    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El 10 de marzo del 2018 se publicó en el BOIB núm. 31 la Resolución del presidente del FOGAIBA de 7 de marzo de 2018, por la que se convocan las ayudas, para los años 2019-2023, para la reestructuración y la reconversión de viñas, fue modificada por las resoluciones del presidente del FOGAIBA de&lt;span style="background-color:white"&gt; 14 de diciembre de 2018 (BOIB núm. 158, de 18 de diciembre de 2018) y de 27 de febrero de 2019 (BOIB núm. 26, de 28 de febrero de 2019) y por las resoluciones de la presidenta del FOGAIBA de 20 de noviembre de 2019 (BOIB núm. 159, de 23 de noviembre de 2019), de 26 de marzo de 2020 (BOIB núm. &lt;/span&gt;47, de 31 de marzo de 2020) y de 22 de junio de 2020 (BOIB núm. 114, de 25 de junio de 2020)&lt;span style="background-color:white"&gt;. Además, por la Resolución del vicepresidente del FOGAIBA de 7 de abril de 2020, publicada en el BOIB núm. 56, de 14 de abril de 2020, se amplió el plazo de ejecución y justificación de las actuaciones correspondientes al año 2020 hasta el 30 de junio del 2020.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dicha resolución prevé un total de cinco convocatorias y se dicta al amparo del Real decreto 5/2018, posteriormente derogado por el Real decreto 1363/2018, de 2 de noviembre, para la aplicación de las medidas del programa de apoyo 2019-2023 al sector vitivinícola español.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El 1 de julio del 2020 se publicó en el BOE núm. 181 el Real decreto 617/2020, de 30 de junio, por el que se modifica el Real decreto 1363/2018, de 2 de noviembre, para la aplicación de las medidas del programa de apoyo 2019-2023 al sector vitivinícola español, en concreto se modifica el anexo XIII de acciones subvencionables en reestructuración y reconversión de la viña por tipo de actividad, pasando a ser unos máximos autonómicos en lugar de estatales.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con la disposición final segunda del Real decreto 617/2020, de 30 de junio, dicha modificación entrará en vigor al día siguiente de su publicación y, por lo tanto, afectará a las solicitudes que se presenten a partir del 2 de noviembre del 2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Finalmente, se han detectado unos cuantos errores en la resolución publicada que deben ser corregidos de acuerdo con lo dispuesto en el artículo 109.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y en el artículo 56 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Por todo ello, en virtud de lo establecido en el artículo 6.1.&lt;/span&gt;&lt;em&gt;g&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; del Decreto 64/2005, de 10 de junio, de creación del Fondo de Garantía Agraria y Pesquera de las Illes Balears, a propuesta del director gerente del FOGAIBA, dicto la siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Primero&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En relación a las convocatorias de los años 2021 y 2022, se modifica la Resolución del presidente del FOGAIBA de 7 de marzo de 2018, por la que se convocan las ayudas, para los años 2019-2023, para la reestructuración y la reconversión de viñas, publicada en el BOIB núm. 31, de 10 de marzo de 2018, en el siguiente sentido:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El punto 3 del apartado quinto queda redactado de la siguiente manera:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;“3. La participación en los costes de la reestructuración y de la reconversión de la viña solo se podrá conceder para las acciones que se indican en el anexo III y no podrán ser acciones financiadas de manera aislada, a excepción del sobreinjerto o del cambio de vaso a espaldera o a otro sistema de conducción. Tampoco son subvencionables las acciones donde se utilice material de segunda mano.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;La subvención para la participación en los costes de la reestructuración y de la reconversión de la viña es el resultado de aplicar el porcentaje del 50% a los importes máximos establecidos para cada una de las acciones recogidas en el anexo III A.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El montante que se debe percibir no puede ser en ningún caso superior al importe que resulte de la aplicación del porcentaje mencionado sobre el gasto efectivamente realizado y acreditado mediante factura y justificante de pago.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;No se financiarán los costes de arranque en aquellas superficies en las que se haga uso de autorizaciones de plantación concedidas en virtud de los artículos 66 y 68 del Reglamento (UE) núm. 1308/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre, no generados por el arranque efectuado en la aplicación de la operación de reestructuración y con anterioridad a la solicitud de esta operación”.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. El punto 2 del apartado séptimo queda redactado de la siguiente manera:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;“2. En caso de que las solicitudes con derecho de ayuda superen las disponibilidades presupuestarias de cada año, se ordenarán las solicitudes de operaciones de reestructuración y de reconversión de viña a partir de la aplicación de los siguientes criterios objetivos de preferencia:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Para el viticultor:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Explotaciones de titularidad compartida, previstas en la Ley 35/2011, de 4 de octubre: 32 puntos.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Agricultor que en el año de la presentación de la solicitud no cumpla más de cuarenta años: 16 puntos. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Presentación colectiva de solicitudes: 8 puntos.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Viticultor que no tenga otra superficie reestructurada/reconvertida en el PASVE 2019-2023: 1 punto.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para la operación:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Superficie que nunca ha recibido ayuda alguna a la reestructuración y la reconversión de viña: 4 puntos.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Menor coste medio de todas las solicitudes presentadas (€/ha): 2 puntos”.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. El punto 1 del apartado octavo queda redactado de la siguiente manera:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Comisión Evaluadora estará integrada por:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Presidente: secretaria general de la Consejería de Agricultura, Pesca y Alimentación o persona en quien delegue.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Vicepresidente: director general de Agricultura, Ganadería y Desarrollo Rural o persona en quien delegue.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Vocales:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Director gerente del FOGAIBA o persona en quien delegue.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Jefe del Departamento Jurídico del FOGAIBA o persona en quien delegue.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Jefe del Servicio de Gestión Económica del FOGAIBA o persona en quien delegue.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Jefe del Servicio de Ayudas OCM, del Estado y de Pesca del FOGAIBA o persona en quien delegue.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Un representante del Consejo Insular de Mallorca.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Un representante del Consejo Insular de Menorca.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Un representante del Consejo Insular de Ibiza.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Un representante del Consejo Insular de Formentera.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Secretario/a: actuará como secretario/a uno/a de los vocales de la Comisión Evaluadora”.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;4. Se modifica el anexo III, que queda redactado de la siguiente manera:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;(1) Incluye la aportación de materia orgánica y será necesario presentar la factura de adquisición.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;(2) Incluye producto fitosanitario.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;(3) Es necesario un acta de control antes de retirar las piedras del terreno.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;(4) Es necesario presentar el plano topográfico, coste incluido al precio máximo, que justifique la nivelación.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;(5) Es necesario hacer un mínimo de 200&amp;nbsp;m&lt;sup&gt;2&lt;/sup&gt;/ha de margen de piedra para tener derecho a esta ayuda.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;(6) Incluye la planta que hay que justificar mediante factura.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;(7) Espaldera: sistema de conducción encima de puntos de apoyo que mantiene la vegetación en vertical con al menos 1,0&amp;nbsp;m de altura, medido desde el último hilo y con un mínimo de dos niveles de hilos, uno de ellos doble.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;(8) Estacada: sistema de conducción encima de puntos de apoyo que mantiene la vegetación en vertical a una altura superior a 1,4&amp;nbsp;m, medido desde el último hilo y con tres o más niveles de hilos, dos de ellos dobles.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;(9) Emparrado: sistema de conducción encima de puntos de apoyo que mantiene la vegetación en horizontal y que cubre al menos el 50&amp;nbsp;% de la viña.&lt;/span&gt;&lt;/p&gt;
