&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Se hace público que durante el periodo de exposición público del acuerdo de aprobación inicial de la modificación del Reglamento por la regulación de las prestaciones económicas de Servicios Sociales, adoptado en sesión plenaria en fecha uno de octubre de 2020, BOIB n.º 174 de 10 de octubre de 2020, no se ha prestado ninguna alegación, por lo cual se considera aprobado definitivamente, procediendo a la publicación del texto íntegro del mencionado Reglamento:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;“REGLAMENTO PARA LA REGULACIÓN DE LAS PRESTACIONES ECONÓMICAS DE SERVICIOS SOCIALES DEL AYUNTAMIENTO DE DEIÀ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;EXPOSICIÓN DE MOTIVOS:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;La Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local en el artículo 25 expone que la prestación de Servicios Sociales es una competencia municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Por otra parte, la Ley 9/1987 de Acción Social de las Islas Baleares (BOIB n.º 53/1987, de 28 de abril) en su artículo 13.2 señala: “Así mismo, y con carácter extraordinario, podrán concederse prestaciones económicas no periódicas a las personas que se encuentren en situación de necesidad”. Más adelante, (arte. 16.4), habla de la concesión de prestaciones económicas periódicas y no periódicas, con cargo a los presupuestos de Servicios Sociales de los ayuntamientos, especialmente para personas en estado de necesidad y en situación de emergencia, en las condiciones que se determinen por sus órganos competentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Ley 4/2009, de 11 de junio, de Servicios Sociales, al capítulo III, artículo 20, establece que las prestaciones del sistema público de servicios sociales podan ser técnicas, económicas o tecnológicas. Definiendo en el artículo 22 como prestaciones económicas las aportaciones dinerarias que tienen como finalidad atender determinadas situaciones de necesidad en que se encuentran las personas que no disponen de recursos económicos suficientes para hacer frente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Consciente de todo esto, el Ayuntamiento de Deià con el apoyo financiero otras instituciones públicas prestadoras de Servicios Sociales quiere instrumentar un marco regulador de las concesiones que se suban dar de este tipo de ayuda, según las previsiones presupuestarias que por cada ejercicio en concreto se puedan consignar al efecto. Las ayudas se concederán dependiendo del presupuesto anual y de los criterios aquí establecidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Atendido el anterior, se plantea la necesidad de formalizar el conjunto de ayudas y prestaciones económicas de subsidio asumidas totalmente por el ayuntamiento o bien complementarías a las que ofrezcan otras instituciones por el mismo concepto y que van dirigidas a familias y/o individuos que pasan por situaciones de crisis económica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Artículo 1.- Régimen jurídico de aplicación.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- la normativa reguladora de este Reglamento es la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;a.- Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;b.- Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;c.- Ley 9/1987, de 11 de febrero, de acción social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;d.- Ley 4/2009, de 11 de junio, de Servicios Sociales&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- El presente Reglamento tiene el carácter de bases reguladoras de las subvenciones económicas en materia de servicios sociales del Ayuntamiento de Deià, según el artículo 17.2 y 17.3 de la ley 38/2003.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Artículo 2.- Definición de las ayudas.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- Las ayudas económicas municipales por la atención de necesidades sociales, son un instrumento de la unidad de Servicios Sociales de Atención Primaria, que posibilita la cobertura de necesidades básicas, así como complementarias por el desarrollo de las actividades de la vida cotidiana, mediante prestaciones económicas o con pago de corderos/servicios básicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- Están dirigidas a las familias y/o individuos que pasan por situaciones de dificultades sociales y/o económicas para cubrir sus carencias, debido tan a causas meramente coyunturales, como la configuración de su propia estructura sociofamiliar, con el fin de paliar o resolver, por sí mismas o complementariamente con otros recursos y/o prestaciones, situaciones de necesidad básicas, prevenir situaciones de exclusión y favorecer la plena integración social de los sectores de población.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Artículo 3.- Características de las ayudas.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;1.- Las ayudas económicas municipales sueño un instrumento, dentro de la intervención social, que tiene como finalidad prevenir la marginación social y favorecer la integración de los ciudadanos, de acuerdo con los siguientes objetivos:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;a.- Son ayudas finalistas, es decir, se aplican a la finalidad por las cuales han sido concedidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;b.- Son ayudas no periódicas, a pesar de que podrán ser concedidas durante el periodo del ciclo anual.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;c.- Son complementarias del trabajo social, actuarán siempre que sea posible, como complemento de un trabajo más ancho que se desarrolla con los destinatarios, dirigidos a conseguir un mayor nivel de autonomía personal y social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;d.- Su ayudas con consignación presupuestaria anual no permanente, dependiendo en cada ejercicio de las previsiones que se puedan establecer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;2.- El importe global de las ayudas económicas municipales están limitadas por la cuantía que anualmente se determine en los Presupuestos municipales vigentes, a la partida 3.480.00.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;3.- Las ayudas económicas serán compatibles con cualquier otra ayuda o subvención de bienestar social, pública o privada, recibimiento por el beneficiario o su entorno familiar o convivencia. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Artículo 4.- Destinatarios.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Podrán ser beneficiarios de las ayudas los individuos o familias que en el momento de hacer la solicitud de la ayuda económica, cumplan los requisitos establecidos por su concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Artículo 5.- Tipo de prestaciones:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;El Ayuntamiento de Deià, concederá ayudas económicas por los siguientes conceptos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- Necesidades básicas primarias del solicitante y de su familia:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;- Adquisición de productos básicos de alimentación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;- Adquisición de productos de higiene personal y de limpieza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- Acceso o mantenimiento de la vivienda habitual y/o gastos derivados del mismo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;3.- Gastos sanitarios&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;- Medicamentos y prótesis no cubiertos por la Seguridad Social o cualquier otra institución pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;4.- Gastos escolares y formativas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;-Comedor escolar y de escoleta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;-Escoleta de niños.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;-Libros y material escolar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;-Actividades extrascolares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;5.- Transporte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;-Por asistencia a servicios específicos fuera del municipio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;6.- Actividades de ocio y tiempo libre, escuela de verano.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;7.- Gastos extraordinarios no contempladas en los apartados anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;8.- Reducción de tasas e impuestos municipales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;9.- Las ayudas para transeúntes se darán por los conceptos de alimentos básicos con una duración no superior a tres días y transporte público dentro de la isla de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Artículo 6.- Requisitos de los solicitantes y beneficiarios.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- Los solicitantes de ayudas económicas tendrán que cumplir los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;a.- Ser mayor de 18 años o estar emancipado legalmente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;b.-Acreditar mediante el certificado pertinente un empadronamiento en el municipio de Deià superior a los seis meses, con excepción de las necesidades urgentes derivadas de causas extraordinarias y sobrevenidas que evaluarán los Servicios Sociales del Ayuntamiento de Deià.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;c.- En el caso de pedir ayuda por él mismo o su unidad familiar, cumplir con los requisitos por los beneficiarios establecidos en los apartados siguientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;d.- En el caso de solicitar la ayuda por otro, tendrá que acreditar su vinculación familiar o profesional con el beneficiario de la ayuda. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;e.- Aportar la documentación exigida en cada caso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;3.- De acuerdo con el artículo 13.2 de la ley 38/2003, de 17 de noviembre, general de subvenciones, los beneficiarios no se pueden encontrar en alguna de las siguientes situaciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;a.- Haber sido condenadas mediante sentencia firme a la pena de pérdida de la posibilidad de obtener subvenciones o ayudas públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;b.- Haber solicitado la declaración de concurso, haber sido declarados insolventes en cualquier procedimiento, encontrarse declarados en concurso, estar sujetos en intervención judicial o haber sido inhabilitados conforme a la Ley concursal sin que haya acabado el periodo de inhabilitación fijado en la sentencia de calificación del concurso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;c.- Haber dado lugar, a causa de la que hubieran sido declarados culpables, a la resolución firme de cualquier contrato celebrado con la Administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;d.- Estar incursa la persona física en alguno de los supuestos de la Ley 12/1995, de 11 de mayo, de incompatibilidades de los miembros del gobierno de la nación y de los altos cargos de la administración general del estado, de la Ley 53/1984, de 26 de diciembre, de incompatibilidades del personal al servicio de las administraciones públicas, o tratarse de cualquier de los cargos electivos regulados en la Ley Orgánica 5/1985, de 19 de junio, del régimen electoral general, en los términos establecidos en la misma o en la normativa autonómica que regule estas materias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;e.- No encontrarse al corriente en el cumplimiento de las obligaciones tributarias o ante la Seguridad Social impuestas por las disposiciones vigentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;f.- Tener la residencia fiscal en un país o territorio calificado reglamentariamente como paraíso fiscal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;g.- No encontrarse al corriente de pago de obligaciones por reintegro de subvenciones. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;h.- Haber sido sancionado mediante resolución firme con la pérdida de la posibilidad de obtener subvenciones según la Ley de subvenciones o la Ley general tributaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;4.- Además de las condiciones generales expuestas en el apartado anterior, serán de aplicación específica los siguientes requisitos para poder tener la consideración de beneficiario de prestaciones económicas de servicios sociales del Ayuntamiento de Deià:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;a.- Pueden ser menores de 18 años, pero la ayuda será gestionada y solicitada por los padres o tutores legales, excepto en el caso de estar emancipados legalmente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;b.- Estar empadronados en el término municipal de Deià, excepto los trotamundos y los afectados por causas extraordinarias y sobrevenidas que se encuentren en situación de extrema urgencia y tengan su residencia al término municipal de Deià. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;c.- No tener acceso a otras ayudas otras administraciones públicas o recursos propios que cubran la totalidad de la necesidad para la cual se solicita la prestación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;d.- Aceptar las condiciones que comporta el proceso de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Artículo 7.- Procedimiento de gestión de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- Los ciudadanos podrán solicitar las ayudas al servicio por propia iniciativa, o bien serán tramitadas a propuesta del profesional de referencia cuando se trate de personas con las que ya se está efectuando una intervención social o psicosocial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- Las ayudas son tramitadas por el Trabajador/a Social de los Servicios Sociales del Ayuntamiento de Deià.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;3.- La solicitud, siguiendo el modelo establecido al anexo 1 de este Reglamento, se presentará en el Registro Municipal del Ayuntamiento de Deià. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;4.- Una vez recibida la solicitud, en el supuesto de que no se haya aportada toda la documentación necesaria, se requerirá al solicitante que lo aporte en un plazo de 15 días hábiles, informando que el incumplimiento del requerimiento supondrá el archivo del expediente sin más trámites.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;5.- En el plazo máximo de veinte días hábiles desde la recepción completa de la documentación necesaria, se emitirá informe por parte del trabajador o trabajadora social, en el que se propondrá la concesión o no de la ayuda solicitada, y, en su caso, de la cuantía de la ayuda. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;6.- La resolución de la concesión de ayuda será por acuerdo de la Junta de Gobierno Local, en el supuesto de que esté constituida, o por el Alcalde en su defecto. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;7.- Una vez resuelto por la autoridad resolutoria el expediente, se comunicará por escrito al solicitante, indicando la cantidad y condiciones específicas de la ayuda, así como los recursos administrativos y jurídicos en el caso de desear la impugnación del acuerdo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;8.- El abono de la ayuda se puede realizar directamente al destinatario, o a la entidad prestamista del servicio o be motivo de la subvención. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Artículo 8.- Procedimiento de urgencia.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- En aquellos casos que, según criterio del trabajador o trabajadora social, se aprecien condiciones de extrema urgencia y gravedad, se podrá dictar una resolución provisional de concesión de un porcentaje no superior al 90% de la ayuda propuesta al informe de baremos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- Acabada la tramitación del expediente, se resolverá la concesión, abonándose la parte de la ayuda que no se concedió de forma provisional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;3.- En el supuesto de que la resolución del expediente fuera resolutoria, se reclamará de la persona solicitando el reintegro íntegro de la ayuda abonada provisionalmente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;4.- Con el escrito de concesión provisional de la ayuda se harán constar las condiciones expuestas a los apartados anteriores de este artículo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Artículo 9.- Valoración técnica de las ayudas.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;La aplicación del baremo de ayudas, expuesto al anexo 2 del Reglamento, se realizará por el trabajador o trabajadora social de acuerdo con el equipo de profesionales (psicólogo) que trabajen con los beneficiarios de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Artículo 10. Determinación de contraprestaciones.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Para garantizar que las ayudas económicas tengan un carácter complementario del trabajo social más amplio, se podrán establecer acuerdos o contraprestaciones con los beneficiarios que los comprometan a desarrollar actuaciones tendentes a salir de la situación de necesidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;En casos especial, y en función de la valoración técnica del trabajador/a Social se podrán conceder ayudas sin que el usuario tenga que llevar a cabo la contraprestación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Artículo 11.- Protección de datos personales.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Tanto la autoridad resolutoria como los técnicos que tramiten las ayudas están obligados a mantener el secreto de la información de los expedientes, puesto que la intimidad de las personas está afectada, y resto sujeto a reserva y tratamiento confidencial, según el arte .18 de la Constitución Española, y al que dispone la Ley Orgánica 15/1999, de 13 de diciembre, de protección de datos de carácter personal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Artículo 12.- Extinción y reintegro de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Aparte de las expuestas en el artículo 37 de la ley 38/2003, son causas de extinción y reintegro de las ayudas las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- Incumplimiento de los compromisos adquiridos con los servicios sociales&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- Falseamiento u ocultamiento de datos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;3.- Desaparición de las circunstancias que darán origen a su concesión&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;4.- Traslado del domicilio fuera del municipio&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;5.- Finalización del plazo temporal de la prestación&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;6.- Muerto del destinatario de la ayuda&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;7.- Renuncia&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;8.- Utilización fraudulenta de la ayuda&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;9.- Otras causas graves imputables al beneficiario no contempladas en los apartados anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Artículo 13.- Obligaciones de los beneficiarios.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- Son obligaciones generales de los beneficiarios de subvenciones las establecidas en el artículo 14.1 de la Ley 38/2003.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- Además de las anteriores, son obligaciones específicas de los beneficiarios de las prestaciones económicas del Ayuntamiento de Deià las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;a.- Comunicar a los Servicios Sociales de Deià todas aquellas variaciones que se produzcan en su situación socio-familiar, que puedan modificar las circunstancias que motivaron la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;b.- Destinar la cantidad percibida a los fines para los cuales se ha dado la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Artículo 14.- Derechos de los beneficiarios&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Los beneficiarios disfrutan de los siguientes derechos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- Derecho a ser informados de las posibles modificaciones que puedan producirse en el régimen de la prestación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- Derecho a la intimidad y tratamiento confidencial de la documentación de carácter personal incluida al expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;3.- Derecho a ejercer su derecho a queja conforme a las disposiciones vigentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;4.- Derecho al abono efectivo de la ayuda o subvención, una vez se haya resuelto la misma. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Artículo 15.- Régimen de infracciones y sanciones.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- El régimen de infracciones a la normativa de subvenciones, y en la aplicación del Reglamento presente, está determinado por el capítulo primero del título cuarto de la ley 38/2003.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- El régimen de cuantías y procedimientos sancionadores se encuentra al capítulo segundo del título cuarto de la ley 38/2003.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;DISPOSICIÓN FINAL ÚNICA&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Este Reglamento entrará en vigor a partir del día siguiente al periodo establecido en el artículo 65.2 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local, siempre que haya sido publicado en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Contra el mencionado acuerdo se puede interponer recurso de reposición en el plazo de un mes a contar desde el día siguiente al de la publicación. El plazo para interponer, en su caso, recurso contencioso-administrativo ante el juzgado del contencioso -Administrativo de Palma de Mallorca, será de dos meses contados desde el día siguiente a la notificación de la resolución exprés del recurso de reposición. Si no hubiera resolución exprés, el plazo será de seis meses, a contar de la fecha en que se entienda desestimado por silencio el recurso de reposición. Todo esto sin perjuicio que pueda ejercitar cualquier otro recurso que considere oportuno.&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&amp;nbsp; &amp;nbsp; &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
