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;De conformidad con el artículo 20 del RD Legislativo 2/2004, se establece la tasa por las paradas de venta en la Plaza de abastos y en determinados lugares de la vía pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;ARTÍCULO 2&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;HECHO IMPONIBLE&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Constituye el hecho imponible la ocupación de paradas de venta en&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;a) La plaza de abastos: paradas del edificio principal y edificio destinado a la venta de pescado&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;b) Mercado semanal Porto Cristo&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;c) Mercado semanal Manacor&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;ARTÍCULO 3&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;SUJETOS PASIVOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Están obligadas al pago de esta tasa las personas físicas y jurídicas así como las entidades del artículo 35.4 de la Ley General Tributaria que previa la oportuna licencia, tengan instaladas paradas de venta en el mercado y en determinados lugares de la vía pública, así como las personas titulares de una concesión demanial o autorización para el uso o aprovechamiento especial del puesto de venta de la pescadería.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;A estos efectos los vendedores y vendedoras tendrán carácter de:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;a) Fijos, quienes tengan asignada una parada de venta de forma continua y de manera exclusiva, así como las personas titulares de una concesión demanial o autorización para el uso o aprovechamiento especial del puesto de venta de la pescadería.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;b) Eventuales, quienes no concurran al mercado de forma continua, ya sea porque no es posible asignarles un puesto de venta (al no existir vacantes en ese momento), ya sea por interés particular.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;ARTÍCULO 5&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;DEVENGO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;a) Se devenga la tasa y surge la obligación de pago cuando se solicite la preceptiva autorización para proceder a la ocupación por puestos de venta en la plaza de abastos y en determinados lugares de la vía pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;b) Cuando se ha producido la ocupación o el aprovechamiento especial sin solicitar licencia, el devengo de la tasa tiene lugar en el momento del inicio de esta ocupación o aprovechamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;c) Por la parada de la pescadería, se devenga la tasa y nace la obligación de pago cuando se inicia la explotación, una vez formalizada y adjudicada la concesión / autorización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;ARTÍCULO 6&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;NORMAS DE GESTIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;A) Vendedores y vendedoras PLAZA DE ABASTOS, EDIFICIO CENTRAL: el pago de la tasa será trimestral y se hará efectivo mediante recibos periódicos trimestrales que se emitirán de acuerdo con los datos aportados al Departamento de Gestión Tributaria por parte de la Delegación de Comercio e Industria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Las bajas que se produzcan dentro del ejercicio deberán formularse a instancia de parte y tendrán efectos en el trimestre siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;B) Vendedores y vendedoras titulares de la concesión demanial o autorización PARADA PESCADERíA: la tasa se devengará anualmente y por el importe de adjudicación. El pago de la tasa se hará por trimestres naturales mediante liquidaciones periódicas que se emitirán por el departamento de Gestión Tributaria. En cuanto a los trimestres de inicio y fin de la concesión, las liquidaciones se emitirán por la parte proporcional correspondiente del trimestre en que se produzca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;C) Vendedores y vendedoras fijos/as: MERCADO SEMANAL PORTO CRISTO: el pago de la tasa será anual y se hará efectivo mediante recibos periódicos que se emitirán de acuerdo con los datos aportados por la delegación correspondiente.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Las bajas que se produzcan dentro del ejercicio deberán formularse a instancia de parte y tendrán efectos en el ejercicio siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;D) Vendedores y vendedoras fijos/as: MERCADO SEMANAL MANACOR: el pago de la tasa será anual y se hará efectivo mediante recibos periódicos que se emitirán de acuerdo con los datos aportados por la delegación de comercio e industria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Las bajas que se produzcan dentro del ejercicio deberán formularse a instancia de parte y tendrán efectos en el ejercicio siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;E) Vendedores y vendedoras eventuales: MERCADO SEMANAL-MANACOR / PORTO CRISTO: el pago de la tasa será trimestral de acuerdo con los trimestres de ocupación y se hará efectivo mediante autoliquidación en el momento de presentar la solicitud de ocupación de puestos de venta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;DISPOSICIÓN TRANSITORIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;La reducción de las cuotas prevista en este apartado será de aplicación exclusiva para el ejercicio 2021, volviendo a las cuotas ordinarias existentes actualmente y que serán de aplicación para el ejercicio 2022 de manera automática y sin necesidad de proceder a una nueva modificación de la Ordenanza.&lt;/span&gt;&lt;/p&gt;
